Why wouldn't I support someone who is fighting for working families? Someone who is fighting to make sure our children have the best education possible no matter what their zip code. Why wouldn't I be fi… why wouldn't I stand with someone who is fighting to make sure that the wealthy pay their fair share? The reality is that civility is sorely lacking in our public discourse. We're not having substantive debates. Unfortunately, our public discourse doesn't consist of debates aimed at solving the problems of Illinoisans. Our debates consist of a barrage of personal attacks when we disagree with each other. We devalue the integrity of our democracy when we are unable to disagree over ideology, or policy, but instead integrate our opposition as evil and corrupt. I've known Michael J. Madigan for years going back to my days as a young staff person in the Illinois Senate. The man I know, not the… not someone I've been told about or the caricature of the individual that I know is someone who is hardworking, dedicated to his family and cares deeply about our state. But a couple of recent experiences have confirmed for me that he is the right man for the job of Speaker of the Illinois House of Representatives. Recently, I welcomed a group of students to Springfield. They came to learn about public safety… public service and the importance of government. While we talked, we talked about the importance of education. We engaged in a discussion on hard work and dedication and commitment. So, as we left the House chamber, we walked down the corridor next to the House Floor and we could see the Speaker through the window sitting at his desk, as you can often find him, hard at work. It was a validation of all the lessons that I just taught them. It is a validation that no matter who you are and how hard… how high you climb you still have to work hard to be successful. The other was an encounter I had at church. "Good afternoon and welcome to the 100th General Assembly. I am very humbled and honored to second the nomination of Michael J. Madigan for Speaker of the House of Representatives. I have been given an opportunity to express why in such uncertain times it is crucial to have an individual with the ability to handle crisis. I think that person is Michael Madigan. The first time I met the Speaker was back in 2001. I went to see him for the same reason many candidates running for office do, that… and that's to ask for his support. He was welcoming, interested and curious. We talked about family, my family and his family. I remember feeling comfortable as if I were having a conversation with an old friend. I never forget that. I thought, wow, he really likes me. But honestly, as I matured in my role, I realized that part of the Speaker's responsibility is to maintain the Majority control to protect our Democratic values and principles. See, once you're in the role of the Legislator your priority becomes your district, effective representation of your constituency is what keeps us in office. Imagine, managing the diverse needs of all districts throughout the state. Sounds close to impossible but Speaker Madigan does it better than anyone knows. I represent a majority of Latinos in my district and many of my constituents are undocumented. I remember early in my first term the Speaker gave me a call to highlight a few Bills that may be of concern to my district and across Illinois. I often reflect on this moment. He didn't have to bring it to my attention, but he did. He is thoughtful and mindful of what matters to his Members. No doubt in my mind he reviews everything. Lately, the nega… negative portrayal of Michael Madigan has reached new lows. Many choose to forget his history of working with Republican Governors and the bipartisan reforms made in pension, worker… workers' compensation and our state budget process. They've forgotten all the times he's fought for safer working conditions, quality health care and marriage equality for all. He understands reform cannot be solely a Democratic or Republican solution. Illinois is great when we work together, when we collaborate and compromise. "Good afternoon. It's my honor to stand up here to do a seconding for the nomination for Speaker for Michael Madigan. In my opinion, Michael Madigan's a true statesman who deeply respects the institution of the House of Representatives. Unlike many people who serve in public office, in many levels of government, you'll not see Michael Madigan traveling around his area or the state making regular appearances to talk about his accomplishments during his career. Instead, you'll see a man that works seven days a week to get his job done without putting the focus on himself. Michael Madigan, as a Speaker, has a tough job as he manages the extremely diverse group of Members from Chicago to southern Illinois to east and west Illinois. I think this is exemplified by his willingness to work with downstate Democrats and Republicans when the General Assembly crafted and passed the concealed carry legislation sponsored by Representative Brandon Phelps. Throughout his career, he's always shown in a willis… willingness to negotiate and to compromise. Examples of this ability to negotiate and compromise were the pension reform 10000001.docx 19 STATE OF ILLINOIS 100th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 1st Legislative Day 1/11/2017 situations that we did in 2001, 2… and 2013. Work comp reform in 2011 and a willingness to continue to work on that issue as he moves forward. We had the budget for results legislation in 2011 led by Representative Sente. We had the Build Illinois and the Illinois FIRST capital programs in the past. All these things were accomplished with both Republican and Democratic Governors, Members of the General Assembly from both sides of the aisle. These are just a couple of reasons why I think Michael Madigan has the personality and leadership qualities that are well-suited for the position of Speaker. But now, I would like to take a different line of thought on why I'm seconding the nomination. And these three brief examples are personal in nature and demonstrate both humor and concern shown by the Speaker. The first example occurred last May toward the end of Session when things are always hectic, as we all know. Everybody wants their thing at the very end of the Session and it's usually just constant pressure. My daughter and grandkids were able to come up to Springfield the very first time that we've been in Session along with my wife; Courtney, Mia, Ryan and Claire came to Springfield along with my wife, Terri. And the Speaker took time out of his busy schedule to meet them. One thing you need to know about my grandson, Ryan is he's four years old. He has a big fascination with cars, trucks, tractors, anything on wheels. And before we got ready to leave the office, we were lining up to take a picture when Ryan spotted a car on the Speaker's table and grabbed it and ran over and started playing with it. As many of you, especially Members in the General Assembly, and many of you out in the audience might imagine, 10000001.docx 20 STATE OF ILLINOIS 100th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 1st Legislative Day 1/11/2017 I immediately had visions that this thing's ending badly. Not knowing the significance of the memento, I pictured it in a thousand pieces by the time Ryan got done with it. Well, the tractor got back to the resting place and we all got a good laugh out of it including the Speaker and the picture went on with Ryan taking a spot right in front of Speaker Madigan, with him patting him on his head. You know, I was kind of embarrassed by that in many ways, but at the same time, the Speaker pulled me aside and said, remember, I have grandkids too. The next two examples lack the humor aspect. They show the level in caring and shows when things are tough. Both had very positive outcomes, I'm happy to say. In June of 2015, I had a medical situation that prevented me from attending one set of the Session days that were scheduled for June. After tests and follow up showed that things would work out, I received regular phone calls from the Speaker, spontaneously asking how I was doing, giving me advice, giving me suggestions like diet and exercise. Even yesterday, he asked me if I was losing weight. He obviously knew I wasn't. And he was just generally checking in, okay. I really appreciated that genuine concern he showed then and he continues to show to this day. And this last example speaks very dear to my heart and to all of us that would be parents. It involves my daughter Courtney. It occurred back in 2005 during my first full Session. And we all know how those first full Sessions go. But let me give you a little quick background. In 1997 when Courtney was 15, she was diagnosed with a brain tumor. This brain tumor required surgery to remove it. And there was another required MRI and further testing. Needless to say, that time that went between the initial MRI and the subsequent test was tough on everyone especially Courtney. As all Members know, that first Session is extremely busy as we get to know the process, the district, our constituents and all that goes with that. But when I called Speaker Madigan to let him know the situation, he immediately put my thoughts to rest and put me at ease. And he told me to do this: totally concentrate on Courtney and the fact that she needs to get better. Your office and the responsibilities that you have will take care of itself and be just fine. Once again, there were follow-up phone calls asking about her condition, all without bringing up anything to do with state business. Today, I'm especially proud to have Courtney here along with my wife, Terri… and the rest of my family who are here also. I will always appreciate the way he showed his genuine and yes, fatherly concern about my health, my daughter's health and those of our family. They've worked very, very hard to get here as most of you know and today is the culmination of their accomplishments also. During the legislative process that we have, Leaders always emerge from these individuals that you see sitting here on the stage. And there's no better example of effective and collaborative leadership than our House Republican Leader, Jim Durkin. We have heard the nomination and the second of the Leadership of the General Assembly and I felt compelled to give remarks to the Leadership as a whole for my expectations of the 100th General Assembly going forward. Please bear in mind, it will only be five minutes 'cause I believe that we have a lot to do today. As all of you, the State of Illinois is near and dear to my heart. Illinois was there for me after my honorable discharge from the Marines when I needed it. I got an unbelievable education from Northern Illinois University which is a publicly funded university. And I believe in our grant system because I received an Illinois Veterans Grant and I received a MAP Grant. These programs are in peril today and I would beseech you that we need to start focusing on what is happening to our State of Illinois. I met my husband at Northern Illinois University. He's an Army veteran. So, we are a veteran couple; we are an NIU couple; we are an Illinois couple. And that was 20 years ago. When we were young, we were promised that a good education and when you work hard, you move up in life. Hard work pays off and that's what Illinois is founded on, hard work paying off. We are voted to be a public servant; we are voted to do a public servant's job. We are here to look out for the disabled, the frail elderly, the children, the victims of violence, the college students and our veterans. But we have a budget impasse that seems just really an exercise in stubbornness that needs to end. So, today, we are talking about the Leadership going forward. We are going to vote on Speaker of the House. There's one individual nominated from the Democratic Caucus; that's where my vote will go. But I felt compelled to make a statement for all the Leadership, even the Leadership from the Republican Caucus, that we have to do better than what we have been doing the past two years. I, personally, am disgusted we do not have a budget for two years. In 200 years, it's going to be this year. In 198 of those years we've had a budget; it can be done. I am appalled, personally, by the backroom deals that I have seen in the two years, secret committee meetings of which I was not even told who my colleagues were on these meetings and private working groups of which I am not invited to. It is clear to me a meeting of just the Governor and four people in a room has not worked in the last two years. And we need to do something different because we cannot afford to have the State of Illinois go off a cliff. We deserve to serve our people. So, I believe democracy is always best in the public and should be held up to public comment and our ideas should be given a true debate. And we can do that through what is truly compromise and collaboration, compromise and collaboration to make sure legitimate injured workers are taken care of and our businesses are taken care of. Through comp… true compromise and deliberation, we can make sure that we have responsible and reliable school funding for our children and that has to hand in hand with true and legitimate property tax relief. I believe and I'm a product of a good university and college student which will contribute to a competitive and educated workforce and we need to empower the people and not unelected lobbyists and bureaucrats. I believe that we must stop backroom deals, secret committee meetings and private working groups and that will lead us to an end of the budget impasse so that we can ensure the health, safety and welfare of all our residents and that we can do our job and take care of the frail elderly, the children, the disabled, the victims of violence, the college students and my fellow veterans. I am addressing the Leadership as a whole 'cause this is not the job of one person. This is the job of all of us that we must embrace and work forward. And so, therefore, I will do my job on the House of Representatives floor as will my colleagues because we are all responsible to the people of Illinois. Marty is joined today by his daughter Jayma. Jayma, welcome to Springfield. It has been two years since our last inauguration, two extremely difficult years. Two years where we disagreed much and worked to find the worst in each other. Let me suggest that as we move forward let us work to end the acrimony and find the best in each other. I think we can all agree that we would all like to solve the Illinois governmental budget deficit problem because a solution will help grow the Illinois economy which will increase our tax receipts which will enable us to better respond to the needs of the people of Illinois. Some of us believe that we can grow the economy by changes in workers' compensation, collective bargaining, and the prevailing wage. These people would argue that changes in those areas would lower the cost for Illinois business which would then act as an incentive for businesses to locate in Illinois or to stay in Illinois. Obviously, this approach focuses almost exclusively on cost. In my opinion, this would be a race to the bottom that would unjustifiably hurt Illinois workers. Let me suggest another approach, growth in the economy. This approach was articulated by Mr. Joe Cahill in Crain Chicago Business on December 7, 2016. I have a copy of the article in my hand. A very nice picture of Mr. Cahill. For our Republican friends, there's a very nice picture of Donald Trump. And you'll be pleased to know that he's wearing a bright red tie, not blue; it's red. Okay. In his article, Mr. Cahill speaks about the shortcomings of zero sum economic policies that focus almost exclusively on cost. The article is concerned with the action 10000001.docx 43 STATE OF ILLINOIS 100th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 1st Legislative Day 1/11/2017 by President Trump and Governor Pence of Indiana to save Carrier Corporation jobs from leaving Indiana and going to Mexico. Mr. Trump used his bully pulpit. Governor Pence committed $7 million of Indiana taxpayer money, $7 million. Together, they saved one-third of the jobs; one-third of the jobs because two-thirds of the jobs are still on their way to Mexico. They're on their way to Mexico because no state in the United States of America will offer lower labor costs than Mexico or other foreign locations. Mr. Cahill stated the better approach to economic development would focus not so much on cost but on another business priority, growth. Mr. Cahill argues that states should develop attributes that help companies drive growth. Attributes such as education, highly skilled workers, new technology, advanced research, global transit connections like O'Hare Airport, strong communications infrastructure. Mr. Cahill argues that these attributes would spark innovation, productivity and efficiency. And they explain why companies are flocking to California despite the high cost of doing business in that state. Mr. Cahill argues further that Illinois already has many of these attributes as well as our first class universities, national research laboratories, an educated workforce, a good transportation system, and innovative projects like Chicago's digital manufacturing initiative. At this point, let's give credit where credit is due. Let's give credit to Mayor Emanuel for securing that project for Illinois. Thank you very much, Mr. Mayor. Joe Cahill's prescription for growth is greatly related to higher education. Though we spend some time talking about the current status of higher education in the Illinois university system, we have severely underfunded the Illinois university system for two years. Consequently, enrollment in the system has decreased by 4,591 students, 4,591 less students in the system. The enrollment declines are as follows: Southern Illinois, 4.5 percent decline; Northern Illinois, 5.5 percent decline; Western Illinois, 6.5 percent decline; Eastern Illinois, 12.9 percent decline; Chicago State, 25 percent decline. Other states like California, Massachusetts, North Carolina and Texas have moved in the opposite direction by appropriately funding their university systems which has resulted in highly successful research parks and developments which have grown their economy and their tax receipts. Now, before I return to Joe Cahill, 'cause he's becoming a very popular guy, I'm going to suggest that we do some audience participation. Now, this is Illinois and when you do audience participation why you do it with great enthusiasm and you make sure that you can be heard. So, let's begin. We know that some businesses have actually taken economic incentives from states like Illinois and then moved jobs out of the country. And so for audience participation, I want to put two questions. Question #1: Should Illinois outlaw incentives for companies that shift American jobs out of the country? Yes or no."

"You did real well, real well. Back to Mr. Cahill. When I was explaining his prescription for growth, I didn't see every Republican head going up and down, not even ascent. I didn't see that. And so, I presume that we have some that would like to pursue a cost approach to helping Illinois business. Let me make this suggestion. If you wish to proceed on a cost-basis to help Illinois business… to attract more business to Illinois and to keep more business here, rather than lowering the standard of living by changes in areas like workers' compensation, collective bargaining, prevailing wage, let's lower the rate of tax on the Illinois corporate income tax by at least 50 percent. Let me say that again. Let us lower the rate of tax on the corporate… the Illinois corporate income tax by at least 50 percent. Now, regrettably, many Illinois corporations do not pay the Illinois corporate income tax; therefore, if we lower the rate to 50 percent… and I think we should do it… there must be one caveat. Every corporation has to pay at least something. There can be no free lunches. But think about this for a bit. Those corporations that do pay the Illinois corporate income tax what better way to reduce their cost of operations without hurting Illinois workers. I believe we can grow the economy, create jobs without hurting middle-class families. Said differently, we can lift up the middle class, provide good jobs for working families, while also passing policies to help business grow and expand our economy. That is the most important thing above all that you can do as an elected Representative. At some point, you will feel overwhelmed and question why you have taken on this position, but trust me, it's worth it. And remember this, Presidents are made under our dome not to mention U.S. Senators, Congressmen and statewide officials. Use your Springfield staff and secretaries. They are amazing and resourceful. I imagine many of the questions and concerns you have, have been addressed by them in the past. Use them, it'll make your life easier. Sometimes your constituents will confuse you with a Member of Congress: Durkin, Durbin, Dunkin. You've heard all that. I get a lot of confusion with my name on the national level and also international levels at times. I think we talked about that. But that's okay. So, when someone calls you up and asks you about a visa issue or Medicare, don't say this is a federal issue you need to talk to your Congressman. You take the initiative; you call your Congressman's office and help facilitate the solution. Why not? And trust me, your Congressman will take your call. Helping a constituent and finding a solution for them is one of the most gratifying moments of this experience. And you will realize in time that our jobs are move than casting a vote. At least you will after today. All beautiful parts of the state. And what I'm saying is that our state is rich with diversity and ideas. And this is how I learn in growth from this job. Leader Lang, you and I have worked together bipartisan on very difficult issues over many years, but in these past two years, we worked on a very, very, very serious issue to combat the tragic heroin epidemic in Illinois and also legislation to afford the sick and infirmed the ability to enjoy some quality of life in coping with illnesses. Lou, thank you for your determination and Leadership on these important issues. I could go on, but I hope you understand what I have done and what I will continue to do. Now, I've already welcomed your families and again, we're glad you're here today. This is a momentous occasion and I do offer my congratulations. But let me tell you about my family. I live in Western Springs, as I stated earlier, that's the west suburbs of Cook County with my wife and my family. And I am joined here today by my wife, Celeste, who's up in the gallery and my stepdaughter, Adrian. Thank you for coming. And more importantly, thank you for allowing me to do this job for many years for the patience and tolerance for many nights at home… away from home when I'm not in Sess… when I'm in Session and when I'm not in Session. It doesn't exactly fit the typical Republican profile, but what the heck, here I am. Remember the kids' tables during Thanksgiving dinner and Christmas dinner? Well, I was exiled there for a few years in my 30s after my first run for office and after my first votes back in 1995 as a Representative. All good fun. But we learned a lot from each other. We learned about sacrifice from our parents. We learned that there is no substitute for hard work. We learned that humility and selflessness… selflessness are never over worn. We learned to have each other's back and most importantly, we learned that doing the right thing is always the right thing. My parents passed just a few years ago and I miss them dearly. They're not here, but they are never gone. So, I would like to impart upon you something my parents would repeat to myself and my brothers over the years. Leave a place better than you found it. We have all heard it in one form or another from our parents. And I cannot underscore the relevancy, timeliness and importance of this today as we took our oath of office. Our state is suffering and is in need of help. By taking that oath, we are charged with fixing it. Today, we are approaching… we are at two years without a budget… a balanced budget and yes, we need and must break this impasse. Now, my caucus is not afraid to work, roll their sleeves up. We have very bright, thoughtful and determined Members who are desperately seeking to be part of the solution. Now, it's just two years ago, on this stage, the House Republicans were welcomed back to active participation in State Government. Two years later, it never really happened and find ourselves in the same place. Rather than solving problems, problems were created in the House. Sadly, our chamber was used more for political votes and fodder rather than resolving the problems our constituents are so desperately seeking. Votes were taken on Bills never meant to pass or never meant to be taken up by the Senate and never intended to become the law. Why? To create political ads and mail pieces for strictly political purposes. On one occasion, we took 17 votes… 17 votes on the same property tax legislation. Really? There were votes after votes on issues that did nothing other than to put Members on the record for the next campaign mail piece. Now, I'm sure Republicans did that at some time in the past. It was wrong then and it's wrong today. I'm asking you, Mr. Speaker, to stop the gotcha votes. The purely political votes that do nothing to resolve the state's debt, our pension liability and unemployment. This tactic is unworthy of our chamber and of our oath of office. That is not active participation in State Government. Enough is enough. Fixing our state means respecting those that make this state great and I do believe that we live in a great state. Why not fix our pensions once and for all? Can you imagine what would happen if we ran our households like we run our state finances? We'd have another 118 home foreclosures in Illinois if we did. Why not put the unemployed back to work, restore their dignity, make them proud contributing members of our society. Why not thank our employers and job creators? Why not give them and their employees the hero's welcome they so deserve through legislation that makes their mission stronger and encourages job growth and expansion. Yes, job growth and expansion in Illinois. How about that. What a novel concept. It's happening throughout the Midwest. Take a look at Indiana, Wisconsin, Iowa, Kentucky, Missouri; it is possible to come back after a strong recession. Now, we heard a little bit about the quality of life of the middle class. I talk about that a lot. But I also want the middle class to tune in and listen carefully. My question you: How have you fared over the past 20 years in Illinois? Right now we have record debt, approximately $11 billion as of January 9; unemployment at 5.6 percent, the national average is 4.6; and the underemployed 11 percent in Illinois. Families are fleeing the state in record numbers. In the last three years, we have lost approximately 80 thousand citizens. And we've lost 29 thousand jobs over the last 16 years. I don't call that standing up for the middle class. Is that protecting anyone? The numbers speak for themselves. Now, I recently read that the House Democrats will embark on a more bold and clear agenda this General Assembly. I think that's great and I commend them for that. It's an amazing, amazing town. It's the jewel by the lake and truly an international destination place. But I, like all of us here, are saddened, sickened and angry with the daily news reports of shootings and murders in the City of Chicago. This must come to an end. We must take the street backs… the streets back from those cowardly thugs who have destroyed neighborhoods and families and that must be done with the federal, state and local collaboration. We cannot go through another summer like we have witnessed in these past few years. RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE HUNDREDTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE SENATE CONCURRING HEREIN, that there shall be submitted to the electors of the State for adoption or rejection at the general election next occurring at least 6 months after the adoption of this resolution a proposition to amend Article V of the Illinois Constitution by changing Sections 1, 2, 3, 6, and 7 and by repealing Sections 4 and 14 as follows: ARTICLE V THE EXECUTIVE SECTION 1. OFFICERS The Executive Branch shall include a Governor, Attorney General, Secretary of State, Comptroller and Treasurer elected by the electors of the State. (c) Whenever the Governor determines that he may be seriously impeded in the exercise of his or her powers, he or she shall so notify the Secretary of State and the officer next in line of succession. SECTION 7. VACANCIES IN OTHER ELECTIVE OFFICES If the Attorney General, Secretary of State, Comptroller or Treasurer fails to qualify or if his or her office becomes vacant, the Governor shall fill the office by appointment. The appointee shall hold office until the elected officer qualifies or until a successor is elected and qualified as may be provided by law and shall not be subject to removal by the Governor. LEGISLATIVE COMPOSITION (a) One Senator shall be elected from each Legislative District. Immediately following each decennial redistricting, the General Assembly by law shall divide the Legislative Districts as equally as possible into three groups.
