And I'm hoping that they're listening today because on the front page of their newspaper today was a salute to veterans. And Ladies and Gentlemen, I'm a veteran, as you know, there are other veterans on the floor and we appreciate that. But we are today celebrating the 150th anniversary of Memorial Day. Veterans have their own day in November. This is the 150th celebration of Memorial Day, which was started by General John Logan, an Illinois General who went on to become a United States Senator. Those 750 thousand individuals from the Civil War, those 116 thousand doughboys from World War I, the 405 thousand GIs in World War II, the 54 thousand in Korea, the 58 thousand in Vietnam, the 4500 in Iraq and the 2350 who put on the uniform of this country, did their service, made the ultimate sacrifice, and did not come back. And I appreciate Representative Harris talking about the 150th anniversary today of Memorial Day and realizing that General John A. Logan was credited with… with beginning Memorial Day. What's unique about General Logan is prior to the Civil War I think we would have labeled him today a racist. In fact, when he served in Congress he… he passed a… a Code known as the Black Code, which prohibited African Americans from entering Illinois and blocked… blocked the passage of a Bill that would have… later would have allowed African Americans to testify in court. As the Civil War progressed, General Logan, in seeing what was happening in the South, definitely became someone who wanted to see slavery ended… ended. And as… later as a… as a Senator, he helped to pass the 13th, 14th and 15th Amendments to the Constitution. And… and then a little bit later in life he ran for Vice President, but the really unique thing about his political career was he… he ran… he was nominated as a Presidential candidate by Frederick Davis… sorry… by Frederick… Frederick Douglass. In fact, Frederick Douglass supported… continued his support for John A. Logan in a speech and to quote Douglass he said, But what of John A. Logan? I will tell you if there is any statesman on this continent now in public life to whose courage, justice, and fidelity I would more fully and unreservedly trust the cause of the colored people of this country or the cause of any other people, no man has been bolder or truer to the cause of the cause of the colored man and of the country than has John A. Logan. There is no nonsense about him. I endorse him to you with all my might, mind and strength and without a single shadow of a doubt. And whereas… and… and later today there will be a… a Resolution passed honoring Memorial Day but also honoring John A. A young man that she's known since birth is a State Police… a State Trooper, an Illinois State Police Trooper, the job he always wanted, a job he very much enjoys. Several years ago, Mr. Cokins stopped somebody for illegal something over on the side of the ride, he found himself hit by a drunk driver. He ended up with 15 broken bones, 8 surgeries, and good deal of therapy later. For the last two years, he has been back on the job, not just desk duty, he's doing the real thing. The bad thing that happened to Mr. Cokins… Trooper Cokins is that he failed a random marijuana drug test. And under current State Police rules that means he must be fired. This measure would say that for marijuana use neither in the Department of Corrections nor in the Illinois State Police would there be required firing of someone in this situation. It was pretty clear that for Trooper Cokins this was a one-time proposition, not somebody who is a regular user. We've checked other state agencies. I can't find any state agency and I can't find, even in the Chicago Police Department, for example, that there is a mandatory requirement that somebody be fired if they fail a marijuana test. And what they'd like to be able to do is for those who are abiding by the rules, doing what they're supposed to do, they'd like to be able to offer them a two-year time frame on the per… on the BAIID Program versus the current one-year program. "Thank you, Mr. Speaker. To the Bill. Some of the confusion coming with this drone legislation is… is we're confusing geographical maps. Airspace maps are different than land maps. So, most of Chicago right now currently is what's in… what's called a no-fly zone. Drones under current Federal Law cannot be operated within 5 nautical miles of any airport. So when I hear Plainfield, Clow Airport, that airspace would actually extend over Plainfield. So right now, we already have Federal Law dictating where these drones can and cannot be flown. This just simply says that instead of the municipalities coming along with a hodgepodge of regulations which may or may not be enforceable anyway because they may conflict, most likely conflict with Federal Law, that if we're going to do anything within the State of Illinois that it goes through the state level and not the local municipality level. As someone who is a… I spent 12 years as a corporate pilot; I'm an amateur drone pilot. These laws are very thorough and they're very confusing. And when you start layering on different map layers, it gets even more confusing. So, this to me is a step in the right direction. It allows those amateur users of, quite honestly, remote controlled drones to do them in a legal, responsible way. Please keep in mind that most major metropolitan areas with an airport it's illegal to fly a drone now as it is because you're within 5 nautical miles of an airport. The current knowledge standard in the possession of a stolen motor vehicle law knowing a criminal law has been raised requires an officer establish that an offender has conscious awareness that a vehicle is stolen or converted in order to charge and convict for possession of stolen motor vehicle when the offender is caught driving a stolen vehicle. Whether the car was taken in a carjacking or stolen from the victim in a theft, when the offender is later caught driving the stolen vehicle he or she is generally able to plead ignorance or have a legitimate claim the car was loaned to him or her and avoid charges for possession of stolen motor vehicle. The current practice allows repeat carjackers and car thieves to avoid meaningful accountability so long as he or she can escape from the carjacking or theft without apprehension. And… and there's something fundamental about this Bill that I think we have to realize, is we are changing the nature of criminal law and how we prosecute people with this Bill. There has been a philosophy about the law, especially about criminal law, that is from time and immemorial. And that is, that we would rather see 10 guilty people go free than we imprison 1 innocent man. This Bill dumps that on its head. The Bill removes the requirement to prove by a reasonable doubt that the… the defendant knowingly possessed the stolen motor vehicle. Now, you just have to prove by a reasonable… beyond a reasonable doubt that a reasonable person should have known. Well, should have known is not the same thing as actually known. By my reckoning, we do not put people in jail ‘cause they should have known. We put people in jail because they did something intentionally. This is a felony. This is something we have to take serious. There was a program that was funded under the Motor Vehicle Theft Prevention Council, which might sound familiar to some of y'all because it's one of the funds that got swept in… during the budget standoff. The folks that worked on that grant during the time I was there, the 10 years I administered that grant, it seemed like all they ever did was carjackings. Never once, in all the years that I worked with these… with these prosecutors, did one of them say to me, you know, I can do my job better if we changed the law. We are holding youth in… in detention causing permanent harm to their lives. This is a terrible Bill and isn't an answer for a problem that is real. And the answer to that problem is better policing and better response in our communities, not greater penalties and more detention of youth, and more destroyed lives. I strongly urge a 'no' vote."

I voted for a Bill to increase penalties for illegal gun offenders and a Bill that's going to apparently reduce crime in a couple of years according to the superintendent. But this is something beyond that. Representative Andersson highlighted the due process violations that are pretty inevitable here. But beyond that, we're retaining youth for 40 hours. We are subjecting them to a mental health screening that based on our backlog at the Cook County Jail, not to speak to other jails, could take many, frankly, weeks if not over a month. This is very bad public policy to get at a very real problem. Currently, this Bill would move the current standard as what is the current practice right now as if… as a juvenile was caught with a gun on a school. So, please remember, Amendment 1 removed the detention for possession of stolen motor vehicle. I know people have mentioned that, but it removed the detention of a stolen… the possession of stolen motor vehicle. That is not in the Bill in its current state. Secondly, if the defendant is able to substantiate his or her reason for driving the car and the trier of fact finds the jurisdiction reasonable, the court or jury can, of course, find the defendant not guilty. So we must… they must give a reasonable excuse, a reasonable alibi. It does not… does not under any circumstances provide or shift the burden of proof. It does not. So there was some concerns. This is the new Bill, Senate Bill 2638 that came from the Senate that addressed some of those issues. Since April 17, we have now received the opinion from the Attorney General's Office. This Bill is an agreed Bill between the Comptroller's Office and the Illinois Municipal League along with other groups. And this Bill clarifies that local governments can continue to file their annual audit statements using cash basis accounting, unless they switch to the accrual basis after June 30, 2019. If a local government files its statement on an accrual basis after this date, then all future filings must occur on an accrual basis. Be happy to answer any questions."
