Later on today I will be presenting… or this week… House Bill 331 in honor of Tamara Clayton. She was a postal worker for 25 years. She resided in Country Club Hills in Representative Debbie Meyers-Martin district. She was shot and killed on I-57 Expressway. In the past 6 years we've had 168 shootings on our expressways. House Bill 331 not only allows State Police and local police the opportunity to capture evidence and use that evidence for people who shoot on our expressways, but it also gives the family some semblance of justice. Today I'd like to recognize not only Tamara Clayton's sister, but the men and women who traveled down here to Springfield to recognize not only what we're doing today or this week for making sure that cameras capture this evidence and our local prosecutors are allowed to use this evidence. These 168 shootings that have happened on our expressway, they closed each and every one of those cases because they couldn’t make an arrest and didn’t have the ability to capture those shootings on our expressway. I ask that we say a prayer for the family, that we continue to do all that we can to make sure that our roads are safe not only for families, but we bring some justice to Tamara Clayton and her family, and our prayers are with you."

Sadly, Mikayla's four-year-old sister ran a bath while her mom was not… not aware and the four year old put Mikayla in the bath. Within three seconds Jennifer was there to get her daughter out. And sadly within three seconds, because there was no safety valve on their water heater, that little girl had third-degree burns throughout her entire body, and sadly passed away because of it. This has been very difficult for this family, and it has been quite a journey. They sued the water heater company and won, but made the decision instead of taking a settlement to commit themselves to changing this and making sure it never happened to another child or another family. So this legislation will prevent that from happening again. This will put a safety valve… require safety valves be put on water heaters so that it can never happen again. I ask for your 'aye' vote."

They actually ended up purchasing three hospitals. They purchased Weiss; they purchased West Suburban; and they purchased Westlake Hospital. Throughout all those negotiations, they stated very clearly that they had no intentions of closing any of the hospitals or changing any of the services for two years. The final sale was finished in the end of January and two weeks later they announced that they were going to close Westlake Hospital, which is in my district in Melrose Park. They were able to do this because two years ago… or actually three years ago, we passed legislation that allowed that… from the Illinois Health and Hospital Association that was meant to streamline reorganizations and repurposing of hospitals and health care facilities to make the process a lot easier. They defrauded both the Village of Melrose Park, and I would venture to say the Illinois Health and Hospital Association, along with the Health Care Facilities Board by stating that they were going to keep these… this facility open. This facility is in a very low income community. It is vital to the community. It has over 50 behavioral health beds, 16 maternity ward beds, and it has an ER that is often times the only ER that is open when other hospitals in the area are on bypass. And two weeks, two weeks after they purchased this community hospital, they did a complete 360. Everyone in here has gone through the purchase of a home process. You know what that's like. You probably had your closing date moved once or twice during that purchase process. This process started in September of 2018. That closing date moved so many times that they didn't close until January of 2019. Why is that? Because they went through due diligence. They knew the facts. They knew every single thing about Westlake Hospital when they bought the hospital and signed under oath that they would keep it open and not make any changes for at least two years. Leader Willis has a Bill on the board that says don't protect liars and cheaters. Don't reward this company for coming in here and abusing our laws. The Village of Melrose Park would be devastated if that hospital closes, 800 employees, 800 plus families, the businesses surrounding the hospital. She's trying to protect the fabric of her community. That's what we're asking here. "As you heard very eloquently by the previous speaker, there are almost 800 employees of this hospital. This hospital has been open for over a hundred years. It is a vital part of the community. So all those employees would lose their positions. Many of them have been there for over a decade so they are totally vested in the community right there. Many of them walk to work. Not only that, with a hospital that is so community based like that, many people… we have 16 maternity ward beds there. So pretty much everybody either had a baby at Westlake Hospital, or knows somebody that had a baby at Westlake Hospital, or they themselves were born at Westlake Hospital. We also have 50 behavioral health beds there. That is something unique to the community. That is something that everybody in the surrounding neighborhoods are very well aware of. Their ER is also one of the few ERs that almost never on bypass. It's been on bypass the last two days because the Pipeline Health Care has decided to close it down, but they are never on bypass. When Gottlieb Hospital is on bypass, when one of the other hospitals farther out is on bypass, the ER is the place at Westlake that is constantly having the Emergency Medical Services come into there."

That black and brown community people who need a hospital that it's right there for them that hospital will be denied to them. That if someone has a stroke and they need immediate care, that that would be denied to them. I just don't understand. I want to ask you a follow up question. How is it that we allow companies that are not even from the State of Illinois to come in and tell us that they're going to do one thing and say work with us and make agreements and them decide to viciously lie to us and close hospitals that we desperately need? "Unfortunately, that's possible because we… two years or three years ago when we passed the legislation, it allowed them to reduce the amount of up front that they needed to do. It streamlined the purchase and transition orders on it making it almost too easy. And that's what we're… that's why we want to repeal that. Let me point out one other thing in the repeal. Where we ask the Governor to step in is only in when we're talking about the exemption that's granted. And that's why we put it into this law that every time that there is a pending law suit, the closure will be denied until the law suit is done. And that is why we changed it into this legislation to go through. Let me add one other final thing and then I'll take some more questions on from you on that. One of the things that also came up was that the Health Care Facilities Board says this is a good thing. Actually, when I had my initial talks with them, they said when we pass this Bill in the 99th General Assembly, they were concerned about it then and they actually have language that they would like to see us work with going forward to fix. And that is truly my intent to work with them in a manner that… going forward. But at this point, I need to send a message to Pipeline… my fellow Representatives in the area need to do the same thing. We need to tell Pipeline they cannot do this to us. They cannot do it to the community. They cannot do it to the people that depend upon Westlake Hospital. Anything else?"

"To ensure that the employees are there providing the health care that we need in that hospital. Is that correct?"

"Correct. And then that's something that is so vital. As you heard prior said, we actually went to court yesterday to put a stay on the closing of the hospital. And while the judge did grant that, the Pipeline Health care continues to ignore that. We're hoping that having the Governor put in his additional power behind that, maybe we can get this to stop. We need to do this until… forward. One of the other things that we've gone and I've gone and worked through, and I cannot stress this enough, I've been working with Deputy Governor Flores, and she has told me that she intends fully to put Westlake Hospital on the transformational hospital list and do a certificate of need and a community survey on the need for the community on what services we truly need in Westlake. That is something that should have been done in the beginning, and I'm very happy that the Deputy Governor has agreed to work with me on that as we go forward with this. But it doesn't do me any good if the doors get shuttered tomorrow or on April 30 when the health care facilities meet. We need to keep it open, keep those services vital to the community throughout this process."

"To the Representative, this is definitely an issue that we spoke about in committee. And as you know, I have a background in health care and have worked on issues of certificate of need and health facility licensing over the years as I expressed in committee, I had a number of concerns. And one of my questions that I wanted to talk about a little bit is just what… we discussed this a little bit, but let's talk about the impact of… there were references earlier that this legislation is going to be so problematic for future issues, but one of the other things we spoke about in the subject matter hearing but also in committee was that if we don't address this issue, this could potentially happen to other hospitals throughout the state. Could you address that for us?"

"Exactly. We have streamlined the process of purchasing hospitals and changing hand so much so that there's really not a checks and balances in there. And that's what we're trying to take it… slow it down, take it a step back, making sure that we truly have a certificate of need as we change hands and that we have it much more strict as to what is the intent of the new purchaser. What are they going to do? "Thank you. And to the Bill. There were a few questions earlier about whether this exists in state statute with other processes. One of my well regarded friends on the other side of the aisle asked, does this happen in other state agencies? I do believe there are few process in which an agency can make a recommendation in which the Governor or the Executive Branch can go in a different direction. And I believe, and I could be mistaken, but I think the Pollution Control Board and the Prisoner Review Board are two areas where there are recommendations made to the Governor and the Governor has full discretion to decide whether to accept those recommendations or not. So the idea that we are increasing the power and the authority of the Executive Branch I think is misplaced. I also think that we created a certificate of need process, and we create a certificate of need process that reflected problems in the past that we fixed. I think that we all agree the certificate of need process failed us here. The certificate of need process that we created that was supposed to fix some of these problems, failed. It failed this community of the Representative. It failed us as a state. It will continue to fail us over and over again unless we fix it. So this is an important issue and the idea that we can stand by and let the courts do what this Legislative Body should be doing, I think is misplaced. So I urge an 'aye' vote. Thank you."

"So, Leader Willis, I'm just curious, normally when a business closes the state isn't necessarily involved and I'm curious… you know, what is the process here for closing a hospital and why is it in the public interest for the state to get involved?"

"Well, as you've heard with other Speakers, health care is a right. And I think when you're taking that away, certainly when you're taking it away from a community, that is something that the state has to step up and we have to make sure that we have it. It's one of the things that I'm sure you have heard and I have heard whenever we're talking to people in the community, affordable, convenient, assessable health care is so vital to everybody's well-being. And when you're taking away a community hospital that doesn't just do inpatient stays, but it does a lot of outpatient work, it has a very robust senior group that comes in there for diabetes checks, for follow ups, for operations. It does a huge thing that has a very robust fitness program that they do throughout the community. It's not just the in hospital aspect of Westlake Hospital that affects it. So it's definitely a community organization and when you pull that out of there that takes a part of the community away from people. And that is why it is so vital to keep this in the community that it has been in for over a hundred years."

"Yes. I mean that is something that we're constantly hearing, especially inpatient mental health. There is always a wait for beds on that. And when we have a hospital that is in a community, especially a low income community that has 50 behavioral health beds, that is not a place we want to close down. We're looking to expand that if anything else. And that is actually something that the Deputy Governor and I talked about, about possibly, as we do the transformation forward if Westlake Hospital qualifies for a transformation, which would be additional funding, to possibly add more behavioral health beds to the hospital."

"Is it also my understanding that the misrepresentation is specifically the reason why you're bringing this legislation because the process itself was flawed?"

"Yes, the exemption process has been flawed and that is what we're so concerned about. It made it too easy to get that exemption without a chance to turn it around. And that's why we're bringing this forward."

"And it was my understanding too, from the hearing that we had, that had the Pipeline Health indicated that they would be closing this hospital in all likelihood, this wouldn't have been approved in the first place. Is that right?"

"I would probably venture, yes, that would not have happened. If they had been up front and told what their plans were for Westlake Hospital, it would not have been approved for sale at that point. The previous owners were very upfront with what they wanted to do. "Leader Willis, you brought this issue to my attention recently and to my discredit, I hadn't paid a lot of attention to it before you and I spoke. And I really appreciate you bringing me up to speed about it. I… I want to talk about process a little bit. So first of all, can you walk us through the process that the company went through in the purchase of the hospital? So, an earlier speaker mentioned that they swore affidavits or gave testimony under oath about their plans for the hospital. Can you describe that process a little bit?"

"So the way it goes, is there was a number of hearings before the Health Care Facilities Board whenever there is a request to purchase a new hospital or change owners of it. They come up with… they present their financials, they come up with what their plan is, and they present it to the health care facilities and the community in which the health care facilities reside in. And then the Health Care Facilities Board accepts the recommendation along with it and that's when it goes through with the approval of the purchase. That doesn't even count in the banks and all that stuff. "And there were… it sounds like there were community hearings as well as formal hearings in front of a board. Is that right?"

"I'm sorry, I didn't hear what your question was."

"Yes, there were. Here, I can go through a timeline for you."

"In September of 2018, they had a state board staff report that talked about the change of ownership, so that was one. They were issued an approval letter in November of 2018, and then that was finalized on February of 2019. And then, by the request of the mayor, on 3/11/2019, we actually then had… this is when we found out that everything was going through and we went through and we had another public hearing. Actually, the public hearing is the one good thing that we had in that Public Act that we did in the 99th General Assembly. It does require a public hearing before a closure can take place, but it doesn't require the public hearing before the transition of ownership takes place. And it also doesn't hold… we had hundreds and hundreds of people come and testify, send in letters, and talk about why they wanted to keep the hospital open, but it doesn't really give a lot of weight to the decision of the Health Care Facilities Board."

"Sure, I understand. Is that right?"

"Correct."

"And one other piece of the Bill that jumps out to me is the business about a pending lawsuit. Can you explain a little bit about the idea there?"

"Right. So the Health Care Facilities Board says normally if there's a pending lawsuit that puts a hold on it but they are not mandated to put a hold on it. And so, we put into this piece of legislation that if there is a pending lawsuit, they are mandated to put a hold on it until after the law suit is done. That's a huge difference because, you know, you're shooting the dice as to where the board's going to go and I don't want to take people's lives on a crap shoot like that."

"Sure. Well, to the Bill."

"I think the measure we have before us is a very reasonable provision, a measured response to a very serious challenge facing the Representative's community and the communities in her area. Folks who are profoundly underserved in so many ways, in particularly underserved when it comes to meeting their health care needs, and we have an institution whose fate is hanging in the balance. And this institution provides services that no one else in the community's providing. And for this community to loose such a critical institution, because some out of state vulture profiteers want to come in and extract a few extra bucks seems to me like a profound miscarriage of justice. I think the Bill before us today is one, as I said, that's measured, that's sensible, that requires a process that we've gone through for many, many years in this state before. This isn't inventing something new out of whole cloth, this is simply returning to a process that we used to use. And frankly, I think the provision in law that Leader Willis is proposing that would suggest that a decision may not be made while a lawsuit is pending in a case, seems very sensible to me that a decision like this if it's working its way through the courts, let the courts make their ruling before the state makes its decision. So I'm very grateful to Leader Willis for bringing this forward. As I said, this was not an issue that I walked into this chamber knowing a ton about, but the more I learned about it, the more it seems like there's a real injustice happening in this community, and we have a very sensible and responsible Bill to address that injustice. "Well, the most important one is to make sure that we codify that if there is a lawsuit, if it's pending, that we make sure that that says that they cannot make a decision while that lawsuit is pending. I think the Health Care Facilities Board is open to that, but one of the things that they are concerned about is the Governor's override ability. And so, I'm willing to take that back in a trailer Bill. And they had some other language that was more cleanup language that they would like to see put in there. The certificate of need was certainly an important aspect of them, what they wanted to see. They did have some concerns on the financial statements and I'm willing to work with them on that in the trailer Bill also." Hernandez, L.: "So, Representative, it appears to me that you're being very open, you're being very willing, that there probably could even be even more conversation on the… once you put the trailer Bill together."

"I would say I try to pride myself in being very open- minded and willing to compromise. The only reason that I did not put in an Amendment on the Bill at this point is I needed to state a stance that I needed to take a strong, hard stance against Pipeline Health to let them know that they cannot do this to my community and hopefully not to anybody else's community. Many people may not know that I was a former program director for Champaign area Boys and Girls Club, and I wanted to highlight and thank the Legislature for the work that they have done for many years to support Boys and Girls Clubs of which we passed with unanimous support, the House Resolution #250. I want to highlight from that Resolution that the Illinois Alliance of Boys and Girls Clubs provide services to over 63 thousand youth at about a hundred facilities throughout the state with the support of programs such as Teen Reach and 21st Century Community Learning Centers, and funding from community foundations, grants, and the generosity of private donors. As well as the Teen Reach Program is unique to Illinois and represents a partnership between the State of Illinois through the Department of Human Services and the Illinois Alliance of Boys and Gils Clubs that is now entering its 20th year of working together to provide great futures for the youth of Illinois. And finally, I wanted to just add that every $1 invested in Boys and Girls Clubs returns $11 to its communities and to those served.
