"Thank you, Mr. Speaker. Thank you, colleagues. House Bill 3665 pertains to medically incapacitated and terminally ill individuals who are housed in the Illinois Department of Corrections. The current… currently, there is a process in place for those individuals to request executive commutation of their sentence. So, we're talking about people who have a few months left to live or people who simply cannot perform the basic tasks of daily life. So, they may petition for executive commutation in order to spend the last months of their life at home with their loved ones. But that process is extremely long and cumbersome. It involves interviews. It involves notarized forms and certified mail. Processing reviews sometimes takes years. And, of course, for most of these people, they simply don't have years to spare. So, the Bill before you would streamline that process, would allow the Prisoner Review Board to make a timely determination of whether someone can go home for the remainder of their life. The measure would still be at the PRB's discretion. There would still be all the traditional processes for victim notification and victim statements to be made. We believe that this is an important measure to allow for some of these folks to… to have an expedited determination of whether or not they can be sent home. The… the Amendment that we just adopted contains language from the Department of Corrections, from the Prisoner Review Board. "So, the… when the incarcerated person is released, they're on mandatory supervised release thereafter. So, yeah, there… there is quite a great deal of oversight of their experience after being released from incarceration."

"That’s right. And just to be clear, the folks we're dealing with here are people who are extremely ill. We're talking about people who simply can't perform the basic tasks of daily living. And just… I wanted to mention this since you're here. Yesterday in committee, there was a mention of the language in the Bill. It said there was one task of daily life that they couldn't perform. We amended that language, in consultation with PRB, to say more than one task of daily life. So, really these are people who, the multiple of the very basics of like getting dressed, putting on your clothes, eating food, taking care of yourself, using the bathroom, they just can't do that stuff. So, these are people who are in very, very serious medical condition, and they're not likely to improve."

They said, 'Men and women with various types of dementia, advanced cancers, increasing fragility are housed in many IDOT facilities. The infirmaries are becoming filled with patient inmates who are confused, incontinent, and require assistance with the basic activities of daily living, including dressing, feeding, bathing, and toileting. The health care and correctional resources required to meet the needs of this aging population is staggering.' Staggering. So, this Bill is one step toward reducing those staggering costs of caring for these individuals in our department. And also, extending some compassion to these folks to allow them to spend their final days with their… with their loved ones. I want to thank the Illinois Prison Project for their advocacy on this Bill. The Appleseed Center for Fair Courts has done amazing work. I want to thank Joe Coleman whose father died in prison seeking executive clemency, serving a life sentence for armed robbery at a gas station. He came and testified before our committee. It was very powerful. I want to thank my colleagues from across the aisle who worked with me on the language here. And I urge an 'aye' vote."

Fellow Members, today I present House Bill 2400, a Bill to amend the School Safety Code to put trauma-informed, age and developmentally appropriate best practice parameters on active shooter drills. As a former teacher and a parent to three students in public school, this Bill is very close to my heart. Although there is very little evidence that active shooter drills are effective at preventing deaths in shooting situations, these drills are required by state to happen within the first 90 days of school. The current statute is vague and leaves the nature and content and identification of those who participate up to the interpretation of school administrators. Students and educators are left to participate in drills that vary dramatically across schools in Illinois, from trauma-informed to trauma-inducing. House Bill 2400 would ensure equity across the state. The parameters laid out in this Bill are simple. Lockdown drills must be announced in advance to all school personnel and students prior to commencement. Lockdown drills must include and involve school personnel, including school-based mental health professional. And during the drills, students must be allowed to ask questions related to the Bill. Law enforcement may choose to run an active shooter drill simulation for their own training purposes only on days when students are not present. We worked with several stakeholders on the drafting of this Bill. Law enforcement, including SROs, the Illinois Association of Police Chiefs, and the Illinois Sheriffs' Association, gave valuable feedback. "Thank you, Mr. Speaker. Ladies and Gentlemen, House Bill 1854 is a Bill that will improve the process for discharge planning in mental health facilities. We brought this Bill in front of the Mental Health Committee. And ultimately what this does is it codifies something that we would all hope for if our loved ones need to go to a facility or need services from a mental health facility. Discharge planning and what happens when your loved ones need to transition out of a facility is so critical, as we have recidivism and people that continually need services for years and most of their life. Behavioral health and mental health facilities are critical that we get it right. This came about because of conversations I had with a constituent who, during the pandemic, had a loved one who was admitted to a mental health facility. And in the midst of discharge planning, was given insufficient discharge help. They weren't given referrals to providers. They weren't giving information about how to provide care outside of the facility. And we need to do better. We owe our residents better when they are admitted and discharged from a mental health facility. This Bill will provide that clarity. Many facilities already provide this support. Our state has a shortage of nearly 290 thousand rental homes for extremely low-income households or those households who are at or below 30 percent of the area's median income. More than two-thirds of extremely low-income household renters are severely cost burdened, paying more than 50 percent of their income for housing. This leaves them with few resources for other basic necessities. These people are at serious risk of homelessness. Created in 2005, the Rental Housing Support Program, known as RHSP, is a program in the Illinois Housing Development Authority that they administer to provide rental assistance for extremely low-income households. RHSP sets aside 50 percent of resources for people at or below 30 percent of the local area median income, or AMI, and the other 50 percent for people at or below 15 percent of the AMI. For those households, this program is a vital resource to keep these families in a secure housing situation. The issue arises when some people are put at risk of losing their eligibility in the program when they just slightly surpass 30 percent AMI mark because of, for example, a nominal increase in their SSI check or a slight increase in income. These families are still vulnerable and are not able to afford any rental housing market rate. Yet, they're often being pushed out of their housing. This Bill will allow the RHSP program greater flexibility in helping this at-risk population. Additionally, this Bill adds further flexibility in providing rental homes with a range of bedroom sizes. Currently, local administering agencies must include two bedroom, three bedroom, and four bedroom units. According to IHDA, more flexibility would give local administering agencies the discretion to include units of different sizes when necessary and better reflect the communities they serve. According to IHDA, there should be no additional costs to the state with this Bill since it only impacts current people receiving a rental subsidy. The Bill also does not increase appropriations to the program. We've been working with the Illinois Housing Development Authority, Illinois Housing Action, and the Chicago Coalition for the Homeless on this Bill. The Illinois Housing Council is also supporting this Bill. I appreciate all the stakeholders coming to the table to help put together this Bill that will keep families in their homes, especially in the middle of a pandemic that has highlighted the need for affordable housing. What this Bill would do would provide proper payment on warranty and recall work from the manufacturers to the dealership and the mechanics. So, just to give a little history. If you take your car in for warranty work to a dealership that… and have that work done, there is a manual they go by, and there is a set time that they allow to pay that work. And in… lot of times that's undercut to where the mechanics and the dealership aren't getting fully compensated for the hours that are put in, to where I'd have a guy go into work and work 55 hours but only get 42 on his paycheck because of this time difference. This is one of the things this Bill addresses to where they get paid for equal time for the amount of hours that they put on a specific job. Secondly, it would provide that the sale of motor vehicles by unlicensed dealer would be prohibited. I'd ask for an 'aye' vote, and happy to answer any questions."

So, if you take a car in for warranty work, and say your fuel injection needs to be fixed. That takes the mechanic… say it take 12 hours, but the book only says it's 8. That’s what the dealer gets compensated, and that's what the mechanic gets compensated. So, I mean, the dealers got their cost of providing the building, the utilities, the insurance, et cetera. So, they're both losing on this end because to perform and work on behalf of the manufacturer that made a faulty product."

"No, they're employees of the dealership. But their pay is based on what they get from the manufacturer dealing with warranty work. If you… for example, if you were to take your car in at 34 thousand miles, and the warranty expires at 36, that mechanic, say, is only getting paid for half the time. But if you're at 37 thousand miles, off of warranty, and you go in, that mechanic is going to get paid for the full amount of hours he put in. And it also reduces the penalty from a felony to misdemeanor for five grams or less of methamphetamines, and a conviction where the statutory penalty lessens as a result of resentencing hearings. Let me just say, this Bill is not ground shaking or groundbreaking. Twenty-two states have already done this. I wish we were in it… in control of this in leading a nation, but I will share with you all that those 22 states are not liberal bastions like California. They're Iowa, Wisconsin, Oregon, Tennessee, Oklahoma, have already done this. Municipalities will also have to report how much increment the project… the project is projected to create as well as how much is actually created. If the municipality issues debt to fund a TIF project, they then must report to the Comptroller and the taxpayers if the debt is being successfully paid off. Additionally, if a private developer says that a property requires TIF funds to provide a certain rate of return on their investment, a third party must verify that the municipality does not overpay. Unfortunately, we're not passing Bills to hold pharmaceutical companies responsible for the production of all the opioids that are throughout our communities. So, the victims of that is not only the addicted person, but they are also then criminalized on top of the addiction. This young lady was a student at our university who had a lot of different issues that I won't go into. But unfortunately, she was caught with some pills that actually ended up getting her a felony record and kicked out of school. This issue came a few years ago from the ACLU asking me to support this initiative. I went to a conference to do just that, to learn about this issue, this international conference of drug policy alliance, and realized that only the United States of the industrialized nations had such draconian laws when it comes to possession of drugs. It is a fact that the men in my family, that my friends who still have petty criminal records are obstructing them from opportunities. Have you looked in the face of a man who wants to take care of his family but is missing out on the opportunity because of something he did at the age of 19? What did you do at 19? I'm sorry about those folks that were affected by drugs, but I have to look at my father when he was addicted to drugs when I was a child. Some of my first, earliest memories of my father was him battling drug addiction. And this man has battled drug addiction his entire life. And in his 50s, he finally got an opportunity to get his life together to move on. And we happened to figure out a way to help this man because of all of the petty criminals, and crimes, and drugs, and what have you that he was involved with. And now, he's a working man down in the St. Louis area. But it's an obstruction. These folks look back and they're sorry. And they can't apologize to you all, but we've got to move forward. We have to give folks opportunity for real citizenship and a chance. The mistakes that I made yesterday are mistakes that I asked God for forgiveness. And those individuals and the person that sold drugs to your loved one, and I apologize, I'm sure he's a… he wants to move forward. But he has a family. He has a child that deserves a college education and deserves an opportunity. And we got to look forward. Believe me, I don't believe I will ever stop attempting to reverse the 1985 drug laws in this state. I will never stop. This will not be the last Bill that you see on reversing the effects of what happened to the black community. Just like we want to reverse the effect of what has happened to our other ethnic groups in this state, we have to take responsibility for actions that were taken by Legislators before us. So, House Bill 2413 is an initiative of one of my communities. So, back in the 1970s… oh my. That's how they treat you? Okay. So, back in the 1970s, something called the Chicago South Suburban Mass Transit District was created. Its purpose was to assist both PACE, which is our suburban bus transit company, and what is now METRA, our regional rail transportation entity, with infrastructure, which would be busses and/or railcars. I believe there was some work early on in order to do that. But… and I've got letters to support it from both PACE and METRA, that that relationship is no longer needed and they no longer need the mass transit district for any support in that way. What eventually took over to help provide that support for the transit agencies was the RTA, and that’s who they've been working with. We obviously support RTA through various mechanisms here. They get portions of transit dollars. So, what they have been doing since is, they have acquired property and have set up commuter parking lots in three communities. Homewood, Olympia Fields, and University Park are the three communities. So, all they do, and I'm not trying to minimize them, but all they do is that they maintain these parking lots for the purposes of commuter parking. So, in the interest of trying to move beyond and essentially say that they've outlived their purpose, each of the three communities that I referenced, I have letters from each of them, where they are saying that, upon the dissolution of the mass transit district, they will take over the parking lots, maintain them, not only for aesthetic purposes, but they will also maintain the parking lots for commuter travel purposes. Which is what both PACE and primarily METRA want to make sure remain intact. And again, I've got letters from each of them where they are acknowledging that they will keep those parking lots for commuter purposes. So, what we're trying to do here, and also in the interest of, not necessarily government consolidation, but we acknowledge that this entity has outlived its purpose. Has simply outlived its purposes. None of the other communities along that line, of which they can make a appointment to that particular board, none of the other communities called, nor reached out to me to say that they would like to see the transit district remain intact. None of them called. So, our effort here today is in the interest of good government to say that this is an entity that was indeed created for a purpose, which it has simply outlived its purpose and is no longer needed for the purpose of maintaining parking lots that the three communities in which the parking lots reside, they have agreed to maintain and keep the parking lots for that purpose. It would address the judicial process by which the court determines whether the failure to pay the fine was willful. The current statute places the burden of proof on the debtor. But what happened was… it was the clerk had forgotten… or there was some problem with the computer and the clerk did not give the opportunity to enter his paperwork into the computer. So, therefore, it came up that he had not paid, when, in actuality, he had paid. But now he is dead. And so, this should not have ever had to happen. And so, now we're merely asking that notice be sent first before there is a warrant that's put out for people's arrest."
