"Madam Speaker, can I vent? I rise today to speak against the Medicaid omnibus Bill that outrageously inserted a provision allowing pharmacists to practice medicine. This is purely profits over patients. Madam Speaker, I've got to ask, is this how business is conducted? Saturday evening, an omnibus is presented with these dangerous provisions buried inside a much larger Bill. This didn't go before the Medicaid working group, which I was a part of, never brought up. Health Care Licensing, which is a purview of these scope of practice issues, I sat on that all Session. This never was brought up. It would've never gotten through, but it's inserted in an omnibus Bill last minute, without the input of stakeholders or anyone except national corporations and their lobbyists, not known for their patient care interest. This process stinks. You all understand why physicians and other medical professionals can't get down here very often to lobby in Springfield. Medical professionals rely on Illinois State Medical Society. The pediatrics have their… the pediatricians have their groups, the family practitioners have their groups, and nurse practitioners, the PAs, and especially our elected Representatives to protect the practice of medicine and guard various patient safety issues and at least let us know when to get involved, when to file witness slips, when to show up. Now, this process has been hijacked. We've been stabbed in the back by national corporations and their associations that want to put their profits over patient safety. This is gross. This is the practice of medicine. I don't blame the pharmacists. There's complex medications. They're starting to organize against their working conditions. They don't have the time or training to practice medicine, but, you know, profits over patients. What does this even look like? Already overworked between selling, I don't know, deodorant and dispensing medications and ringing up, I don't know, Nerd Ropes, they're going to practice medicine too? The practice of medicine is history. Physical exam, medical decision making, differential diagnose… diagnosis, and prescribing the appropriate treatment, physicians have the education, training, experience, not pharmacists. Who knew that all we needed to do, instead of all that training, was slip a Bill into an omnibus Bill? Test and treat is an insult. It's simply practicing medicine poorly. And… and RSV, really, on kids? The most important thing in RSV is the physical exam. I've seen children die from RSV. It's not an insignificant disease that you can just test. You look at the kid. You listen to their lungs. You look at accessory muscle breathing, retractions, how fast they're breathing. There's not much treatment for RSV. We're just going to test and treat a positive test? This is outrageous. Flu, let me guess. Every patient with a positive test for flu will get a very expensive Tamiflu prescription as they go out the door. Strep throat, this should good. Do they know the complications, peritonsillar abscesses? Have they looked at a throat? Have they looked through the pill hole at the throat? Scarlet fever. Rheumatic valve disease. If it's negative, they shrug their shoulders. And if there's complications, they refer to a real doctor. Don't let them undermine the processes of the General Assembly and the practice of medicine by putting profits above patient safety. Please commit, all of us, to work to restore patient safety and reconsider this law as soon as possible. Thank you." "Thank you, Madam Speaker, Ladies and Gentlemen of the House. I move to concur in Senate Amendments #1, 2, 3, and 5. This Bill is the annual procurement Bill that we generally do every year. It contains several articles in addressing several agencies, as well as local government entities. It provides for a Progressive Design-Build Pilot Program. That's for the Capital Development Board. There are various miscellaneous procurement smaller provisions in here. There's a DNR clean energy procurement language. There's communications infrastructure leases. There's Freedom of Information exemptions that prohibit certain communications being shared. That's the road and bridge engineers so they're not giving out trade secrets. RFPs for leases, Procurement Code exemptions for recruitment in hiring… hiring processes. There is the Hotel Florence, which is an initiative of Leader Smith. There's the Illinois business… Illinois business bid preferences, unsolicited proposals, BEP goals. I believe that a lot of that was by Leader… or, Representative Tarver. There is also an Illinois… Illinois construction preferences, joint purchasing rankings, Commission on Equity and Inclusion provisions, as well as the cleaning up the McPier competitive bid threshold and the public-private partnership guidelines. So, it's a fairly comprehensive Bill dealing with several areas on… on procurement. I don't believe that there is opposition, but I would ask for a favorable roll call." "Thank you. Leader, appreciate you going through the items that are contained in the Bill. I just had a few questions. First, as it relates to the Progressive Design- Build Pilot Program, what changes are we making there?"

"It's my understanding that this is for the Capital Development Board, and that is contained in Article 1 of the… the Bill. It's my belief that what this does is it maintains, basically, the design-build process that they currently have, but allows them to use the same contractor for design-build purposes on at least three projects."

"There are also some changes related to IDNR and the department's ability to lease land for up to 40 years for commercial solar energy projects. I believe we had a separate Bill on this earlier in the General Assembly. Do I have that correct?"

"As with the Reimagining Hotel Florence Act, I believe we saw legislation similar to that previously. And this is 21 million in capital infrastructure funds to aid in the restoration and capital improvements at the site. Is that accurate?"

"Yes. That… this is… was Leader Smith's proposal for the Pullman site."

"You had referenced the Business Enterprise for Minorities, Women, and Persons with Disabilities Act that this will set forth uniform standard of contract goals and the participation level of certified vendors on state contracts. Are we doing anything that's changing the definition of those that are included in the program, or just dealing with the goals of the program?"

"Give me one second. I'm… I'm pretty sure it's just the goals, but I want to make sure that I don't misspeak. Yes, just the goals."

"And there… there are provisions that deal with enforcement within the Executive Branch if there are violations of this Act. Is that accurate?"

One is that the Procurement Code does not apply to procurements necessary for increasing recruitment and retention of state employees, particularly minority candidates for employment. This includes procurements for registration fees for jobs fairs, other outreach, but does not change or affect state responsibilities in hiring. What was the reason this was brought forward?"

"It's my understanding that they would like to bring in an… an entity that would specialize in that type of work. And we have a… a large amount of openings in state government and trying to fill those openings so that we can conduct business. This was a… was an attempt to do that."

"Also, in the Procurement Code, it states that the chief procurement officer can require at any time the bidder or contractor prove they are an Illinois business. And it appears that the definition of Illinois business will also include foreign corporations duly authorized to transact business in this state that have a bonified establishment for transacting business within this state. Is that accurate?"

"Yes, it's my understanding that… that if you are under the definition of Illinois business, that you get an enhanced amount of points. So, should just say, in order to get the state contracts."

"Well, what we did is we added a requirement that all state agencies… all state agencies has to set goals for the participation levels of BEP certified vendors on their contracts, including construction contracts."

"And many of those goals already exist. "Thank you. The other part of this also changes… makes changes to the Commission on Equity and Inclusion Act. Can you describe those more in depth, what the changes are there? And are they the body that's supposed to enforce if there's no or little African American participation that reaches those goals?"

"That's contained in Article 75 to… let me get to it, okay? A lot of articles, Representative. I believe that it… it indicates that they would supervise the implementation and effectiveness of supplier diversity training of state procurement other than to… other than supervise the implementation of diversity in state workforce broadly. So, what this… what this does is it ensures that they supervise the implementation and effectiveness. So, it expands what they need to do."

"So, it… it says in this summary here that the… provides that the commission shall supervise, rather than oversee, the implementation and effectiveness of supplier diversity training of the state procurement, rather than the implementation of diversity training of the workforce. What it indicates… it's a… this is an initiative of the Commission on Equity and Inclusion attempting to clarify its purpose as to supervise and assess the effectiveness of supplier diversity training. So, I believe that they wanted us to ensure that they had all… all of those powers. And so, I would say that it actually enhances their power as well as clarifies what their power is."

"Thank you. For the record, I'd love to see the enhancement of their powers 'cause I haven't seen the effectiveness of their existence. So, we'll come back to that. One of the other questions that I have here is that the design… the progressive design and build, can you describe that? I… I think I heard you respond to another Member and said that one contractor could possibly do three… up to three projects with a design and build model."

"Progressive design-build means a project delivery process where both the design and the construction of the project are procured from a single entity that is selected as… as early as possible through a qualification-based selection process. A progressive design-build entity is the single entity after a team affirms that handle a construction project from the design phase through the construction. It also then provides when the state construction agency chooses to use a progressive design-build delivery method, how that would be done. "I believe that that participation would be required as… as is required under any construction contract in the state."

"And then lastly, under all of the procurement changes here, are there any reporting requirements that will come back either to the General Assembly or to any of the bodies that will oversee, including the Commission on Equity and Inclusion, or the Capital Development Board, or any other part of this process?"

"That's okay. I'll restate. In all of the procurement changes that you're proposing here, are there any reporting requirements that will track implementation of any of these minority participation? And, specifically, in the State of Illinois, African American contractors, business owners, professional services participate in extraordinary low percentage. And so, I'm asking if any of this procurement will have any reporting requirements connected to them at all."

"I appreciate you taking the time. This… this is extraordinary. To the Bill, Madam Speaker. This is an extraordinarily large package, certainly made up of lot of provision and portions. However, I would argue that procurement in the State of Illinois has benefited largely, certainly in the BEP program, the MBE Program, largely white women instead of actually minorities for which it was designed initially. And so, what we have is a low, low percentage of opportunities and participation for African American business owners and construction trade, including the one that is taking place on this ground, that we have little to no participation of African Americans in the projects. And so, I don't see the need for us to continue to make procurement changes that are actually locking out, by its own design and its own reporting, of participation of African American businesses, professional services, and the like. And so, I have considerable concerns about passing a package this large without full consideration for the large percentage of African Americans in the State of Illinois. And I am not certain I will vote for this Bill. And I'm not asking people not to, but I certainly ask for a serious consideration when it comes to procurement in the State of Illinois. "I'm… Representative, I'm looking at the Metropolitan Pier and Acquisition Authority Act and I… it says, reinstates the $25 thousand limit on contracts for architectural, engineering, and land surveying services and only increases the limit to $100 thousand for other professional services provided to the authority. Is… is that for no-bid contracts? What… what exactly is that?"

"It's my understanding that Amendment #3, the threshold is still raised to 100 thousand for all other types of professional services. However, what this does, this is to resolve a conflict with the Architecture, Engineering, and Land Surveying Qualifications Based Selection Act, which sets a 25 thousand threshold for these 3 services."

"So, is that a… I'm trying to understand. Is that $100 thousand limit for no-bid contracts for other professional services provided to the authority?"

"What it does is it makes it consistent that that 100 thousand threshold will be consistent across all of the professional services. Apparently, there was a conflict with the Architecture, Engineering, and Land Surveying Qualifications Based Selection where it was set at only… at only $25 thousand threshold."

"I don't… is that a no-bid? No matter what… is that hundred thousand no-bid?"

"They can make the… McPier could make the determination on their own through their process of selection, making sure that they are adequately qualified. So, I want to look back and I want to talk to you about our budgets for the last six years. You know, when… when we first started and I first started in here, the annual budget was about $40 billion. Today, we're looking at a $53 billion budget, which is about a 32 percent increase. So, I started to think about what's… what have we gained? What's happened over the last five or six years? You know, we've spent about $200 billion of taxpayer money over the last 5 years, and I wanted to go through a couple of things as to how that budget… what we've done for the people of Illinois. So, when we started in 2020, there were about 3 million people on Medicaid. Today, there's 3 and a half million people on Medicaid. So, actually, we haven't done much. Our Medicaid spending the night in 2020 was right about $13 billion. Next year, we're going to spend almost $20 billion on Medicaid. We're going to spend $10.3 billion next year. So, our student enrollment has gone down, and our spending has gone up over $2 billion. Same thing on higher education. 2020, we spent almost 1.9 billion. We're projected to spend $2.5 billion on higher education next year. So, how do we get there? Sales tax revenue in 2020 was 8,000,000,500. We're projecting sales tax revenue of 10,000,000,500. We are taking 2 billion more dollars out of the pockets of our taxpayers in just 5 years. Personal income tax revenues. In 2020, our personal income tax revenues were $19.7 billion. Next year, we're going to take 25.7 billion. That's 6 billion more dollars out of the pockets of our taxpayers. Property taxes, something we've never addressed in the five, six years I've been here. In 2020, we took $31.8 billion in property taxes. Next year, we're projected to take 36.6 billion. Additional $5 billion out of the taxpayers' pockets next year. So, what's happened? What's happened in the State of Illinois we've spent 20 billion… $200 billion? Well, companies are leaving. Companies are leaving Illinois. Headquarters for Caterpillar, Boeing, Citadel, Guggenheim Partners, all gone. Tyson Foods have closed down. Quaker Oats factory in Danville, going. Since the decennial… in 2020, the census. Since 2020, they estimate that we've lost an additional 240 thousand citizens since 2020. Unemployment. What's our $200 billion done for the unemployed in Illinois? Actually, nothing. You know, the government is supposed to help people become independent. In Illinois, the number of people in the last six years dependent on the government has gone up almost a million people on Medicaid. Almost 100 thousand more people are dependent upon us for food stamps compared to when we started. So, as you debate and you think about voting for this budget, I ask you, what have we done for the people of Illinois in the last 5, 6 years with the $200 billion that we've spent? If you think that this money has been well spent, if you think that what we're doing here is helping the people of Illinois, then I guess you're going to vote for this budget. We've watched another billion dollars is going to be taken out of our taxpayers' pockets next year. We've done everything we can over the last five years, taxes, fees. We've done everything to get every dime we could out of this economy to pay for this wasteful spending that's really producted no positive results for the people of this state. So, I'm of the opinion that the only thing left, the only place left that we haven't taken money from our taxpayers is in the income tax. So, I'm going to predict that next year, when you sit here and you're debating how to make this budget work, you're going to be talking about an income tax increase. So, everybody that's listening, everybody out there that's listening, I want you to ask your candidate, ask your candidate that's wanting you to vote for them in November, 'Do you pledge not to vote for an increase in the income tax next year?' Because of that inaction, a water main break burst 2 million gallons of contaminated water with asbestos and other hazardous materials to nearby wells, putting residents in danger. A structure fire at the abandoned facility happened. It was difficult to extinguish because of the overgrowth and the lack of a working fire hydrant, putting firemen in danger. There have been countless service calls responded to by local police departments at the facility, putting police officers' lives in danger. How many hard- earned taxpayer dollars were wasted due to this inaction? I'm going to support the Bill because the time for inaction is over, but in no way does that excuse all the negative politics on all sides at the expense of the taxpayers. I'm hopeful that all this negativity is behind us and that the new Tinley Park multi-purpose center is an overwhelming positive for the families, seniors, children, and visitors of Tinley Park." I think it's horrible when people don't have insurance and they find themselves in a bad situation, but the reason so many people find themselves in that place is because we've made insurance so unaffordable through mandates. There are tens of thousands of families in this state who would easily take on additional risk, additional higher deductibles without the mandates in exchange for a cheaper premium so that they could have it if the absolute worst struck their family. We need to continue to trust the American taxpayer to know what's in their own best interest and reintroduce a concept of consequences for the decisions that we make so that we can be there for the most vulnerable in our communities and support them. But we also see here there's something over $4 billion worth of debt held by this 1.9 million people in the State of Illinois. The bigger picture, to the previous speakers, you know, we… we have a couple of issues, and maybe I'll just go right to the Bill. You know, Representative Caulkins spoke about the health care cost of a billion dollars plus that we're spending on a population of people that's here illegally in this country. Representative Keicher… Leader Keicher talked about the government has gotten involved with health insurance and made it unaffordable to a lot of citizens in the State of Illinois. I think we've got to really look at reforming this system. A $10 million program as… as well intentioned as may be, and they may be able to… the Sponsor, you may able… it sounds like you're able to leverage those dollars to receive some private dollars to help alleviate this pressure. But I think we've just got to look at this thing overall, figure out how to reform our health care system, and figure out the priorities of the spending of the State of Illinois that it… if this is a worthy program, that it goes to provide some relief to these individuals and, again, not spend hundreds of millions or billions of dollars on a population of people that are here illegally. This is an initiative of the Department of Revenue, and it provides that retailers obligated to only collect and… Use Tax on sales to Illinois purchasers, when those sales are sourced outside of Illinois, would be obligated to collect and remit destination-based Retailers' Occupation Tax on those sales. This is, I would guess a… I guess I could call it a cleanup to the Leveling the Playing Field for Illinois Retail Act that we passed several years ago, and it just involves two classes of retailers and kind of closes a loophole to make sure that those retailers are subject to the Retailers' Occupation Tax rather than the Use Tax. "That's correct. There's two examples that the Department of Revenue cited for me. The first would be that the seller is headquartered outside of Illinois and the sales are transacted outside Illinois. However, the seller has a physical presence in Illinois. For example, the seller may lease space, may maintain an inventory, or may have a brick- and-mortar store in Illinois. Under the way the law was written, there was a… that was an instance where they were still only obligated to pay the Use Tax, and this would bring 10300115.docx 63 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 115th Legislative Day 5/28/2024 them into paying just the full Retailers' Occupation Tax so that there would be not only the state sales tax, but the local sales tax. The second example that the Department of Revenue provided is that the seller is headquartered in Illinois, but the sales are transacted outside Illinois and fulfilled from inventory that's maintained outside Illinois. Again, that was a loophole, I think just a situation that they didn't account for. And in that case, the full Retailers' Occupation Tax would be applied to those two situations."

"In the first situation you mentioned, is the buyer in Illinois?"

"Yes, the buyer is in Illinois in both situations."

"In both situations. Do we have an estimated revenue expectation from this change?"

"There is, and it is… hang on one second. It… it's estimated… it's quite… quite large. It's estimated between 300 and 400 million dollars. And these are all sales tax dollars that would flow to different units of local government, including municipalities that have a sales tax, but in addition to some of the special sales tax… or some of the entities that collect sales tax, business district tax, the Metro East Transit District, McPier, just all… all the different special units of government that are entitled to sales tax."
