Stevenson High School District 125. I have presented a number of resolutions like this before. I have never presented one that is this long. This… and that speaks not only to the years that Terry Moons has dedicated to the Stevenson High School community but the substance and the significance of all the accomplishments that she has brought. I'm not going to read the entire thing. I know we have a lot of business to get through today, but I do want to note some highlights. Terry Moons played an instrumental role in shaping district policies throughout four decades of service, making impactful decisions and ensuring the continued growth and success of the district, all while maintaining a legendary ability to recall the details of board meetings from decades past. Thirty-three thousand, seven hundred and thirty-six students have graduated under her leadership. Her leadership was instrumental in overseeing four major additions to the Stevenson High School facilities. She played a key role in the hiring of five superintendents and eight principals, ensuring strong and effective leadership for generations of students. Terry Moons helped introduce the development of professional learning communities during her tenure. She served as board secretary, in addition to her many other roles. She was a founding board member and has been the only board secretary of the Exceptional Learners' Collaborative, the special education cooperative for the district and other school districts in the community. That was a year where a small number of people had the poor judgement to question her leadership, and the voters spoke loud and clear that we are proud of the work that Terry Moons has done for our community and we supported the leadership she brought for us over the past 40 years. When I was 3 years old, my family moved to Buffalo Grove because of Stevenson High School. And when people ask me what is my agenda for education as a State Representative, my answer is always the same, that every single child in the State of Illinois should have access to the same world-class public education that I had as a Stevenson High School student. Terry Moons, that is because of your leadership. I thank you for everything you've done for me, for our entire community, and your legacy will be felt throughout the State of Illinois for many, many years and by many, many children, some of whom are not even born yet. For more than 31 years, they've given a voice to the over half a million American Muslims who call Illinois home. Grace is also an honor student at Rockford Lutheran High School, where she somehow finds the time to play varsity soccer. Today, Grace is joined by her family who has come to support her. "Thank you. House Bill 2857 creates the Highway Work Zone Safety Act. There were 295 work zone fatalities between 2012 and 2021. Please note that this legislation previously passed the 103rd, both time receiving unanimous vote of approval. The only difference is amendment 3. Speed cameras are already authorized in Illinois work zones. However, the program administration needs to be updated to allow IDOT and ISP to move forward with implementation. This bill also addresses constitutional issues with our current law. House Bill 2857 will move violations from a criminal traffic violation to a civil traffic violation that may only result in administrative fine. I respectfully request an 'aye' vote."

The transit district in Bloomington and Normal called Connect Transit asked me to amend the bill and to add that public transit agencies are allowed to use electric rearview monitoring system. Right now, they can… public transportation cannot use them. But… and the reason they would like to use them is, you know, e- mirrors actually have the capability of night vision. And so, public transit, as you know, operates 24/7, and this would increase the visibility for drivers to see if anyone's behind them, even at night. HB1699, this bill is actually a measure that would help address our state's critical shortage of skilled water and wastewater operators while ensuring that safe, clean water remains accessible to all communities in Illinois. This bill is designed to protect women and men who have been victims of sexual assault from the predatory practice of at-home sexual assault collection evidence kits. They are not admissible in any court of law. They have a reliability rate that is less than acceptable. And, most importantly, victims of assault, survivors of assault, will lack the care that comes from the programs that we have put in place as a General Assembly prior to this. What it does is basically provides a civil remedy for victims who have been marketed, advertised, or bought a kit of $1,000. And I'm open to questions and ask for an 'aye' vote."

And in the course of that… that visit, we were shocked, disgusted, frustrated to learn that very often survivors report being misled in the course of an investigation. A few years ago, this body saw fit to prohibit using deception techniques in investigations involving juveniles. So, building on that, we sought to provide protections for victims. I was in… part of discussions, and it was particularly embarrassing to hear the Kane County state's attorney talking about how law enforcement needed, needed, to be able to deceive people who have been raped, sexually assaulted, and otherwise. I'd like… I'd like the attention of the body please, Mr. Chair. I want to be very clear about that. It was only when we started to discuss the fact that several of us on a call are elected, and if they felt that way, they should speak publicly about that, not put in an email, not privately. So, I want to say again, it was absolutely gut-wrenching to hear the Kane County state's attorney, in all of her splendor, talking about how she needed the tools and law enforcement needed the tools to talk to people who have been raped and to deceive them. And it was pretty embarrassing to hear her talk about the fact that the Illinois Supreme Court has upheld the ability to deceive individuals who have been raped. I think she forgot somewhere along the way that we actually make the laws that they interpret. So, I thank Representative Cassidy for bringing this bill. I enjoyed the tour to learn more to see how we can help individuals, particularly children. And I want to say again on the record, I think it's absolutely distasteful, disrespectful, and I now have an utter disdain for the Kane County state's attorney for what she did. This bill was a request from an elderly constituent and seeks to address this type of marketing that pesters seniors, the disabled, and families with constant automated phone calls asking them to sign up for whatever good or service they're selling, sometimes after they've been specifically asked to be removed from call lists. The amendment to this bill simply clarifies the definition for a robocall as upheld by the United States Supreme Court, as well as removes a cap on damages for class action lawsuits, as we don't have those in the State of Illinois. Due to the egregious nature of the willful violations, the increased penalty is necessary to deter violations and hold the back actors… bad actors accountable for risking the health and safety of public servants, such as firefighters, public works employees, water and sewer department employees, and many others. To be clear, this bill only applies to public employees and employers, as federal law prohibits the state from enforcement in the private sector. Over the past 10 years, there was been 18 willful violations, 12 of which have resulted in either serious injury or death. The effective date is October 1 to match the federal fiscal year. This is an important piece of legislation. Many of you know, in 2021, we passed the Tamara Clayton act, a postal worker who was shot and killed on I-57. At that time, the… the bill was a pilot program, and it allowed the state police to put a camera on the expressway to prevent expressway shootings. And part of that, just to read some stats, 82% of the internet… interstate shootings last year, the cameras have helped the state police not only capture the individuals who involved or had people who witnessed the shooting work with the state police. And I'm happy to report to this General Assembly that since 2021, there's been a decrease in shootings, a 31% decrease in 2023, 53% decrease from 2022, and a 71% decrease when we implemented the bill. And last year, the state police announced a hundred percent of the shootings on the expressways in 2023 resulted in arrests, and that is a good measure and a good result for this General Assembly and everyone who supported this bill. I know that there's opposition on the side from the ACLU. We attempted to not only quell that but also work with them. But this is a great bill, and I would ask for an 'aye' vote. House Bill 3511 is a bill that would some small changes to our School and Municipal Social Work Loan Repayment Program that's administered by ISAC, and the bill would establish the Nonprofit Clinical Supervision Grant Program to be overseen by our Department of Human Services. Both components of this bill take aim at the same problem, which is our pervasive behavioral health care workforce shortage. That includes loan repayment, and it also includes far better access to clinical supervision hours to speed up access to clinical licensure for our LCSWs, who provide… of all the professionals, they provide the most mental health care in Illinois. We want them to work at the top of their licensure. We want them to be able to bill. So, very briefly, the bill changes this social work loan repayment program because its undersubscribed. There are funds available and people are not actively going after the funds. So, we're increasing the available amount to incentivize people to go after the funds from 6500 to 8,000. We're including social workers that are employed by counties, and then we are establishing the Nonprofit Clinical Supervision Program so a nonprofit association can run a program by employing LCSWs to provide efficient and effective supervision so people can accelerate to full licensure more quickly. Although this bill is subject to appropriation, which makes lots of folks very nervous, it actually moved out of the Higher Ed Committee unanimously. And that's because there is a 6 million approp that's GRF to the school social work program that we have been appropriating for three years, and it's in the governor's introduced budget. And so, our proposal is to take a million of that and put it towards the supervision program. Thank you for your indulgence. Happy to answer any questions."

And in that cause, she's… she developed this language for this legislation that would require libraries in Illinois to have on hand opioid antagonists in the case of an opioid overdose occurring in… in one of their facilities or at… at a library event. The bill requires that libraries shall take necessary steps to have these antagonists available. It specifies that library staff and authorized personnel are immune from liability for the administration of the opioid antagonist, except for willful or wanton misconduct. And ultimately, at the end of the day, what we have to make sure is that AI is not denying your health insurance claims. It's that simple. We have narrowed this legislation to make sure that it's targeting the true focus, which is health insurance providers, health insurers, not other types of insurance. This is really focused on health insurance payers. We have a number of supporters of this legislation. It's not only going to protect you from having your insurance claims denied from AI, it's also going to provide new disclosures to the Illinois Department of Insurance and, most importantly, new disclosures to you as a consumer. It can help in consumer protection and… and just consumer response when you go onto your website for whatever your payer is to ask questions of whether or not you have coverage or not. So, like customer service functions, right? But we're really getting at the adverse consumer outcomes. So, no, it would not get to billing back and forth between a provider and an insurer."

"So, that… that is not the intent of bill. So, while that is not the intention of my legislation, I don't want to mislead anyone to think that the department doesn't care about that. And we all should care if billing is being automatically denied for somebody because of their race or their age or their credit score or what have you. So, there are things and functions today in law that the Department of Insurance has. That is not what we're trying to get at with this legislation."

Without boring the body, the question really, at… at the core of the leader's question, is whether or not we're just limiting the review to a health insurance payer or some of the other ancillary services that are involved with these kinds of reviews of your health insurance claim. Third-party administrators are increasingly reviewing your insurance claim. A constituent brought this concern to my attention. His business was struggling for a variety of reasons that were outside of his control to complete the construction of their pool for a hotel he was opening within the one-year scope of the permit. Drinking water is a major source of PFAS exposure, and the sheer number… this is a Environmental Working Group quote, 'The sheer number of contaminated sites shows that these chemicals are likely present in most of the U.S. water supply.'"

"Okay. And then, as we're talking about this drinking water being contaminated, is this something that might impact children at all?"

"Absolutely. PFAS bioaccumulates in the body, so it's particularly problematic when… with young children, if they're exposed to it, if they drink water that is contaminated, if they… if it ends up in their system in any other way. It is bioaccumulative, meaning there is no natural biological mechanism for them to rid their body of that PFAS, and that can have really detrimental effects, including be cancer causing. It impacts thyroids. It has a range of other impacts."

"And how many studies do you think have been conducted over time? Is this just something that's happened recently?"

"There has been extensive, extensive study of PFAS. And, you know, PFAS isn't just one thing. There are more than 9,000 known PFAS compounds. More than 600 of them are used in a wide variety of products. However, I want to focus on the water. Water, we… every one of us drinks water. I hope we all drink water every single day. And if we have PFAS in that water, then we are exposing ourselves to… to some… to unfortunate health risks."

And I've maintained, and I hope that we all would agree, that it should be the… the polluters, the manufacturers of PFAS, who are paying the price for contaminating our water and not this… not the average person, not the taxpayer here in Illinois. And this bill makes it clear, as I said in my introduction. It finds that the manufacturers or the producers of PFAS, not taxpayers, should bear the cost of PFAS mitigation."

"Today, I'm presenting House Bill 2371, which fine-tunes our dental insurance system by aligning with existing health insurance payment structures in Illinois by simply ensuring direct reimbursement to dental providers. Under the current law, health insurers are required to make direct payments to health care providers when a claim is assigned. Yet, dental insurance operates under a different, more burdensome structure, forcing patients to pay up front and navigate reimbursement for themselves. House Bill 2371 would eliminate that payment hurdle by directly providing providers… or directly paying providers, excuse me, cutting red tape for both patients, who want timely care without out-of-pocket costs, and providers, who won't have to chase down payments. By mimicking the existing health insurance payment structure for dental insurance, House Bill 20… 2371 ultimately streamlines reimbursements, reduces administrative burden, and makes visiting the dentist office more affordable for patients. This is an initiative on behalf of the Illinois State Dental Society, and amendment #2 was provided for the Illinois Department of Insurance concerns and has rectified their concerns. It's important to note Illinois law provides restitution in the form of compensation to exonerees who have proved in court that they are actually innocent and did not commit the crime for which they were in prison. The current Illinois statute scheme has proven to be irrational, as it discounts awards to exonerees who have served lengthy terms versus those who have served fewer years in prison. Current Illinois law caps recovery at approximately 286,000 no matter how long a person was wrongfully in prison. On average, Illinois pays $11,190 per year for each year of wrongful imprisonment. This is well below the poverty line. The federal recommended minimum standard is 50,000 for each year an innocent person spent wrongfully imprisoned. It's important to note that other states actually paid more than this 50,000. House Bill 3363 will bring Illinois in line with the federally recommended minimum standard of $50,000 per year for wrongful imprisonment and help these innocent women and men as they recover and better their lives outside of prison. This bill is prospective only. It is not retroactive. I also want to note that while this bill is making substantial substantive policy changes, we… there will be an associated fiscal component to this initiative that must get finalized for the Court of Claims. We voted this bill out of our chamber unanimously in the 103rd General Assembly. HB3663 came out of committee this year unanimously. We had bipartisan support from leadership in the Senate on this bill. I urge a 'yes' vote on House Bill 3663."

House Bill 1628 is an issue that I've been working with a variety of stakeholders for… this is my, I believe, my third year in the General Assembly working on this particular topic. This is a follow-up to some considerable reforms that we passed in 2017, of which I was the sponsor, around civil asset forfeiture, a process by which law enforcement can seize individuals' property if they suspect that property was involved in criminal activity. When we passed that original reform, there were a number of data collection provisions in that bill, but the data that has been produced by those provisions has been inadequate. So, the bill before us today reflects an attempt to strengthen those data collection provisions. As I just mentioned, the amendment that we just adopted is the result of, as I said, several years of negotiations with the law enforcement community, the sheriffs' association, the state's attorney association, the state police. And all stakeholders from law enforcement have removed their opposition to this bill. For instance, the original bill said they had required to report the location of the seizure, but we didn't say what we meant by location. So, this bill now says county, municipality, and zip code. We also added a couple of additional provisions, such as demographic data of the individuals whose possessions are forfeited. And… and I think really the key provision here is the annual reporting on behalf of state's attorneys. And it's… it's very minimal, but the goal is to see where civil asset forfeitures are connected to criminal proceedings. And we just didn't get enough information to understand the effects of that original reform. So, our goal really here is to see what's happening, what's the current landscape, is this law working as we intended, do we need to make changes in one direction or another. So, basically, this bill grants the IDPH the authority to impose civil penalties on noncommunity water supplies that violate drinking water standards. It brings the Illinois public defense system up to standards of 48 other states, the ABA, and reports… the ABA, and the reports prepared for the Illinois Supreme Court, along with the majority of the public defenders in Illinois. This is not a bill, to be… to be clear, for the state to take over any public defense or to turn any county employee into a state employee. It only meant to provide an even playing field for public defender clients inside and outside the courtroom. This is commonsense reform that came about from discussions with state's attorneys, public defenders, circuit judges, survivors' groups, the ISBA, the ACLU, and other advocates. The amendment removes oppositions from the ACLU and incorporates proposals from chief PD appointments made by the ISBA. Although they're still… while that would not bring them to neutral, they're still against, and we're still willing to work with them. The point of this bill is to create an Office of the State Public Defender, per the Supreme Court study, which is to collect data, which will help us figure out where we need to send our resources to help severely underfunded and understaffed PD systems, to provide resources to these county PDs once we get that data, and to come up with an alternative appointment model in order to balance the 10400029.docx 165  STATE OF ILLINOIS 104th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 29th Legislative Day 4/9/2025 necessity of independence while making sure that we keep local control and local practice. "Thank you, Mr. Speaker. The… House Bill 3037, as amended, is the Right to Play Act, and it came from me… came to me from student-athletes in my district and in districts throughout our state. The original bill passed with 12 'yes' votes and 0 'no' votes. And I believe it passed with that margin, at least to some extent, because Members just inherently recognized the absurdity it is that our Illinois students are bound by rules that have resulted in, for example, an autistic cross-country runner being disqualified from his cross-country season for participating in a 20- minute charity run on behalf of his hospitalized sister. Since introducing the bill, it's… I have received countless messages from students, from student-athletes, their families, their coaches about how the bill would help them. In addition to runners, I've heard stories over and over again from dancers, soccer players, wrestlers, cheerleaders, gymnasts telling me about how this bill would finally give them a chance to be heard and address the issues that they have felt ignored on. At the same time, I… I, and maybe many of you, have heard from constituents about some of their concerns about the original bill and, in particular, the concern that club and travel teams would potentially be able to find loopholes through this bill that will allow them to take priority over their school teams. And so, to prevent that possibility, this amended bill narrows the legislation, and the amendment allows principals or athletic directors the option to give up to two waivers per student per school year to participate in a nonschool athletic event without losing their student-athlete eligibility. So, the first thing that this bill does is ask the State Board of Education to more effectively advertise the availability of grant funds to school districts and school boards across the state. When we see those application numbers rise, the second thing this bill asks the State Board of Education to do is strategically prioritize giving grants to school districts who have financially similar profiles. The loophole, or the error, as it would be, would… it occurs when an individual in the public sector works a shift that is not an 8 to 5 shift. And park owners must annually provide tenants with a written explanation of how the tenants' share of the utility charge was calculated and must provide a copy of the park's monthly utility bills to tenants for any charge separately billed upon request of the tenant. Using artificial intelligence, we're seeing middle and high school students creating sexually explicit images and sharing those… those doctored pictures amongst one another. The… this use of exploitative AI apps is so new that a lot… oftentimes, schools are unprepared to address these issues. They are unsure and unprepared for what to do. So, House Bill 3851, it gives schools the framework for dealing with this by clearly including it in the bullying prevention and cyberbullying part of the School Code. And in doing so, it puts policy and procedure in place for reporting. It informs parents and guardians of incidences, and it sets up a framework for investigating and addressing these issues. This bill also passed unanimously in the previous General Assembly. It passed through committee unanimously, and I ask for an 'aye' vote."

A few years ago, you may recall, we created a new offense, organized retail theft, in response to concerns we heard from retail stores in many communities. This bill that we're doing today is the culmination efforts by Representative Kelly Cassidy, who worked in conjunction with the original stakeholders, state's attorneys, and retail merchants, to recalibrate and realign some of the tenants of the original legislation to ensure parity between the rights afforded to retail victims of crime and individual survivors of crime, including survivors of 10400029.docx 202  STATE OF ILLINOIS 104th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 29th Legislative Day 4/9/2025 domestic and gender-based violence. First, current law grants corporate victims of organized retail theft the right to seven days' notice for any court dates while other victims in the state, including gender-based violence and other violent crimes, are only afforded timely notice. The stakeholders have been working on this issue to bring parity, and we don't have final language yet, but all stakeholders have agreed to address this in the Senate. It will likely involve some sort of elimination of a time certain for notice and instead provide some sort of prescreening process to determine what reasonable notice is. So, that's the first piece. Second, the ORT law and data provision, law enforcement officers cannot refuse to take a written report. Here, we are correcting the inequity and ensuring that police adequately respond to survivors of gender-based violence by requiring written reports and prohibiting officers from just being… discouraging people to file reports in cases where there exists a bona fide allegation. And finally, since we are striving to ensure parity and justice for all, the bill adds a section in response to concerns from the Illinois State Police which would allow expedited relief so that human trafficking survivors have a real and meaningful opportunity to expunge or seal criminal records based on offenses that were incurred during the course of being trafficked, often retail theft related. And what we're going to do now is give it to people who are in the county… leaving the county jail who have been identified with the same substance abuse as a form of drug treatment in… in the event that they find theyself relapsing on the drugs.
