And, originally, when we first talked about it, it was our understanding there was $2 million of federal money that had not been used. And so, it sounded like we were passing up on these dollars. And then yesterday, it sounded like… talking to the department, it sounded like those dollars were possibly being used for something else or there was a matching dollar amount. And I was trying to get… figure out what… where we were on this because I believe on Wednesday, we're… we were saying that there was no cost to General Revenue Fund. And then yesterday, we were told that there was a matching amount. And so, I… it's my understanding that this will cost the State of Illinois some money to receive the $2 million." Jiménez: "So, we… thank you so much. We… we did have that discussion, and so I appreciate your… your questions and your inquiry. We did speak to the department, and they confirmed that the dollars are federal dollars. So, TANF is a federal program. It's a federal block program where the dollars are appropriated for the crisis intervention, and that’s the 2 million that we were referring to in committee. So, they did confirm to us after committee. There was a… a question, and they did confirm to us after committee here that the dollars are federal dollars, that there are… is no match and there will be no need for GRF. And I will add that the dollars that have been used in the last couple years have only been from zero dollars three years ago to $55,000 last year, and we do have that 2 million appropriation that we spoke of. We have been working on this clarification for the last three years to make sure that we get it absolutely right. We have been working with stakeholders, with the Illinois Municipal League that is neutral. So, I believe there's some misunderstanding about what this bill really does. So, let me tell you what it does do. It clarifies that when state construction projects managed by the Capital Development Board, they must abide by permitting requirements from local governments. Right now, state construction projects do not need to abide by local ordinances or zoning restrictions. This is based on several Illinois Appellate Court cases, which found that local governments should not be able to use their ordinances to block the construction of facilities that the residents of Illinois need and overall ruled that local ordinances do not apply to state construction projects. Even though the vast majority of the Capital Development Board's projects have, again, been managed for a very long time without any conflicts from local governments, there have been a few incidences where the Capital Development Board has struggled to move forward with projects at state facilities because of local governments trying to change that and trying to assess permit fees worth hundreds of thousands of dollars that aren't based on the impact the state facility actually has on the local infrastructure. That means, if they were successful, that the state would be using bond funds that taxpayer dollars will need to pay back with interest in order to pay a different level of government. We have worked with the Illinois Municipal League and the Illinois Association of Wastewater Agencies to craft the language that is here now. The General Assembly, that's us, appropriates funding for Capital Development Board to build and renovate buildings on state property for state agencies, universities, and state parks. They follow best practices for construction, and they require their architects to review local requirements. This bill will allow the Capital Development Board to complete projects faster by reducing the conflicts that create delays and increase project costs. This does not allow the state to stop doing anything that they have currently been doing for years. Common practice. In fact, it has added additional collaboration and compliance beyond what the state is currently mandated to do. That's why this bill is supported by the Illinois Association of Wastewater Agencies and makes the Illinois Municipal League neutral. I'm happy to share case law that has supported this legislation with anybody who is interested in, but I will not continue for this body unless you really want to know the actual case law. "Well, it was for me, but the Capital Development Board was already working on this, and they were involved in court cases in… in other areas where the local municipality tried to impose local fees, not impact fees, but local fees, and it went to court. And, again, I can give you the case law, but the courts every time ruled that the Capital Development Board was doing what is correct. And I will say, you know, in one ruling, they said the state has plenary power over state operated educational institutions and any attempt by a home rule municipality to impose burdens on those institutions in the absence of state approval is unauthorized. In another ruling, they determined a local government may not force the state to comply with a zoning ordinance when the state is carrying out a statutory duty encompassing a statewide concern. So, that's actual verbiage from the case resolutions."

That's… that's wrong, and that should be corrected. But this legislation today goes quite a bit further than that, and that… in that furtherance is what creates some concerns for me. Because while nothing in this legislation would preclude… if you're a community with impact fees on your road infrastructure, your utilities, you may still have those fees paid for state projects, but this legislation enshrines a practice that would allow the State of Illinois to not pay for building permits, which I believe is wrong. I think it sets up one standard for private development, on the one hand, and the State of Illinois exempted on the other. And when you ask the question, who does the inspections for these developments and projects? It's your local community. You are paying for and still responsible for the obligations and inspections associated with this work. That's what building permits are for. They shouldn't be used as a weapon against the State of Illinois, but the State of Illinois should not be immune from covering these services for our local communities. This legislation does one other thing that troubles me. It makes sure that, and this is why home rule is preempted and a higher voting threshold is required for this bill, that home rule units of government cannot establish their own building code and design standards that must then be followed by the State of Illinois. In other words, a state project may consider itself now exempt from some of the standards that have been put in place by your local leaders in your local communities. "I think the only reservation I had on this is the networks that are negotiated by different insurance companies with different neonatal intensive care units. It's part of the competitive advantage that a certain hospital has. For example, my hospital in Peoria, OSF Saint Francis, has a neonatal intensive care unit. That is a market competitive advantage that they have. This bill would take that away from them. What's your response to that?"
"My response is that I'm not sure that we should be looking at competitive advantages as a right to health care when it comes to this kind of care. This is an… as clarified with the Department of Insurance and ILHIC, they believe that this is already in the intent of the statute that… that mandates emergency care be charged in-network rates. And so, neonatal care… it is the intent that neonatal care is part of that. This is a clarification."

And… and in my situation, I just happened to go to my in-network hospital. I just happened to be at home, but I was 26 weeks. If I had been in… in Springfield, then I certainly wouldn't have been thinking about is this in network or out of network. But the impact of that is it could've cost my family tens of thousands of dollars. For an in-network NICU stay, we pay $10,000 out of pocket for each child. So, if it had been a situation where I would've had to go to an out-of-network, it would've… the reports show, because families are… like I said, the intent of the law is this is already covered. But there is confusion in that families are having to pay out-of-network rates, which are close to $100,000, the… the reports that we've read."

It truly is a simple form that can protect families from those nosy neighbors. They can demonstrate best practices in homeschooling, things that they're already doing, keeping records of a child's progress and the many different things they can learn. But most important, it provides a tool to make sure children do not go dark and missing. We want to know they are okay. A simple form was not so simple, was it? It created burdens on families across Illinois, our entire school system, and nobody seems to care that that was going to cost our schools and our families valuable resources that could be spent instead on fixing our public schools system that often fails children. So, instead, the sponsor has blamed misinformation instead of listening to families. The over 130,000 times that families went to the website and filed in opposition, they just want to be heard, they just want to be listened to. The sponsor blamed families instead of fixing the broken DCFS child welfare system. Good homeschooling families are not to be faulted for the problems of childhood abuse and neglect. Thinking that a form was going to fix this was never going to work. The bill was doomed from the beginning. I'm glad that she has agreed to hold it on Third, that was important, but I can tell you our families still feel like they are under attack and walking on egg shells… egg shells in Illinois. It aims to update the Open Space Land Acquisition Development grants, OSLAD, project matching amount by expanding the amount of funding available to distressed communities and locations. Currently, the law only allows the department to use 10% of total amount of OSLAD funding to cover 90% of the funding opportunity for the distressed community. This proposal would, if you allow, redefine the metrics used to determine what communities would qualify as distressed community. This bill would also expand the ability of the department to award a higher amount of appropriated funds to distressed communities so they will receive a higher level of assistance. Additionally, defines distressed location projects. This new metric, in definition, will incentivize units of local government to develop and apply for OSLAD funding. We want this money to get to our communities. This proposal calls for no more than 10% of the total allowed fund to be utilized for the distressed location projects that are located in a nondistressed community. Now, if any staff person has ever had a conversation with me, one thing that I do tell them is that I used to work for a member of Congress. So, I have been staff, and I know how tough that is. And as staff, our job is provide that support, that help, carry stuff, if necessary, and I used to wind up carrying a lot of stuff, and I did a lot of driving. While this is a little different, and we get the benefit of their knowledge and expertise and subject matters, it's tough still to know absolutely everything. Now, maybe some of you do, or at least pretend like you do, but I'm not one of them. House Bill 1862 amends the Home Illinois Program within the Department of Human Services Act, providing that a service provider shall not have to fulfill the current 25% matching funds requirement in order to receive funds from the Department of Emergency and Transitional Housing Program or the Supportive Housing Program. We had passed similar… we had similar legislation to remove the state match for providers providing community-based youth services just last session. This can be especially difficult on smaller entities or entities in rural or depressed communities, which do not have access to many donors or particularly wealthy donors, making it hard for these dollars to flow into the areas of the state that are most in need of this kind of financial support. This particular match was made in rules, and DHS is following the long process to amend those rules to remove the match. That process will mean, though, that without this legislative intervention, the matching requirement that will be required through the rest of this fiscal year. The state actually increased funding to the Emergency and Transitional Housing Program and Supporting Housing Program budget lines last year so providers could address the rapidly escalating problem of homelessness, but the match makes it hard to get the money out the door and to the providers doing the work on the ground in these most challenged areas. We would like to assist DHS in lifting the match requirement as quickly as possible while they work on the rules so that providers can more readily access and utilize these grant funds. I am aware of no opposition. I'm happy to answer questions. I would appreciate your support."

House Bill 2584 pretty simply removes any ability to… for insurers to… impose prior authorization on access to HIV and AIDs medication, both treatment and… and prevention meds. The second amendment that we adopted today, I want to… I want to be completely transparent with the House. I did seek the fiscal notes because I was concerned about what the costs might be. I've gotten conflicting answers from departments about the cost. And, in addition… so, DHS came out with a pretty high number, which is why we filed the amendment to take Medicaid out. At the same time, they said you don't need to include Medicaid because we are already doing this. Because of the late hour of getting the… the notes late, in committee I did say I would like the… the department to show me their math 'cause their math ain't mathing. I don't understand how it can be $50 million while also not being necessary because they're already not allowing prior auth in Medicaid cases. So, if in fact that math does not add up, it is possible that this will come back here on concurrence with Medicaid back in it. So, I want to be very clear about that. I don't like it when we get conflicting information and we can't be clear. I kind of… is a bit of horse's patootie, frankly, but here we are. The bottom line is, if Illinois is going to get to zero new cases of HIV, we have to remove barriers to treatment. And prior auth is one of the… the most egregious of the barriers to treatment.
