"Thank you, Mr. Speaker. Senate Bill 1784 is the culmination of three years of hard negotiation that started, quite frankly, six years ago in 2019. Senate Bill 1784 is a jobs bill. This bill is about taking Illinoisans and providing them with an opportunity to work, to build wages, and to gain wealth. This particular piece of legislation has certainly, although it is coming up in the waning hours of this spring session, this is not a new piece of legislation. As I have stated, this has been actively negotiated with stakeholders around the state for the past three years. And because of those rigorous negotiations, this legislation has a diverse coalition of individuals that are proponents to this legislation. Those proponents are individuals like the Illinois State's Attorneys Association, Live Free Illinois, the Illinois Retail Merchants Association, End Permanent Punishment, Clean Slate National as well as Clean Slate Illinois, and the Illinois Manufacturers' Association. This legislation also has the support of the Illinois State Police and the neutrality of the Illinois Sheriffs' Association. I believe that it is important to lay the groundwork at the outset that this legislation has the… a wide, diverse coalition that you typically don’t see on pieces of legislation like this. And the reason why I think it's important to lay that out at the outset is because of the important reality that we have over 2 million people in Illinois that are living with old criminal records, keeping them locked out of our state's economy. Illinois has one of the highest unemployment rates in this country and one of the 10400054.docx 37  STATE OF ILLINOIS 104th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 54th Legislative Day 5/30/2025 highest in the Midwest region. Old criminal records reduce the likelihood of finding a job, they depress wages, and it causes an early exit from the labor market. Employment barriers also destabilizes families and communities while limiting the strength of this state's workforce. These barriers also undermine our state's public safety, stability, and economic security to help people escape poverty and the cycles of crime and violence. For people with old criminal records, strong connections to work and family, community reduce the likelihood of recidivism and increase public safety. Record sealing is already available to most people with a criminal record, but administrative barriers prevent individuals from accessing the overwhelming benefit from… from bipartisan policy that this General Assembly has passed. Illinois, like many states, has turned to record sealing as a way to limit these barriers and restore people to safety and stability. Over the past decade, Illinois has expanded petition-based access to record sealing several times, recognizing the lifetime burden criminal records can cause. The majority of people in Illinois with an arrest or a conviction record are already, already eligible for sealing relief. Illinois' current petition-based system cannot meet the growing and unmet statewide need for this critical relief. The overwhelming majority of people in Illinois are already eligible for this relief, but because of the complex legal process, it's oftentimes very costly and intimidating. People don't actualize that support. Those that do oftentimes see incredible backlogs, very long lines at court due to the level of burden and the current process that it puts on local 10400054.docx 38  STATE OF ILLINOIS 104th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 54th Legislative Day 5/30/2025 systems. Illinois can move from its current process and approach to an automated approach. Between the Illinois State Police, the courts, and the government stakeholders already, they have the information determine who is eligible for record sealing and who is not. Illinois can harness the data to automate this opportunity and ensure that people have access to this critical process. States across this country has faced with the same problem, and many states have already passed this legislation, 12 states to be exact. And over the next five years, there are another 12 states that are slated to do so. But what I would like to add is that we are the… we… if we pass this state… excuse me, when we pass this legislation, we would be the first state in the nation to pass this legislation with the diverse coalition of grassroots, law enforcement, and the business community supporting these efforts. The proposed legislation automates the sealing process for a subset of records that are already eligible for the petition-based sealing. Under this proposal, records would be subject to automated sealing in line with the eligibility and statutory waiting periods that are already current law. This legislation makes conforming changes to the procedures that have… that govern the petition process to automate… for the shift of automating the record clearance and aligning timelines. I want to make this very, very clear: Serious criminal records are not eligible for automated sealing. I want to say that again. Serious criminal records are not eligible for automated sealing. The legislation excludes both the limited subset of criminal records that are ineligible for petition-based sealing and the most serious 10400054.docx 39  STATE OF ILLINOIS 104th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 54th Legislative Day 5/30/2025 records that are eligible for petition-based sealing. Those would remain eligible under the current petition-based process that was, again, passed in a bipartisan effort by this chamber in 2017 and signed by a Republican governor. This bill excludes convictions for all offenses in Article 9, which would include homicide, and this covers all homicides, including murder, manslaughter, reckless homicide, involuntary manslaughter; all offenses in Article 7, which is where sex offenses reside. So, all sex offenses are excluded from this. All Class X felonies are also excluded from this, violent felonies, including, but not limited to, the felonies… the felony crimes as defined by 730 ILCS 166-20. This includes the following: any aggravated battery resulting in great bodily harm or involving the discharge of a firearm, kidnapping, aggravated stalking, stalking, home invasion, residential burglary, armed robbery, aggravated vehicular hijacking, arson, robbery, Class 2 burglary, weapons offenses involving the discharge of a firearm, armed habitual criminal, high quantity and recidivist weapons trafficking offenses. Offenses currently eligible for petition-based sealing, this would also include… exclude domestic violence, a violation of an order of protection, DUI and reckless driving, as well as animal cruelty. Sealed records will no longer be available for the general public. But I also want to make this very, very clear: Law enforcement, prosecutors, and the courts will remain… will, excuse me, they will retain complete access to all of… all of these sealed records. People oftentimes excuse… excuse me, they confuse expungement and sealment. This is sealing. These records will not be destroyed. They will only be sealed to allow for an individual to be able to move their lives forward. And any entity already authorized by the law to have access to these sealed felony convictions, they will still retain full access to those records. It's also important to note that this legislation provides for a full three-year ramp up for the implementation. So, this period is incredibly important because it allows for stakeholders to continue to meet, as we have over the last three years, to identify and acquire the technological and infrastructure data needed for this automation. It will allow for the phased implementation after that to identify and to seal old records and an implementation task force to monitor and inform the development of these implementation processes. I think it's important to think about the fact that right now in the state of Illinois we have over 2.2 million people that qualify for this opportunity. We also currently have 277,000 jobs in this state that are vacant that need a employer… excuse me, they need an employee who wants to work. All we are talking about doing here today, ladies and gentlemen, is giving people a track to run on, giving people an opportunity that, for many of us in this room, we don't need that opportunity. But there… all of us have individuals in our districts who are currently calcified in poverty because of something that they may have done five, 10, 15 years ago. These individuals feel on a daily basis like they are auditioning for their humanity simply to exist in this world, to be able to provide for themselves and to provide for their families. Only 10% of people who are eligible for this actually do it. And so, I am just a big supporter of making this more automatic for the people that are already eligible. And this bears a lot of likeness to so much of what we see in our human service system, where people who are actually eligible for services and resources but they don’t know they are or they have to jump through a hundred hoops to get there. I'm going to vote 'yes' in the spirit of a group of people in my community out of St. Elizabeth's of the Trinity church in Gladstone Park in the St. Vincent de Paul Center, and they're engaged in a program called 'One Parish, One Prisoner.' And that group is led by a retired police commander, and he's doing incredible reentry work. They're working with a man named Michael right now, who came out of DOC not too long ago, and they're going to be so excited about this bill. And I wanted to underscore that he's a retired police commander, and he's leading on this issue. So, that's one of the many reasons I'm voting 'yes.' In addition, it provides how a landowner will get compensated if the land is used to run broadband. The Farm Bureau is neutral on the bill. I've negotiated it and know of no opposition.
