"Let us pray. Our Lord, we thank You again this day for your kindness upon us. We thank You for the beautiful day that you've given to us to worship You and to praise You. We thank You for this season that we've just observed. We thank You not only for the death and the burial but also we thank You for the Resurrection of Christ. We love and appreciate You today because we know that You are the friend that stick closer than a brother. The wisdom of Solemon that was a patriot of ode. The wisdom of David. "Amendment #3 has been worked out with the Sponsor, the Gentleman from Cook, the Republican staff and Democratic staff to try to bring legislation in conformity with the Constitutional Amendment adopted in November of 1980 that was short in the period on the scavenger sales. We determined a six months period of redemption was more practical than a three month period. The Constitutional Amendment authorized one as short as 90 days. That was considered to be too short to be practical so the Bill with this Amendment reduces some two years to six months, the period of redemption of a scavenger sale and therefore, implements the Constitutional Amendment passed by the voters in November 1980 that was sponsored by I believe by Senator Rock and Representative Madigan and I move the adoption of Amendment #3 which has been agreed to by the Sponsor."

House Joint Resolution Constitutional Amendment #21, McCourt, resolved by the House of Representatives of the 82nd General Assembly of the State of Illinois the Senate concurring herein. That there shall be submitted to the electors of the state for adoption or rejection of the general election next occurring at least six months after the adoption of this Resolution. The proposition to amend Secions 8, 10, and 12 and to add Sections 12.1 and 12.2 to Article VI of the Constitution and amend and add Sections to read as follows: Article VI, the Judiciary, Section 8, Associate Judges. Each Circuit Court shall have such Members of .. numbers of Associate Judges as provided by law except who are elected in a accordance with Section 12.1. Associate Judges shall be nominated by Judicial nominating Commissions in each 24  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 26th Legislative Day April 21, 1981 Judicial Circuit and selected by the Governor in a manner provided in sub-Section D of Section 12 of this Article. In the first Judicial District, unless otherwise provided by law, at least one-fourth of the Associate Judges shall be appointed from and reside outside Chicago. The Supreme Court shall provide by rule for matters to be assigned Associate Judges. Section 10, term of office. The terms of office of Supreme, Appellate and Circuit Judges shall be six years and Associate Judges, four years. Section 12, Selection and Retention. A Supreme Court, Appellate, Circuit and Associate Circuit Judges shall be selected in a manner provided in Section C of this Section where nominees submitted by Judicial nominating Commissions except as provided in Section 12.1. B) The office of a Judge shall be vacant upon his death, resignation, retirement, removal or upon the conclusion of his term without retention in office. Whenever an additional Judge is authorized by law, the office shall be filled in the manner provided for filling a vacancy in that office. C) There shall be a Judicial Nominating Committee in each Judicial District which shall nominate persons to fill vacancies on the Supreme Court and the Appellate Court for that District. There shall be two Judicial Nominating Commissions in the Cook County Circuit which shall have identical functions and concurrent equal jurisdiction and which shall nominate persons to fill vacancies in the offices of Circuit Judges, Associate Judges, in the Circuit as such vacancies shall be allotted to the two commissions by Supreme Court rules. In each of the other Judicial Circuits which have elected to provide for the selection of Judges under the Section by referendum under Section 12.1 of the Article, of this Article, there shall be one Judicial Nominating Commission to fill vacancies in the office of Circuit Judge and 25  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 26th Legislative Day Associate Judge. April 21, 1981 D) If the vacancy occurs in the office of Supreme, Appellate, Circuit or Associate Judge the administrative director shall notify the chairman of the Appropriate Judicial Nominating Commission which shall immediately convene the Commission. The Commission shall within thirty days after the vacancy occurs select at least three nominees for each vacancy and submit their names to the administrative director within seven days after he has received the names of the nominees. The administrative director shall publicly draw by lot the name of one of the nominees and submit it to the Governor. The Governor is allowing one veto for each vacancy to be filled. If the Governor does not veto the first nominee to be submitted to him within twenty-nine days after the name of that nominee has been submitted to him, the vacancy shall be filled by that nominee. If the Governor exercises his veto within twenty-nine days period the administrative director shall publicly draw by lot the name of one of the remaining nominees. Such second drawing constitutes the selection of the nominee whose name is drawn and the Governor has no further veto. The same nominee may be submitted by the Commission to the administrative director for no more that three successive vacancies. The name of any nominee veto by the Governor shall not be resubmitted during the term of that Governor. E) Not less than six months prior to the general election next preceding the expiration of his term of office, any Judge previously selected or elected may file in the office of the Secretary of State, the Declaration of Candidacy to succeed himself and the Secretary of State not more than ninety days or less than sixty-three days before the election shall certify the Judge's candidacy to the proper election officials. And the District Judicial Nominating Commission shall survey 26  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 26th Legislative Day April 21, 1981 the record of each Judge who has filed a Declaration of Candidacy to succeed himself and shall a determination as to whether or not he has met the then prevailing excepted Judicial standards. If the District Judicial Nominating Commission determines that the Judge has met such standards it shall file a statement of such determination with the Secretary of State before the certification of the Judge's Candidacy and this determination shall be printed on the election ballot along side the Judge's name. At the election of the name of each Judge who has filed a Declaration shall be submitted to the electors separately and without party designation on the sole question whether he shall be retained in office for another term. The retention election shall be conducted at general elections and the Appropriate Judicial District and Circuit... The Affirmative votes of three-fifths of the electors voting on the question shall elect him to the office for a full term commencing the first Monday in December following the election. Any Judge who does not file a Declaration within the time herein specified or having filed fails of retention shall vacate his office on the first Monday in December following the general election whether or not his successor shall yet have qualified. F) If an incumbent does not file a Declaration of Candidacy within the time specified above the selection of appointment of his successor, if any, shall proceed immediately in the manner provided in sub-Section D of this Section so that the successor may take office as soon as a vacancy occurs. G) Any law reducing the number of Judges of the Appellate Court in any District or the number of Circuit or Associate Judges in any Circuit shall be without prejudice to the number of Judges in office at the time of the enactment to seek retention in office. Reduction shall become effective 27  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 26th Legislative Day April 21, 1981 when a vacancy occurs in the effective unit. Section 12.1, Selection and Retention in other Circuit Courts. A) The Judges and Associate Judges of Circuit Courts outside Cook County shall be elected in vacancies and such office may be filled by appointment for interm periods in such manner as maybe prescribed by law provided that sub-Sections E, F, and G of Section 12 of this Article shall apply to such Judges and Associate Judge shall be elected pursuant to the provisions of this Section. However, the elections of any Circuit outside Cook County made by referendum adopt the provisions of Section 12 of this Article to govern the selection and ten year of Judges and Associate Judges of that Circuit. The electors of any Circuit outside Cook County shall vote on the proposition that the general election held not less than three months following the filing of petition with the Secretary of State signed by not fewer than 5% of the total numbers of electors who voted at the next preceeding general election of the Circuit asking that the proposition be submitted to referendum. If the majority of votes cast on the proposition shall be in the Affirmative, the provisions of Section 12 and 12.2 of this Article shall thereafter govern the selection and ten year of Circuit Judges and Associate Judges of the Circuit Court of that Circuit. Section 12.2, Judicial Nominating Commission. A) The Judicial Nominting Commission of each District or Circuit shall consist of six lawyers, not more than three of them shall be Members of the same political party, five laymen, no more than three of them shall be Members of the same political party and on Judge who is then sitting on the Circuit or Appellate Court. The Judge shall be the chairman of the Commission and shall vote only in the case of the time. B) The lawyers Members of each District ОГ Circuit Commission 28  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 26th Legislative Day April 21, 1981 shall be selected in the following manner: The county chairman or chairman of each established political party for the county or counties comprising in a Judicial District or Circuit shall select one lawyer of that party in that Judicial District Circuit to serve as a Member of the Commission for that District of Circuit. The Governor shall appoint the remaining Members of the lawyers to make up a total of six lawyers in each District and the Circuit. Such lawyers shall be selected from the certified election result list, a Bar Association secret ballot conducted elections for that District or Circuit. The Governor may select as his first appointment any lawyer on the Appropriate Certified election result list. Each of the selective additional appointments of the Governor shall be the remaining lawyers then standing highest on the certified election result list who is not with the same political party as the lawyer last appointed before him. As to each Judicial District or Circuit the Supreme Court should designate a major Bar Association to conduct the election of lawyers. C) The five lawyer Member of each Judicial District and Circuit shall be selected in the following manner: County chairman or the chairman of each established political party for the county or counties comprising a Judicial District or Circuit shall select one layman who is a registered voter of that party and who resides in that Judicial District or Circuit, to serve as a Member of the Commission for the District of Circuit. The Governor shall select and appoint two laymen Members who are registered voters of different political parties and who reside in that District or Circuit. In the event of the existence of two established political parties the Governor's selection of laymen as to that extent determined and if be determined to be one layman then that appointee 29  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 26th Legislative Day April 21, 1981 may be of any political party. As to every Judicial District and Circuit the Supreme Court shall designate in a major Bar Association to select a layman for each District or Circuit in the following manner: The president of the designated Bar Association shall submit the name of a registered vote of each established political party in each Circuit and in each District to the Illinois Court Administrator who shall publicly draw by lot from those names submitted from each Circuit and for each District one name as a layman Committee Member for that District or Circuit. D) Judicial Member of each Commission shall be selected as follows: All of the Judges then sitting in the Circuit Court of that Circuit or in the Appellate Court of that District shall vote by secret ballot and elect one of their Members to serve as chairman of the Commission for the Circuit or District. E) Initially the Governor shall provide the laymen appointees and lawyer appointees into two groups and shall designate one group to serve for three years and one group to serve for six years. And as near as may be the group shall be equal in the number of Members of one political shall not exceed half the number of the group. Thereafter, the terms of all Members shall be for six years. F) A vacancy in the office of chairman or Member of the Commission shall be filled for the unexpired term in the same manner and for the same qualifications as those originally chosen. G) No person who holds any office under or is an employee of the United States or this state or any municipal corporation or political subdivision of this state or who holds any official position in the political party is eligible to serve on a Judicial Nominating Commission. No incumbent president or major Bar Association is eligible to serve on the Judicial Nominating Commission during his term of office. Compensation for 30  26th Legislative Day STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE April 21, 1981 service in the state militia or the armed forces of the United States for such periods of time as may be determined by rule of the Supreme Court shall not be considered a disqualification. No Member of a Judicial Nominating Commission may be nominated to Judicial office for a period of three years from the last day of the service on the Commission. A Member having served a full term with six years on a Commission may not be elected to serve on a Commission for the next three years. H) Members of a Judicial Nominating Commission shall not receive any compensation for their service but shall be entitled to reimbursement for necessary expenses. Such Commission may conduct such investigation..employees such staff Members as may be necessary to perform their duties. The decision of the Commission must be by concurrence of a majority of the Members proceedings of the Commission shall be confidential. I) Any lawyer residing in Illinois may vote in their respective Districts and Circuits as to lawyers nominees to Commission Membership through the ... Bar Association and whether or not they are dues paying Members of that Bar Association. Lawyers may vote only in the District and Circuit which their principal office is located. Where the presidents of the representative Bar Association shall not be notified to the contrary by lawyers to his residence at the time of any Bar conducted election. In the Supreme Court Clerk's records is to residence at the time admission to the Bar shall serve as the last known address for purposes of any validing by the Bar Association. Schedule if approved by the electors this Amendment to Article VI of the Constitution takes effect the next day following proclamation of the result of the vote. "House Joint Resolution Constitutional Amendment #22, Koehler, resolved by the House of Representatives of the eighty-second General Assembly of the State of Illinois, the Senate concurring herein, that there shall be submitted to the electors of he State for adoption or rejection at the general election next occurring at least six months after the adoption of this Resolution, a proposition to amend Sections 5 and 6 of Article IV, Section 13 of Article V and Section 2 of Article VIII of the Constitution to read as follows: Section 5, Sessions. The General Assembly shall convene at 12:00 noon on the second Wednesday of January in the year next ensuing the election of Members thereof, and at no other time, except as provided by this Constitution. The General Assembly shall be a continuous body during the term for which Members of the House of Representatives are elected.
