Father Johnson: "Our Heavenly Father, we come to You again this afternoon and we're thankful for the privilege of invoking Your presence, Your guidance, Your wisdom, and we know that Solomon told us in Proverbs that all wisdom comes from God. I pray that You would endue the Legislators of the State of Illinois with the wisdom that You would have us to have in part knowledge and direction and let those rules and laws be enacted that would be a benefit and blessing to the people of this sovereign state. "Representative Kane, those Bills are alive...whatever that means. They are all exempted as determined by the Rules Committee. Does that answer your question?"

"What does the sentence mean then when it says 'Any Bill not acted upon in compliance with these deadlines', namely May 4, 'shall be automatically tabled except Bills on the Interim Study Calendar.' I would think that that language says that those Bills died at midnight last night."

"Mr. Speaker, in reference to Representative Kane's interpretation of Rule 25D. What the Speaker has done...one can construe the rule in its strictest sense as you are doing, which I understand, Representative. But I think what the Speaker has done within the realm of his ability is in effect as the Bills were falling to the table so to speak. "Under what Rule has the Speaker resurrected these Bills as they were falling to the table? I don't think that there is a provision in the Rules to allow the Speaker to do that."

"Representative Telcser."

"Representative, I think if you refer to Rule 27C Paragraph 3 you'll find that the Rules Committee when ve meet will have the ability to exempt any of the Bills which remained in Rules Committee, and then send them on their way through the process if a Majority of the Members of the Rules Committee wish to do so. What the Speaker has actually done is simply in effect created a posting notice as the Bills are going down to the table saying that the Rules Committee when they convene can take up the matter of all the Bills which were remaining in Committee. We frankly thought that would be a convenient way for the Members who are concerned about their Bills to have another chance at having their Bills move along the process."

"I realize..."

"It is true. Strict interpretation of Rule 25D which you are making, the Bills would in fact be on the table and the Members would then have to garner 107 votes to take them from the table one at a time."

"...A broad...a very broad perspective in order to give the Members the ability to move their Bills along, not to put power in the hands...not to take anything away from 107 Members but to give to 177 Members the right to move their Bill along the process and not have them lost in the shuffle. And so I think its...is the glass half full or half empty? It depends on your point of view. We like to think that we're helping the Members on both sides of the aisle with their Bills."

"Under...under which Rule though are those Bills alive?"

"Well, pursuant to Rule 27C Paragraph 3..."

"It has to do with introduction, doesn't it?"

"The..."

"That is a rule that has to do with introduction of Bills."

"It has to do with the Majority of Members of the Rules Committee can exempt a Bill, consider the Bill an emergency. If...if you and others feel that a Bill should lie upon the table, so be it. But we want to help our Members out."

"I am just concerned that we go according to the rules and that the rules are the same for everyone, and they are not different for you than they are for the Minority Leader."

"What we're...what I think we've done, Representative, is avoided the Members having to make Motions, say of the 107 votes. They can go to the Rules Committee and get...and if the Rules Committee wishes their Bill to be exempt, they can get them back on the floor."

"I don't think that you can do that though because...unless you suspend this rule which you have not suspended. "Representative Kane, wait a second. Representative, there are times during the course of the Session where we have to be a little innovative and creative on behalf of our Members. Now the alternative, if we would take this strict interpretation of the rule, all Bills would be upon the table, it would require 107 votes from the Members to get their Bills from the table. Now if you're concerned about Bills from a partisan point of view, we could just reintroduce our Bills, send them to the Rules Committee, get them back out onto the floor. So from the Leadership point of view, it is a 'mox-nix', as my friend Representative Peters would say. We are really trying to help Members with their Bills with a broad interpretation."

"If you were trying to help Members with their Bills So much why didn't you support the Minority Leader's Motion to suspend that Rule and keep all of those Bills alive in the Committees in which they already were? It seems like you're talking out of both sides of your mouth."

"The Rules Committee can only exempt May 5, 1981 Bills from the introduction deadline. There is no procedure under which the Rules Committee can take a Bill from off of the table. The only thing that the Rules Committee can do under Rule 27 is to exempt Bills from the introduction deadline."

"The Parliamentarian, Representative Kane, tells me that these two rules are in direct conflict, and we've made an interpretation. And that is our interpretation. Representative Madigan."

"Mr. Speaker, I regret that I was not in the floor at the beginning of the Session, and because of that I failed to hear Mr. Telcser's explanation. There has been no prior discussion with me regarding the action which you propose to take from the Chair. Mr. Telcser, as I said, I regret that I must burden you and ask for a second explanation, but I must point out that there has been no discussion with me regarding your next act of tyranny. Could we get another explanation?"

"No. Nr. Madigan, I think that if you and Representative Kane and Telcser will come down here we will explain to you and then you can get up and give your speech on tyranny if you want after we talk to try and explain you what we've done." to

"I said if you and Representative Kane and Representative Telcser would come to the podium, we'll try and explain this, and then if you're not happy with the explanation you can give your speech on tyranny."

"Mr. Speaker, Ladies and Gentlemen, it is nice to ask that Representative Telcser and Madigan get together with the Parliamentarian, cause in the end I know that's where we'll be anyway. But in the meantime, innovation is one thing and creativity is another thing. But as Doug Kane has duly pointed out, to resurrect Bills that are clearly declared dead without suspending the Bill is clearly out of order. Now, the Parliamentarian may stretch his imagination, may create living rules, flexible statute, and a growing distain of the Members, but I suggest to you that, Mr. Speaker, it is highly improper that we do this and we are truly getting close to the point where we tread on the rights of all the Members. I, as other Members, have sat in Committees knowing that my Bills would not be heard, knowing that they would not be favorably approved, but I was willing to live and die by the rules which is the first necessity of a Democratic society. But now at this stage to suit your own convenience or for the convenience of a few other people, that is indeed trampling on the rights of all the other Members. I suggest to the Speaker that no matter what happens, one day we shall all come to the bridge that we must cross of 89 votes in this House and the necessary 30 votes in the Senate. And if we do not have a little goodwill on both sides of the aisle here, we are indeed going to be in a state of anarchy that may well last past the 30th of June. So I would either ask in the alternative that the Leadership either get together...put together the package of compromised Bills which we're all going to vote on, and I am willing to vote for them and let's proceed with the business, or if we don't want to do that yet let's at least proceed in somewhat an order that does respect the rules as written 7  34th Legislative Day STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE May 5, 1981 because that is one of the fundamental things that we fought the war on as we can't have unwritten rules at the request of the king. It was pointed out to me that technically the language in the Bill didn't say that, and this attempts to put in a calculation that will make sure that that increase on the corporate property tax is indeed proportionate but no more than proportionate to the increase in the personal income tax."

So in other words instead of the Bill in its present form...if it says you don't have to have a flagman on a construction job if the traffic count is less than 600 cars a day. The Bill would now say that you don't have to have a construct...a flagman on a construction job if a road is closed to traffic, and I would ask for adoption of Amendment #2."

"Thank you, Mr. Speaker, Ladies and Gentlemen of the House. I do not support this Amendment. I feel if this Amendment is attached it more or less will gut the Bill. The intent of the legislation is to provide for some common sense and a tax savings and cost savings to counties and township government. Currently we mandate to those units of government that a flagman would be required on all road projects. Hy Bill, what it would do is eliminate the requirement for a flagman on a road that is closed which is common sense, and the rest of the Bill would eliminate the requirement of a flagman on road projects in which there are 600 vehicles a day or less. Okay, this is a very light traveled road. It is about one car every two and a half minutes. And when you take into consideration the fact that the high volume traffic times during the day are eight to nine and four to five when probably there won't be any construction anyway. The traffic count through the day when the work is going on would even be less. I think what this Bill will do is provide for some common sense and cost saving factors to many units of local government. I urge a 'no' vote on this Amendment."

"Thank you, Mr. Speaker. In response to the previous speaker who said that there would probably not be any 26  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 34th Legislative Day May 5, 1981 construction during high traffic periods from eight until nine and from four until five. Those are usually the high traffic periods of the day. I am not clear why the construction work would stop or cease during these periods. Most construction work starts around seven or seven-thirty in the morning and runs until four or five in the afternoon. It would be very unusual that the construction was shut down during these two busy times during the day. He didn't indicate at all what the speed limit might be along some of these roads. The speed limit in a number of cases, 55 miles per hour. And even if you do have only one car coming by every minute or every two minutes and in these peak periods one car coming by every thirty seconds or I would even say once a minute or once every two minutes at that speed constitutes a reasonable danger to those men and women working on the road. The purpose of this...the purpose of the original legislation was, as the Sponsor of this Bill just said, was common sense. It is common sense to put someone out there with a flag to tell automobiles and the drivers of those cars to slow down that there is men and women working there, and if they don't slow down they're going to kill somebody. This Amendment clearly says that unless the road is closed, we believe that in the interest of the safety of men and women working on these road projects, we believe that their safety takes preference over whatever this common sense notion is that somehow 600 vehicles a day doesn't constitute a real danger to the men working there. I think it is a good Amendment. I think it is necessary if we're going to avoid accidents to highway construction people. I support the Amendment."

"Thank you, Mr. Speaker. I would like to touch on one of the points that the Sponsor of the legislation brought out 27  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 34th Legislative Day May 5, 1981 when he said that the Bill is now limited to roads with a 600 count or less per day. I would point out to the Membership that these are usually the roads that people feel safer to travel at a higher speed...at a higher rate of speed on and many times they are roads that are used by people when they are running late for a short cut they go down a road, there is not much traffic, and they feel a little freer to drive at a faster rate than they would normally in bumper to bumper traffic. Also, if by doing this one accident or one death results. I think that that would probably equal or more than equal the cost of the flagman out there on the job. And I stand here, perhaps the only man on this floor or Lady on this floor today who has actually been a flagman on a construction job, and I tell you right now even the flagman have to jump behind the barracades at times because people don't care. Usually about the third or fourth week into the construction job they're mad, they're annoyed because traffic has been reduced or because they have to be a little late going to work or their time is impaired a little bit. Sometimes they even swerve at the flagmen or at the construction people working along the side of the job...or on the job. I think it is imperative that we keep one thing in mind. The flagmen were placed there in the first place to keep the construction job as safe as possible. Many times people working with their back to the flow of traffic. It is up to the construction man to...or the flagman to make sure that the traffic and the speed of the traffic is reduced. It is also up to the flagman to make sure that trucks enter...or leaving the construction job leave in an appropriate break in traffic, and I would ask that we adopt this Amendment, and, Mr. Speaker, I ask for a Roll Call please on this." 28  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 34th Legislative Day

I think the Amendment is doing something to a Bill that is completely wrong and let me preface my remarks a little bit to some of the freshman who are in here. I happen to be in the construction business. I am not in the road construction business. The Bill that is before us that is presently being amended right now is...is permissive legislation. There are many times that there are situations out on the road where a flagman is not necessary. And I think that it behooves to defeat this Amendment in order to give the general contractor a little bit of flexibility. He is not going to put a job out there that requires a flagman without having one simply because he cannot afford the exposure to his workmen's compensation, the trial lawyers, and everybody else if something like that does happen. It is something that is very definitely needed, the legislation that Representative Watson is proposing. I would urge a 'no' vote, and I would like to see a few more red votes up there."

In explaining my vote I would just like the Hembers of the House to realize that when they drive down to Springfield often times they see flagmen out there, and it has occurred to me and it has happened to me, and I am sure that it has happened to other Members. And if we want to have traffic accidents and slaughter on the highways, just go ahead without this Amendment, and that's what will happen. We have to have that human being out there to slow down traffic. We can't always judge our speed when we're inside the vehicles. This is not any type of a Bill to cause any undue hardship for the construction trades or for the Department of Transportation, but it is for the safety of those construction workers and for those fellows out there that we often see behind the big orange trucks filling the cracks with tar and sand, and when we often don't judge our speed properly we could hit. So I would solicit an 'aye' vote. Thank you."

I once worked on the road and...in the 1960's and prior to the requiring of flagmen I had to dive into the cement one time when a guy came streaming through the road too fast. I think that this issue is not just saving counties and township monies, what you're talking about is saving somebody's life. Now if the 'no' votes would really look at that your 'no' vote might require that somebody in your own community might be run over by a car or truck someday, I don't think you'd be voting 'no'. This is not a labor management kind of Bill. This is a safety measure that cuts through political lines of both Parties, and I think maybe the 'no' votes are making a judgmental error on government and on safety of individuals. And this is not a political issue."

So those who have been saying that flagmen are needed and this is very important, really ought to be voting 'no' because the Amendment is eliminating them on all road projects rather than just those with a low traffic count. The point of the Amendment obviously is to try to gut the Bill before it ever gets to Third Reading, and I think that it would be more responsible to take a look at the Bill on Third Reading and decide how you want to vote on flagmen at that time. But those who are voting 'yes' in order to protect construction crews are voting exactly opposite to how the best interest of the construction crews would work, and I urge you to defeat this Amendment."

Giving local governments the opportunity to check employees that come to work for them to see if they have an arrest record and that's all this does. It's a clean up Amendment and it's agreed by by the Department of Law Enforcement Agency. I know of no opposition. I move for the adoption."

"Just to clarify here that the intent of the Amendment is to eliminate the possibility of arrest information being given out and making clear that it's conviction information that will be given out in conformity with present practice. Is that correct?"

"That's correct. It's legalizing something we're doing illegal. The Department of Lav Enforcement Agency. Everytime you make a request to find out if anybody had an arrest conviction, it goes down as a criminal investigation and somebody might... John Doe might ask for four or five different jobs in a period of five or six years and when they pull your sheet out, you'll find out that he has got a criminal investigation instead of an employee investigation or an employment investigation. And what's really bad about this, Representative Getty, is that someday some American Civil Liberty's Union is going to get a hold of this and sue almost everyone that is trying to question the man's personal record instead of his criminal investigation record."

"Thank you, Mr. Speaker and Ladies and Gentlemen of the House. Amendment #1 corrects two technical errors in spelling and in punctuation, and the third correction in Amendment #1 deletes lines 24 through 26 which is the heart of the Bill. The Amendment, in effect, brings us back to the present situation. It makes... It prevents Illinois from becoming a right-to-work state as this Amendment attempts to do. Rather than debate the Bill, I would simply move the adoption of the Amendment."

"Mr. Speaker, Ladies and Gentlemen of the House, here is an issue and I might say that which I most greatly feared has come to pass. But here's an issue of outstanding importance to every citizen in the State of Illinois. Here is an issue that I put into Bill form and I did so in a straight-forward manner. I didn't clutter it up with Amendments. I didn't try to hide what I was doing. I came forward with House Bill 831 which was, of course, a right-to-work Bill. I have had no information until just now, and I hope that everyone of you are listening to what I'm saying. The Sponsor of this Amendment did not have the courtesy to come to me and to give me any indication whatsoever that any such Amendment was being prepared. I feel that in all fairness, he should have. I feel that in all fairness, if this Bill is going to be decided on, if this issue is going to be decided upon, it should be decided upon fairly. It shouldn't be done in a covert behind the door fashion with an Amendment which, in effect, strikes the enacting clause. I've been down here long enough my colleagues to have heard debates on this floor 72  34th Legislative Day STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE May 5, 1981 relevant to striking the enacting clause, and invariably Members on the other side of the aisle will get up, if this is done, and they will defend the right of the Sponsor to have his Bill heard in the form that it's heard, that it's written, that's it's presented. I feel that this is only fair. I suppose Representative McPike should be thanked for correcting two technical errors, inserting a comma or whatever else it was. But my colleagues on this floor, I don't think I have ever come to you and really pleaded with you to support me on an issue. If you want to, if you want to... if you want to defeat this Bill, if you want to vote against this Bill, if you're opposed to right-to-work in the State of Illinois which would give every labor union member the right to join or not to join a union, then do so at the proper time. But don't do it this way. Don't do it this way, I plead you... plead with you. And I particularly plead with my Members on this side of the aisle who saw fit to help Sponsor this Bill. I plead with the Members on the other side of the aisle. I plead with my Democrat colleagues over there to give this measure a chance to be heard and debated in a fair and square measure... manner. Again, I say to you, and I know how many of you feel and I respect your opinions and I respect your feelings, but I plead with you over there; do not kill this right-to-work measure in this manner. Because I think it's unfair. I think it even lacks courage which Representative McPike does not lack. Representative McPike is an honorable man as far as I know. Representative McPike is a man of courage. I've always considered him to be a man of integrity, and I would ask Representative McPike to consider withdrawing this Amendment, to tabling it and letting the measure be debated on its merits at the proper time. Everybody can be heard, Republicans, 73  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 34th Legislative Day May 5, 1981 Democrats alike can be heard on this issue. But I'm telling you, if you do this and do it in this way, this issue will not die. This issue will come back in one way or another. It'll be debated. It'll be discussed and as a matter of fact, if you do it in this way, you may be instituting a virtual crusade in the State of Illinois for right-to-work which many of you don't want. That's what can happen. So with that, Mr. Speaker, and thank you for your indulgence, but this is matter of supreme importance to me and many other people on this floor and across the State of Illinois. So I'm going to conclude. I'm going to close and I'm going to ask for help from by Republican colleagues and help from any... you fairminded people on the other side of the aisle not to do this to one of your colleagues. Undeserving of the Bill, undeserving of the issue and I'm really surprised. I'm really surprised that Representative McPike did this with no knowledge on my part and no reference to me. So I am going to close, Ladies and Gentlemen. I'm going to close my case just with one final plead and that is, don't let this happen to this Bill in this manner. Thank you, Mr. Speaker."

Representative Epton: "Thank you, Mr. Speaker. Ladies and Gentlemen of of the House, I I know that too often many of us have utilized the microphone and I certainly don't intend to abuse the privilege. won't question the motivation of either of the Gentlemen involved, but I would simply point out to the Ladies and Gentlemen of this House that the Sponsor of this Bill has time and again, on this floor, voted contrary to the manner in which I have voted. Yet, never has he done so with venom, never has he done so with any malace. At no time has this Representative at any time indicated any antagonism because of the way I voted or he voted, and I might say the same for the mover of this Motion. But I do think that when we have a man of the calliber on our side of the aisle who asks to have this Bill heard and I might say that I probably will vote against this Bill when it reaches Third Reading. I do think that this Motion should be defeated because I think that the Bill should have a full debate. And, I certainly do not for any moment impune the maker of this Motion because I suspect it was a hard decision for him. But I think we owe it to the Sponsor of the Bill... it's not his Bill. We've heard that too many times. It's our Bill, but that fact is the subject is of sufficient importance and I would ask my colleagues on both sides of the aisle to allow this Bill to be heard on Third Reading in the manner in which the Sponsor desires. "Representative McPike, some of us did not hear your explanation of your Amendment. We did hear moving around some commas and some technical changes. Does your Amendment have the effect of striking everything after the enactment clause?"

"I said there were three things it did. It corrected a spelling and changed a punctuation and then it deleted lines 24 through 26 of the Bill. Those three lines are the underline portion and that will have the effect of putting this Bill back in the same shape as the present law is in."

"Well, Mr. Speaker, I probably won't support this Bill on Third Reading, but I, like Representative Epton, feel that Representative Hudson ought to have the right to hear this Bill on Third Reading to present his arguments as to why he felt that it was important to introduce this piece of legislation. I would urge a favorable vote."

"Thank you, Mr. Speaker and Ladies and Gentlemen of the House. I rise merely to echo Representative Epton's words. I won't say probably. I'll say to this House right now that I do not support right-to-work legislation and will not vote for this Bill on Third Reading. But I know that deep emotions of this type of legislation provokes and I know how deeply felt are the principles and the feelings that Representative Hudson has in regard to this legislation. That is not to put down the feeling that Representative McPike has on the other side. But this is a Bill that Representative Hudson has nurtured. He has 76  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 34th Legislative Day May 5, 1981 brought along, he believes in deeply and I think that he deserves the chance to have this issue debated on the floor of this House if he desires. I'm not going to vote for it. I'm going to vote against it on Third Reading, but I certainly respect his rights to present this idea, this concept to this House and let it go up ог down on its merits. NOW this Amendment, as I read it, doesn't strike the enacting clause. All it does is strike the right-to-work language which is the same thing as striking the enacting clause. It's not a maneuver that we should take lightly. I don't think that this is an Amendment that we should endorse. I would ask every Member of this House to join with me and with those of us who will support Representative Hudson on this Amendment on Second Reading in the full knowledge that we are not with him on the Bill, but I do urge you. Give him his right to have this matter debated fully on Third Reading. Give him his chance to go with this. He feels so deeply and has worked so long and so hard to put before the Members of this House. I really think that we deserve... we should give another Member this chance that he so richly deserves, and I say we're talking about a man who has supported or fought everyone of us at one time or another but always with deep belief, always within the framework of the rules and always sincerely with no hint of rank or anamosity. Please, defeat this Amendment and then do as you will as I'm going to do on Third Reading, but let's give the man the opportunity to present his idea to the House."

"Thank you, Mr. Speaker. I'm just going to have to echo what the last speaker said. I think it's very unfair for a Member of the House to take another persons Bill and just more or less change that Bill to where it's meaningless. So, therefore, I would hope that ve would all support or oppose this Amendment and leave Representative Hudson's Bill as it is and then make a decision how we want to vote."

"Mr. Speaker and Members of the House, actually the proposer of the Amendment has his reasons for offering the Amendment and I understand that. I think it does have the effect of striking the enacting clause which hasn't been done too often in my 13 years in the House. This is an important issue. It's one that I could have defeated in Committee a week or so ago had I chosen to do so. I expressed myself then. I would express myself now. This is an important issue. I don't plan to support Representative Hudson on Third Reading, however; I did support him to get it out of Committee because it is a vitally important issue to the state. It's a vitally important issue to the Sponsor of the Bill. I think that's what we're paid for, to come down here and make some tough decisions on occasion. This just happens to be one of those occasions. I think that the Amendment ought to be defeated. It ought to come to Third Reading then you can vote your convictions one way or the other. At least it has full debate. I doubt that it will pass the House, but I think everybody in this House ought to have the prerogative of voting for it or against it on Third Reading and that's why I would urge you to defeat the Amendment."

"This is one of the things that in my short term here in 78  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 34th Legislative Day May 5, 1981 the House that I have not enjoyed is seeing any Members' Bill remade into the shape that somebody else wants the Bill. I feel like the Member has the right to have his Bill heard on its merits. If you don't like the Bill, kill it. But at least give him a chance to have it heard. It's one thing to kill a Bill like this without allowing it to be heard and it's another thing to take an Amendment and kill a Bill. I think it's a disgrace that we resort to these tactics. I think the Members should stand up and be counted to vote 'yes' or 'no' on the Bill, and I think the Bill should be as the Sponsor wishes it. Thank you."

"Mr. Speaker and Ladies and Gentlemen of the House, I'm certainly glad I had the opportunity to talk after the last speaker, being a sophomore. In the 20 years experience that I've had down here, none of us ever claimed..."

"None of us ever claimed the pride of authorship on any of the Bills that we introduced. We usually try to reflect the mood of the people that we represent and if there's ever any Member in this House, if there's ever ever Member in this House that's been responsive to the people of his district, it's the Sponsor of this piece of legislation. I don't know whether he really feels what's in this Bill but I know that the people back home wanted this Bill in his district which I'm very familiar with. And I think that to this is a dasterdly act to pull a stunt like this. It's just as bad as striking the enacting clause. I stood up on the floor of this House three terms ago when one of our Members on our side of the aisle did it to a Democratic Member. I felt badly at that time and I was ashamed to be on this side of the aisle when we tried to do it to one of the Democrats and any other Member ought to be ashamed to 79  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 34th Legislative Day May 5, 1981 try to do it because none of us have pride in authorship of these Bills. He are being responsive to the people that send us down here. Give this man an opportunity to go back home and say he was representing his people."

"Thank you, Mr. Speaker, Ladies and Gentlemen of the House. I, too, rise to oppose the Amendment that has been offered. Representative Hudson is one of the most sincere, one of the most honorable Members of this august Body, and to take a Bill and an issue that is so historic in this Legislature; that for the first time in the history of this state I understand, this right-to-work Bill has gotten to the floor of the House. And whether you except it or are going to vote for it or not, at least the author who is a man whose honor is undisputed and who is so strongly in favor of this Bill, as are many of us who are Cosponsors, I think that the Bill at least ought to be able to be voted up or down as the Sponsor has presented it."

"Thank you, Mr. Speaker and Ladies and Gentlemen of the House. Let me just say in defense that there was nothing covert about offering this Amendment. It's been filed for over a week. It's been on your desk for over a week. Anyone that pays any attention to their own Bills would know that this Amendment has been in file. It's been on the floor for more than seven days. I... For the life of me, I've never heard this concept that you can't amend other peoples Bills. Now this is something new. Maybe the Freshman don't recall but ve debated a worker's compensation on this floor last year for eight hours and it was my Bill. And we had 50 Amendments from the other side and I opposed everyone of them. And this year I have three or four Bills on the Calendar right now that you've filed 80  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 34th Legislative Day May 5, 1981 Amendments to. Why don't you just table those Amendments so that I can vote on my Bills as I want them on Third Reading? Because, to be honest, that's not the legislative process. You have Amendments filed to my Bills. I have Amendments filed to your Bills and there's not one person on this floor that ever has the right to stand up here and say, 'I want everybody to table their Amendments. I don't want to discuss any Amendments. I just want my Bill to go to Third Reading. We're going to debate my Bill, no Amendments. We're going to pass it in that form'. Now that's the silliest argument I have ever heard up here. No one has that privilege and the only people that got up and suggested that are those people that are for right-to-work. I happen to oppose it. A lot of other people in this state happen to oppose right-to-work and I have a right to amend this. And to imply that in any way, shape, or form that is dishonest or is not honorable is really stretching our imagination. This Bill came out on the House floor for the first time in 50 years. We are wanting to debate right-to-work for the first time in the history of this Body. And I really don't think it should be debated. I think it's rather ironic that the Republican Party supplied 9 votes to put this Bill on the floor. When the free world is applauding trade unions in Poland, I think it's ironic that the Republican Party wants to destroy trade unions in Illinois. I don't want that to be debated. I think it's a good Amendment. It should be adopted".

"Very briefly, we have a lot of work to do and we have a lot of Amendments and we have a lot of Bills and I'm afraid that if this Amendment which strikes the guts right out of Representative Hudson's Bill prevails, there's very likely to be a lot of Members who will, for whatever reasons, will feel that if that's the way this issue is going to be handled, why then we'll have Amendments filed to five or six or seven Bills. And, instead of debating a right-to-work once, we'll debate it 15 times and I don't think any of us want that. We all have our positions and our philosophy. Some of us believe that people ought to join churches, political parties, and unions freely because they want to. Other people believe that sometimes it ought to be compelled. That's a matter of individual philosophy and it isn't partisan at all. It's not Democratic or Republican at all, but I don't want to see us debate this 15 or 20 times as Amendments to every Bill coming along. And I would certainly urge that more people vote 'no' so that we'll have this one vehicle go to Third Reading and at such time as it might be called, you can vote 'yes' or 'no' and get it over with instead of taking this strike at a conscientious Member's Bill and, in my mind, it's going to stimulate and encourage some other people to offer Amendments and we'll be talking about it too much. And I would encourage more 'no' votes."

I would not vote for this Bill on Third Reading and I told Representative Hudson that I wouldn't do it under any circumstances. But there's no more honorable and dedicated men that ever sat in this House than this man. And this is what he honestly believes. He thinks about it just as much as I think about the people that live in my district. Whether he's right or wrong, anybody that has worked as many years ought to have a right to have his Bill heard on Third Reading somewhere down the line other than just having it gutted. Now, you Democrats listen to this. There's a whole lot of you over there that have 100% labor record. But there's a whole lot of you that don't have as good a labor record as C. L. McCormick. Look over your stars and you'll see what I'm talking about. And I wouldn't vote for this Bill on Third Reading for any amount of money or anything that you could do for it. But I think it's a crying shame that you won't give him enough 'no' votes to let him have this day in court next week or the next week. And he'll get it over with and he'll give you a chance to make your fifth star or maybe they'll give us sixth star and a campaign contribution too. But I think it's wrong to do Representative Hudson this way. And if you have any principles about you, you'll be a good labor man and you'll give him a fair break like labor always expects us Republicans to give them. Thank you."

"Thank you, Mr. Speaker and Ladies and Gentlemen of the House. In ways I wish I had yielded my one minute to Representative Winchester for he has stated my position far 83  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 34th Legislative Day May 5, 1981 better than I can state it. I, too, am opposed to right-to-work. I will be voting against this Bill on Third Reading. But I think the Sponsor has the right to have it go to Third Reading in the manner in which he wishes it to and that we're simply subterfusing the parliamentary process. Thank you."

"Thank you, Mr. Speaker, Ladies and Gentlemen of the House. I think that a vote against this Motion is the proper vote. The Sponsor of the Amendment points to the recent uprisings in Poland and certainly we join with all of those people who are rising against the tyranny that governs Poland. But I'd simply point out to you that this Bill strikes a Bill for freedom. It's a Bill that says people shall not be compelled to do something they do not want to do. Now, I suggest to you that this Amendment, if adopted, is merely a way of dodging the issue, ducking the issue. I think that we should allow the Bill to be heard. That we should vote this Bill up or down, but this is not the right way to dispose of this matter. I urge a 'no' vote."

Ladies and Gentlemen of the House, in explaining my vote, I would like to point out to the Members who are not voting in favor of this that those of us who are in favor of this Amendment and against this Bill are voting our philosophy. We may have a labor oriented philosophy. It is not necessarily whether we get four or five or six or eight flags or the contributions or things of that nature. The reason we are voting this way is because of our philosophy. If it were to go to Third Reading, our votes would be the same. But look at some of those folks that are voting 'no'. It's very easy for them to hide behind Representative Hudson and say we are voting against this because we don't believe in striking the enacting clause or we don't believe in this parliamentary maneuver. That's why we're voting against it. And how many of those same Members are going back to the Chamber of Commerce and the Manufacturer's Association at a later date and then say to those folks, 'I voted with Ray Hudson on that Bill'? I think this a time for integrity. This is a time for honesty. It's a very simple issue. If you believe in the right-to-work or if you don't. "One of our former Members is in the back, Representative Gale Schisler and Gale remembers very well six or seven years ago when this same thing happened. I don't know of an instance that probably splits that aisle more than a situation such as this. I went over it when the Sponsor of this Amendment introduced it and went over and asked him exactly what the intent was and if, in fact, he was going to call it or whether it was..or whether it was for the purposes of a Roll Call vote for, which one of the other Members on the other side alluded to. And yes, that's exactly what it is for. But philosophically, we are just opposed to anybody having legislation emasculated in this manner. I know in fact, I've had at least six people come by my desk and indicate to me that another Bill that I'm on and Cosponsoring with the Sponsor that they're really concerned about the effect it's going to have on other legislation. And so I just look to all of those who are voting...who are voting for this legislation to remember that this is not the final vote, that there are many, many Members of this side of the aisle as well as the other side of the aisle that do not...who will not support this legislation in its final passage. And this is a political movement. I'm sorry...I'm certainly sorry it got to this point."
