"House Bill 588, a Bill for an Act making appropriations for the ordinary and contingent expenses of the Department of Children and Family Services, the Department of Public Aid, the Department of Public Health, the Department of Mental Health and Developmental. Disabilities, and the Department of Rehabilitation Services. Third Reading of the Bill."

"Representative Wolf." Wolf, J.J.: "Thank you, Mr. Speaker and Members of the House. We started going through this the other day before it was taken through the record. The Department of Children and Family Services, their budget is one hundred and eighty-one million, one hundred and sixty-seven thousand which is 3.3% less than it was introduced. Department of Public Aid, two billion nine hundred and thirty-five million, four hundred eighty-one point six, which is a reduction of 1.2% below as introduced. The Department of Public Health as recommended in this Bill, a hundred thirteen million, thirty-five thousand seven hundred dollars, which is one tenth of percent less than as introduced. The Department of Mental Health, five hundred and sixty-seven million, eleven thousand eight hundred dollars, which is seven tenths of a percent below as introduced. "Mr. Speaker, Ladies and Gentlemen of the House, I made my remarks reference to this Bill yesterday. Even though this is almost four billion dollars and it's a lot of money and state spending to some, and I'm sure that some may withhold their votes just because it's four billion dollars in state monies and funds. I feel that we must fund human services, I think all of us heard the prayer by Sister, just a little bit ago as she said, we should help the poor. My problem is that very often when we talk about public assistance, that there is a myth that we are giving too much for the poor and so often it is the providers that are making the monies and the poor remain poor. I intend to support this appropriation Bill and hopefully see its passage today.

"Pardon." Wolf, J. J.: "Hundred and fifty million, seven hundred and forty-one thousand, four hundred."

"What I'm doing..." Wolf, J.J.: "Personal Services."

"What I'm doing is checking with figures that I received yesterday from Public Aid. They had indicated that the administrative cost were two hundred thirty-five million, one hundred and thirty-seven thousand. So we have a discrepancy there, I believe." Wolf, J.J.: "Okay, what. I gave you was Personal Service, I thought that's want you wanted."

"No, I was talking about adminstration...I would like to address this Bill." Wolf, J.J.: "Two hundred and twenty-seven million, one hundred and sixty-seven thousand, six hundred. That's GRS.".

"Proceed, Representative."

"Thank you. Yesterday after we amended this legislation and attempted to amend it further. I checked with the Department of Public Aid and I learned that there were in excess of ten thousand bureaucrats working to administer.. the Public Aid funds. Furthermore, they indicated that.. there was a sum of two hundred and thirty-five million, one hundred and thirty-seven dollars used to administer the program. Further checking I learned that of the budget, one billion six hundred thirty-four million, six hundred and eighty thousand dollars goes to doctors and hospitals.. This is more than goes to the recipients themselves, the recipients receive one billion, one hundred and two million, eight hundred, forty-one thousand. So we have a 5  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 52nd Legislative Day May 29, 1981 program that employs over ten thousand people in the state, it costs over two hundred and thirty-five million to administer and the most funds of any program go to doctors and hospitals. We have a need for welfare reform, the Carter Administration has proposed welfare reform. in this area, it fell upon deaf ears, President Reagan has not yet called for a reform of this. Here in Illinois we have. House Bill 79, I believe it is, introduced by Catania and Ryan. But this Bill has not had a fair hearing on the House floor, it has not been acted upon. I think this whole system needs reform, I think that were're...we have a system where the recipients are receiving some assistance but most of its going for administration and to doctors and hospitals. I would encourage my colleagues to vote 'present' on this until we have some meaningful reform in the Public Aid Department. Until Catania, Ryan Bill is voted on by this House of Representatives. There's really no emergency here, we're talking about appropriation for. fiscal year beginning July 1st. I think if we can withhold our votes, resurrect the Catania, Ryan Bill, we would have a better chance of improving the system the delivery of services in cutting back on this wasteful: program. Thank you."

"Representative, what is the Department of Child and Family Services done with the purchase of care contracts they've had in effect for some time with some of the private agencies?" Wolf, J.J.: "Would you repeat that question, please.".

Wolf, J.J.: "I've been advised that they still have contracts for the coming year like they have currently."

"Well, they still have contracts and tend to continue. those contracts, why aren't they providing that...allowing those private agencies to fulfill those contracts. Why are they withholding the...those individual situations from the private agencies then? Doesn't that seem like a conflict? Make a contract then not allow them to function." Wolf, J.J.: "I'm not sure I understand the question. If they have a contract, I can't understand..."

"But they're not letting those contracts function.. They are denying the right.." Wolf, J.J.: "In what way? If someone has a contract that they contracted to deliver services, I can't see how they can be impared from delivering those services."

"Well, that's what the agency has been doing for some time. Well, let me go one other question.. What's the position of the agency in cutting back the million plus to some four hundred thousand dollars as far as the prenatal and maturity services to some of the agencies? Is it the policy of the department to discontinue that completely next year, since you've reduced it over 50% on this years budget?" Wolf, J.J.: "The department as I understand, is going to continue the program at a somewhat diminished level and are making. every effort to clean it up."

"But what happens if you have the need there, is...hov. can you exist on less than 50%.funding. if we have need of greater than that this year? It seems to me that the teenage pregnancy in unwed mothers category is increasing every year rather than decreasing... "Well, Ladies and Gentlemen of the House, it just seems to me that this is another time this agency has shown the irresponsible actions of past fiscal years. They keep saying they're going to take care of the children, they aren't, they're not taking care of the expectant single mothers when the need is there. They certainly aren't. filling their obligations as far as the written contracts between private agencies and the state and it seems to me that until they have a thorough discussion with those. private agencies and some kind of meaningful dialog, we ought to vote 'present' and not give them the sufficient: votes to pass their appropriation."

"Thank you, Mr. Speaker, Ladies and Gentlemen of the.. House.. Just briefy, as Chairman of the subcommittee, that heard this appropriation. We worked very carefully and very closely between the two parties, Representative Bowman, the Minority Spokesman and myself and all the Members of the subcommittee.. We dealt as best we could with the various problems that were brought to us. And I think we present to you a Bill that is in reasonable shape., Now there's in an area here where the proponents wouldn't like to have more money. That will be the story on the whole budget here, in the Senate, when you get to final passage on the Conference Committee. We would like to give more to all kinds of good causes but we have responded. We did listen. We did take into account the complaints that were made, that day care was being cut too much and we responded to that. We did take into account the complaints that direct patient care position in mental health were not being funded sufficiently, and we responded to that.. HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 52nd Legislative Day worked through this Bill for many many Committee, the subcommittee and in the full May 29, 1981. hours in the Committee and if you remember for about six hours the other day... I'm. sure you were all exhausted listening to it but you all sat here, I was very proud of the whole House. We worked our will on this and we won some and lost some on the various Amendments. I think the Bill as it comes to you has been worked on very carefully and in very close cooperation. I commend Representative Bowman, I commend Representative: Matijevich, Representative Wolf.. We have all from both parties worked to put this Bill in the best possible shape... To not pass it at this point and move it along is in plain simple language, not only irresponsible but also a. vote....if you don't like the planned kind of omnibus Bills you have now, defeat this Bill and wait till you see what comes back from the Senate on July 3. If you don't like this you'll love that. The only responsible vote and a. good, honest conscientious principle vote at this point is to vote to fund these agencies, send this Bill over to the Senate and move on with the process. I ask with all the sincerity that I possess for a favorable vote on House Bill 588."

Kelly, D.: "Can you tell me, in Tinley Park at the Tinley Park Mental Health Facility and the Howel Center, if there will: be a two and a half million dollar reduction in our budget and if so, does this mean, I understand there's going to be 9  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY

I believe it's under Amendment #18 or 19." Wolf, J.J.: "Representative Kelly, I understand there's a slight decrease in dollars it is not that large of one...from this year, fiscal '81 to fiscal '82. And that there will. be. some small decrease in number of employees from FY-81 to 82 but, it is not two hundred like two hundred like you've..." Kelly, D:. "I have an explanation of Amendment #19 and it says here, transfers two and a half million from the Howel Developmental Center to Dixon and Shapiro Developmental Centers for caring of a hundred and sixty residents and then it notes that there are at Tinley Park, forty-eight people and at Howel Center two hundred and twenty-four. people who will be either transferred or else will lose their employment. Now that's the explanation that I have of the Amendment and....is that not correct?" Wolf, J.J.: "Okay. I understand there were suppose to be a hundred and sixty residents transferred to Howel originally. These people were instead shifted to Dixon and to Shapiro and therefore, the additional personnel would not be needed since the additional patients would not be going to Howel." Kelly, D.: "Okay, well then I just...." Wolf, J.J.: "We're talking....these were to be new position and they are not needed now because of the patients are not going to be....that is one hundred and sixty residents are not going to be transferred to Howel." Kelly, D.: "Okay. Thank you., I would just like to speak on this issue, Mr. Speaker and that is, that a particularly the Legislators that are representing that area. We're going to have a number of people and we already have high. unemployment rate and this is going to add to it and I have 10  STATE OP ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 52nd Legislative Day May 29, 1981. always supported this appropriation. And I feel very bad not to but I just can't do it with that large. a....and by closing down those facilities, that would be, I think a real tragedy and I'm going to encourage those of you particularly from the south suburbs to either vote 'noor vote 'present'."

"The question is, 'Shall the main question be put?' Those in favor will signify by saying 'aye', those. opposed.. The 'ayes' have it, Representative Wolf to close." Wolf, J.J.: "Thank you, Mr.. Speaker. In answer to the last Gentleman, I would like to submit to this House of Representatives, it is not the function of any department to try to use patient care to solve unemployment problems on a regional basis. We could make the same argument for Dixon for Shapiro, for any other center and as to the patient should be moved there to solve some local unemployment problems. I think these exist all over the state. In answer to a previous Gentlemen, who said that there were over ten thousand bureaucrats in the Department of Public Aid, I wouldn't consider case workers and people who are out in the streets trying to fulfill the needs of the people out there as bureaucrats. Now there are over...close to two hundred, ten thousand AFDC recipients alone, that these ten thousand employees are taking care. of. I don't have the figures on the others but I know in AFDC alone there are close to two hundred and ten thousand people out there that have to be served and I think.. it's foolishness and folly to vote 'no' on this appropriation... The question before you now is, are you going to fund this budget, are you going to take care of the people in these various agencies in Children and Family Services, in Public Aid, in Mental Health or are you going to give them. nothing... And that is the question before you now at Third Reading, I would ask for your affirmative votes."

Today cooler heads prevail primarily because our Speaker, Speaker Ryan, has opened up the channels of communication and for those reasons, I will support the appropriation process and I'm happy to state, Speaker, that I am very pleased that we have finally opened up the channels of communication so that we can solve the problems for all the people of the State of Illinois. I vote. 'aye'."

"Mr. Speaker and Members of the House. It really hurts me not to be able to support these budgets for human services which are of dire concern to me. But a part of the mental health budget as it now stands, is an.. elimination of regional offices and in return, some monies put into the central office in Springfield instead. "Thank you. Thank you, Mr. Speaker and Ladies and Gentlemen of the House. I rise to state for the record, not only my voting 'aye but I think for the first time that I can recall in my short tenure here. That we have. bipartisan cuts in the Public Aid budget...minus the cost of living increase for publicaid recipients of which I would have liked to have seen in this budget., I thought that there was one very significant Amendment to this Bill. I noticed that Representative Vinson had put an Amendment to this Bill that cut out a hundred and seventy-five dollars...seventy-five thousand dollars to health systems agencies.. I think Representative Vinson should be. commended for at least pointing the way to the radication of an agency or agencies across the state that I think have been a tremendous deterent to quality care. And I want the records to show at least, some Democrats believe in budget cuts and if for no other reason, I'm supporting that one."

"Thank you, Mr. Speaker, Ladies and Gentlemen of the House. I recognize this Bill has to be passed and I frankly hope that:89 people will at least vote for it.. I will not lend my vote to this Bill, however, not only because the cost of living is not in there, I'm not that much of a spoiled sport. It will set up a separate.....if the cuts in this Bill are passed, it will set up a separate standard of health care for the poor. I frankly find that unconsciousable. The cuts in the hospital lines, what it does in terms of health services I find to be counter productive and short sided. I believe that the poor will suffer and for that reason, I'm voting 'present'."

The Department of Insurance at eight million, one hundred eighty-seven thousand six hundred dollars, that was 2 1/2%. less than introduced. The Military and Naval Department, six million, four hundred and ninety-one point three thousand. Six million, four hundred ninety-one thousand, three hundred dollars, a reduction of 5.8% under the Bill as introduced. "Mr. Speaker and Ladies and Gentlemen of the House,. I again would now urge the Members on this side of the aisle to withhold their votes or vote no on House Bill 589. And we do, I believe, have legitimate reasons why we should not vote for this Appropriation Bill at this time. For the last couple of....last: Session, this Session, we've been having some real serious problems with the Department of Law Enforcement and up grading its system, the computerized criminal: history systems. Which is so important to local police departments, local law enforcement agencies. They rely so heavily on this information, in the court systems and when you don't have that adequate information you are not doing a good job in law enforcement. Now I realize. that Director 'Zagal' has said, that they are going to all that they can to upgrade this system. But they have such a backlog, I think that the only way we can show that we mean business is by withholding our votes. Now that...I think that does work to a great extent, for example, one of the other agencies in this omnibus type of Bill is the Racing Board. In fact, one of the Gentleman from that agency said, well just don't give us the money, we just won't have any racing dates. I think that type of arrogance is a type that we, as a House ought to show that we do have final approval on those appropriation Bills. And the best way. that we can show that we mean business and we want accountability, we want those agencies of government doing their job, is by withholding our votes. So I would urge. the Members on this side of the aisle at this time to withhold their votes or vote 'no' on House Bill 589."

This rewrites the Resolution, provides that the....it be a creation of a Judicial Screening Commission to certify the fitness of candidates for Supreme Appellate Circuit Court and Associate Judges. No person will be eligible to serve in the Office of Supreme Appellate Circuit Court or Associate Judge unless they are certified by the Judicial Screening Commission. And it would not apply to such Judges in office at the time of this 22.  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 52nd Legislative Day May 29, 1981. adoption. There would be twenty-three Members on this Screening Commission, the First Judicial District would have nine, three appointed by the Supreme Court, three non Lawyers appointed by the Governor with the advice and consent of the Senate. Three Attornies selected by. attornies from the district. And the other four downstate districts, there would be twelve members, three from each district, three appointed by the Supreme Court, three non lawyers, one appointed by the....all appointed by the Governor. And again, three attornies selected by attornies from the district. There would be two, at large, members appointed by the Supreme Court. The members of the Screening Commission would serve for six year terms, the Supreme Court shall designate one of the Judge members as Chairman for a two year term. The Commission shall adopt.. rules of procedure and in order to be eligible to serve or be eligible to hold the office of Supreme Appellate Circuit Court Associate Judge, a person must submit his name for certification to the Screening Commission. No person may hold such office unless his fitness has been certified. As I said before, they should use the following criteria, judicial temperment, legal knowledge, experience as an attorney or Judge, integrity and partialty in absence of prejudice and avoidance of impropriety.. There would be, for the purpose of evaluation and certification, there would be two categories, Supreme and Appellate and the other category would be Circuit and Associate. It would take twelve votes to certify a candidate and the certification shall be valid for six years subject to findings of ethical or judicial conduct. violations by the. Supreme Court. That's what the Amendment does, I would be. happy to answer any questions and ask for its adoption."

What this does, is to insure that ve have quality candidates but it still keeps the people...allows them the right to decide who the Judges shall be."

What Representative Cullerton, is proposing is an attempt to essentially rape the principle and purpose of the Constitutional Amendment we're considering.. But the Constitutional Amendment that we're considering would do is provide, by judicial district for an optional basis for people to choose to go to a merit selection of judges nominating procedure. It would not impose that any place in the state, the people would have to choose it. The problem with the Amendment is, that this would still throw. it back into an electoral system and you would have no guarantee that that electoral system still would not be rigged to produce highly partisan judicial results. I would strongly urge defeat of the Amendment."
