I presume that the Gentleman wishes to take this Bill from the table and then to offer an Amendment which would carry an appropriation for revenue collectors in the Department of Revenue and, also, for a transfer in the Department of Public Aid to meet the state's obligation to certain welfare recipients in the general assistance category. If that action were to be taken today, it would 7 STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 105th Legislative Day May 7, 1982 require that the Bill be sent to the Senate, which has already adjourned and which will not return until Tuesday. Therefore, the Bill could not be read OB First Reading until Tuesday. It would require Second and Third Readings, at the earliest, on Wednesday and Thursday. Therefore, this clearly would not be an expeditious manner in which to provide for the appropriation to the Department of Public Aid. There is an easier and more expeditious manner available. Th There is a House Bill in the Senate, sponsored by Senator Schaffer. Senator Rock offered an Amendment to that Bill today that would accomplish this purpose. When the Senate returns on Tuesday, that Bill can be called. "Mr. Speaker and Members of the House, let me first say I was delighted to hear that the Minority Leader did not express any real opposition to the notion that we ought to fund the necessary dollars to provide for the 700 and some odd auditors and employees in the Department of Revenue SO that we can continue to collect the necessary money to fund State Government. One of...One of those functions being to provide public aid dollars. I would say, Mr. Speaker and Members of the House, however, that Senator Rock has adjourned the Senate. That's beyond our control. Each and every one of us has been elected to do what we believe to 8 105th Legislative Day STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE May 7, 1982 be the right thing for those whom we represent. We are still in Session, and if we act today, as I believe we should, we will be saving precious time so that 95,000 some odd citizens of Illinois can receive the checks, which they depend upon so much, simply to live day to day. If we must delay the action by even one day, let alone longer, it is those citizens most of whom, by the way, live in the county from which the Minority Leader and I come from, those citizens will suffer undue hardship. Now, in regard to the Gentleman's remarks about the Comptroller stating that we have enough money. It is our opinion that the money does not exist in the state's General Revenue Fund, at the present time, in order to meet those obligations which we have to those Illinois citizens. And I would hate to see this Assembly, no matter what side of the aisle we sit on, have to get into the middle of that debate; because, I don't know who's wrong, and I don't know who's right, whether it's the Bureau of the Budget or Mr. Burris' office. But if he is wrong, it will be he, Mr. Burris, the Comptroller, and those Members who refuse to act today, who will have to bear the responsibility of causing that hardship to Illinois citizens. So, Mr. Speaker and Members of the House, let me reiterate. First, my appreciation to the Minority Leader for not setting forth his opposition to funding those 700 some odd revenue agents. And I implore the Members of the House to help us provide the necessary 107 votes to take this Bill from the table, so that we may amend it and pass it, so that the moment the Senate returns they can begin action on this very, very important piece of legislation. It's our obligation. It's our responsibility, and it will simply take 107 votes. There are a number of Members absent today on both sides of the aisle. "Mr. Speaker, in response to remarks of the Majority Leader, I stand in opposition to the appropriation to the Department of Revenue for the revenue collectors. I have not changed my position. If an Amendment or a Bill is offered which combines the appropriation to the Department of Revenue with the appropriation to the Department of Public Aid, then I shall stand in opposition to that Amendment or that Bill. I don't believe that we should leverage welfare recipients against patronage workers."
"Representative Wolf." Wolf, J. J.: "Thank you, Mr. Speaker. Well, first of all, let me clarify a few things. The distinguished Minority Leader said we had filed some Amendments pertaining to revenue collection officers. That is not the case. The only Amendment filed is on the matter of public aid recipients. And, of course, the intention was to amend this Bill to address the emergency situation that now exists in...in public assistance. We...As was pointed out, the Senate has failed to act on a Bill to provide add...additional funding for the General Assistance Program to the Department of Public Aid, and the fact of the matter is that an additional 19.7 million dollars must be provided. If not, I think the number is about 103 thousand persons in Chicago may not receive their general assistance payments. Now, while it's true that last week's checks were written, the 10 STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 105th Legislative Day May 7, 1982 fact of the matter is the checks that will be written Monday ΟΓ Tuesday cannot and will not be written without the specific authorization of this General Assembly. Now, the checks will continue to be printed, but will be held by the Comptroller starting on May 11th until sufficient funding has been acquired. Now, the first impact will be on the checks that are scheduled to be received the week of May 17th for the Chicago general assistance recipients. Of course, there is a smaller number of downstates which will not be immediately effected. On December 28, 1981, a U. S. District Court ruled that the Department of Public Aid had improperly included food stamp benefits in the final grant calculation. Their two-tiered flat grant system, they claim, was unfair, and the assistance level was too low. Now, the court has, since that time, ruled that a single flat grant of 162 dollars a month would be paid to all Chicago general assistance recipients. The rate has been paid by the Department of Public Aid despite the number of appeals that have been aimed at lowering that particular grant level. This Amendment covers the 162 dollars a month rate paid for March and April and will fund 144 dollars a month grant for May and June, as the Department believes the next appeal will, undoubtedly, be successful. Mr. Speaker, Members of the House, I believe that there is an emergency that exists here. I believe that the 103,000 people who will be waiting for their general assistance checks to buy their food, to pay their rent, to pay their utilities and other necessities of life is necessary, and I would say this is not a partisan matter. It is certainly a bipartisan matter which should be addressed, not only by the Republican Members of this House, but by the Democrats as well. The Chairman of the Appropriations Committee, himself, decided to let this Bill go down where it now sits on the table. I didn't make that decision. He made that decision. He could have put that Bill on the matter of Postponed Consideration. To use this vehicle as a Bill, to play with the lives of poor people, is really a political joke. You know, I've seen both Reagan and Thompson play Pac-Man politics with the poor and the disadvantaged and the handicapped. That's all you're doing. You're eating up the poor people. Now, let's face the real fact. The fact of the matter is that patronage means so much to you that you use a Bill in the Senate and try to strike a deal; that the only way that the public aid recipients are going to be paid is if that you can put Republican workers to work in the Department of Revenue. You already have 3,000 employees in the Department of Revenue, and all you're doing is screwing up daily with the Department. You screwed up with the matter of the miscalculation of the sales tax exemption on machinery. You did that royally. You delayed the Circuit Breaker. Now it's starting to hurt, Jake. You delayed the Circuit Breaker payments. You... You not only did that, the income tax refunds. On a federal level, the tax cheaters are getting away. That's why..."

"The point is that we are in an emergency Session. You are declaring this an emergency. The Minority Leader has already said that information from the...from the Comptrollers Office is that the poor are going to be paid. You are trying to develop an emergency. You know, we're in an emergency Session. Look in the Calendar at Third Reading. You have over 100 Bills that are Republican Bills. We've got Democratic Members who have been told, 'If you want that Bill to be considered, get your name off. Then it may be an emergency.' Who the hell's kidding who? The Speaker is screwing up the whole Session in declaring what's an emergency and what's not. Now you're trying to play politics with the poor people. If we're going to be here Monday, I think the Speaker really is ashamed to go out there and to campaign before the public. He's got an excuse that he doesn't have to campaign, because he's in Springfield. We don't even have an emergency, but he wants to be here rather than face the public. I'm telling you, this is the worst Session I've been in in all of my time, because of the way it's operated. Now you want to make an emergency that hasn't even been developed, because you want to put patronage people to work. That's the whole issue. Now, we are a two-House Session, a...a Senate and a House. And the fact of the matter is that, if this Bill got off the table, no matter what you wanted to put on it, it won't pass until we have three more days over there. There is a vehicle over there that can be done Tuesday, real quick; but, no, you want your revenue collectors. We already have documented that we have the Secretary of the Boone Central Republican Committee whose husband has been hired. And they said, 'No, we want to keep the level of funding within our Department that we have now'. So they refused. We were here in November in a Veto Session. Again, did they come forward for revenue collectors? No, they didn't. No, but at the eve, now you want to tie it up with poor people. Who are you kidding? The poor...The poor are going to be paid from all the evidence we have. And even if your Motion is successful, they will not be paid any more ex...expeditious...expeditiously, if you would only, only take away that other plan that you've got of playing politics with it. So, Mr. Speaker and Members of the House, I would urge the Members to vote against this Motion. It's the silliest, as I said, Pac-Man politics against the poor that I've ever seen here."

I wasn't going to reply to the previous...the last speaker, but I just want to remind him that the last month, before Dixon went to the United States Senate, he had a good Bill here that would help and code some 2600 employees in the State of Illinois, and the Republican Party wasn't looking at fat cats or patronage. We felt it was good for the people in the State of Illinois that these people come under the Personnel Code, and we supplied them Republican votes to code some 2600 people. Now, I ask to the Minority Leader, I can't speak for my colleagues, DiPrima and Doyle, but of the 14 STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 105th Legislative Day May 7, 1982 100,000 people that will be receiving checks, some 22 percent of those we represent, not in this new district that you gave me, Mr. Minority Leader, but in the district that I am in now. Twenty-two percent of those people in my district will be receiving those checks. Now, when you're calling these revenue collectors patronage people, let me tell you what these revenue collectors will be doing. They'll be collecting 15 million dollars a month, Mr. Minority Leader. Fifteen million dollars a month, of which 12 million will go to the state to help pay some of these checks, and three million dollars a month will go to the fifth floor in other local governments in the State of Illinois. Let's forget about patronage cats. Every time the Republican Party has a good Bill, we are patronage cats and we're trying to put people on the patronage rolls. Twenty-six hundred people in the State of Illinois going to the Secretary of State's Office, was not considered patronage, was it? I say, let's quit clowning around. Let's give the State of Illinois the revenue collector it needs, so that they can collect this 15 million dollars a month, so we can get on with the state's business and finances."

"Mr. Speaker, I rise to respond to the last point, which I presume was also on the Motion. What he did not tell you is that those revenue collectors begun to be hired in January of this year. What it as early as November? Those revenue collectors have been hired. The Governor did not come to us to ask authorization until only recently. He hired those revenue collectors without having an appropriation to hire them. And we should not, at this point, for a very narrow political purpose, pull his chestnuts out of the fire. We should not link a political objective of hiring revenue collectors or sanctioning the illegal hiring of revenue collectors with paying a public aid appropriation when there is not, now, the need to do it. He can come back next week, take care of the public aid appropriation properly and let the Governor get rid of those revenue collectors and then come back to us and have it done the right way."

When you stop to think that these two Gentlemen rank very high in the list of big spenders in this state, the one Gentlemen from Lake is the number one big spender. He has voted for every appropriation for the last 16 years that I can think of. And if we hadn't had these kind of appropriations that he was voting for, we probably wouldn't need to collect as many taxes as we do today. But the fact remains that these taxes are owed. We're not imposing any new taxes. These are tax cheaters that you don't want us to go after. The other side of the aisle is unwilling to address this problem of general assistance by itself. They want to tag on a rider that will be to their own benefit, to their own good fortune, and they want to extract that good fortune from the taxpayers of the State of Illinois, at the risk of jeopardizing food on the table for the poor. I think we should just simply defeat this Amendment and force the issue up to the top the way it should be, for general assistance only, and that, of course, can be done."

"Thank you, Mr. Speaker and Members of the House. I want to correct a misstatement by the Sponsor of the Motion. He suggested that the 162 dollar benefit per individual per month is an increase, would represent an increase in spending in the G.A. Program. That is factually inaccurate. The 162 level was arrived at by the Court as the average of payments made in the G.A. program in fiscal...in...I'm sorry, in Calendar Year 1981, the last month, December. So, when we talk about 162 per recipient per month, we're talking about a commitment this Legislature made to people who are on general assistance, a commitment we made in the last fiscal year and in the fiscal year before that. As I understand the Sponsor of the Motion, his intention is to offer an Amendment that would leave this program seriously underfunded. We're not talking about saving the General Assistance Program if we vote for his Motion on House Bill 2204. We're talking about leaving the poor people who are on the General Assistance Program without the dollars they need to survive during the months of May and June. We're talking about telling people, who have rent bills of 175, food bills, clothing needs, medical requirements. We're telling them all they get is 144 dollars per month. I might be willing to support this Motion if we were talking about full, adequate funding for the General Assistance Program, but that's clearly not the intention of the present administration. The Governor of this state is playing political brinkmanship with the needs of the poor people, not only in Cook County, but all over the State of Illinois. This issue, the issue of funding the General Assistance Program so the checks can go out next week could easily have been resolved in the Senate yesterday. The 22 STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 105th Legislative Day May 7, 1982 President of the Senate was prepared to offer an Amendment to an appropriations Bill that had nothing to do with revenue agents, nothing to do with the Governor's patronage workers. The holder of that Bill, a Republican, was not prepared to move it, because the Governor doesn't want these issues separated. He wants to hold the poor people at the brink. He wants to make the Democrats, who care about poor folks, feel that the only way we can meet our responsibilities is if we're willing to give him the patronage workers he needs in an election year. There is a better way, Representative Wolf. There is a Bill on Third Reading which can be returned to Second, an appropriations Bill in this House. At that point, we can address separately, as they should be addressed, the two separate issues whether we need to have more auditors to collect more taxes, and whether we're prepared to meet our responsibilities to fund fully the General Assistance Program so that the poor folks in the State of Illinois can make it through the rest of May and the rest of June. I urge a 'no' vote on Representative Wolf's Motion."

There is only about 900,000 dollars left. There is insufficient amount of dollars, and the checks which must be written Monday or Tuesday, let me repeat, may not, may not legally be written without the authorization of this General Assembly. And people were talking about law-breakers. Nobody wants to place the Comptroller in the position of violating the law. And I would ask, Mr. Speaker, for an Oral Verified Roll Call on this question."
