"Thank you, Madam Speaker, Members of the House. House Bill 294, as amended, seeks to address a problem as it relates to emergency services and disaster agencies created in townships in Cook County. With the adoption of Amendment #1, there were a few problems created which has... which needed to be discussed between the State Emergency Services and Disaster Agency and the County of Cook. With Amendment #2, those problems have been answered and basically what Amendment #2 does is to provide that the townships who wish to create an emergency service and disaster area in Cook County must, within thirty days after the enactment of this law, provide a copy of the report to the State ESDA, and must also have an approved report, and 3  STATE OF ILLINOIS 84th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 28th Legislative Day approved plan on file with the Cook April 23, 1985 County Sheriff's Office. It makes it really applicable to only one township in Cook... in Cook County... a township which currently does have and is the only township in the state that does have an emergency services and disaster agency. And I would move for the adoption of Amendment #2."

"That is correct." Vinson: to table the "Madam Speaker and Members of the Assembly, the Gentleman's Amendment is an Amendment which has a negative impact on the concept of home rule in the State of Illinois. Now, it is also true that the Bill has a negative impact on the concept of home rule in the State of Illinois, but the Amendment doesn't cure that problem as it might have been intended to do and he needs a much better Amendment to do that. The Bill still involves, even with that Amendment, adverse impact limitation of home rule powers and mandates on home rule units of government and other local units of government in the State of Illinois. I don't believe that we should permit this Amendment to go with the Bill because if we take this Amendment off the Bill, the Gentleman will have to come in with a Bill... with an Amendment which absolutely cleans up the Bill and removes the impact and the cost on home rule and local units of government. Now, the Speaker has been most forthright in condemning past efforts in this General Assembly to impose impacts on local units of government which raise costs for taxpayers at those local levels of government and he has adopted a program to strike at any possibility that this General Assembly might continue its war on local governments. This Amendment that is on the 7  28th Legislative Day STATE OF ILLINOIS 84th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE April 23, 1985 Bill now is part of a concerted effort against local government in the State of Illinois. By supporting my Motion to table you will be effectuating your constituents desires that we place local power in local hands and that we stop passing sweeping mandates and shipping the bill to the local taxpayers. I would urge a 'yes' vote on the Motion to table the Amendment."

"Yes, Madam Speaker. I wish I knew what the previous speaker was talking about. It was certainly kind of confusing. Amendment #1, which was adopted unanimously in Committee, simply would stipulate that... which is pertaining to the Indoor Clean Air Act, which was stated that it did not affect any home rule mandates and, therefore, the mandate wasn't even required, as stated by the... under the State Mandate Act. What the Amendment only did is that it allows local government organizations to enact more strict no smoking regulations than those that are provided under the legislation. I'm sure that all of us are aware that some local units of government may want to incorporate no smoking because of either health or safety rules and, therefore, this Amendment simply allows the local unit of government to do that and certainly is necessary on this legislation and I would move that we vote against the Motion to table Amendment #1."

"Thank you, Madam Speaker. I rise in support of the Motion and cite Rule 42 to the House, where it holds that no Bill denies or limits any power or function of a home rule unit unless there is specific language limiting or denying that power. So the question becomes, 'Do you want to fully exempt or not have applied to home rule units HB 33 and then make it a simple 60 or 61 vote majority for passage or do you want to leave Amendment #1 on?' It... Amendment #1 specifically, explicitly applies to home rule units of government and allows them to pass only more restrictive measures. It is clearly a preemption of home rule authority and if it on Third Reading does not receive 71 votes, then it would be appropriate to declare it not passed. So I move to table it at this time and you can proceed with Majority. I support the Motion to table."

Amendment #2 basically is clarifying language that a public place does not mean a retail establishment that derives 75 percent of its income from the retail sale of alcoholic liquor, which means a... basically what we are doing is a bar that sells sandwiches would be classified in this category. And all that... the clarifying language on this is basically, you know, clarifying as far as what a liquor establishment or a bar is classified as and I'd ask for a... you know, affirmative vote on Amendment #2 on House Bill 33."

"Yes, Madam Speaker. I oppose Amendment #2. Basically, the Amendment is nothing more than dilatory anyhow. You don't need any 75 percent of retail establishments. It is specifically outlined in the Bill and the Bill should be voted on as is and not some frivolous Amendment... 75 percent of the liquor sales. And so I would move that we do not adopt Amendment #2 and vote "no"."

"Thank you, Madam Speaker, Ladies and Gentlemen of the House. Madam Speaker, could we have some order here, please? It's beyond my comprehension why the Sponsor is opposing this Amendment. If he is in a situation where he says he hasn't had a chance to read the Amendment, hey, I'm willing to hold the Amendment and come back to the Bill tomorrow or later on today when he has had a chance to read it. But as far as, you know, using as an excuse he hasn't had a chance to read the Amendment when it has been printed and distributed on the Members desks, I mean that's sort of a flimsy excuse. What this basically states according to the Bill the way it is written right now, that a bar, tavern is classified as a public place. Very few times do you go into a bar where there are not people smoking.. And this would just be exempting a establishment that has... 75 percent of its income is derived from liquor sales being exempt from this Act. It does not exempt a restaurant, like the Gentleman vas a little bit worried about that before. It doesn't exempt a restaurant, but it does exempt a bar. And I think it is a good Amendment. It's a fair Amendment. I was, you know, the Gentleman vas in a discussion with Representative Vinson before. "Under the present law, Mr. Speaker and Members of the House, when there is a foreclosure under the present law, the financial institution has to pay revenue stamps to get the title in their name and then turn around and pay revenue stamps when the property is sold. This merely exempts the foreclosure procedure itself from the revenue stamps and as far as I know, there is no opposition to it."

"I'm sorry, Representative. I didn't hear the explanation, but I thought that this would remove the transfer tax on sales pursuant to foreclosure actions."

"It would remove it at the time of the foreclosure, but the lending agency that took possession of the property would have to pay the tax when it sells it or transfers someone else. It eliminates a double tax actually."

"So presently, there would be a transfer tax when the to person who foreclosed the property obtained title to the real estate?"

"There is now, but... and then he pays it twice. He pays it again... when he gets it and then again when he sells it. This would leave the tax in when he sells it."

"But the person who is obtaining title pursuant to the foreclosure action isn't necessarily the same person that would be selling the property a second time."

"Well, I can't think of a situation like that. The one who forecloses would get title in their name and then they would have to sell it to transfer it to someone else and at that time he pays the revenue stamps, the same as any other seller."

"But the seller pays the transfer tax, right?"

"Right."

"Well, who pays it in the case of a foreclosure?"

"Well, the one who forecloses, in this case, and then he has to turn around and pay it again when he sells it. So it's a double tax as it stands now. This merely amends it so that he would pay it at the time that he sells it to a bonafide purchaser."

House Bill 228, as amended in Committee, requires that all garbage trucks, both new and old, would be equipped with an automatic backup signal which would make a sound that is audible from the rear of the truck automatically when the garbage truck backs up. This was brought about by several accidents which have taken place in the last few years resulting in both injury and death to various people including... mostly children, to be quite honest with you. I felt that it was necessary that all garbage trucks because of the size of the garbage trucks and the difficulty of a driver seeing behind him when he does back up that it is necessary that all garbage trucks make this noise. All large equipment currently is mandated to have this. Garbage trucks were just small enough that they slipped out from under the OSHA Federal requirements. So we would like to require this at the state level. And I know of no opposition to this Bill at the current time. I thank you very much and request your support."

Presently. there is no real law that allows a procedure for people to properly have their tax bills sent to a correct or a new address. Right now anybody can go to a county treasurers' office and if he or she knows the real estate property tax number they can have that tax bill mailed to any address they wish. They don't have to have any relationship to the property. They don't even have to know the owner. They don't have to even be involved whatsoever. If we carry that to an extreme case, this could result in the rightful owner of not receiving a tax bill, not paying their taxes inadvertently and losing the property in a tax sale. This establishes a simple procedure that the county treasurer or county collector would be able to at least know that those people who submit the request for changing the property tax mailing address for that bill at least has an interest in the property. And I'll be happy to answer any questions."

House Bill 555 is the result of several meeting that 37  28th Legislative Day STATE OF ILLINOIS 84th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE April 23, 1985 transpired starting last November with the Illinois County Pair Association in an attempt to give the county fairs in the State of Illinois some relief from the financial problems that they have had. The Bill does, basically, three things. We have changed the formula and the method of reimbursement to the county fairs up to 66 and two-thirds percent of what ve call an authorized base predicated on the amount of agricultural premiums that they have paid. The second thing that this Bill does is to increase the amount of capital money reimbursed to the county fairs where they improve whether it be horse barns, race tracks or so on. The third thing the Bill does is to allow those ten large fair and expos nore flexibility in the use of their reimbursements. As of right now, their particular reimbursement only allows them to use their Boney for capital projects and we are saying within this Bill that they would be able to use that reimbursement for things other than capital improvement and certainly the... for agricultural premium funds. There will be absolutely no appropriation in conjunction with this Bill. The Bil1 actually would not trigger into effect until Fiscal 1987. That's basically what the Bill does. I would be glad to answer any questions on it."

"Okay, so that the money goes into the Ag Premium Fund comes from horse racing, and out of the Ag Premium Fund, what do we pay? What do we pay for from the Agricultural Premium Fund?"

"Into county fairs?"

"County fairs, what else?"

"We pay for... now, I'm guessing, Representative, and I'm not sure, but I think we pay for some veterans' scholarships. I know we pay for some capital operating costs in McCormick Place... several funds."

"And what is the cost of this Bill in FY '87?"

"Approximately 1.2 million dollars."

"There... really, the question before the General Assembly, for each and every one of your districts, is how do you want to spend the money that we skim from horse racing around the state? How do we want to spend this money? Last year we increased the amount of money to civic centers. We have authorized about ten new civic centers. There is probably another ten Bills in this year to 39  STATE OF ILLINOIS 84th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 29th Legislative Day April 23, 1985 authorize new civic centers. Those civic centers, the new civic centers are funded from the Agricultural Premium Fund, and we have a seventy-five million dollar debt limit so that as those bonds are paid off, we are allowed to float more bonds to pay for new civic centers. We pay of approximately four million dollars in bonds every year. We have refused to raise that debt limit from 75 million to 80 to 90 or to 100 because we simply can't pay for those bonds so we have frozen the debt limit at 75 million dollars. There are a lot of Members in this General Assembly that have pet projects in their districts to build new civic centers. Those civic centers will not be built if we are going to spend the money on county fairs. There are a lot of people from Chicago that are anxious to pay off McCormick Place. That would be jeopardized if we spend more and more money for county fairs. There are some people that think that the excess that goes into the Agricultural Premium Fund should be returned to the General Fund so that we can fund education, mental health and everything else we provide for in this state. So this is a matter of priorities. This does not fit with my priorities. I don't think that we should spend more and more money for county fairs. I don't think we can afford a million dollars for country fairs for operating costs. We already take most of the money that we skim from horse racing, most of the money that we skim from horse racing in Cook County and in Madison County and we give that to all the county fairs all over the state. I think it's about time that we realigned our priorities and stop skimming all this money simply to spend on county fairs, start spending it for some civic centers, for education and mental health and the other proper functions of state government and not continue to bear the burden that should be borne by local 40  28th Legislative Day STATE OF ILLINOIS 84th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE counties. So I would oppose this Bill."

"Representative, I don't recall specifically, but this Bill is supported by certainly the Illinois County Fair Association, Department of Agriculture and, quite frankly, an awful lot of county fair board members all over the state."

"And it's... you are representing to the Body that the Department of Agriculture now supports the Bill?"

"Perhaps our staff analysis is incorrect. It indicates that the Department is neutral, but I'm sure Representative Ropp has some influence in that Department. Madam Speaker, and Members of the Assembly, first of all, I'm chagrined as to how this Bill could come out of the Agriculture Committee and be placed on Short Debate when it has such a devastating effect on exposition centers across the state, as the Majority Leader had indicated. I'm also chagrined that at a time when we are talking about the Build Illinois Program and the Governor has set up a horse racing task force to talk about a dying industry, we now have a Amendment... amended Bill before us which is a subsidy for county fairs over and beyond what they are presently receiving. I'm sure those of you who are from major metropolitan areas and who last Session fought to make certain that your local civic centers, whether they be in Rosemont or McCormick Place or Rockford or Springfield, 41  STATE OF ILLINOIS 84th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 28th Legislative Day April 23, 1985 that you are going to take a close look at House Bill 555 and make your decision based on what is best for those civic centers in your home districts or in the districts adjacent to you. "Madam Speaker and Members of the General Assembly, as I recall last year eight million dollars went up to the Chicago area for planning on the... 1992 fair. There are a lot of us downstate here who are not going to be able to go to that fair every day or every time we turn around because we are going to have a lot of costs in addition to the admission charges. We go to our local county fairs and this is our option and that is where we want our money to go. If you can give eight million to a world's fair that we are not going to attend, I think you can give eight million to us downstate to attend our own fairs. There are some people who don't understand that we all aren't going to flock to metropolitan areas, and in answer to those people who have just recently spoken, I have a civic center in my district just as well as the rest of you, but I also have a county fair. We have been supporting our civic center for a long, long time. I think it's time that we looked to the rural communities for them to have some of the things they need. I think it's very ironic that we talk about a lot of civic centers in the State of Illinois, when, in fact, we want to save money and spend on civic centers when there hasn't been a single one of them that has stayed out of the red. So I think it's quite interesting how we are very much concerned about that. Let's point the finger to the thing that we are really attempting to do here in terms of spending dollars and making some priority assessments. You know, we spend a lot of money on social programs throughout the... part of our state, a lot of 4-H fairs, FFA fairs, county fairs are training grounds for young people, young people who, in fact, are busy with their hands creating projects, growing livestock, developing new kinds of crafts and so forth. And I can assure you that we spend very little money for these people. These are the kinds of people who, frankly, will not need money in their later years because they have been involved in doing something illegal, corrupt or indecent. These are good, honest young people. These are the kinds of people that we ought to be spending dollars for. If the small amount of money that we spend for these kinds of programs in our county fairs throughout the State of Illinois in comparison to what we spend in trying to prevent gang crime in other portions of the state... It's also an economic development for many of our counties. A lot of small towns have county fairs. It creates a center for a lot of activities both rural and urban.
