"Thank you, Madam Speaker. Ladies and Gentlemen of the House. This is an amendment to the Illinois Lobbying Act. Now the lobbyists think that it's some trick to get them in trouble. That's not what this is about at all. This is a Bill, an amendment, I should say, to the Lobbying Act, which seeks to find out how much it costs and how much society pays to make public policy. That's what this Bill is about. Some years ago I commissioned the legislative counsel to do a study to compare Illinois, with its loose lobbying Bill, with California and Washington. We found that in a relatively similar period California reported $49,000,000 in lobbying expenses. In the similar time we acknowledged about $38,000. $49,000,000 for them, $39,000 for us. The reason is because this Bill calls upon people who hire lobbyists to file and to make a clear explanation of how much they spent. Now, let's not kid ourselves. I'm a Representative here and I like to think that I'm kind of a gunner because I'm elected by 100,000 people or so, and I go home and they say to me as I walk down Oakton 5  STATE OF ILLINOIS 85th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 43rd Legislative Day May 11, 1987 Street, they say, "Hello, Representative, how you doing?', and then I come here and they say, 'Al, the Whip and Buggy Lobby says uh-uh to your Bill., and that's the end of it. So and So, the lobbyist says, 'Uh-uh", and that's the end of it. And that's for me and that's for you and that's for everybody here. So the truth of the matter is that they make public policy. Now I disclose my campaign contributions. This Bill provides, now there's two Amendments. I will tell you that. This Amendment is the tougher Amendment. Amendment 1 is the tougher Amendment. Amendment 2 is the easier Amendment. Amendment 1, which is this one, requires people who are lobbyists to keep accounts. To know how much is being spent on lobbying. To know what the expenses are on lobbying. To lay out, by the way, if you've gotten several thousand dollars to lobby, that's not a Ma and Pa little friendly operation. That's somebody who is really lobbying. To lay out, for example, if there is a threshold of so much money that is spent on a legislator. You know, its a crazy thing. We're the only people in the whole world, in the whole world, that people come and give us money and spend money on us and we're expected to ignore them. We're expected not to think that they're some quid pro quo. Now everybody here knows different than that. This is the time that we ought to speak out. Now what's going to happen here is, this kind of Bill as we look at say, well, we don't need it. Then we're going to have a scandal here in this state, in some state, in the Federal government, and there's going to be 118 Cosponsors to some Bill like this. I want to let you get in on the early sale, on the early action. This Bill has another aspect. Now, when I came here when Stephen Douglas was in Illinois Politics then, and I think Lincoln was running for the Senate, they had one person that would 6  STATE OF ILLINOIS 85th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 43rd Legislative Day May 11, 1987 come out here from some agency of state government. One person, that's all. And maybe he would say...he'd be here for a budget, you know. I sit up there in that Chair sometimes and it looks like the mob scene from Quo_Vadis. There's hundreds of people from government agencies here on the floor of this House. I think we ought to know how much they spend, is spent, for them to lobby. How much public money do we spend to lobby you guys. I think that is something we ought to know. Now Mr. Ropp, the Gentleman from McLean, he says, "Why do we want to know all that information?" Well, maybe knowledge is power. Maybe that's worthwhile. Is there somebody on the floor of this House that thinks that those tobacco companies, which ever side you're on on the smoking issue, those tobacco companies judge whether public spirited citizens want to discuss cancer and smoking here. Or maybe you think General Motors just had a just sort of an interest in highway safety and dropped down a couple years ago when we were doing the seat belts. Don't you want to know that? Don't you want to know how much Chrysler and General Motors paid for that? The Gentleman from McLean says, why, he doesn't care about that. I think we should care a great deal about how much it costs to make public policy in this state. If there is any Bill that talks about the ethics of the legislature and government, it is this one. We sat here in this room and the Governor of Illinois said, "One of the issues we're going to address this year is ethics." Now I haven't seen a lot of Bills coming by my desk dealing with ethics. But this is a chance, this is an opportunity to do that. No one is interested in hurting the lobbyists. We just want to know what it costs in America, what it costs in our society, to have government lobbyists and to have the public make public policy. May 11, 1987 "The Gentleman has moved for the adoption of Amendment #1 to House Bill 178, and on that question the Gentleman from McLean, Representative Ropp."

"Thank you, Madam Speaker. Ladies and Gentlemen of the House. It has been my intent for the last couple of years to provide an opportunity for incoming legislators, as well as those who have been around for some time, to become better acquainted with the some 600+ lobbyists that we have in the State of Illinois. I have attempted to address the situation as did the State of California, when they, in fact, had lobbyists pay a small fee of some $10, as I am proposing in this legislation, so that we, in fact, can publish a booklet, through the Secretary of State's Office, and determine by visual picture, as well as their name, who everyone is that is serving as lobbyists in the Illinois General Assembly. And I am saying that I think it is a very good idea. The situation is, however, that the individual that is attempting to address this by amending my Bill, a Bill that he has been trying to get on for a number of years, that has failed every year since he has attempted to introduce it, I think deserves some concern on behalf of this Body to allow a Bill to be presented in the manner that the chief Sponsor wants. The Sponsor of this Amendment is saying that he wants to determine, to determine how much power, how much power and authority is given through the lobbyists and the influence that they have in this Body. Ladies and Gentlemen of this Body, I am telling you that I am questioning whether or not, who's going to use this so-called power that is being determined through this Amendment. Will it be potentially the Speaker of the Illinois House? Will it be the Sponsor of this Amendment, who, I have been told, rarely receives any money from the lobbyists because of his concerns for their good 8  STATE OF ILLINOIS 85th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 43rd Legislative Day May 11, 1987 favor. I guess I'm asking you, as Members of this good Body, to not support this Amendment so that I, in fact, as well as other legislators, can determine who is a lobbyist and how we can identify them with a picture. It is a very simple Bill and I am saying that if you want what the Sponsor of this Amendment wants so badly, then you support his Bill when he introduces it, for if you support it now, you're not going to get what he wants, I can assure you. I welcome your support to not support this Amendment and I would ask for a Roll Call vote."

"Madam Speaker, I wonder if the Sponsor would give us a little more than very beautiful platitudes on what's in all his righteousness, and tell us what's in his 16 page Amendment. I'm sure it must have some specifics. I don't think its written in such flowery terms as he described it."

"Representative Greiman, Representative Ewing asks that you..."

"Sure. Sure. I'll be glad to. First off, it requires, makes some definitions of who are lobbyists and what's legislative action. And by the way, it also raises it up to non-representative situations where a lobbyist is lobbying at the Executive Level, as well. We think of lobbying as only as lobbying here, but if it is lobbying for the, for the General...at a higher level, in the Executive, it covers that lobbying as well. And that's a new twist. It requires that if they get $1,000 or more semi-annually, that would be $2,000 a year, then they have to register. Okay. It expands, as I said, lobbying to include, for those people who have to report, those government agencies. It also requires that people who hire 9  STATE OF ILLINOIS 85th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 43rd Legislative Day May 11, 1987 lobbyists over a particular amount have to do that. And it requires that gifts of over $300, of over, I think its $300 or $500, in a semi-annual period, have to be reported. My God, don't we believe that if somebody gives a legislator $500 bucks we ought to say something, it ought to be someplace? I think we should. It provides a method of enforcement. Right now we have very questionable enforcement methods of the present Lobbying Bill. This allows it to be enforced in a sensible way, on a state-wide basis through the Attorney General."

"Madam Speaker, Ladies and Gentlemen of the House. I appreciate the answer. I think it serves the point that I want to make. This Amendment was a Bill. That Bill, I guess, didn't get out of Committee. I don't know what happened to it. But we have a very elaborate committee structure in this House, in fact, it's SO elaborate it's difficult to keep up with it, but that's why we have the committee structure. This Bill, or this Amendment becomes the Bill, is SO complicated, SO involved and SO comprehensive that if the Committee, the Democratic controlled Committee didn't let it out, why should we, as thinking people, add it to another Member's 3i11. I suggest that Representative Ropp is absolutely right when he suggests the right vote on this is a 'No' vote. And if it is such a good idea. if it's such a good Bill, why doesn't that Sponsor take it back and try and run it through the Committee again."

"Thank you, Madam Speaker, Ladies and Gentlemen of the House. In regards to the last speakers point, that's a very interesting point. I noticed, when I came in this 10  STATE OF ILLINOIS 85th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 43rd Legislative Day May 11, 1987 evening, on the top of my desk was an Amendment sponsored by Representative Daniels containing some airport regulation language which did not get out of committee either. I trust that the Gentleman from Livingston will rise in opposition to that Amendment when the time comes to consider it. In any event, we will, we will see. The point I want to make with respect to this particular Amendment, however, Ladies and Gentlemen, is simply this. Consider your own legislative agenda, and then consider how many Bills you drafted yourself. How many Bills were given to you to introduce by lobbyists. How many Bills have you introduced at somebody else's request? You know, when the size of the House of Representatives was cut from 177 to 118, the number of Bills filed actually increased. And you know why the number of Bills filed increased, instead of decreased. That's because most of the Bills that we consider originate with some interest group or some lobbyist. So lobbyist are actually, in some ways, if you look at it that way, more important to the legislative process, perhaps, than legislators themselves. I think it's only appropriate that we have legislation like this on the books if we, as legislators, are required to file economic disclosure statements, I think it is only fair that lobbyists have to file disclosure statements as well."

"Thank you, Madam Speaker. I am the Minority Spokesman on the Committee in which this Bill was heard. It was heard once and died badly. The Sponsor then amended it and it died again, and by his own admission he has run this every year for three or four years, and every year this Bill dies. Lobbyists, presently, fill out a great deal of information. Anybody that's interested can go see that, just as they can go see your records. This is a very far reaching Bill. It digs into state agencies as well as lobbying. They already provide a great deal of information. This is a matter of, as the Sponsor said himself, of having the power to know how much money it took to pass the Seat Belt Law. Well, let's say it took $53,000. Does that matter if it was $53,000 or $62,000? No, it's the knowledge of knowing it and the power that gives you and how this power will be used is very questionable and I encourage you to let this Bill die, this Amendment die, and leave Representative Ropp's very fine Bill to run on its own merit. The Bill died twice. Let's have it, the Amendment die here on the Floor."

"The Gentleman from Cook, Representative Cullerton, on the Amendment."

"Yes, very briefly, Madam Speaker and Ladies and Gentlemen of the House. I recently looked at the Illinois Lobbying Act that we have on the books. In one respect its very, very tough. There's a, it's a Class III Felony, a Class III Felony, if you are a lobbyist and you do not register with the Secretary of State's Office. And the definition of lobbying is very broad. If you in any way attempt to influence someone in their vote, you must be 12  STATE OF ILLINOIS 85th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 43rd Legislative Day May 11, 1987 registered. If you don't, it's a Class III Felony. And, of course, the main reason for that is so that we, as legislators, have an accurate list of who the lobbyists are and their mailing list SO we can invite them to our fundraisers. After we make it a Class III Felony for them to not tell us how to get in touch with them to invite us to our fundraisers, it's a joke. This Amendment, if you don't like this one, the least you can do is vote for the next one. We have nothing at all, nothing at all, comparable to the very tight system that we have as legislators having to report our income. The same thing should be true with regard to the lobbyists. So if you don't like this Amendment, you're going to have to vote for the second one. It's a very important vote, I think, for, for your district, because I think people in your district, when they see how you vote on this, are going to want to know why you voted against it."

"Representative, let me give you an example, and you tell me if the reports would have to be made. If the UAW were giving funds to candidates for office, would the source of the money and the identification of the recipient be required?"

"If they were giving it for lobbying, or for political contributions?"

"For election. This is election...this is lobbying. It's not election. Because that's a campaign contribution, but lobbying is something else. explaining where he got it. What you would have is not him You would have General Motors, or the UAW, filing a file, filing a report, saying, "This is how much we spent for lobbying." So that you would have the people who hire lobbyists also filing reports. I hope that was clear enough."

"Well, it was clear that my example was not going to be covered under the Bill. What would constitute lobbying? Is that defined in the Bill?"

"Yes."

"And is it defined to exclude political contributions, or is it your interpretation or intent that it exclude political contributions?"

"But we cover that in the Campaign Disclosure Act. These are two separate Acts, and they're separate now. We would not, this would not include campaign disclosures. It has nothing to do with campaign disclosures. Nothing at all."

"Is the act of lobbying which would trigger the applicability of this Act, is it defined in the Bill?"

"Yes."

"And will you explain briefly what that definition is?"

"It is communicating directly, or soliciting others to communicate, with any official in the Legislative or Executive Branch, for the purpose of influencing legislative or administrative action. That's in the Bill. It's been construed in California and Washington courts."

"Yes, it would not include, it would absolutely not include them. We have a Campaign Disclosure Act which expressly and explicitly includes and describes political contributions."

"Now, how does this differ from Amendment #2. I heard Mr. Cullerton speak, but I...didn't understand."

"Alright. Yes. Amendment #1 regulates the lobbyists, state government and the people who pay lobbyists. Amendment #2 regulates, takes out the lobbying, and in other words, it leaves how we regulate lobbyists the same as it is now. So it just adds people who have to report. In this case, Amendment #2 would add governmental agencies and people who hire lobbyists. Those, too. And it leaves how we regulate lobbyists themselves in the same way. Because, and it was, by the way, in response to the major complaints of the lobbyists, I tried to respond to their complaints."

"Now, would the UAW, assuming the activities it asks someone to engage in, would it have to file that report you're referring to the employer of the lobbyist?"

"I think it would, yes. I think it would, absolutely."

"Okay."

"I hope it would. I sure hope it would."

"Okay. So that, for example, that union, if it had a lobbyist, would have to identify the amounts paid him?"

"Absolutely. Absolutely. What they had to pay lobbyists. Absolutely."

"Okay, and is that all it would have to do, just state the amount paid the lobbyist or would it have to identify

"Have to identify lobbying, what it pays to lobby."

"And what does that include?"

Let me see if I can quickly get it. It requires persons other than lobbyists, in Section 10 of the Act, to file statements relating to people it employed or money spent or payments of $250 or more a month to influence legislative or administrative action. That's what it basically does."

"Okay. Would the activities of, for example a person on contract to the Minority Leader or the Speaker, or to the General Assembly, I suppose, if he were later engaged in activities trying to pass laws for the authorization or issuance of bonds, would that person be considered a lobbyist. Would he have to file a lobbyist report. Do you have some sort of conflict of interest in here?"

Amendment #2 incorporates Amendment #1, which was adopted in Committee, and that makes some additional provisions. It provides that the Secretary of State is required to issue confidential plates to all public safety and law enforcement personnel, and the confidential plate is to be defined as a registration plate issued to a motor vehicle in accordance with the vehicle code, but cannot be traced through the Secretary of State's records. It provides that vehicles issued the confidential plates, those aforementioned people in the public safety and law enforcement personnel, shall pay a one time fee of $8.00, and this fee is consistent with the fee paid by vehicles owned and operated by counties, township and municipal corporations. So the main thrust is that it will allow the plates to be obtained for $8.00, rather than have to pay the higher amount. It is consistent with the other vehicles owned by local government. Right before the Bill we just finished was House Bill 1146, and I think you recollect when you called that, I... my opinion was that it was an abuse of the process to have a fiscal note filed on that Bill, which only calls for publication of lists of state employee vacancies. There is no fiscal impact. and the rules, I just discovered, Rule 34, says that the fiscal note either has to be supplied or determined to be inapplicable, and I would like very much, Mr. Speaker, if you would call 1146 for the Parliamentarian to look at this and see whether or not a fiscal note is applicable in this case. I don't see any reason for games being played to impede the process and to abuse our rules, and I'd really like to have a determination by the Parliamentarian whether or not a fiscal note is applicable in this case."

This legislation attempts to bring about coordination by mandating it. To make it permissive, simply allows them to continue doing what they have been doing. So I would oppose Amendment #1."

"That's correct. If the... the Bill as originally presented merely had physical handicapped. The industry claimed that that term was too vague and too uncertain for their purposes. I agreed that I would define it within the House Bill itself, which had previously been before the Committee, and which had been approved. This, I think, satisfies all of their concerns and at the same time, provides completely for the purposes I had when I submitted the House Bill."
