Resolved by the House of Representative of the 86th General Assembly, the State of Illinois the Senate concurring 2 STATE OF ILLINOIS 86th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 16th Legislative Day March 27, 1989 herein. That there shall be submitted to the electors of the State for adoption or rejection of the General Election. Next, occurring at least 6 months after the adoption of this Resolution. A proposition to add Section 11 of Section 9 of the Illinois Constitution. The added Sections to read as follows: Article 9, Section 11, limitations on total of state taxes revenue state shared. Committed to local government prohibition of mandate of local programs without state funding. (a) There is hereby established a limit on the taxes imposed by the State for a fiscal year. The State should not impose taxes of any kind which together with all other revenues of the state shall exceed 8.5 percent. The personal income of Illinois for the latest known fiscal year, except as provided in subsection (b) of this Section. 'Personal income of Illinois' means the total income received by persons in Illinois for all sources as defined and officially reported by the United States Department of Commerce or it's Successor Agency. 'Revenues of State means' all public funds received by the state, but does not include public funds received from the federal government. Contributions to and earnings of the trust funds in the custody of the State Treasure. No expenses of State Government for the General Revenue or Common School Funds, shall be incurred for any fiscal year which exceeds in amount the revenue limited established by this Section. (b) For any fiscal year in the event that total revenues of the state exceed the revenue limit established, in subsection (a) of this Section this excess shall be transferred to the Budget Stabilization Fund in the State Treasury which is hereby created. Emergency expenditures from the Budget Stabilization Fund may be made only if all the following conditions are met: 1. The Bill is provided for the appropriation of funds for the emergency must be passed by two-thirds vote of the Members elected to each House. The emergency must be declared in accordance with these procedures, prior to incurring any of the expense which constitutes the specific emergency request. Income earned from the funds maintained in the Budget Stablization Fund shall accrue to the fund. For any fiscal year in the event which the amount in the Budget Stablization Fund, exceeds two percent of the revenue limit established by subsection (a) of this section. The General Assembly shall provide for distribution, of the excessive revenues in any of the following three methods. The distribution to the various State Pension Funds, established by law and proportion to the respective actuarial reserved deficiencies, of the several funds based on the benefits in effect at the time of the effective date of this Section. Funds distributed under this method, shall be used only to reduce the actuarial reserved deficiencies of the various State Pension Funds. The distribution of the retirement of outstanding general obligation bonds of the state. Funds distributed under the method, shall not be used to pay current principal or intrest charges, but shall only be used to retire outstanding general obligation bonds. In distribution to the form of the reducing or reabating the state taxes. The General Assembly shall provide by law for the implementation of the provisions of the this Section. The General Assembly shall by law provide for an executive or legislative agency and the State Government shall determined each year no later than February 1st, the revenues deposited in the General Revenue Fund received from state taxes. For any fiscal year that proportion of state expenditures, paid to all units of local government and school districts shall not be reduced below the proportion paid in fiscal year 1990. No new program or increase in the level of service under the existing program, shall be mandated by the General Assembly to units of local governments or school districts, unless the school appropriation has been enacted to pay the cost of the mandated programs or services. In the event of the substantial cost of such state mandated program or services, are not paid to unit of local government or the school districts, such mandated shall be avoided as to such unit or district. For the purpose of this section, General Revenue Fund means all moneys belonging to or for the use of the state, paid into the State Treasury and not belonging to any specific fund in the State Treasury, and to Common School Fund means money to or use of state paid into the State Treasury, and expended for financing public education through secondary level.
