This Amendment was filed yesterday, and it certainly...but let me just say that what the Amendment does, and this is a critical vote, it's a critical vote to senior citizens and blind people throughout the State of Illinois who by virtue of action taken by the Federal Government with the 1986 Tax Reform Act had taken from them the extra exemption that they previously enjoyed on their Illinois Income Taxes. When the Illinois General Assembly and the state adopted the Illinois Income Tax Law in '69. We said at that time, that our residents would be entitled to the same number of exemptions that they were given on the federal returns. That was for senior citizens and blind people we're given, people over 65 and blind we're given an additional exemption, and they've enjoyed that exemption throughout the entire time that we have had in Illinois Income Tax. Because the Feds took their action in '86 they reform the way in which these taxpayers pay their federal liability by reducing the number of exemptions they got, but conpensating them through a higher standard deduction, as a result at the federal level, these 16 STATE OF ILLINOIS 86th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 24th Legislative Day April 12, 1989 taxpayers were treated pretty well. They came out pretty well on the Federal Tax changes. But, in the State of Illinois, they were hit with a tax, because of those changes, because our standard deduction didn't change, and all that we ended up doing was taking from them one of their exemptions. Now the underlying Bill would say 'yes that's true,' but let's only give this to the circuit breaker eligible seniors. Well, I would submit to you that there are relatively few circuit breaker eligibles who even have a tax liability. So, that really this Bill without Amendment does very little, is flocked and does not really address the problem that came about because of the Federal Tax Reform Act. So, I know that there was no Legislator who came in with a Bill prior to the change of the Federal Law to take these exemptions away. All that this Amendment would do would be to restore these people to the position that they were in prior to the change in the Federal Tax Law. It's supported by the A.A.R.P., and by clear thinking and right thinking citizens throughout this land who simply want to restore to seniors and the blind, what was rightfully theirs to begin with, so I would urge your favorable consideration and would ask for Roll Call vote."

For those Members who are somewhat confused on this Bill, the Revenue Committee put out two Bills: House Bill 340 which is this one, that provides income tax relief for senior citizens who are qualified for the circuit breaker. Further down on page 4 is another Bill #490, which puts out a senior, which puts out the income tax break for all seniors. It was my intention to vote on both of these, but to provide both the Senate and the Governor an alternative in terms of funding, especially in the final day of the Session. House Bill 340, which is just the exempts or...applies only to those on the circuit breaker, would cost a little bit more than 9 million, under 10 million dollars. The other Bill would cost in excess of 30 million. I would prefer to keep my Bill clear, those who are interested in voting for this Amendment should just vote 'aye' on House Bill 490, because that has it incorporated, and I opposed Amendment, I would ask all of you to vote 'no' on Amendment #1."

"My understanding is that there are 42 members on the Committee. The rule says that it can be no more than 35. So, if this rule was not to be adopted, the Committee would have to be reduced...the Committee would have to be reduced by 7. I would suggest...or 8...it's obvious that what's going to happen if this rule doesn't pass is that 8 Republicans will have to be removed from the Committee, and I don't think that is fair to the Republicans to proceed in that fashion. No one who is opposed to this rules change is in at position because they believe that the subject of that Committee that is presumably going to have 42 members, is not important. As a matter of fact there is probably no more important issue that we need to address in this entire state than reform of the Chicago Public Schools. I submit to you however, Mr. Speaker that the numbers of persons dealing with an issue does not necessarily have any relationship to the importance of the issue or whether in fact the issue will be addressed well. There are two things I always think of when somebody wants to create this mammoth of group to study a very significant issue. The first is one that I am reminded of every Christmas. Every Christmas, I think gratefully that God so loved the world, that he did not send a Committee, then I think of the definition of a Committee. A Committee, Mr. Speaker is a group of the unfit, appointed by the unwilling, to do the unnecessary, and for that reason I am opposed to this rules change."

April 12, 1989 "Well, not exactly, our judge is doing it, but he had some doubts to whether or not he could if he was challenged and so he's doing it...he's asked me to do this for two reasons. One is to remove all ambiguity as to whether or not he has the right to do it as a Chief judge, and the other is to suggest to other circuits, that they might like to try the same thing."

"Yes, it is absolutely permissive, there is no requirements."
"It isn't a mandate, that they have to do it in every case where minor children are involved?"
"Well, it's only mandated providing the Chief Judge decides to do it in his district, but it is permissive, supposedly as Chief of the Circuit is concerned."
"Alright, one last question if you would, and I appreciate your kind answers. Would there be a cost involved in a circuit where the Chief Judge would mandate this? I assume there would be additional expense in the litigation. Would there not?"
"The cost is very negativable. The main thing that happens that there is some time spent by the parents of the small children, in having to attend classes, for a couple of hours. That's the main objection we've heard so far. And all those Judges testified before the Committee of all those people who have now came before the instructional classes by far the majority of them have said they got some good out of it. So it's been accepted by those who have been required to attend SO far.
