What we did on 541 in the Senate was put an Amendment on there which was unacceptable to the credit unions and the credit unions asked us to opt them out of the Bill. So this Conference Committee Report opts out the credit unions. It only involves banks and savings and loans. "Yes, this is the first time I ever knew that I needed a microphone, I thought I talked loud to start with. Only Andy McGann can out talk me. What the Bill does itself is offer to senior citizens' homes, places like Lady of the Snow's and people that are confined, the opportunity to have mobile banking come in and do check cashing, deposits and minimal amounts of bank services. It's a permissive thing and we're not sure the banks and the savings and loans will take advantage of it or that they will care to fool with it. So, we limited it to a few counties to keep from interfering with currency exchanges. Representative, if you recall in the Mental Health Committee, which you're a Member, the...Representative Ropp, had brought this issue to the floor...I mean, to the Committee in regards to reimbursement for the transfers that takes place in the different counties. The...we had passed that in House Bill 1508, the structured Committee Bill, we sent it to the Senate. The Department in conference with the Senate felt as though at this time they could not have that in their budget because it was an unknown amount. The Department opposed the issue all the way along the line. My feeling was that it was very credible to have because the counties should not be penalized for these transportation costs."

It is a Bill that amends the Drug Paraphernalia Control Act and the original legislation removed language that the Supreme Court claimed was vague and unconstitutional, so the Bill itself makes our drug paraphernalia law constitutional. The Amendment which we adopted in this House, 115 to 0, makes a criminal penalty for those who sell drug paraphernalia. It also increases the fine that they can be fined for selling drug paraphernalia. The technical Amendment...I'm sorry. It...the Amendment was somewhat too stringent. The Medical Society...the Illinois Medical Society felt that the language should be moderated and Conference Committee Report #1 reflects that moderation. The report as you can see in your analysis makes the following changes 26 STATE OF ILLINOIS 86th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 67th Legislative Day June 29, 1989 to the Bill: It changes the title and it provides that the Department of Nuclear Safety must, by rule or regulation, provide for the accreditation based on experience and skill for nurses, technicians and other assistants who have been employed in the field of administering radiation to human beings for at least 24 months prior to July 1, '89. It also says persons who have had such experience shall be accredited by the Department to perform specific radiation procedures without passing an examination or completing of any continuing education requirements when the Department receives written assurance from individuals licensed under the Medical Practice Act or the Podiatric Medical Practice Act. It changes the repeal date of the Radiation Protection Act from December 31, '93 to December 31, 1990 and as you can see the Illinois State Medical Society asked for this Conference Committee Report to attempt to force the Department of Nuclear Safety to adopt adequate accreditation standards. The Medical Society feels current standards are to strenuous...stringent I should say, and would like to see them relaxed where individuals licensed under the MPA or the PMPA could through assurances to the Department, provide the accreditation for individuals administering radiation under their supervision. And basically what this is, we talked about it once before, it's just impossible to get qualified...have people who are qualified under our present law. We're not graduating any of these therapists and therefor I'd be happy to answer any questions and ask for a favorable Roll Call."

House Bill 1571, the First Conference Committee Report on this House Bill is being presented to you from the Committee on Mental Health and it's worked with the Senate, and worked with the department, and has the full signatures of the Senators and the Representatives involved in the Conference Committee. And after meeting in person, we have come to an agreement that the department will study...shall conduct a study of alternative formulas for the distribution of grants-in-aids for community services, which are dispersed by the department. They will report back on May 1, 1990 to the General Assembly the results of its study. It'll include a description of the results obtained by using each of the alternative formulas, in terms of the amount of funds received by the various geographic areas and community service agencies in the state, and in an evaluation of the relative benefits of 32 STATE OF ILLINOIS 86th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 67th Legislative Day June 29, 1989 each alternative to existing services area...areas and to the provision of mental health and developmentally disability services. It's a feeling as though that we will go along and leave the Inspector General within the department for the present time receiving abuse...reports and acting thereon. The Auditor General shall conduct a program audit of the Office of Inspector General during these times and will report its findings to the General Assembly no later than May 1, 1990. And finally, the Section of the Inspector General will be repealed on January 19, 1991, and the General Assembly will decide the direction that we should take thereon. This has been worked out very well, by all the parties that I've previously mentioned, and it's a compliment to the Senators and Representatives that were involved. And I would ask for the adoption of First Conference Committee Report, House Bill 1571, with support from both sides of the aisle. Thank you."

And specifically the Section that calls upon the department to reevaluate the method by which they distribute grants-in-aid to community services. Some of you may remember that we discussed possible changes in the distribution formula on this floor last week. And I believe it was Representative DeJaegher, which shared with us some of the possible ramifications of new formulas. He indicated, I believe, that it would reduc substantially monies that would be available in Rock Island County and in Peoria County. He indicated that it might affect distribution to community agencies in the Chicago area by tens of millions of dollars. So it is with...with reluctance and with certainly respect for the Members of the Conference Committee, that I rise to express reservations about this. And would ask all the Members of the House to look carefully at this, because it may have potentially negative impact upon the distribution of grant-in-aid money for community services to their area of the state."

They came out with a formula in April of 1989, which they agreed in the Conference Committee that it was not in their projections workable. It would have cost a lot of areas tremendous dollars, especially in the City of Chicago. There's a feeling that we should follow the lines in having a study made, and only a study. It does not commit the department to take any action whatsoever before this study would come back to the General Assembly. And with the alternative formulas being offered at that time, the General Assembly will decide what way to go, if any way, or remain in the present, truly unstable approach to formula funding in...that's present in the department."

We in Rock Island have had our mental health facilities closed and centralized in Peoria. Our only alternative has been community hel...mental health. And from the original formula, Rock Island County would appear to lose about 500,000 dollars out of its community health program. I would ask the downstaters to consider that situation might exist there if this money is going to go to Chicago. And I really don't know what the department's program objectives are right now. And I would question what...what they're going to be next year after this report comes back. I would sure hope that my county with its only...only community mental health services would not lose a half a million dollars of services right now, that are way short of what they should be. So I would reluctantly stand in opposition to the Gentleman's Motion."

"Thank you, Mr. Speaker. I share the June 29, 1989 concerns of the previous speakers. You know, it's an old saying, if it ain't broke, don't fix it. And it seems like this is what we're trying to do. The Mental Health Department obviously is doing a fine job, but to try to base a study or as we saw the earlier attempts...basing it on population also, it seems to me it diverts some of the dollars just to a populous area rather than to a needy area. And certainly mental health of all things should be based on the needs of its citizens. So I too, share some of the concerns of the downstaters and some of us in Kane and McHenry Counties and other areas, that perhaps will be losing dollars that are so vitally needed. I think we should reject this Conference Committee Report, because I think we're not doing too bad a job as we are. Thank you."

"Thank you, Mr. Speaker, Ladies and Gentlemen of the House. There are two main issues addressed in this Report. And so far the debate has focused on only one of them. And in my opinion, the...the least important. However, before turning to the, what I consider to be the most urgent issues in House Bill 7...1571 in its present form, let me address the concerns that were raised. Let me just ask you a rhetorical question and reflect on it for a moment. Do we have an adequate mental health system in the State of Illinois? And I think most of you would have to conclude that it is not adequate. Do we have enough money being spent on community mental health programs in our respective areas? Many of you probably would conclude that we do not. Therefore, it's not hard to see why some Legislators might have concerns about the amount...the way the money is being allocated right now. And that's precisely why the issue arose in the first place. Not the department coming to us 36 67th Legislative Day STATE OF ILLINOIS 86th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE June 29, 1989 and saying we want to do this, but Legislators, like you and me, mainly in the Senate, who said, 'We think that our areas are getting a bum deal. We think we...we ought to look at this problem more carefully. Now, because of the same concerns that have been raised bef...in the floor debate so far, the conferees were very sensitive to the question of whether we were...would create the impression in this Report, that we were trying to put in a new funding formula, because we don't want to even create that impression. And so we...I think we went out of our way to try and write language, to make it clear, that we're only asking the department to...to take a look at some different ways of doing it. Not just one way, but several different ways. And then report back to us and let us make the decision. Maybe the decision is to stand pat and do nothing, but if not at least we will have several alternatives before us. And so for those of you who are concerned about what this might mean for your respective areas, let me try and reassure you that at the moment it doesn't mean a thing for your respective areas. We are simply directing the department to look into the matter. Now, as to the main body of the Report, the material...or the...the proposals contained in House Bill 1571 are the results of the Special Committee on Patient Care, which made numerous recommendations of ways in which we can improve the delivery of mental health services within our state operated facilities. The main difference between the House version and this version is that the Office of the Inspector General will remain within the Department of Mental Health, rather than being made an autonomous department. However, we will study the...the actions of that component of the Department of Mental Health through a program audit conducted by the Auditor General. And the 37 67th Legislative Day STATE OF ILLINOIS 86th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE June 29, 1989 statutes clearly provide and the Department of Mental Health in a letter dated today and signed by the General Council, indicate that their interpretation of the law, if this Bill passes, is that the Auditor General and his people would have full access to all records, including material that would otherwise be confidential pursuant to the Confidentiality Act. So that we will be able to get a... for the first time, a clear and comprehensive view of how abuse and neglect is being handled within the Department of Mental Health. So I rise in strong support of this measure. I hope people will not be deflected or sidetracked by some language that they...that in the Bill, that they're fearful of, because that language, I assure you, does nothing more than to direct the Department of Mental Health to do a study. And it will not in any way, result in a change of funding or delivery of services until the General Assembly says so. So I urge you to put your fears aside and focus on the positive aspects of this legislation and vote for this Conference Committee Report."

I've never known Representative McGann to not have a sense of fairness for all mental health concerns in the State of Illinois. And to that extent he has really crafted a piece of legislation here that addresses those concerns of everybody in this House. And I don't think any of us want to hurt any one geographical part of this state. This proposal does not do that. It is simply, as was stated earlier, a study that is to be conducted and those guidelines that they are to use are population served, and their needs, relative poverty, and geographical locations of those populations. Andy, when we talk about the subject of mental health, I don't believe that anybody is more concerned in this General Assembly than what you are. But I also have a concern and basically what we're discussing this evening is perhaps changing the funding level that is presently with us. That something has to be done to basically address ourselves in a better nature than what we have been for a period of years, pertaining to mental health facilities. Let me inform you and also Members of the General Assembly, it goes without saying that basically and oftentimes, the downstate Representatives are what you might say in the 'forgotonia area' of the State of Illinois. Very seldom, are adequate funding provided for downstate Representatives. But a case in point, in the last twelve years we've had three mental health facilities close in our area downstate. That's Dixon, East Moline and Galesburg. So you have to realize the fact that we as downstate Legislators are concerned with what's happening with mental health. And hopefully that...as these...this funding formula takes effect, that you will be completely cognizant of it, that you will address yourself to the serious concern that we in the downstate area have with mental health facilities. I had the pleasure this Session of sitting on the Mental Health Committee and as some of the previous speakers have acknowledged, we had some very interesting meetings and oftentimes, some very acrimonious debates. That was not because of the personalities involved, but rather because of the nature of the issue and different possibilities as to how we should solve some of the crisis in this field. All Members of that committee, I think, acknowledged that we had some very severe areas that had to be dealt with this Session, mental health, and unfortunately, we didn't yet and haven't yet come to solutions for all those. But I do believe that in House Bill 1571 we have begun to at least to try to embody within this Bill some of the key areas, in which we see problems that have to be dealt with. 1571 does not offer all the solutions, but it does, I believe, offer a beginning for an effort by this General Assembly to consciously try to solve the problems in the mental health field. Nothing's really more important this Session than that we try to deal with that issue. And I would ask because of that, that we all support 1571. Thank you."

And I think signals the first time that the low income consumers and the utilities have really sat down and had the opportunity to have an extended dialogue and I hope and expect in talking to various parties, they'll be...this will be the first step in a continued dialogue between them, between the different sides for the future. "Thank you, Mr. Speaker and Ladies and Gentlemen of the House. Just an additional note to what the other speakers have said on this Bill. I think one of the fine points of this legislation is that it makes this program available to all citizens in the State of Illinois. Those people who 46 STATE OF ILLINOIS 86th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 67th Legislative Day June 29, 1989 may be served by a rural electric cooperative now are eligible to receive some assistance. Those citizens who are served by a municipal electric utility or a municipal utility are also eligible, as well as those that are served by the public utilities in the state. And as a member of the Governor's task force on the Affordable...Residential Affordable Payment Program, I want to commend the people that worked on that...those task force... on that task force that represented some very divergent points of view when we first got together. We had an excellent moderator in Gretchen 'Monte' from Bloomington, who met with us and brought those points of view together in such a way that we could reach a compromise. And there was a tremendous amount of give and take on both sides of this program by the community action providers who, many of you know Bobbi Bennett, who's in the gallery at this time, who worked very hard to press her concerns with this issue. I think some of the utility companies that were also concerned that their interest would be protected in this and that their...the short fall would be taken care of, the issue of pre-planned arrearages has been addressed. And I think we've truly met the needs of the people in the State of Illinois to see that during the winter months of the year, people will be able to keep the heat on, stay warm in their homes and be able to live somewhat more comfortably without having to fear that their... their source of heat will be turned off during the winter months. I commend the people that worked very hard on this Bill and also commend the staff of both the House Republicans and Democrats and the staff of the Senate Republicans and Democrats who put in long hours and came up with a very creative program to deal with this need. And I would also add, as Representative Levin has said, that this is merely a first step, a first 47 67th Legislative Day STATE OF ILLINOIS 86th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE June 29, 1989 step at addressing a long term social need in the State of Illinois. House Bill (sic - Senate Bill) 1046, the Conference...First Conference Committee Report on House Bill (sic - Senate Bill) 1046 puts in the procision...provisions of House Bill 580. And when that Bill came out of the House, I think it had 114 votes. What happened is that there was an Amendment that was technically flawed in the Senate. They didn't handle it the way they needed to do, so we put it into Conference 48 STATE OF ILLINOIS 86th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 67th Legislative Day June 29, 1989 Committee Report. This is the same Bill that passed out of the House 114 to nothing. It's been signed by all the conferees. It lowers the caseload of the Department of Children and Family Services over a period of four years from where it is now, to 30 to 1. Be glad to answer any questions. Ask for your 'aye' vote."

"Thank you, Mr. Speaker. Ladies and Gentlemen, I regretfully rise in opposition to this because I see basically several things wrong. First of all, it is enormously expensive. If we assume a case load, does not vary at all, the first year out or next year this would cost us four million dollars. By the fifth year out this would be 42,600,000 extra dollars and that's if our case load stays even. If the case load rises, it would be more than that. I think it's very dangerous to be setting these caseloads at exactly thirty. What if the thirty-first case comes along, does that mean it won't be handled? Does a worker say, 'No, I won't handle that', the investigator, who only has twelve cases per month? Or the follow up, who only has thirty cases per month? Do they say, 'Whoops, I reached my limit, I'm not going to do that'. The union has been excellent in the past by recognizing employer's right to establish reasonable workload levels. If the cases are up, they all take a few more. If the cases are down, they take a few less. That has worked out very well. And by setting this limit, we're going to have cases perhaps that won't be covered. And if they are covered, and if our caseload stays exactly even, as I've described to you, by the fifth year this is 42,600,000 dollars more than we are spending right now. I think it would be wonderful if we could do this. It's certainly a goal to reach for. "Thank you, Mr. Speaker and Ladies and Gentlemen of the House. I rise in support of this Conference Committee Report on Senate Bill 1046. The previous speaker was throwing out what really amounts to red herrings. There is nothing in this legislation that implies hints, says or requires that if there's a thirty caseload limit, that the thirty-first case will go untaken care of. This simply states what the policy of the State of Illinois ought to be in setting the caseload limit, so that children are cared for. What is the sense of having caseworkers have a caseload that means, by definition, they are unable to deal with their patients, their... their customers, clients in the...in this area. You have to have a caseload that make sense so you can do a job for the children you're trying to indeed protect. And that's what this Conference Committee Report does. Its simply states what state policy ought be, that a...a worker ought not to have more than thirty cases that that individual is responsible for. This is long overdue. We've had this up here many times in the past. This is the time to finally pass it and to put some teeth into it."
