"Introduction and First Reading of Constitutional Amendments. House Joint Resolution Constitutional Amendment #13, offered by Representative Zickus. Resolved by the House of Representative of the 86th General Assembly of the State of Illinois. The Senate concurring herein that there shall be submitted to the elector of this state for adoption or rejection that the general election next occurring at least six months after the adoption of this Resolution a proposition. A proposition known as the Illinois Liberty Amendment. To amend Section I of Article IX of the Constitution of the State of Illinois to read as follows: Section I, state revenue power, (a) The General Assembly has the exclusive power to rise revenue by law except as limit by paragraph (c) of Section and otherwise 3 STATE OF ILLINOIS 86th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 69th Legislative Day October 4, 1989 provide in this Constitution the power of taxation shall not be surrendered, suspended or contracted away. Sub-section (b) The power of units of local government to impose taxes shall be limited by paragraph (c) of this Section and as otherwise provided in this Constitution. Paragraph (c), the people reserve to themselves the power to propose laws and to adopt or reject the same at the polls and independent of the General Assembly for purpose of eliminating the extent to which and the methods by which the General Assembly or units of local government may raise revenue. The people also reserve to themselves at the polls and independent of the General Assembly the power to reject any Act or part of any Act passed by the General Assembly for the purposes of raising revenue. The powers described in this paragraph shall be implemented through initiative as defined in paragraphs (d) and (e) of this Section. The initiative is the power of the electors to propose and pass statues and to reject same. An initiative measure may be proposed by a petition signed by a number of electors irrespective of geographical distribution throughout the state. Equal in number to or at lease four percent of the total votes casted for candidates Governor in the proceeding gubernatorial election. A petition shall contain the text of the propose statute and the date of the general election at which the proposed statute is to be submitted and the date. Shall have been signedby a petition elector of not more than twenty four months proceeding the general election and shall be filed with the Secretary of State at least six months before the general election. The procedure for determined the validity and sufficiency of a petition shall be provided by law.
