When this waso..when this Bill was up last the eagle-eyed staffers working with Representative Daniels and Representative Black discovered that there was an error in the section of the...of the Counties Code that we were amending. The underling Bill deals with the problem of people .dealing in slum property and not being findable when it comes to taxes. The intent of this Amendment was to put in the Bill the opportunity for the Cook County Recorder of Deeds to collect a fee for the filinq and we had inadvertently put that in the downstate county section so Amendment 3 clarifies what was our intent. They received p..l received many good suggestions and input back from them, and but I was unable to get it in form of an Amendment before it was passed out of Committee. So when went to the Legislative Reference Bureau, they suggested that I completely rewrite the Bill after the enacting clause. So that's what this Floor Amendment deals with.''

The purpose of my Floor Amendment today is to add such technical improvements to my Bill as first, one, making clear that the decedent had, had to the have the right to retain the power to revoke right up to the time of his death, two, making sure the scope of the Bill extended to intestate situations as well as in cases where the decedent left a will: accelerating future interests if the survivinq spouse elected to take a share under the instrument of transfer and excluding which the transfer which the decedent had received full money consideration, and lastly excluding from the Bill's operation certain joint property and insurance proceeds. It also would chanqe the effective date so it will apply only to transfers made after the effective date.'' Lang: ''Did you say earlier in response to some question that dealt somehow with joint tenancy property?o Persico: ''The part that deals with joint tenancy is only the part that the decedent left in the will, or into the estate, not what the surviving spouse or whomever that he set up a joint tenancy with. It only deals with that person's share, would be subject to the Lifetime Transfer of Property Act.'' Lang: 'We1l, don't understand how you can do that with joint tenancy property. That's the purpose of joint tenancy property to...to make, to have the property immediately go to the survivors without creditors or anybody else getting in the way. Many of the specialty crop buyers, in the State of Illinois, come to an agriculture community and contract with farmers to buy green beans, pumpkins and so forth . They may be fly-by-nighters, they may be legitimate, we don't know exactly how many there are out there, so, in order for the Department of Agriculture to :et a handle on how many specialty crop buyers there are, whether it be zucchinis or popcorn or so forth. What we are hoping to do is establish this Act which requires them to ,register with the Department of Agriculture. We charge them a $100 fee. Representative Mcpike.'' Mcpike: HThank you Mr. Speaker, Ladies and Gentlemen of the House. The Senate sent this Bill over last week. It was read a second time and held on Second Reading. The Senate added...bas two provisions that the Senate put in at the Govenor's request, and...one was for the WIC program, and the other is for the Department of Children and Family Services. The CFS moneys that's 10 million dollars for that and 29 million dollars for the WIC program. On to that, this Amendment will add a money for AFDC, Aid to the Aged, Blind, Disabled, General Assistance and Refugee Assistance that the Govenor has requested. For this fiscal year of 77,300,000. The Governor has requested al1 the items that I've just mentioned. In addition to that we are adding for FY92 a money for AFDC, Aid to the Aged , Blind and Disabled, General Assistance for AFDC and Refugee Assistance amounting to 942,700,000. This has been requested by the Governor, in his Public Aid budget that was introduced this year. In addition to this money that would, that I've just described, we've added l million dollars to the Department in order to process these checks. We have no idea if we're going to be Session in July, but if we are in Session in July there is no reason whatsoever why people on General Assistance..ol'm sorry, why people on...that are receiving these checks AFDC and the others I mentioned, why these people should not be receiving these checks if we end up in an argument over the budget. The purpose of this is to try to avoid what happened in 1985, when we were here until July 8th and there were no checks being sent out. We think its the proper thing to do. And we would like to have the tape reviewed because, in fact I'm not sure that House Bill 1588 even received enough votes to be reported out of committee. And so we'd like to have, as said it was not only myself but there were a number of other legislators in that committee, was the composting Bill that voted 'no'.
