The second part of Amendment #3 would restore funds for the Substance Abuse Advocacy Program for the recipients of General Assistance. Seem to me that those individuals that we'd like to see back in the job market and are prevented from doing so because of their substance abuse problems, ought to be aided by a small amount of money. We're only talking about 1.4 million dollars to help get those individuals back in the work force SO they're no longer draining state dollars by being on General Assistance. I would urge your support of Amendment #3 to Senate Bill 45."

The three major hospitals in the Peoria area in central Illinois, in cooperation with the Peoria School of Medicine, University of Illinois, is preparing to go into clinical research, with the three hospitals all involved, and they are looking for a grant from the state for $3,000,000 to match $6,000,000 which Congressman Michael is working on now with the Federal Government and, practically, has the money awarded to this area for this clinical research. Many pharmaceutical companies have been encouraged to contribute to this fund. Each one of the hospitals are (sic is) coming up with a million dollars each. With the federal grant of six million, and some way or another, with the state's contribution of three million, this legislation should probably have been in the DCCA budget, but with all the cuts in DCCA, what we would be looking at is, if the Capital Development Board does go into any type of bonding, if they would be purchasing bonds for buildings, this would be a state-owned building at the University of Illinois Peoria School Branch of Medicine, two point four million dollars would be very much awarded toward the amount of money they're expecting the state to kick into this program. "Thank you, Mr. Speaker. Ladies and Gentlemen of the House, if I can have your indulgence just for a few moments, I'll be as brief as I can but I need to explain to you what's going on. The Amendment #6 of Senate Bill 629 is now the real Coal Bill legislation that we intend to pass, in Senate Bill form. Most of you remember, just a few days ago, out of this House, we passed 2342 with 110 votes, and I speak on behalf of the coal miners in my area and, I think, throughout the state, that that vote was truly appreciated by the Members of this House. Since then, Representative Woolard, Deering, myself, Hannig, several, with the Coal Association, the United Mine Workers, the utility companies involved in this, with CUB, negotiated as the Bill went to the Senate. There were several items that I'm going to briefly outline that were incorporated in the legislation since it left the House, which did make it better in the eyes of everybody that (sic-who) was negotiating, including CUB; but at this particular point it is not agreed by CUB but it is by all the other parties that (sic-who) were involved in 44 STATE OF ILLINOIS 87th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 71st Legislative Day negotiations. June 24, 1991 When it went to the Senate, the Illinois Manufacturers' Association and the Industrial Energy Consumers had some serious questions about the review sections of the Bill, what was used and useful, as well as what CUB had questioned. I believe, as this process has moved on, I've been thoroughly convinced that there have been reasonable compromises that neither jeapordize the Bill, in the intent to save coal mining jobs and to use scrubbers which the Energy Department have (sic has) given us statistics showing it to be even 40% of a less cost than switching to low-sulfur coal and with the industrial user's concerns being addressed also with the construction work in progress, items that have been negotiated and extended in the amount of time for that item, sensitive item, to all of us, has brought this Bill to this particular juncture in point of debate, and I believe that after I outline the items for you on how the Bill did change after it left here, that we should not only get 110 votes, but 118. Number 1, it now prohibits the increase of pre-approved expenditures unless required by change in law and regulations. It extends the period to six months to review proposed increase and pre-approved expenditures. It prohibits the inclusion of non-governmental grants and a rate base. It permits the ICC and other parties to propose changes in compliance plans. It prohibits double charging of transportation costs included in the fuel adjustment clause. Essentially, that's the new items that were incorporated within the legislation as it left here and went to the Senate. The other two items, since it's come back over here in the House, to address the IMA and industrial consumer's concerns, were to, if the rates are increased, require allocation of scrubber costs among customers classes, the three classes: residential, 45 STATE OF ILLINOIS 87th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 71st Legislative Day June 24, 1991 commercial and industrial, in an equitable manner according to a fair apportionment of the cost. That was very much of the IMA'S concern. That has been addressed and agreed-to in this Bill and lastly, it insures that utilities are entitled to a rate base no more than the lesser of the ICC approved scrubber costs, or in the event that actual costs are lower than the approved cost, then, actual cost. There was some debate on whether the cap would have a chance to be raised, once the ICC approved that maximum cap. What this now says is that it cannot be raised above the cap, with exception of a mandate from the federal or the state level of governments. So, that is extra concerns and protections for the consumers, and with that, I will be glad to answer any questions I possibly can."

"Thank you, Mr. Speaker. I rise in opposition to Floor Amendment #6. In doing so, I need to state that a week ago or so, when this Amendment was before us on the House Bill, I supported the measure because, at that time, I understood it to be a win-win proposition; but, on reflection, I'm not sure it is a win-win proposition. The Amendment is offered on behalf of the coal miners in southern Illinois, and we're certainly concerned about keeping them employed and on the job, but this, in fact, may have the effect of throwing other workers in the State of Illinois out of work. I come from a district that's heavily dependent upon rail transportation, and a couple of the major Western railroads cross in my district. They're concerned because employees on the railroad may well be thrown out of work, while we put the Illinois coal miners to work, and I think another thing that we need to point out, as we vote on this Amendment today, is Amendment #6, for those people in Illinois Power territory, will mandate a rate increase, and 46 71st Legislative Day STATE OF ILLINOIS 87th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE June 24, 1991 I don't need to tell those of you who represent those areas of the state, that that's been a cause of concern for us as Legislators, and with this vote today you will effectively be mandating another rate increase for those who subscribe to utilities in your district. I realize a good deal of work has gone into this, and I certainly commend everyone who has...who has tried so hard to make this something that...that would be a...that everybody would be...would be really happy with; however, I am told that the Citizens Utility Board is now opposed to this proposal and that the principal reason for that is because the...affected utilities would probably have to have rate increases, as a result of this kind of a program. My constituents are served by Commonwealth Edison, and I think most of them believe their bills are already quite high enough; and, consequently, because I don't want to see the bills for Commonwealth Edison increased, I rise in reluctant opposition to Amendment #6."

We've heard some talk already about rate increases and the sad fact of...is that, regardless of what happens on this Bill, the Clean Air Act that the Congress had passed and that the...President has signed, will probably mean that there'll be rate increases for most utility companies in the State of Illinois. That's a given, unfortunately. So, in my opinion, the real question boils down to not whether we'll have rate increases or not, because unfortunately we're already looking at those, but whether we want to save coal mining jobs or whether we want to see those jobs shipped out to Western states, so vote 'yes'."

I understand the coal miner's plight in the State of Illinois. I think that the people that have worked on this measure have done a tremendous job in trying to get something low, but they are being taken by the utility companies who have gotten the best of both worlds, and what they are doing is, is not only are they charging us for the scrubbers full-price, they're recuperating additional profits not only in the sale of byproducts, but, also, in lower costs. I think this is a bad concept, and I would urge a 'no' vote."

Mr. Speaker and Members of the House, before we came into this Session this year, there was virtual legislative hysteria; I mean hysteria over a 15¢ per month increase for our...on telephone bills that would assist those who...who may be poor and need some assistance. There were at least a half a dozen Bills, a half a dozen Bills, to react to that problem. I don't see the same concern by Legislators over what could amount to millions of dollars of overcharge for ratepayers in Illinois. I think everyone of us here, everyone of us here and surely I, want to help the coal miners. All of us here want to help Illinois business. In my record and...in this Session and prior Sessions, there's been 100% for labor interest; however, above that is an interest of consumers, an interest of ratepayers. Even without any legislation at all, we are all aware that ratepayers are going to pay for the cost of scrubbers SO 50 STATE OF ILLINOIS 87th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 71st Legislative Day June 24, 1991 that we can burn Illinois coal, but the issue is should ratepayers pay more than reasonable cost? That is the issue that all of us must address. We should not hurry this Amendment that just came over our desks, and...I filed an Amendment moments ago that cannot be printed in time, and I know that, but neither should we vote on this Amendment hurriedly when it really doesn't do much more for consumers than the Bill that sailed out of here a couple of weeks ago. The fact is that, the Bill that came out of here would have allowed unlimited increases of cost for scrubbers. Now, the Sponsor of this Amendment said that's been changed because there's been put on a cap; there's only allowed one increase, but what he doesn't say is that increase can be of such a limit that it's virtually unlimited anyway. It can be one increase but can it be a very large increase? And so there really can be a...an unlimited, as far as the costs are concerned. Under the Amendment, utilities could recover from ratepayers, that's you and me, unreasonable costs. Under the existing law, which we were very careful to write when we wrote the Public Utilities Act, the ICC reviews expenditures on pollution control devices after, after construction is completed. Now, doesn't that make sense? That's after all the facts are in. This is the most reliable way to determine whether all the costs are reasonable or not, but, under this Amendment, the ICC would approve a guesstimate, a guesstimate of the reasonable costs of the scrubbers before construction begins. Utilities would then recover all costs, up to that guesstimate, or more...or more if they were...persuaded the ICC to increase the cap by that virtually unlimited amount. Even if the expenses were reasonable...were unreasonable, that to me doesn't help the ratepayers and the consumers. I...you know, I've heard 51 71st Legislative Day STATE OF ILLINOIS 87th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE June 24, 1991 some who say...you know, they come from downstate, some have said to me, 'Well, we don't want to pay the costs that...that Commonwealth Edison is going to...have to put on other ratepayers, with regards to this Chicago franchise.' What's the difference if...other ratepayers are going to have pay the costs of this $35 million grant, and it's a grant, outright grant, and that isn't by the ratepayers, that's by the taxpayers. That is everybody, everybody in the State of Illinois. Now, Mr. Speaker and Ladies and Gentlemen of the House, I know that before we adjourn that we are going to come to some resolution of this Bill. My personal feeling is that, under the existing law, that we ratepayers are going to pay for the cost of scrubbers; under the existing law, we should pay, but only the reasonable costs. Now, what the...what is happening, the public utilities are acting very much like some of these...baseball teams all across the country are doing. They are telling us, 'We're going to go out and get Western coal if you don't subsidize us.' That's what they're telling us, but the fact of the matter is they have not told you that they have already ordered the scrubbers, already ordered them, so they're putting a hoax, a hoax on you so they can get some money out of you. That's what they're doing. Now, before we act on this, I think we ought to hold it up. It's going to be in a Conference Committee; hold this up, but let's show them that we don't approve of them acting the way they do, until they can consider the concerns of consumers and the ratepayers. You can vote 'no' on this Amendment; if you do, you are helping ordinary ratepayers."

But the lost fact here that many of us have really seemed to overlook or not accept, I don't which it is, is that when the Federal Clean Air Act became law, it imposed upon the states to comply with the Clean Air Act and the sulfur emissions by 1995. These utility companies are forced to decide now whether to put additional scrubbers, to use our own home-based Illinois coal, or to switch to low-sulfur coal; and, if you would like to finance the schools in Wyoming and Montana, out West, you go right ahead because the federal law did not take into account whether or not rates would be increased. That is a fact. The issue is, right here in your vote, is the least cost of rates to our consumers, and that's you and me, also. I would not be standing here before you to vote for this Bill if I felt like it was not the very best scenario for, not only rates, but also to keep jobs in Illinois, because you have not seen unemployment rates spiral so until you see us fail to hold the jobs that are so sacred to the economy, not only of my area, of the whole State of Illinois. We work very hard to put provisions in this Bill that would establish a process where utilities could not, through persuasion, go to the ICC and say, 'We want to raise beyond the cap.' If you take Illinois coal out of...if you take Illinois coal out of the Loop, do you really think for one minute that the rates on Western coal and the rates that the shippers charge to get the Western coal to Illinois will stay the same? The social cost, if we don't pass this, the social cost, the unemployment insurance cost alone, are estimated to be $36 million and a permanent loss of 10,000 jobs. We talk about good government; we're talking about the cost per resident is much higher at LaSalle than at Quincy. The difference occurring in analysis indicates $4,000 per resident. According to what we're looking at here, this $400,000 or, it depends on which analysis you're looking at (one says $257ours shows $424) there'd be transferred from Quincy would result in eliminating 47 beds. We have 659 residents right now at the Quincy Veterans' Home. They've got 60 out of the 100 capacity, and they're wanting to go up by 15 beds. We're talking about eliminating 47 beds. It just doesn't make sense. It's not good government. You talk about a park project, here we're talking about a situation where we've got a much more efficient location, and we're being talked about taking a $400,000 hit and eliminating 47 beds so we can pick up 15 somewhere else in the Member's district. I would urge all the Members of the General Assembly to vote 'no' on this Amendment. I'd ask for a negative Roll Call."
