It expands the prompt payment Bill to include automatic payment for Senator Davidson's Amendment to interest penalties, optometrists, physical therapists, physicians, medical doctors and podiatrists. This is Senator Davidson's Amendment, and then Senate Amendment #2, Senator Cullerton's Amendment, adds new language to the Prompt Payment Act. "Well, let me follow that up with another question. I certainly agree with you. I don't think we have any disagreement about paying our bills on time, but isn't it a fact that the current group insurance, for example, for state employees, is underfunded by approximately $55 million?"
"I think you realize that we...we just passed a supplemental. Representative, when this Bill left the House, it had a 2% interest on it. It's coming back to us with 1.5% interest. Arguing against accepting this Amendment argues in favor (as I don't think you intend to do), for higher interest penalties against this administration when they make late payments on bills to vendors."

I just don't know how you can impose an interest penalty that, even under the revised estimates, would cost in excess...in the millions of dollars for Public Aid and close to $4 million for the Central Management Services program. It isn't going to guarantee that anybody gets paid on time when the money isn't there - hasn't been appropriated - to...to pay the bills."

"Well, Mr. Speaker, Ladies and Gentlemen of the House. To the Gentleman's Motion. This is...this is not (and in all due respect to the Sponsor), this is not a philosophical difference. In fact, Representative Curran and I probably agree on 'most every issue that would come before this House. I simply stand in opposition to his Motion, for the fact that our latest fiscal impact shows that this would cost the Department of Public Aid some $50 million at some point in the process. Not because they don't want to pay their bills on time. Not because they aren't willing to pay their bills on time, but because we have not appropriated sufficient dollars to pay those bills on time. So we're compounding an error that I think we make, not the department. We appropriate the dollars. We know, both of us know, all of us know, that the dollars appropriated, in fact the dollars that are available, are not sufficient pay their bills in a timely fashion. That's wrong. The prior speaker said that maybe it's our fault sometimes that we don't appropriate this money. Well, maybe that is true, but I don't think that two wrongs make a right. It's not right for the State of Illinois to say that simply because we didn't appropriate enough money to pay that bill, then now we don't have to pay any penalties or interest to the vendor after 30, or 60, or 90, or 120 days. You know, if a small businessman tells the State of Illinois that he doesn't quite have enough money in the bank to make his sales tax payment or his income tax payments, we don't give them any kind of special situations and say, 'Well, if you don't have the money we'll just let it ride for 90 days interest free.' The first thing that we do is we assess a penalty and an interest charge to that vendor, and he has to pay that in addition to whatever he owes us. So, this Bill is really only fair, and, as Representative Curran said, if we would get our financial house in order and quit overspending here in the State of Illinois, we could pay these bills on time and there'd be no fiscal impact. "Thank you, Mr. Speaker. I rise in opposition to this Concurrence Motion, and I've had occasion to debate this with the Sponsor and with other Members of the House on previous occasions. But, you know, a new thought has occurred to me in how to illustrate the point I wish to make about this, and what this is, is the Springfield version of deficit spending. Our Constitution, unlike Congress, does not allow us to spill red ink on the chamber of this floor like the blood of SO many taxpayers. So, instead, we promise benefits that we can't afford to pay. We pass the substantive legislation; we stand up; we take credit from the press; we send out a newsletter; we send out a press release saying that we've solved the problem. But we haven't addressed the problem, because this problem has nothing to do with any substantive issue. This problem has only to do with money. Only money. The reason we don't pay our bills now is because we don't have money, and if you think, at least in the short, term if that situation is going to change, you are mistaken. And if you think, in the short term at least, that that situation is going to improve, you are doubly mistaken. All you do is pile benefit on top of benefit on top of benefit. Now, I understand why this sells because there is a superficial appeal to it. If I had all the money in the world, I'd be willing to pay interest on late payments. "Thank you, Mr. Speaker. When we had money in the State of Illinois, we didn't pay our bills on time. Let's face it. The State of Illinois suffers from poor management principles. If we paid our bills on time, even when we had the money, what we would have done would be to lower the cost of the products, because, let's face it, every vendor raises the price of those products to us as a state because we cannot pay our bills on time, or we don't want to. We need management in this state that reflects what our businesses are expected to do. Let's look at another point on this. We are closing businesses in this state because we don't pay our bills on time. Ask your small pharmaceutical companies, ask many of the small businesses that cannot get the money from us that are closing. What happens then? We not only lose the tax revenue, we lose the employees; we increase the joblessness rate in this state; we destroy our economy. We are driving people out of work. We're closing businesses. If Illinois pays its bills on time, it generates more money. It's a simple, business practice. Voting against this says that you're for a higher interest rate. This lowers it to 1.5% per month. That's logical; that's realistic; that's the way to go. I urge your 'aye' vote. There's no excuse for any other vote."

For one thing, the prior speaker has forgotten that it has been a long, long time since there was a Republican Comptroller or Republican Treasurer, because, in fact, it's been a Democratic Comptroller and a Democratic Treasurer who hasn't been paying their bills on time. If that's what the problem is, you better look to within, but the real...the real story here is the contradiction, the big contradiction. Representative Hannig, not more than three weeks ago, told us why. Not only did he propose cutting by $45 million services to the developmentally disabled and the mentally ill in Illinois - those that cannot take care of themselves - he wants to cut $45 million out of their budget - and now comes back and says that really what we ought to do is...we're still gonna cut that $45 million to the developmentally disabled and the mentally ill, but now we're gonna come back and spend $56.7 million this year in interest charges because we're unable to pay our bills on time. Think about the contradiction. Think about how that's gonna look next November. Think about how that's gonna look on the campaign trail. It is totally contradictory; it is absolutely ridiculous to propose spending a another $56.7 million in interest charges, but yet we refuse to help those who cannot help themselves - the mentally ill and the developmentally disabled in Illinois. It is totally contradictory and ridiculous."

And I think perhaps we should maybe go back to a Conference and try to make it more reasonable. And let me give you a suggestion to the Sponsor. I think the interest rates are a little bit excessive under today's conditions, and I think probably a 1% penalty would be more in keeping with what we're doing. Secondly, I understand...and the business community who has talked to me and has sponsored and supported the prompt payment Bill that I have on the calendar now - have supported the concept that let's wait, maybe one or two years, and maybe make it effective January 1st, 19...say '94 when the state does get in a better financial condition, and then allow it to be made automatically so the businesses aren't cheated again. But what we're trying to do is have a reasonableness between the real life of our financial and fiscal problems of today, with our genuine, honest concern of trying to be fair with our businesses around Illinois. So, I would (almost and I have to almost reluctantly) concur that we should not agree with the Senate Amendment, so that we would have a chance, maybe, to reach that compromise between the Central Management and the Governor's Office, that could be real and honest and something that we would finally promise our business community, once and for all: that we will pay our bills promptly. The state has a chance to get out of its financial dilemma what we know we'll do. Because very honestly, Ladies and Gentlemen, the Governor would be forced to veto this Bill. I know it, and you know it, and I don't want that to happen. We've fought the battle too long. There's a difference between authorizing spending and having money in the bank to pay the bill. Here, about three weeks ago, many of the same people who are rising opposing this legislation supported spending about $125 million in additional GRF spending supplemental - for this year. There was no increased taxes, no increased revenue to pay for that, and it was a very easy vote because what they did was just simply increase the lapse period spending - spend out of next year's revenue. Now that is...fiscally irresponsible. What we're saying, with this Amendment, is if the Legislature, in conjunction with the Governor, want to continually...continue to act in a fiscally irresponsible manner, there will be a penalty. As bad as the Federal Government is, at least when they deficit spend, they pay interest. A little history. When this Bill passed the House with 70 votes, it had a 2% interest penalty payment on it. Another like Bill, with an interest penalty payment at, I think, was it 2%, passed the Senate in the last couple days with 55 votes. Every Republican Senator voting for it. Every single Member on the other side of the aisle who spoke against this voted yesterday to build the largest, the most expensive airport in the history of the planet. You guys are dreaming. One of the Members said that this is about money, and I agree this is about money. It's about who pays the interest rates. When the State of Illinois borrows, the State borrows for about 3 or 4%, but when your local businessman borrows, he borrows for 8, or 10, or 12% or more. We are mindlessly cheating our business people when the state becomes a deadbeat and doesn't pay its bills. I move to concur with this Amendment, 1 and 2, a Democrat and a Republican Amendment, because it is a good philosophical policy to follow, to pay your bills. That's what Illinois needs to do.
