Now, we already have billions of dollars in bonds outstanding in this state. I think this is a...at this particular point in time, very, very ill advised to allow the Treasurer's Office to sell bonds, no limit, to guarantee some Business Surety Bond Guarantee Act. While the underlying idea may be good, the prospect of having any of our state offices being able to add to our bonded indebtedness, without the authority of the General Assembly or the voters of the State of Illinois, is bad fiscal policy at this time. "Thank you, Mr. Speaker. The Conference Committee Report basically returns the Bill to the shape that it left the House originally. It restates the same subject matter covered by the underlying Bill. It amends the Hotel Operators Occupation Tax to define 'public' and makes the point that this only applies to facilities primarily devoted to employment training. And what we're talking about is the facility that Arthur Andersen uses for training, and that...I think this would also apply to Mc'Donald's and to one other facility. The organization owning the hotel...must be one in which the business activities of its members are coordinated internationally and its members share common policies, and so on; and it's basically restricting...restricting it to the two corporations who own conference centers used primarily as training facilities. I'd be happy to answer any questions, and ask for a favorable vote."

"Thank you, Mr. Speaker. I rise in opposition to House 23 STATE OF ILLINOIS 87th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 165th Legislative Day June 29, 1992 Bill 3594. It is my understanding that this creates an exemption in the hotel, motel tax for certain companies that operate convention centers. The Amendment states that: it is supposed to be declaratory of existing law. But that's not the position of the Department of Revenue. This is a tax break. And according to the information that I have, it's a tax break for some of the biggest companies in the state - for AT&T and McDonald's. I personally don't intend to vote for a tax break, (even though, perhaps, a modest break) in the hotel, motel tax for some of the biggest companies in the state, in the same year that we may be asked to vote a tax on residents of nursing homes and hospitals. Thank you very much."

"Thank you, Mr. Speaker, Ladies and Gentlemen of the House. I, too, would rise in opposition. I think the previous speaker has touched on one of the major points. What this particular Bill does, is to allow an exemption of hotel and motel taxes. I might point out that these...companies are also taking advantage of deductions on their income taxes as well, so, they're deducting the expense of the...the subsidiary companies are deducting an expense, and now they also want to be exempt from hotel, motel taxes. In addition, another provision in here which makes me a little uncomfortable and that is that what this Bill does is to say that we cannot audit back-taxes on these companies, that they may owe, so that there are millions of dollars that are presently under audit. What this Bill would do would be to shut that down and not allowthe Department of Revenue to collect some of these past-due taxes. So, I think that...while I know that the 24 STATE OF ILLINOIS 87th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 165th Legislative Day June 29, 1992 Sponsor is well-intended, and I recognize the difficulty facing the company, I thing this is a bad time to provide a large exemption for a couple of large companies and also remove the ability of the Department of Revenue to audit and collect these taxes. So, I would rise in opposition. If you're concerned about the tax policy, and being able to make sure that we have enough revenue to meet the budget needs of our state. I think you ought to look at this Bill and oppose it at this time. Thank you."

"Representative, in the Conference Committee Report, it was my impression that some of the offending language had been removed. Is... Could you elaborate on that?"
"Thank you. Yes. Basically, this Bill applies to two private training facilities in the State of Illinois. One is the AT&T facility and the other is the facility for Arthur Andersen consulting and accounting firm. Both of these firms...both of these facilities do not charge people, their employees who use them; they do not charge them room rent when, let's say, someone goes to AT&T to learn how to fix a new phone. There is no rent charge to the employee of AT&T at a training facility. So how can you charge a tax on someone going in, using a facility, for which there's no money paid? This Bill, contrary to the boogieman of a new tax, or whatever it is, or a tax loophole, this applies to two facilities. They're both training facilities, privately owned one's by AT&T, one's by Arthur Andersen and it's for their training of their 25 STATE OF ILLINOIS 87th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 165th Legislative Day June 29, 1992 employees. So, I think it's very interesting..."
