House Bill 216 simply raises the fine for anyone that (sic - who) illegally parks in handicapped parking places that are allocated in various businesses and public streets across the State of Illinois. The current fine is $50, and it raises the fine to $100. I suspect no one really gets aggravated more when they see individuals that (sic - who) are not handicapped, that do not have handicapped license plates, or that do not have the proper authorization from the Secretary of State's office for a handicapped parking permit that (sic - who) parks in facilities like this. It certainly takes the ability of handicapped people to park near businesses and doctors' offices so they have better access to reach and do their business, and I ask you for your support."

"No, the notice of lien is sent within 30 days after. The notice to the property owner that you're going to cut their weeds is sent prior. So, in other words, you notify them prior to cutting the weeds; then, if they don't take care of it themselves, the community is going to, and then we'll charge them for it. So they are noticed prior to the cutting, and they're liened within 30 days after."

"The practice now is that the property can be liened without the notice, and we simply feel that the property owner should be noticed (sic given notice) prior to the cutting of the weeds, so that when the lien comes, they've already been noticed that the lien will be there if the Bill is not paid."

"Right now, the community decides that this property owner has not cut his weeds or his grass. What you're saying to me is that the city goes in, cuts the weeds and then sends the homeowner the bill, correct?"

"Yes."

"If they don't pay that bill, in what period of time, then you put a lien on the property?"

"They notify the property owner prior to cutting the weeds...that the..."

"How much notice do they have to have?"

"I think in the Bill, it's 60 days prior."

"Well, I think that's kind of ridiculous. You know, being from an agriculture (sic agricultural) community, weeds will grow two, three, four feet, and if you require the city a 60-day notice before they can go on the property to cut those weeds, the place would be a jungle. I simply...object to this piece of legislation and would urge my colleagues to vote against it."

"Mr. Speaker, the 60-day notice is in the current law. That is not an addition."

"Representative Balthis, let's just make this clear: What is the current law, what is the Bill, and then what is the Amendment? It's my understanding the Bill was 30 days, and your Amendment deletes that provision, so notice is given after."

"The...the notice to the property owner that they're going to cut the weeds and bill them is still...is still the...current law, and it will remain the law if this is passed. The...the notice of lien has to come within 30 days after the service. Currently, that lien could come at any time. Well, this Bill was looked at as a way to help the property owners make sure that they were gonna know about this lien, whereas before that lien could come at any time. Now it has to come within 30 days after incurring the cost. So it is a...it is a benefit to the property owner, and not to the municipality."

He's the coach of the York Cross Country team. They won this year their fourth consecutive championship in cross country in high school, but that, in and of itself, is a remarkable accomplishment. This is a team that throughout the United States is recognized and called, I think, Coach, the 'The Long Green Line,' and represented by the young men that are here today, young men that will go on to West Point, as Dan Ruecking. "All of the other instruments that are now allowed for investments seem to be short-term... or readily marketable...vehicles. This does not sound like something one could sell quickly. Is that correct?"

"Well, a money market fund you can get your money out the next day; a short-term obligation of a corporation would be 180 days, it says in paragraph four. ...Savings accounts you can generally take out the same day, and U.S. Bonds and notes and agencies, can be sold on the secondary market within a day. I see a vast difference...in liquidity between those which are... the investments which are currently allowed and the investment that you are suggesting in this Bill. The fact is that the local governments, including the Municipal League and others, ...had this as their...their idea and their thought to provide them for a more diversified opportunity to invest and maximize on those investments, which helps...which helps their bottom line and their necessity to go...their property taxes. So, I think that in terms of the...the ability for them to...to look at investments, they would take...they would take the liquidity under consideration."

The one question that did arise last year was that they...there was some more safeguard that was needed by making certain that those investments were top quality investments. That seemed to be agreeable to everybody, that was the safeguard that that was necessary, because we do need to provide those municipalities the opportunity to be able to invest... to invest more wisely, and to maximize their benefits. "Thank you, Mr. Speaker and Members of the House. This is a Bill that arises out of a circuit court ruling in the City of Chicago, having to do with efforts to vote precincts dry. What happened in that situation, is that there were community members who tried to put that question at a referendum at the next general election, but, apparently, the opponents of the proposal, also filed a set of petitions with the clerk. That set of petitions did not meet statutory requirements, so the questions was not on the ballot, and the court ruled that the second set of petitions, (that filed by the proponents of the referendum) could not be considered; since the first set did not meet eligibility requirements. This Bill, which, again, only applies to the City of Chicago, clarifies that if a first set of petitions filed by whomever, does not meet the threshold's statutory requirement, that the clerk may look at a second set of petitions. The effort here is just to make sure that people in the local community, at the local level, have the opportunity we thought we gave them, to petition to put that question of voting a precinct dry on the ballot when they have adequate numbers of signatures to do so. I'd be happy to answer your questions and would appreciate your support for what we thought was already the law."

"This is the... It's my understanding that it's the City of Chicago, and this...this is the... The Bill amends the statute that governs how local communities can address the question of voting precincts wet or dry in the City of Chicago."

"This represents a change? I... Did the prior law apply to cities over a million, or over 3 million?"

"The population is the same in the Bill as is current law. There's no change. My Bill doesn't change that."

"Would it apply to any cities in Illinois, other than the City of Chicago?"

"I don't believe so, Representative, but remember, I'm not amending the population requirement; I'm not amending the population threshold. I'm only dealing with current law in respect to a clarification of the procedure."

"And...and how does this clarify the existing procedure?"

"It clarifies it in the way that I thought we all thought that it operated. That is, there is a procedure for gathering petitions from people, registered voters living within a precinct, to put a question on the ballot, and what happened in this particular instance in the County of Cook was that the opponents of the referendum question filed faulty petitions with the clerk before the community petitions were filed. The clerk threw out the first set of petitions and said current law did not permit consideration of the set of petitions that were filed by the proponents of the referendum in the community. UNFUNDED MANDATES. Whenever the Legislature or any state executive action requires a unit of local government to establish, expand or modify its activities in such a way as to necessitate additional expenditures of revenue by the unit of local government, the state shall provide funds to reimburse the unit of local government for the costs necessary to carry out the mandated requirement, except that the Legislature may, but need not, provide funds for the following mandates: Legislatively mandated requirements requested by the unit of local government affected. Legislatively mandated requirements enacted before the effective date of this Amendment or state executive actions initially implementing legislation enacted before the effective date of this Amendment. A mandated requirement that is not funded is not enforceable while not funded unless the bill implementing the mandated requirement passed with the concurrence of at least four-fifths of the members elected to each house of the General Assembly and specifically states that it is a nonreimbursable mandate under this subsection. (b) No real property taxpayer whose real property is farmland for purposes of real property taxation shall pay real property taxes in excess of 2% of the agricultural economic value of the property in any year. (2) In counties that classify real property for purposes of taxation: (a) No real property taxpayer shall pay real property taxes (i) in excess of 2% of the fair cash value of the property if the property is in the lowest class or (ii) in excess of 4% of the fair cash value of the property if the property is in the highest class of real property in any year.
