"Mr. Speaker, Members of the House. This makes four changes in the Bill. The first change exempts leaf burning conducted by public bodies when undertaken for the purpose of maintaining natural areas. The second part of the Amendment exempts all counties with a population of less than 180,000; as opposed to 100,000, therefore exempting Champaign, LaSalle, McLean, Macomb, Rock Island, Sangamon, and Tazewell Counties. Within such counties, it exempts towns with a population of less than 5,000; as opposed to 1,000. And the fourth part of it exempts all unincorporated areas. The original Bill set up a provision that allowed...a change in calculating the...the fish...take when you're in a fishing tournament, and we had to do this in order to...have the big bass tournaments in this state. We had to change the law slightly to allow during fishing tournaments that...that catch limit should not include...be included in your calculating your daily limit. It's very...noncontroversial Bill. Conservation... This is a Conservation supported Bill. The Amendment that Representative Giglio put on yesterday raised the amount of catch of perch in Lake Michigan to 300,000 pounds per licensed commercial fisherman. I think the Amendment had 90 votes. Actually it's not a controversial Bill with respect to the Department of Conservation, who opposes the Amendment, and they oppose it seriously because of the whole aquatic system in Lake Michigan. This increases from 69,000 pounds of perch per comer...per commercial fishing license to 300,000, which is a significant Amendment. It's a 500% increase, and in the event it gets the requisite number of votes, Mr. Speaker, I'm gonna request a verification."

Now Woodstock didn't use this financing, obviously, but the parallel is still there. Now I do not believe we should be giving special privileges, special interest rates, to primarily out of state commercial enterprises that come in and compete against our home grown...enterprises. What this does for a municipality, if someone has already taken all the training to be a paramedic, it's very expensive. And if they already have...their commission paramedic license and they go for...to apply for a job, they save a municipality a lot of money by not having to pay for that training, and this is why they think they should have a few additional credit points for the pretraining that they take and for the amount of savings that would save the municipality upon employment."

"Representative, it's my understanding that this Bill would then mandate any one coming into the State of Illinois. For example, my district borders Indiana. Anyone coming into Illinois from Indiana, whether it be for a visit to their children, or to shop, or whatever; if they had a infant child in the car, they would have to have that child in a child protection seat, correct?"

"Can you tell me, does Indiana have such a child restraint law?"

"I don't know, Representative, but for example; we generally require people who drive here from Indiana to comply with our motor vehicle laws. Yesterday, you may remember that this House passed legislation requiring people to turn their head lights on when their windshield wipers are going, and that or may not be the law in Indiana, but certainly we would anticipate that drivers from Indiana, coming from Indiana into Illinois would comply with that law."

"Okay. Thank you very much. Mr. Speaker and Ladies and Gentlemen of the House, to the Bill. I think the Representative makes a good point. I didn't vote for the windshield wiper law yesterday, for the very reason that I won't vote for this Bill. My district borders Indiana, there's hardly any place in my district that isn't less than 10 miles from the state of Indiana. I don't know what the State of Indiana law is, quite frankly, on child restraint, but I will say this; there are many of us who are bordering Iowa or Missouri or Indiana or Kentucky, 41  STATE OF ILLINOIS 88th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 59th Legislative Day May 13, 1993 where ever those states might be, Wisconsin, and I don't know what those laws are either. But, I can tell you this, my district relies heavily on those people who live in western Indiana to come and spend their Indiana dollars in my Illinois district. Now we're going to be ticketing these people if they fail to follow the various and the sundry motor vehicle laws of the State of Illinois, among them as the Representative said yesterday, the windshield wiper law, now the child restraint law. Well, very simply, what I think will happen is that they on longer will come to my district, which is a border district, and spend their money in Illinois. They'll travel to Terra Haute or to Indianapolis or LaFayette, any of the bigger cities within a short distance of where I live. We've already had problems with this when we had the truck inspection law. It didn't work, it caused all kinds of problems. We don't allow reciprocity. It's a good Bill, it's a good idea, I don't quarrel with the idea. But, when we begin to say to other people you can't come into our state unless you follow this law, and they only want to come over maybe 2 Saturdays a month to shop, they're not gonna buy a $80 or $90 child restraint seat, they just won't do it. So, they'll... My district will obviously feel the impact of this. There is no quarrel with the law, no quarrel with the idea. I do quarrel with the fact that those of us who live on border districts need to make trade as free and uninhibited as possible for those of us in eastern Illinois to survive, and those of us in western Indiana to survive, and it's for that reason I stand in opposition to the Bill, and I intend to vote 'no'."

It wouldn't be, obviously, because the parent wasn't there to give you the car seat."

So, I think the suggestion that we would do damage to our competitive nature by virtue of passing this Bill makes no sense at all. The point of this provision is to secure children, to make sure children are not victims of car accidents that result in substantial injury or even death, and I urge your support for this Bill."

This Amendment provides that certain counties with a population in excess of 500,000 but less than 600,000 may enter into an agreement with any public utility for the use of right-of-way for a public utility in excess of 60 feet in width to be used by the county for the construction and maintenance of bikeways. It also provides that the county may construct and maintain the bikeways with such funds as it would use for county highways. The language is permissive, it is not mandatory, and addresses concerns by the Municipal League, the Illinois Department of Conservation and the Illinois Farm Bureau that were brought up in committee.
