There has been many cases where there have been sewer collapses and as you know they endanger the public health, and all they are saying is that they would like to increase that amount from 25 to $50,000 in case...in cases of emergencies only."
"Well, Representative, what is the current procedure?"
"The current procedure is where it's up to $25,000, and over the past several years the cost of sewer construction has increased so dramatically that when you have a major sewer collapse that all they are asking is for the increase in the amount that they could spend without going through the open bidding process. And for your information, Lake County just was increased up to 100,000."

"Well, Representative, I think that we ought to take a long look at this...this Bill before we pass it because it does change significantly, and I...I would ask my Members on the Republican side of the aisle to pay attention to this, that it does dramatically effect the amount of...of contracts that can be issued. These are contracts. Let's face it. These are emergency contracts that can be issued without allowing the Board to make a judgement as to whether these are good or bad and I think that the question of emergency is an open question. We ought to tighten that particular provision to make sure that this provision is not used to skirt the law. So, I would think that maybe what we ought to do is send this Bill to conference and 13 STATE OF ILLINOIS 88th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 65th Legislative Day May 25, 1993 tighten up these provisions so that we can make sure that these provisions aren't used in a less than good manner. So, I would hope that we could oppose this Motion and make some changes in the language which is very wide open at this point and make sure that this isn't abused. We...we've spent a lot of time this session talking about how contracts are being issued and they're not being issued properly. And here we're saying, we're going to double the amount of contracts that can be issued by this authority without going to the Board of Trustees, and I don't know about you, but I think that before we do that we ought to make sure that this language is very, very tight and that it's going to work. So, I would hope that our side of the aisle and some of my colleagues on the Democrat side of the aisle might look at this Amendment and...and oppose it at this time. So, I would hope we would vote this Concurrence Motion down."

I think the Senate Amendment, Senate Amendment #2, I believe, let me make sure I'm right. No, Senate Amendment #1 incorporated three Bills, House Bill 2092, which creates the sunset rewrite of the Occupational Therapy Practice Act. Also, incorporates House Bill 61, which passed the House 112 to nothing. It amends the Professional Counselor and Clinical Professional Counselor Licensing Act. It changes the membership of that Act Advisory Board, 7 Member Advisory Board, to 2 licensed counselors, 3 licensed professional counselors, 1 full-time faculty member of an accredited college and 1 public member. That's different than current law. Senate Amendment #2 provides that veterinarians, which is the underlying Bill, privilege against disclosure is waived when the following laws are involved: communicable disease, cruelty to animals or public health and safety. So, now there are some people who want to remove that authority from the Board and yet we want to say here with your legislation it appears that if this money is used improperly by adults, local school council members, who may not even be there the following year. "Well, let's just say...you know, we have elections. We have elections of local school councils. Let's say there are four elected people sitting there, or whatever, and they make a decision to misuse those funds. The following year those people are not even sitting in those elected seats. There're new people in those seats. The only people remaining are those children, who have absolutely nothing to do with how those funds were being spent and yet it is the children who will suffer. To the Bill, Mr. Speaker. I would urge a 'no' vote on the concurrence of this Senate Amendment because it hurts the children who have absolutely no say on how those adults are spending the money. And when that legislation hits the floor that removes the Board as the authoritative one over those...how those funds should be spent, vote 'no'...vote 'yes', but on this Bill we should all vote 'no'. We should not punish children when adults are allowed to misuse the funds that are spent to educate children, and if adults choose to go on trip...trips it doesn't mean that the children the following year should suffer. Now, one of the concerns was that if this money was misused, it would be sent back to Chicago Board of Education, and so, we had to clarify an Amendment in the Senate. And basically, the Chapter 1 programs which are determined by the State Board of Education, there's only certain amount...certain things that you can do with it, like early childhood and reducing class size or not. The House Bill 2400 is a new provision in law, dealing with...particular times when the court might be looking at issues of child...abuse and neglect, and the underlying Bill said that the Department must assist the court in providing information, appearing and so forth. Sitting next to me is the lobbyist for the AFL-CIO, who I had to invite on the floor and while we're at ease because he would not come on the House floor if we were in session. And the only time I've ever seen him in here while we're in session is today. I knew when I first got here, I knew Stanley Johnson, who was president of the AFL-CIO. He was a carpenter. I knew a Bob Gibson, who was from Granite City, who took Stanley's place. He was a steelworker. And they were great labor leaders. I knew 'em well. I knew both of them very well, and they were great men. They're still... Stanley, I think, lives in Arizona, and Bob still lives in Illinois. Both great guys. I've never meet anyone like Rich Walsh in my life, and I doubt if...if Illinois will ever see a president of the AFL-CIO as capable as Rich Walsh. 54 STATE OF ILLINOIS 88th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 65th Legislative Day May 25, 1993 Most of you probably don't know that he's an attorney. Instead of practicing law his whole life, he dedicated his entire life to the labor movement. He believes in it heart and soul. He lives it. Labor is his life. It is...it is his soul. It is part of him. I've never meet a more competent individual, one of the smartest lawyers you can find. Knows everything about labor law. I've never seen a more dedicated individual in my life. If Rich was in Chicago at 9:00 at night and I told him to meet me at Cairo, Illinois the next morning at 8:00, he'd drive down. No question about it. And we'd meet for three hours and solve a problem, and then he'd...we'd go out to a local bar and have a Budweiser and then he'd drive back to Chicago. No matter what you asked of Rich Walsh, Saturday, Sunday, Christmas, whatever it is, you ask him to be there, he's there. He has fought... He has fought for 18 years for organized labor in this State. He has had me come on the House floor and make some of the goofiest, craziest arguments of my entire life. We would sit in my office and I would argue with him for hours, and finally, I would have to come out here when George Ryan was the Speaker and try to fight some Amendments, not because I believed in any of them, only because I had to defeat them so that Rich Walsh could go into negotiations and come out with something in negotiations. I had to argue on the House floor that when a guy got hurt playing softball for the team, slid into second base, I had to argue that was a work-comp injury. I had to argue on the House floor that when a lazy bum quit his job because he didn't want to work, I had to argue that he was entitled to unemployment insurance. Every goofy thing I can imagine that I've argued on this floor, I did it because I believed in this guy.
