The excess of any unencumbered funds shall be determined by subtracting from the annual unencumbered funds at the end of any fiscal year an amount which together with the latest estimated revenues is necessary to fund the ensuing fiscal year's General Revenue Fund budget, including the required estimated General Revenue Fund supplemental and automatic appropriations for that ensuing fiscal year less estimated reversions. Any remaining unencumbered funds that exceed the 5% limit of the Budget Reserve Account will be returned to the taxpayer in the form of tax returns, calculated by the appropriate State fiscal agency. EXPENDITURE LIMITATION. (a) A limit on the total amount of expenditures by Illinois in each fiscal year is established. (b) The annual State expenditures shall not exceed the total expenditures for the prior fiscal year, except for annual percentage changes in the cost of living and population. The General Assembly shall by law provide a method for determining the percentage change in the cost of living and population, but in no case shall the percentage change in expenditures exceed the average percentage change in the State's per capita personal income over the prior 3 fiscal years. SECTION 2. DEFINITIONS. As used in this Article: "Personal income" means the total income received by residents of the State from all sources, including transfer payments as defined and officially reported by the United States Department of Commerce (or appropriate agency) for a 12-month period of time. "Cost of living" means the Consumer Price Index for the United States of America, or any comparable index, as computed by the Bureau of Labor Statistics or the Department of Commerce of the United States (or appropriate agency) for a 12-month period of time. "Population" means the number of people residing in the State, excluding armed forces stationed overseas, as determined by the United States Bureau of Census (or appropriate agency). "Expenditures" means the total amount of moneys appropriated by the State, except the following: (1) appropriations funded by moneys received from the federal government; (2) principal and interest on bonded indebtedness; (3) appropriations funded by unemployment and disability insurance funds; 13 7th Legislative Day STATE OF ILLINOIS 89TH GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE January 25, 1995 (4) appropriations funded by discretionary user charges to the extent that the charges do not exceed the cost of the goods or services and their purchase by the user is discretionary; (5) appropriations funded from permanent endowments, trust funds, or pension funds; (6) proceeds of gifts or bequests made for purposes specified by the donor; and (7) moneys appropriated for tax relief. "Fiscal year" means the annual State accounting period established by law. "Per capita expenditures" means the quotient derived from dividing expenditures of the State for a fiscal year by its population on the first day of that fiscal year. "Emergency" means an extraordinary event or occurrence that could not have been reasonably foreseen or prevented and that requires immediate expenditure to preserve the health, safety, and general welfare of the people. SECTION 3. BUDGET RESERVE FUND. Any excess of State revenues over expenditures at the end of a fiscal year shall be transferred to a Budget Reserve Fund. The Budget Reserve Fund shall not exceed 5% of the total expenditures of the current fiscal year. Appropriations from the Budget Reserve Fund may be made only upon the total depletion of all other available funds in the event of State emergencies such as natural disasters, budget shortfalls, and other unforeseen circumstances. Appropriations from the Fund can only occur upon the concurrence of two-thirds of the members elected to each house. Income earned on the Budget Reserve Fund shall accrue to the Fund. SECTION 4. EXCESS REVENUE. For any fiscal year, the excess of revenues over expenditures, except as provided in Section 3, shall be refunded pro rata based on the annual Illinois income tax returns. The General Assembly shall reduce State tax rates for the next tax year to reflect the excess of revenues over 14 STATE OF ILLINOIS 89TH GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 7th Legislative Day January 25, 1995 expenditures except as provided by Section 3. SECTION 5. EMERGENCY. The limitation imposed by Section 1 may be exceeded upon the exhaustion of the Budget Reserve Fund and upon declaration of an emergency by the Governor and the concurrence of two-thirds of the members elected to each house. The General Assembly, by law, shall set forth the amount of the cost of the emergency and the method by which it shall be defrayed. The limitation may be exceeded only for the year or years in which the emergency is declared. In no event shall emergency expenditures, as expressed in Section 3, be included in the computation of the limitation imposed by Section 1 for any other year. SECTION 6. MANDATED AND SHIFTED COSTS. The State shall not impose upon any unit of local government any part of the total costs of new programs or services, or increases in existing programs or services, unless a specific appropriation is made sufficient to pay the unit of local government for that purpose. The proportion of State revenue paid to all units of local government, taken as a group, shall not be reduced below that proportion in effect at the adoption of this Article. When costs are transferred from one unit of government to another unit of government, either by law or court order, the limitation imposed by Section 1 shall be adjusted and transferred accordingly so that total costs are not increased as a result of the transfer. SECTION 7. SEVERABILITY. If any expenditure category, or revenue source, shall, by a court of competent jurisdiction in a final order, be adjudged exempt from this Article, the process of computing the expenditure limitation shall be adjusted accordingly and remaining provisions shall be in full force and effect. SECTION 8. IMPLEMENTATION. SECTION 9. LOCAL TAX LIMITATION. (a) Units of local government are prohibited from levying any tax not in existence upon adoption of this Article and from increasing the rates of taxes existing upon adoption of this Article without the approval at referendum of a majority of the voters of that unit of local government. This Section does not apply to taxes imposed for the repayment of principal and interest or other indebtedness or for the payment of assessments or contract obligations in anticipation of which bonds are issued. (b) The General Assembly may impose an expenditure limitation upon units of local government not inconsistent with the provisions of this Article.
