"Thank you, Mr. Speaker. Ladies and Gentlemen of the House, I would move to concur with Senate Amendment #1. Senate Amendment #1 would amend House Bill 1462 and would amend the Illinois Commercial Transportation Law in response to the federal deregulation of intrastate trucking. I might point out this Amendment is the result of many months of legislative hearings and meetings involving representatives of the trucking industry, the Household Goods Movers Industry, the Illinois Commerce Commission, and Members of the General Assembly. The agreed provisions of this Amendment set forth the operations of the Transportation Division of the Illinois Commerce trucking. bring the Commission in wake of the deregulation of Essentially, what this Amendment does is to Illinois Commercial Transportation Law into compliance with federal law. Many aspects of the trucking regulation, with the exception of Household Goods Movers, were deregulated, effective January 1st, 1995. There are a number of provisions in the Bill. All of these provisions are agreed. I recognize there may be some questions. I'd be happy to respond to those questions and would appreciate your #1." support of the Concurrence Motion on Senate Amendment

"He indicates he will." "Representative Kubik, I'm familiar with this piece of legislation and since this deregulation of the trucking industry took place, we're now downsizing the ICC. Is that correct?"

"How many personnel do we have yet in the agency and the trucking division, now, to handle the household goods carriers part of the legislation which is not deleted?"

Speaker Daniels

"Representative Kubik."

"Representative, I don't have that answer. I would point out to you that what the Bill does do is to ask the ICC to generate rules for the regulation of the household goods industry. My assumption would be that once those rules have been promulgated, a understanding of how many individuals will be necessary would probably be better met at that time."

"Thank you, Mr. Speaker. It's my understanding, Representative Kubik, that we may have to clean up the statutes and the rules, simply because we're deregulating so many portions of what the Commerce Commission did for the trucking industry in general. I'm not sure we have to promulgate new rules because I think some of the same rules that applied to the household movers portion of the regulation will probably still be in place. "Yes, Representative Hartke, that is my understanding."

"One of the main provisions of the regulation of the ICC, if I recall correctly, was the requirement of insurance for truckers across the State of Illinois. Are we now saying, with this Conference Committee, that truckers no longer are going to have to provide proof of insurance to cover their liability in case things happen? Before, that was part of the permit requirement before you got an ICC permit. Truckers had to provide proof of insurance. Now when we delete that, are we still requiring that and who is going to handle that paperwork per se to check to make sure that these individuals, although they will not be required to have a permit, are we eliminating their necessity for insurance as well?"

"Representative Kubik."

"Representative Hartke, my understanding is that the Bill will set into statute the Commission's current practices which would allow for open entry into the trucking business to filing of application, a filing fee, and proof of insurance. So there would still be a process that they would have to file an application, have a fee, and then a proof of insurance. Now the Commission, as I understand it, still retains the authority to revoke a license of carriers who are in flagrant violation of Illinois law."

"Representative Kubik, I think you missed the point. What about all those truckers that no longer are required to get an ICC permit? We did require them, when they received their permit, to also have proof of insurance. Now, I don't think that we're going to eliminate that proof of insurance. My question is, who is going to handle that paperwork? Is that now going to be put over to the Secretary of State's office or the Department of Transportation? Who is going to check to make sure that the..."

"Who is going to provide the necessary documentation that this insurance is carried by those truckers who are licensed in Illinois, not permitted, but have truck license?"

"Representative Hartke, Representative Hartke, it is my understanding that the ICC will still do that. But I'm going to ask the staffer to check on that to make sure and I will elaborate on that before we close. But my understanding is that the ICC will still handle that paperwork."

"Thank you, Mr. Speaker. Representative Kubik, it's my understanding that there is a fee increase in Senate Amendment #1. Could you please explain to the Members, particularly on this side of of the aisle, what the fee increase is for, how much the fee increase is set for in the Amendment?"

Speaker Ryder

"Representative Kubik."

Kubik

"Representative, you are probably much more knowledgeable in this area than I, but my understanding is that because of the deregulation in the federal trucking law, that the ICC is no longer going to do as much regulating as they currently do. However, one area that they will be very active in regulating is the area of household goods transportation. And the federal law says that they should be very active in that area. What I have been told by the ICC is that is an area that they haven't regulated with any great degree at this point in time and so the fee of $25 was a very minimal fee. They would ask that it be increased to $50, SO that they could better get the resources to regulate this particular area of the trucking industry. I might point out that this proposal is agreed to by the household goods transportation people as well. So they've signed on to this proposal knowing that there is a slight increase. There is an increase in their fee and that increase, Representative, for the record, would be from $25 to $50."

"Thank you, Representative Kubik. I didn't...I missed one part of that, Jack, and that was the fee will increase from $25 to $50, if I under...and the fee will increase. Now, could you please explain who will be assessed this increased fee. You talk about a certain group. "Representative, the individuals or the company that would pay for the fee increase would be household goods movers and as I stated earlier, these are the people who would be regulated by the ICC at this point in time. So those are the individuals that would be assessed the fee increase."

"Representative Kubik, when you talk about household goods movers, what would that entail? Are you talking about those people who would transport furniture, retail goods, those types of goods, Jack?"

"Representative Kubik." move "Yes, they would be people who would move furniture, us in and out of our districts if need be, depending on the situation, but they would be household movers who would primarily be known as furniture movers."

"Were you Granberg: concluded, Representative? Representative Granberg." "Jack, when you talk about those are large entities, or those are intrastate because that's the only people we can assess these fees on, I would assume. But would this also cover any small carriers that are located or doing business in Illinois?"

"My understanding, Representative, is that this Bill would also reduce the fee on general commodities carriers who are not transporting household goods. That fee would go from $6 to $5. They are called general commodities carriers, but these are people who are not in the furniture moving business. "Thank you, Mr. Speaker. Representative Kubik, when you talk about lowering the fee on general commodities transporters, you said the current fee is $6 and with the concurrence of the Amendment, that would be lowered by $1 to $5. Does that equate the amount of revenue that would be increased or that would be offset by the increase for the retail movers from $25 to $50? Is it basically revenue neutral or how would that...what would be the impact of that?"

"Representative, I'm sorry. Could you please restate the question?"

"Please give the debate your attention. I don't wish to constantly remind you or to interrupt with loud noise from the podium. If you'll kindly give the speakers your attention, they can hear each other and we can hear them. Representative Granberg, I think you need to repeat a question."

"Thank you, Mr. Speaker. Representative Kubik, you indicated that the fee on general commodities transporters will be lowered from the current $6 to $5. "Representative, it's my understanding that they are two different industries. So, obviously, one would experience a reduction and the other would experience an increase."

"But I assume, Jack, that they would be approximately the same. Because I would think the revenue raised would be used by the Commerce Commission for these duties. So I didn't know if it's an additional revenue raiser for the Commerce Commission or if it, in fact, it's revenue neutral and that was agreed to by both of those groups. Could you give me some insight on that?"

Speaker Ryder

"Representative Kubik."

"Representative, I don't know whether it's revenue neutral or not. That's the answer to your first question. The answer to your second question is that the truckers, the trucking groups, all of the trucking groups are in agreement with this Bill. There is no opposition to the Bill. So, you know, my assumption is that they see this as a reasonable piece of legislation and the fees are not at issue here."

"Thank you, Representative. The trucking groups are all in agreement to this legislation. Is there anybody that is in opposition to the Amendment and are there groups that could be impacted, the smaller groups that would not have any or they had not contacted you or the Senate Member who sponsored the Amendment?"

I might point out that this Amendment is an Amendment that has been negotiated over a long period of time, so there would be ample opportunity for anyone who might be in opposition to raise that opposition and at this point, we have experienced no opposition to this Bill."

"Thank you, Representative Kubik. When you say the negotiations have taken place over a long period of time, the negotiations between the parties, I assume, those groups, the retailer haulers, the Commerce Commission. Are there any other people that were in those negotiations and was someone from this side of the aisle involved?"

"Representative Kubik."

"Representative, my understanding is that the negotiations included representatives of the trucking industry, household goods movers, and Illinois Commerce Commission, and Members of the General Assembly. Groups that are supporting this Bill include the Midwest Truckers, the Illinois Transportation Association, the Illinois Road Builders, and the Associated General Contractors of Illinois. "Is that all those groups are in support of this legislation."

"Thank you very much, Mr. Ryder... Mr. Speaker."

"It's my pleasure, Representative Hartke."

"I don't stand in opposition to this Bill. I just want to call the Members' attention to the magnitude of what we're trying to do here today. The ICC's somewhat deregulated the trucking industry, except for the household movers. The real question is how are we going to maintain the insurance for those truckers that are running up and down the roads, simply because we know that accidents do happen and we want them to be adequately covered? The ICC and their inspection and the things they did for trucks was good for the State of Illinois, but it's deregulated and, but we still want to make sure that those insurance companies maintain their insurance. I'm concerned about the loss in revenue because the biggest portion of that revenue was gained from the mass trucking industry as a whole. Now we're just taking one segment of that industry, and that's the household movers, and lowering the permit fee for them. This will mean a decrease in revenues collected by the agency, yet we're still going to have to do a big job, that is making sure that all these trucks are insured in the State of Illinois. I'm concerned about the cost that's going to be incurred and I might ask the Sponsor, is there any estimates on the revenues income that we will be receiving because of the number of trucking firms now that household movers, that will pay a decrease fee. That's one, and number two, what is it going to cost 13 STATE OF ILLINOIS 89TH GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 87th Legislative Day January 23, 1996 to insure that all of this insurance is registered in the State of Illinois? Who's going to pick up that additional cost?" then

"Representative, it is my understanding that we will no longer be regulating those individuals. So, while you're right that we will not be collecting those fees from them, we will also not be regulating them. We will be regulating the household mover industry and not the general trucking population."

"Representative, I fully understand that. We will not be regulating the trucking industry as a whole, only the household and furniture movers. "Thank you very much, Mr. Speaker. I think there will be some cost involved. I'm not sure how much and I'm in favor of what we're trying to do. But I want Members to be aware that I think we'll probably have to go to the well, the General Revenue Fund, to subsidize this thing because I think that costs are going to be greater than we anticipate. I agree in the downsizing. I agree with what we're doing. That's okay. Mr. Speaker, I would request that we have a Roll Call vote on this Concurrent Motion."
