A point was raised during the debate on the Rules which argued that if a statement was filed with the Clerk and a Member was named in that statement the Member named in the statement ought to have an opportunity to prepare a 7 STATE OF ILLINOIS 90TH GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 19th Legislative Day February 20, 1997 response before the entire document was made public. So this Amendment would provide that where a Member is identified in the statement they will have one Legislative day or three business days, whichever is shorter, after notification by the Clerk to file a response. #2) This Amendment would provide that Members must always be on the Floor when they are voting, which was a provision of the Rules of the last Session and which is also a Section of State Law. And lastly, this would provide that the Committee appointments are for the duration of the term. So three points, #1) Where a statement is filed and a Member is named they have an opportunity to respond before the original statement is made public, #2) Members must be on the Floor when they vote, #3) Appointments to Committee are for the duration of the term. I move for the adoption of the Resolution."

But I have some questions on that process, because the Clerk has the responsibility of notification in this matter. Your Rules are silent as to the method of notification. Is there a reason, excuse me, is it your intention that the cover sheet would also contain the Statement at the time it's delivered to the Legislator that is mentioned?"

You and I philosophically differ about this Rule itself. My simple concern is the mechanical part of showing to the Legislator that their name has been mentioned, how it has been mentioned, and I'm wondering if, because I didn't have an opportunity to hear, if the Statement of the proposing Legislator will be attached to the cover sheet that you describe that is delivered to the mentioned Legislator."

"Ok. That is good, I think that is an improvement. The Clerk, under your proposal then delivers that to the office of the Legislator in order to start the clock running. Is that my understanding, or your understanding?"

"I apologize for the series of questions. I intend to support your Rule, your modifications, because they are making a certain circumstance about which I complained, somewhat better. I still have the philosophical problems with the concept of Member Statements and I thank you for the explanation. As I think of, or perhaps as practiced, will see, perhaps we may have some additional suggestions on how to make it work. A point was raised during the debate on the Rules which argued that if a statement was filed with the Clerk and a Member was named in that statement the Member named in the statement ought to have an opportunity to prepare a response before the entire document was made public. So this Amendment would provide that where a Member is 27 STATE OF ILLINOIS 90TH GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 19th Legislative Day February 20, 1997 identified in the statement they will have one Legislative day or three business days, whichever is shorter, after notification by the Clerk to file a response. #2) This Amendment would provide that Members must always be on the Floor when they are voting, which was a provision of the Rules of the last Session and which is also a Section of State Law. But I have some questions on that process, because the Clerk has the responsibility of notification in this matter. Your Rules are silent as to the method of notification. I would have preferred, I suppose for the Clerk to personally hand that document to a Legislator. Rather than delivering to the office. Your Statement is silent as to the method of delivery that you just mentioned. I do acknowledge the cover sheet as a means of communication, I understand that. Is there a reason, excuse me, is it your intention that the cover sheet would also contain the Statement at the time it's delivered to the Legislator that is mentioned?"

My simple concern is the mechanical part of showing to the Legislator that their name has been mentioned, how it has been mentioned, and I'm wondering if, because I didn't have an opportunity to hear, if the Statement of the proposing Legislator will be attached to the cover sheet that you describe that is delivered to the mentioned Legislator."

I still have the philosophical problems with the concept of Member Statements and I thank you for the explanation. As I think of, or perhaps as practice will see, perhaps we may have some additional suggestions on how to make it work. Right now we're simply attempting to suggest your response to a limitation on debate to allow Members to put in Statements I think would be unnecessary if we did not have, originally, that limitation on debate.
