House Bill 3990 is an initiative that came from Lake County that will address all road maintenance related problems in the state as it refers to townships that were platted before January 1, 1959 and counties that are under township organization. Basically, there is an unincorporated area in Lake County, as many of you might have similar problems, where there are private roads, the roads are not going to conform to township standards. There are no ways to be able to improve these roads currently. This Bill provides for a special service area to be created in a relationship that will occur between the county and townships to go ahead and improve the roads. I'd be happy to answer any questions."

If they do, they do."

"Representative, there is an item on the analysis that always gets people shook up. And that is that there is a back-door tax referendum in the underlying Bill. And while that may be an accurate portrayal in some respects, there is nothing in this Bill that would obligate all of the taxpayers of Lake County to improve a road in a subdivision that wasn't platted. Isn't that correct?" Moore, A.: "That's correct, Representative."
"In fact, the only people that would pay the tax would be located in a specific area, it could be an acre of ground, it could be a subdivision by name. And more than 50% of the people who reside in that special service area would have to agree to be taxed. Isn't that correct?" Moore, A.: "Yes, that's correct. They really want this."
"So, in my experience on the county board and you often had this with water districts, these are people who in an area not served or whatever the reason the developer didn't plat the subdivision, the initial road has gone to, literally, decay and ruin. The people in the area are not asking the county taxpayers to come in and fix their road. They know it's a private road. You can't do that. What they are asking is for the authority to allow themselves to pay a tax so that then the road commissioner or the county highway superintendent can come in and fix the road at their expense, correct?" Moore, A.: "That's absolutely right."
"So, there's no expense if I don't live in the subdivision. I'm not going to pay any increase in property taxes so that the subdivision in question can upgrade a 22 STATE OF ILLINOIS 91ST GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 95th Legislative Day February 16, 2000 road that wasn't platted properly." Moore, A.: "That's right."
"And is there any provision in the Bill for a default? Let's say I do the work, the county bids out the work, the road is done, they're happy with the road, but then suddenly six or seven homeowners say, 'Well, we don't want the special district to be here forever. So, now we no longer support this special district.' There's nothing to prevent those people from abolishing the special district, correct?" Moore, A.: "That's correct. There are provisions to abolish it once the work is completed."
"And the road in question then does not revert to county ownership, correct?" Moore, A.: "That's correct."
"So if they want it repaired again, then the only recourse is to go back and reformulate their special service district. In other words, these are neighbors banding together for an improvement that they are paying for, not the general taxpayers of the county. Correct?" Moore, A.: "Yes, Representative."
"All right. Thank you. I... that was a very forthright answer. Mr. Speaker and Ladies and Gentlemen of the House, to the Bill."

"This is a way that people, and I wish county and local governments didn't get into this, but they do. And I say get into this because they have no subdivision ordinance or they don't enforce it and so a subdivision is built, maybe there are 100 homes, the road is never accepted by any governmental entity because it wasn't built to the standards of the time. There is no way under existing law 23 STATE OF ILLINOIS 91ST GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 95th Legislative Day February 16, 2000 that any governmental body can go in and fix the road. The governmental body is... has no maintenance responsibility for the road. It was never platted properly so it is not a public road. So all they're doing, and this is not an unusual situation there are many areas of the state that have special taxing areas where the property owners within that area agree to have a tax levied on them to either do a water distribution system or in this case a road. It puts no burden on the other taxpayers in the county or the affected area. It is a reasonable way I think to address some problems that you have that otherwise no one is responsible for. And if you're willing to tax yourselves in a contiguous, relatively small area for the improvement, good heavens, you should certainly have the right to do that, especially when it doesn't impact me or anyone who doesn't live in the special taxing district. I think it's a creative way to address some problems. And I don't think it should be portrayed as some kind of a sneaky way to get a road tax increase for the entire township or the entire county. It does not do that. I stand in support of the Representative's Bill."

"Thank you, Mr. Speaker, Ladies and Gentlemen of the House. This, of course, is one of the great privileges and honors that I have in my role as the Republican Leader of the House to recognize some outstanding young men, perhaps some of the best of the best, not only in this state, but recognized by Harrier Magazine as the #1 cross country team in the country. These young men established themselves in Peoria on November 6th by winning the Illinois State Championship and what I believe to be standing before you, right now, the best cross country team in the history of the State of Illinois. I was there, I watched them. I watched Don Sage, our championship runner, come up the hill leading the pack, #1, finishing as a State Champion. Followed by the York Dukes in a pack, established themselves... 'What is it Coach, six... ' Six all-Staters, the first time in the history of Illinois to have six all-Staters in one team. We're a proud community, we're a very happy community today. Our Superintendent of Schools, Joe Morris, is here, Joe. Our principal of York Community High School is here, Linda Yonki. And we have with us, this is also Representative Biggins' and Representative Durkin's district, representing Elmhurst. We have with us our coach, Coach Charlie Curns, who is the assistant coach 27 STATE OF ILLINOIS 91ST GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 95th Legislative Day February 16, 2000 to the legendary Joe Newton, who unfortunately, had an operation on Monday and could not come down, it was unexpected. And I said, you know, Monday? I thought this guy knew how to work through pain. And I said to the Co... I said to the boys, I said, 'You gotta go back there and tell this guy how to work himself through a little pain.' And then I said, 'All right. The coach isn't here, we wanted to honor him, too. He's a legendary coach, former Olympic Coach, and known throughout the country today in the cross country area and in track. And it's unfortunate he's (sic-not) here, he just has to win again next year so we can do this again.' Ladies and Gentlemen, if you'll give me just a short moment, this is such a special opportunity. We're joined by the parents of these young men, are up in the gallery, if you'll say hello to them please and recognize the parents. Mr. Speaker, it is a little unusual, but I'd like to ask with your permission, Sir, for the assistant coach to introduce these young men to you. And then, of course, we want to make sure you recognize some of the managers of the team and other team members in the back because some of these people are going to carry us to our next State Championship, which will be our 21st. So coach, can you just take a moment and let me just let you know this is highly unusual, but since this is an unusual team, we'll ask if you will introduce the boys to the House."

Coach Curns: "Thank you very much, Representative Daniels. We are very grateful to be here this past year. I don't know how many people really like to run. It seems to be a love or hate type of thing. And as I look around I see some smiles, so maybe there's some people out here who cannot 28 STATE OF ILLINOIS 91ST GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 95th Legislative Day February 16, 2000 stand running. These fellows, this past year, running in rain, and in the cold, in the morning before school, all those things to help them be successful this year. And it paid off. And the success starts with our first athlete, but it doesn't stop there. Our first athlete is Don Sage, he finished 1st in the State Championship this year. Don Sage is right here. In the National Championships for high school athletes, Donald finished 2nd, there was only one athlete in the whole country this year better than he. So he had an outstanding season. Our next athlete finished 5th in the State Championship, his name is Adam Palumbo. Finishing right behind him in 6th place is Peter Cioni. And we have great athletes on this team, but we also have great students. Donald is going to be attending Stanford in the fall and this next athlete, Peter Cioni, who finished 6th, he will be either at Yale or Princeton. Peter. Finishing in 8th place, helping us to be even more excited about next year and perhaps coming back again with Mr. Newton, is a Junior and his name is Adam Roche. Finishing just a little bit behind him in 12th place is another Junior, of which as I said earlier makes us very excited for next year, his name is Peter Stasiulis. Finishing 24th and a Senior, his name is John Janulis, and his performance helped us to be the greatest team ever in the State of Illinois with having six athletes earn all-State honors. John Janulis. Our next fellow was, his name is Jay McGrane, he is a Junior will come back next year. And in this race of the State Championships there are 20... or 224 athletes competing and he finished 73rd. And in comparison to his teammates, whoa, what happened. But that's still an outstanding performance and he'll be back next year to try to be all-State. Jay McGrane. We also take eight athletes every year, as alternates, to experience what it's like to go through a State Championship, so that when their turn comes, as Juniors and Seniors, they are able to handle the pressure and perform as outstandingly as these guys did right here.
