House Bill 155 expands the maximum years of continuous service from 10 years to 14 years on the Structural Engineering Board of the Department of Professional Regulation. Under the present limitation of 10 years, a person being appointed to the Board filling an unexpired five-year term would be limited to reappointment for only one additional five-year term. And increasing it to the 14 years would allow a person to be appointed to a second term. And I know of no opposition."

Right now, we have some procedures in place to forfeit certain equipment relating to child pornography and child houses of prostitution. This Bill simply adds computers to that list of forfeitures. I'll be happy to entertain any questions."

"Thank you again, Mr. Speaker and Ladies and Gentlemen of the House. This is a Bill that would allow the Attorney General to convene the statewide grand jury in certain cases of Internet sex offenses. Basically, what happens if there's an Internet sex crime in Kane County and the subject is communicating with an individual down in Sangamon County, the order of who or which State's Attorney would deal with the case. This would help alleviate some of those discussions, if it so desired. I'll be happy to entertain questions."

"Will the Sponsor yield?"

"Representative, currently, what are the subject matter that you can have a statewide grand jury, and how does this expand it?"

Schmitz

"Right now, the existing law is for a limited number of sex offenses and for drug offenses."

Hoffman

"Such as?"

Schmitz

"This would make it for any type of sex offense listed, I believe Chapter 11."

Hoffman

"I'm sorry, I couldn't hear you."

Schmitz

"Ditto."

Hoffman

"The question was, how does this expand the current statewide grand jury statute?"

Schmitz

"This would not just limit this Bill to just sex crimes 6 STATE OF ILLINOIS 92ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 11th Legislative Day February 15, 2001 against children it would be any sex crime described in Article II of the Criminal Code."

"But, is... I guess what I'm asking is it's... what I'm trying to figure out is how this is going to affect... normally the way we do things here in the state is we do things on a local basis and we prosecute locally with local State's Attorneys and have local grand juries. And I was here when we provided for, in certain instances, statewide grand juries. And the kind of the reason that we did that was because they wasn't limited to... these type of offenses weren't necessarily limited to county lines. And so, in the case of drug trafficking, things like that, we said you can have a statewide grand jury. What I'm trying to do is figure out the nexus, why are we saying all sex related crimes now will be allowed for the statewide grand jury?"

Schmitz

"Representative Hoffman, that's a great question and I hope to have a great answer for you. But, this does allow... this follows along those same instances. Internet sex crimes don't just happen in one county, so they do... they do travel statewide."

Hoffman

"Well, I guess what I'm saying is... is I understand the idea you're saying that because it's over the Internet. These are limited to sex crimes over the Internet, is that right?"

Schmitz

"Yes."

Hoffman

"And so, are you saying that because it is over the Internet, therefore, it's not really necessarily in every county boundary? Is that..."

Schmitz

"That's correct."

Hoffman

"Is that why you think it's..."

Schmitz

"It's not limited to Sangamon County. You could have 7 STATE OF ILLINOIS 92ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 11th Legislative Day February 15, 2001 communications going county to county. And again, this is not it has to be a statewide grand jury. They can petition the court to convene the statewide grand jury, and a judge does have to sign that order."

Hoffman

"Well, I guess what I'm asking is why aren't we... Generally, I don't know that I disagree. But, I don't... my concern is, I don't want to step and begin to take away the purview of local prosecutors and try and develop, to be quite frank with you, a fiefdom that the state is looking over their shoulder when they are elected officials, independently elected, and should be able to make that determination as to whether or not to convene grand juries. So, my point to you is, if we're going to say sex crimes, why don't we talk about all Internet crimes? Why don't we expand it that way or why don't we look at the issue in a greater light, so that we could begin to address Internet crimes, generally. And I mean... So, to me, that makes a little bit more sense than to just continually whittle away at the rights of local prosecutors."

"Well, the State's Attorney Association didn't speak out in Committee opposing this Bill. So... and I did talk about this to them and we did talk about the possible erosion of the State's Attorneys rights in prosecuting their own cases. But, this is in place just to assist them. If there's some disputes on who's going to try the case, then they'd come to the state, come to the Attorney General's office and say, can we have some help on this, both of our staffs are booked, we can't handle it. And again, as I said a minute ago, the judge has still got to agree with the order, and he's got to sign it."

Hoffman

"Yes, the Assistant Attorney Generals would handle that, through the Attorney General's office."

"So, we convene the statewide grand jury, and then if they return an indictment, the Attorney General does the prosecution, as opposed to the local State's Attorneys?"

Schmitz

"Yes. Yes, that's... It would be parallel just along the same lines in the drug cases the we are doing at this moment."

Hoffman

"Do you have any idea how many cases the Attorney General's office did, utilizing statewide grand juries, in that authority we gave them, in the last year?"

Schmitz

"No, but I'd be happy to get you that information."

Hoffman

"Is this an initiative of the Attorney General?"

Schmitz

"No."

Hoffman

"Is he... what's his position?"

Schmitz

"Neutral."

"What about the Appellate Prosecutor's Association?"

Schmitz

"I didn't hear anything good or bad from them."

Hoffman

"Did they... Okay. Thank you."

"As I stated before, this isn't... in my view, it's not going to step on anybody's toes in the counties. This is just going to be another tool, that's going to be added to the drug offenses that we already do now in the statewide grand jury. I urge you an 'aye' vote."
