"House Bill 3645 creates the Louis and Clark commemorative bicentennial license plate. This is what many other states have done for this program to help fund their activities for the upcoming bicentennial celebration. I don't know of any major opposition to it other than people that don't like specialty license plates. So, with that, I'd urge everyone to vote 'yes'."

"We would hope by next year, and it would only run for the time of the bicentennial, 4 years to 2008."

"There's been somewhat of a problem of getting plates issued... or produced in a timely manner the Secretary of State's Office. Have you talked to the Secretary of State's Office to see if they can actually do these in a timely manner?"

"Their only comment was, it'd be treated as any other license plate."

"Thank you. What this Bill does, is set up an exemption for facilities at schools where children have already gone to school that day, for latchkey programs if they're are run by a private entity. As we discussed in committee on this this is a situation that's been going on for years and years. The YMCA runs many programs throughout the state in the school facilities. However, the actual school facilities doesn't meet the same standards that some day care facilities have. I'll be glad to take any questions."

Speaker Hartke: "Is there any discussion? The Chair recognizes the Lady from Cook, Representative Mulligan."

Mulligan

"Thank you, Mr. Speaker. Will the Sponsor yield?"

Speaker Hartke

Mulligan

"Representative Holbrook, as you know I had some questions of you in committee on this. Part of which I got the information, but only part of the information, and my question to you basically is what was the difference between what DCFS requires for a day care center as far as a facility goes and what the State Board goes? If you place it in a school there's a big difference between removing a five-year old from a building in a fire and a three-year old from a building in a fire. So, the State Board sent me back a stack of things which I just received yesterday, and I haven't had time to go through them all, but they also said that they did not have the time or the people to analyze the difference between the DCFS program and the State Board requirements. So, I still don't have the answer yet. And my understanding was you were going to hold this Bill until we had the answers and that you were 6 STATE OF ILLINOIS 92ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 93rd Legislative Day February 7, 2002 going to be able to tell me specifically in your school district what the problem was that they weren't going to certify it."

Holbrook

"Yes, that's true, we were provided that information two days ago. And as I reviewed it, and you're correct it was a couple of inches thick. The only real issues I saw there were some of the ones that had to do in my area was with some of the playground equipment. I can't answer you for anything in that ream of material that we did get that said specifically the problem between day care regulation facilities and school regulations. And as I said in committee, I felt that if the children had went to school there all that day it was much safer for them to stay at that school and continue with the latchkey program rather then move to another location. And again, this does not exempt the operators which 99% of those regulations appear to hit for the people being licensed and we're not exempting that in this Bill at all. We're only exempting the physical facilities."

Mulligan

"So, you changed the original Bill so that the person that or the entity that's running the day care center would have to still meet all the criteria for the personnel. It's the facility that we're okaying. And my main problem still is the difference, which I would like to cooperate with you, because I understand where you are coming from as far as moving kids, or particularly, kids that are old enough to be in a half-day kindergarten program and then move into a half-day day care program. But my one concern that I'm not sure that's been met yet, which I would really like to see met before we voted on this Bill, is what the difference is in what the school would okay about a facility and what DCFS would require, particularly, as to 7 STATE OF ILLINOIS 92ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 93rd Legislative Day February 7, 2002 getting young children out of the building. How the facilities meet the fire requirements compared to how they would for another day care center and that we're not starting down a slippery slope in how we certify a facility for all day care centers?"

Holbrook

"And again, I have to agree with the State Board of Elect... of State Board of Education. There is a lot of material there that would have to be gone through. However, if the kids have already been in that school all day, I have to feel that that school board and that regional superintendent of schools that does that inspection feels that it meets that specific criteria as far as the safety of our students. I cannot tell you all of the issues that may differ between the day care facility and the school that they're required to meet. I looked through it as much as I could to try to answer that question, and about the only thing I could find in there was some of the playground issues that were brought up."

Mulligan

"I thought... All right, I mean, that may be okay for your facility and I know you said it was the depths of the mulch that was in the playground, which I wouldn't think would be that hard to take care of. My concern is basically the facility, the exits, and the entrances. Five-year olds that have been in that school all day in a Kindergarten program probably have an idea or participated in fire drills on how to get out. But there's a difference in leading five-year olds out than there would be getting three-year olds out. And the program would be a program that only does three-year olds and not a program that would take care of infants or under three."

Holbrook

"And again, it was written up according to the criteria definition, which says under three it's three when they 8 STATE OF ILLINOIS 92ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 93rd Legislative Day February 7, 2002 enter that time of year. So actually, probably most of them are three years or older. All I can say is they've gone to school in that same facility all day under the same conditions and were meeting the day care facilities for the licensing of the individuals running it, so they should be just as trained as any other day care facility. The only issue here is the facility itself and again, the kids have been in that school all day."

Mulligan

"But we're not passing this law just for your situation. It's a law that's being passed for the state. So, there's still that one problem which I think you could probably solve for us if you would come back with the difference between the two, which you kind of assured me in committee that we would have, which we don't have yet."

Holbrook

"Well, I did..."

Mulligan

"So I would request that you take vote for out of record until you can come back and tell us that, and I'd be happy to vote for it, if you can satisfy that."

Holbrook

"Well, Representative Mulligan, I did say I would get you the information or at least that the State Board of Education committed to get it. We got it and as I read through it all I could see was some of the things mainly on the playground. Ya know, I'm no attorney. I'm sure you could pick it apart to death. But this just isn't my area, it's anywhere in this case, say the YMCA would run a program throughout the state. I just... I guess I have more faith in the regional superintendent of schools and our school boards that our schools the physical places, facilities are safe, throughout the state just not my area."

Mulligan

"We have a state that has multiple entities and multiple school boards. And so whoever's elected to a 9 STATE OF ILLINOIS 92ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 93rd Legislative Day February 7, 2002 school board at any given time may not always look at the issues the way I'm sure your excellent school board and facilities are looking at them now. So, I still have that overall concern about how we're gonna address this. And since we are making a statewide law, I would like some assurances that there is gonna be some uniformity there and that the differences between what DCFS requires and what the State Board requires are not so far apart that this is going to be a problem for small children."

"Thank you, Mr. Speaker. Will the Sponsor yield?"

"Tom, I apologize for not coming over and asking you this. I had a phone call, as you know, from a constituent in my area, you and I talked about this the other day. And we only were able to talk last night. We were playing telephone tag all day yesterday. And I said, 'Well, what is it in the Bill that you have a problem with?' And she said the thing that she had a problem with was the three-year olds, going down to the age of three and four. And she said because physical facilities for a three-year old are different than physical facilities for kindergarten or above. Now, you can have a school that might have an Early Intervention Program in it and then they would have facilities there for three and four year-olds. You know they need the extra low stuff, the stuff that you and I can't even get into. So, is this... is it in the... and I didn't know if it was in the Bill or not? Is it in the Bill that if you have students of the ages three and four then they can continue on in the latchkey thing? She didn't have a problem with that, but if you were in essence 10 STATE OF ILLINOIS 92ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 93rd Legislative Day February 7, 2002 opening up so that three and four year-olds from the community could come into the school, then her problem with it is that you don't have the physical facilities there to accommodate them. And I honestly didn't know how to answer the question. I didn't know you were calling the Bill right now, so can you help me out on this?"

Holbrook

"Well, the reason age three was put in there, it's if they're gonna be age three at the time they are enrolled in school, and some pre-ks allow the children to come in while they turn four-years old. And they would be in that school anyway. I mean, we are not talking about shipping kids into the school to run a Latchkey Program. We're talking kids that are already at the school, that have already went through... that had actually played on the equipment during the day or sat in those chairs during the day."

Pankau

"But does it say that in the Bill, that you in essence have to be enrolled in that school to then stay afterward for that program?"

Holbrook

"No, it doesn't. No, it doesn't. It simply states that private entities, or grounds of public elementary schools, secondary schools that serve children who have attained the age of three, the physical properties are the only thing exempt. It doesn't say that they couldn't ship somebody in... I guess if the school wanted to open it up..."

Pankau

"Is there a way that we could add that in there? Because at that, I don't have a problem with it then, I think it's a darn good idea. But my concern would be my constituents' concern about the physical facilities. Could we add it in?"

Holbrook

"I would be willing to talk to the Senate Sponsor to do something like that, whoever we get to pick it up. I couldn't change it, but I do want to get the Bill out of here."

"I mean on the basis that..."

"Would you mind if I joined you to talk to whomever the Senate Sponsor is, and just make sure that we get those words in there? Because after that, I mean latchkey classes... I mean, it's the thing, it's here. So we might as well recognize it."

Holbrook

"I have no intention of students being allowed to be... or children to be brought over to school and put into a program that is already there that they're not going to school there. This isn't set up to be competition for day care facilities. This is set up so that the children don't have to leave school and may be go to some other facility. And I'd be happy to try to add that over in the Senate, if you'd like and work with you on that. I put you down as a hyphenated Sponsor on the Bill and whoever we can get to pick this up in the Senate, have them add that language and tell them we support it fully."

"I think it's just a matter of a couple of words and then we would clarify it. Thank you, Tom."

"Thank you, very much, Mr. Speaker. As spokesperson on Children & Youth I rise in support of this Bill. And there was a lot of discussion concerning the issues. Increasingly, there's more need for before and after school public schools, and also increasingly, there are more and more three-year-old and four-year-old programs at the public school. We all know how important early learning is, but in order for parents to be able to advantage of 12 STATE OF ILLINOIS 92ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 93rd Legislative Day February 7, 2002 those early learning programs often they need to be... have child care either before or after. I think it's important to emphasize that this exception does not include the personnel or the programs it only refers to the building, and so I do rise in support of this Bill."

"Is there a reason we need to move this forward so quickly this week, instead of trying to correct some of that issue that has been addressed by several other Representatives in our chamber instead of going over to the Senate chamber?"

Holbrook

"I understand there's a backlog coming. I'm just trying to get my Bills out of here. Quite honestly, I'd be willing to get it over to the Senate and work on it over there and add that to it over there. The only reason this Bill I wanted to get moving at this time was, the YMCA in our area for throughout the Southern area of Illinois has run these programs just like this for seven years. It's just last year that this issue came up that the Y would have to license its people and the facilities within those schools. And it really caused a problem. So they've made some adjustments down there, working with DCFS and with the local school districts, and I would like to keep this thing going. I just want to get it moving and out of here. I 13 STATE OF ILLINOIS 92ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 93rd Legislative Day February 7, 2002 don't want it to get lost with other Bills when we have 500 of them in the next month come up here. I'm just trying to move it along."

"And I understand your concern and I appreciate that. To the Bill. I will vote 'yes' with the acknowledgement that Representative Holbrook is going to work on that wording so that it doesn't affect areas other than that YMCA in a way that could harm children. And I look forward to working with you to make sure the wording is addressed. Thank you."

"Yes, I'll commit to work on this over in the Senate to add where a student is already in that school are the students that are going to be eligible to go to this facility. And, it's a good program. Our kids don't need to be leaving school and driving 5 miles to a day care center after school to be part of a Latchkey Program. It's a good Bill. I ask for your vote 'aye'."

"Thank you, Speaker. House Bill 3749 sets up a grant program through the State Fire Marshal's Office for fire equipment and HAZMAT equipment for those programs. Currently there is no such program. I know Representative Moffitt and Representative Smith have been working on this quite awhile. What this Bill does in essence different than theirs is set up a program for HAZMAT. There is no funding in this program right now. We hope to work on that. We've been talking to people in several departments already and hopefully, we'll address that at appropriation time."
