“Mr. Speaker and Ladies and Gentlemen of the House, I rise in support of House Joint Resolution 11, which would provide that the Illinois State Library would be named after Gwendolyn Brooks. Gwendolyn Brooks was the first African American to win a Pulitzer Prize, that happened in 1950, because of her collection of poems entitled Annie Allen. She also served as the Poet Laureate for the State of Illinois for over 30 years and at the time her only predecessor in that position was Carl Sandburg. I would suggest that this designation would be very appropriate because of the time and the effort of Gwendolyn Brooks in education and especially education of children. She was very devoted to the principle and the idea that the best method of communication was the written and the spoken word, especially with children, because it provided an incentive and a continual motivation for them to interact. I, too, rise in support of this Resolution and I’m glad that we’re offering it and adopting it on the second to last day of Black History Month, a very appropriate tribute to a very great, a very important Illinois woman. In fact, this renaming will keep Black History in our minds, in our thoughts, in our hearts not just during February, but through every month of the year. Gwendolyn Brooks was a groundbreaker, she led a long and distinguished career. She cared deeply about education, about making sure that our young people have every opportunity to succeed. She was a wordsmith whose poems were understandable, we’re connected, made it easier for us to understand other people, other visions, other lives. I am proud to participate in this effort and I am sure we will have unanimous support from this House to rename our state library after the distinguished poet and educator, Gwendolyn Brooks.”

“Representative, could you just tell the Body how this is helpful, explain it, how it would work if you were working with somebody that had a deadbeat parent?”
“Absolutely. Representative, one of the problems in collecting money from people who owe child support is finding them and finding where they work. If, let’s say, the cable company… I’ll look between them. If, let’s say, the cable company got a subpoena and they had information as to where a particular debtor lived or where that particular debtor worked or where that particular debtor banked and then if the state got the information they’d be able to track that person down and collect the money.”
“Now, do you have to go to a judge and ask for… a lot of times this is proprietary information or this is information that would be covered under privacy rules. How does the court allow this to happen, what is the vehicle used?”
“We have something in the law now called an administrative subpoena and so a state agency can by subpoena ask for the information. They… they can do it now with some areas, but this would require that these additional entities be required to respond to such subpoenas.”

“It’s my understanding that the director or some responsible person at a high level would have to sign off, just as if we do a subpoena here in the House of Representatives, if a committee wants to subpoena something or somebody in the House, the Speaker has to sign off on that subpoena. And so, these subpoenas would not be signed off on simply by a clerk.”
“Okay. And where is that in the… is that current law or is that in your legislation as to who has the responsibility of signing off? Is it already there and you’re codifying it or, again, I just don’t want… I want somebody responsible that has the authority to do this.”
“My Bill does not change the current law about how a subpoena is issued by one of these agencies and I don’t have that current law in front of me, but it doesn’t change that law. And in some cases they’re doing this now.”

“This is legislation that is my legislation. As you know, one of the things that I have worked on for some years is collection of debt owed to the state and I see child support as one aspect of that and maybe the most important aspect of that.”

That’s not acceptable in this state, it’s not acceptable anywhere. If you have a family, you have a responsibility to provide for that family. So, I will rise in support of this legislation and the Sponsor will try to make sure that the innocent are protected. Thank you.”

“Representative, I… I’m tempted to vote ‘present’ on the Bill and let me tell you why, I don’t think I will but… I have no problem with what you’re attempting to do and I know you’re sincere. My concern on child support for the last five years in this chamber and I was sorry to see that the Child Support Enforcement Committee was not continued this year. Lou, we continue to give the department more and more and more ability to go after the true deadbeat, noncustodial parent. I don’t see any action coming out at the other end of that funnel. We still have one of the worst records of child support of any state in the country, I think we… I think Illinois noncustodial parents owe more than 2… $2 billion. You know the fiasco that we had with the State Disbursement Unit. There is a contract pending, I believe, with a new provider to run the State Disbursement Unit. I’m not sure that that… and that’s a federal mandate that we can’t change, I think the county clerks or circuit clerks were doing a better job. But I think at some point what I… and I rely on people like you and others in the chamber, we have to start demanding better accountability from the Department of Public Aid who continually want us to give them additional powers, some may even say continually invading our right of privacy to collect this debt. Now, I have no empathy for a deadbeat parent, I have no empathy at all. I think you were here, I think it was during Governor Edgar’s term, when they came up with this brilliant idea that they were gonna post the deadbeat of the month on the Internet or put his picture on a milk carton or whatever and the first person they picked… and they had a big press conference in the ‘blue room’. One of the reporters walked out with the name and in 30 minutes found out exactly where this individual was living and where he was working, but he was supposed to be the deadbeat of the year that the department couldn’t find. I don’t have a problem with your Bill I may vote for it, but the message, I think, should be to the department, if we continue to give the tools to you to do the job, we expect a better return than what we’re getting. And I don’t think you disagree with that, I’ve heard you speak on that before.”

First, despite the problems we have in collecting child support, there’s no more important tool than information. So, this is something that’s going to help the department get information, which should lead to finding more of these people. “That’s good idea, it’s long overdue, I think it has met its premature death in the Senate on more than one occasion. And you’re right, if we could collect just a small percentage of our outstanding debt we could almost solve the budget crisis between now and May. So, I, again, I have no problem with the Bill. My message is simply to those in the Department of Public Aid, do a better job of tracking these people than you’re doing. I had a Bill some years ago and we couldn’t get it out of the House transferring this… this entire enforcement to the Office of the Attorney General. But however we do it, I don’t think anybody in this chamber should be satisfied until we have a far better return on delinquent child support than we’ve seen in the last few years. And I appreciate your work on that… on this most perplexing problem.”
