We were sent to do a job and we completed that mission, and we were relieved that we would soon be home to our mothers and fathers, husbands and wives, sons and daughters, or in my case, a soon-to-be-born child. House Bill 4079 is a… deals with a very important group of people, a small group of people, but a very important group of people, and that is the employees in our child advocacy centers. And what this Bill does is allow them to buy insurance for… buy the… allows the centers within the State of Illinois to buy insurance for their employees, annuitants, and their dependents under the state… group insurance program. Under this Bill, which… they see this as a solution to a very serious problem facing the children’s advocacy centers, and that is the inability to obtain affordable health insurance 09400100.doc 6 STATE OF ILLINOIS 94th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 100th Legislative Day 2/28/2006 for their employees. Most of Illinois’s 36 children’s advocacy centers operate with a small staff, fewer than 10 employees. With such small staffs, they are unable to benefit from cost breaks that are offered by insurance companies to larger employee… employers. And as a result, many of these children advocacy centers cannot afford to offer health insurance to their employees. This would give them an option. And there is no… there is no fiscal impact on the Department of Children and Family Services and also the Department of Commerce and Economic Opportunity says that House Bill 4079 does not create a state mandate under the State Mandates Act.”

“Premium… premiums for noninsured groups, such as the advocacy centers, have typically been determined by setting a baseline for the group by using the claims history of the individual offices within the group. Or if the offices were previously uninsured, as many of these might be, using demographics of the group. After the initial year, each individual office is rated in a tiered form using their claims from the previous year. Groups with a high rating, those that are making fewer claims and in good health, pay rates that are lesser than the baseline. Groups with a low rating pay higher rates than the baseline. And I might add, if I… if I can add one thing.”

“And that is that they provided me some demographics with this. Almost all of their employees are under the age of 35. They are a young, healthy group.”
“All right. There is no way that there will be minimal expense to the plan. If you bring a couple people in with a couple million dollar plan, which is, again, high… highly unlikely, I admit. But it could happen. Even one could be a half a million or a million dollar in claims, and that will have an effect on the overall group insurance for CMS, ‘cause it has to be shared with all the members of that group.”
“Okay. Could… could you repeat that, please? I… I think I understand it, but this time the experts didn’t.”
“I’m saying if it happens to be a half a million dollars…”
“Yeah.”
“…or a million dollars and it goes into a… into a claim and they’re in the CMS plan, one, the small group of people cannot absorb that increase, and… if you want me to talk to you ya gotta look at me like you’re interested in what I have to say.”

And woe is any of them that might have high blood pressure or a diabetic or anything during that 12-month period, ‘cause now they have a preexisting condition. I… I think you better take a good, hard look at your legislation and make sure this is really want you wanna do. ‘Cause today it’s this group, which I have the highest respect for all of those people that work in that arena, as you do. But I’m just concerned about what we’re doing to ‘em with this. And tomorrow, it could be another group that another Legislator wants to put in. The way you’re doing it is… could be very expensive and it could be a catastrophe to some of these small groups of people wanting to get into this plan. I think you better think hard and long to whether or not this is what you really wanna do.”

“Thank you, Mr. Speaker and Members of the House. This is a Bill that Representative Bellock is a cosponsor with me, and we both had the same idea… the genesis of the same Bill. And we think it’s very important, dealing with the domestic violence issue. Currently, there are eight states in the country that require a bail hearing when one is charged with domestic violence, but Illinois does not require it. In… few domestic violence cases result in convictions, often because the power the abusers have over their victims. That’s according to my state’s attorney, Lou Bianchi. He says the offender most often makes promises to the victim and the case is dropped. Domestic violence convi… convictions are also infrequent because they’re often pled down to simple battery. What this Bill will do is it deals with bail with people charged with a violent crime against a family or household member. It’ll require a judge to look at 11 considerations and basically have a checklist to determine what the bail should be. And what’s important about this is it creates a paper trail to reduce the… the ability for repeat offenders to continually get a diversion program because there is no history that they have been through the courts before. I’d be glad to answer any questions.”

“No. No, I’m saying there’s not always the bail hearing because it could be lower… it could be a lower charge. Or we have a very small incidence of domestic battery getting convictions because oftentimes it’s pled down or the… the perpetrator has such power over the victim.”
"I… I understand that. But I just wanna make very clear that if someone is arrested for domestic battery, they are not able to bond out that same night. They must appear in front of a judge…”

“But this would have a paper trail of these 11 considerations that we would have, and it would show that one is charged with domestic battery. Because that would be one of the considerations should that individual be charged again in the future. And as you know, the recidivism rate is… is very dangerous. Because oftentimes when there’s a repeat offender, it’s much more violent than the first time. But what they found is when you get a conviction the first time and it’s a misdemeanor, the second time, as you know, it becomes a felony. Oftentimes, the perpetrator get the… gets the message then, because if he’s charged with a felony, loses his job among other things.”
"So, you’re saying with these 11 individual items for… for the person… and in all instances, you know, the State’s Attorneys office to look at during the bond hearing, you don’t feel that what’s currently in the statutes to take into consideration with setting bond is good enough for domestic battery cases. Is that right?”
“Correct. That’s correct. And we have the support… I’m looking for my notes here. But we have the support of the State’s Attorneys’ organizations, of the Cook County State’s Attorney, McHenry County Sheriff’s Department, the State’s Attorney Appellate Prosecutor, the Coalition Against Domestic Violence. All those organizations and others agree.”

“No, I think it’s a checklist, and hopefully, they’d be able to find out… we’re not looking for additional liability for someone who’s doing their job.”

“Actually, yes. There was a… there was a case in Ohio and Ohio passed their law in August of ’05, it’s called Amy’s Law. There are eight other states that have similar laws and two others that are… are looking at it as well. Actually, it was highlighted on the Oprah Show and that’s where we got the idea.”

“I had a very similar case in my district just a few months ago. It was domestic violence, a husband and wife separated. I don’t think they’d been separated very long. To make a long story short, they met at the home to discuss some terms of the separation. The husband allegedly… and I say ‘allegedly’… pumped 15 shots into his estranged wife, and there were two minor children involved. In fact, would have been reachable. Common sense prevailed and the state’s attorney intervened. This is a very good Bill. It, unfortunately, reflects what so of… often happens in society today. And in the case of a domestic violence alleged murder where there are minor children involved, and a jailhouse snitch later said this alleged perpetrator approached him to get out and kill some of his former in-laws, that obviously bail should be difficult to obtain in a case like this. And I looked into this and shame on me for not going far enough to come up with… with something that would pass a test and get the State’s Attorneys’ blessing. Believe me, until you have seen what has happened in a particularly violent domestic violence case where there are still very strong feelings between the once in-laws and now the person accused of the crime, this Bill makes eminent good sense. It addresses a situation that I wished we didn’t have to address, but it’s there. And to turn our back on it and pretend that it isn’t is not doing due diligence at Legislators. I commend the Sponsor on the Bill. I urge an ‘aye’ vote.”

These levels of sedation shall be defined by the Division of Professional Regulation.
