"And so, if a violent criminal is transferred from Menard to somewhere in Peru it's nec… as you want it to… we should tell the victim of the crime that the perpetrator's in Peru?"

"So, when you say foreign, you don't necessarily mean out of the country?"

"Out of the country. Well, then…"

"So, that constituent would care if the person who did the crime was transferred out of the country?"

"Well, why… why does she care where he's housed? Does she wanna go throw things at him once a week or I mean, why would… If he's not here causing a problem in our society, why do we care if he's in Australia?"

"Well, so if that sys… if that offender stays in the State of Illinois are they notified?"

"Right. So…"

"…but if… if that offender is moved from one correctional sys… institution in Illinois to another, is that person notified?"

"You believe."

"And so you wanna put different rules on the transfer of prisoners to Australia than the transfer of prisoners, let's say, from… between Menard and Joliet?"

"They are required. And so, what you're trying to create here is balance."

"Why didn't you say that? This is a system here… Let me explain to you, Representative. When you come here to the floor of the House, you really need to know your Bills better. So, you come here to the floor of the House, you're talkin' about sending people all over the world… Do they need passports when we send them to Australia or Peru or wherever we send them?"

"Who takes these people, Representative? Would it be… representatives of the Governor's Office?"

"The U.S.?"

"Not… Illinois people don't do these transfers?"

"And you believe, so you don't really know?"

"The U.S. Bureau? So, perhaps the Bill we oughta have here is requiring our own people to do this. Why should the… why should the folks from the U.S. Bureau of Prisons get those frequent flyer miles? Why not… why can't the Illinois people get them, Sir?"

I think most of the people on this floor, Sir, even people on your side of the aisle would like to help a freshman with a Bill have a real stake in making sure that when people come to the floor on their very first Bill… well, you've been here since January. You've had two full months to get the answers to these very simple questions and you seem to be out of the loop. Are you gonna be traveling with these prisoners to Peru and Australia?"

"And… the U.S. Bureau, so the Federal Government."

"Does the state still pay for that?"

"So, the Federal Government pays for that?"

"So, this is a cost savings to the State of Illinois on the transport, right?"

"That was my next question. And… and so, we're also saving money on the incarceration for whatever period of time they were sentenced to we're gonna save money on… on housing them and feeding them and whatever other programs that they may availem… avail themselves to in the Illinois Department of Corrections, right?"

"Now, have you run the numbers that for the… potentially the number of people that this would apply to would that be enough of a cost savings for the money to cover the amount of money that Representative Reboletti needs for all the sentencing enhancement Bills that he has for the people that are now going to be locked up for years and years and years in the State of Illinois? Is that enough money to cover those bills and those people?"

So, I just wanted to clarify that. I think what we were doing… I agree with Representative Cross… with Leader Cross that all bridges even if they're not state- owned but privately owned on public waterways, that we also needed to make sure that we looked at notice to people so that the safety factor is there also and Representative… Leader Cross had… did… did say that we thought it would cover it and his concern was the same as mine which was even private dams on public waterways need to be. So, I just wanted to clarify that that Leader Cross was not the one that thought he… I think he just had it confused because I probably did that in committee when I just said the Kankakee River. "Well, it's very important. I've had people talk to me about it taking 1, 2, sometimes 3 years to… 1, 2, and 3 years to clear up a situation dealing with identity theft. And so, this is extremely important. There's also precedence having taught in university. A lot of colleges used to use the Social Security number as a student ID number, they no longer do that. They have unique numbers for the students' use, so it's something that has a… a lot of credence and has precedent."

"Is that one answer to one question that you just gave me?"

"That's the universal answer to many questions."

"Well, I see. So, this would be like the universal health care answer? So, I notice in your Bill that… that… that we… they can't use the patient's Social Security number as the patient's identification number. I guess I get that."

"But then it says you can't use it in any mailing sent to the patient. Are we trying to keep the patient's Social Security number a secret from him, Sir?"

"I would presume that the patient would know it. Of course, then…"

"Well, as the Bill states, except in cases like Medicare where it's required by federal regulations, if a person doesn't fit in that particular class, I guess maybe I'm trying to protect the individual more than he might be… he or she might be trying to protect themselves."

"Huh? What did that mean? Who… Well, all right, maybe you could give us an answer at some point as to why we can't write the patient's Social Security number down and send it to the patient. Are you afraid their spouse will get their Social Security number if they open the mail?"

And so… and so the facil… but a health care facility, ya know, is a… ya know, big office, there's a lot of opportunity, ya know, for people to… Did I answer the question?"

It is the Social Security number that is tied to so many things about an individual. If it's been compromised, it just caused a lot of problems, rather than a driver's license number. I guess I could also say the driver's license numbers are more in the public domain than Social Security numbers are and it's not something that we… that we hold as dear in terms of causing us harm than the Social Security number is…"

"…tied to our employment and all kinds of other things."

"Well, I'm glad you recognize that this could lead to that… that problem. Now, do you have any compunctions about trying to dictate to insurance companies and health care facilities, how they operate?"

"Well, you know what, only in so far as not using this important number for means of identification. We must think about the protection of consumers. And the other thing too is, you can come up with a random number, it is not difficult to come up with identifica… identifying numbers that doesn't use Social Security."

"Well, speaking of that, isn't it a fact that… that health care facilities and insurance companies have already discontinued using Social Security numbers, which is why they haven't opposed your Bill, but it renders your Bill totally unnecessary."

This Bill says that after 60 days of a fine being levied, regardless of an appeal, it doesn't give time for an appeal, it says that those fines will be added to your property taxes. The second problem which I think on that face should be enough to get everyone not to vote for it because I believe it's fatally flawed constitutionally. But second of all, what you're saying now is the municipality that should levy a fine and let's assume for the sake of argument that the fine is correct, okay, and there's no appeal. But what you're doing now is saying the municipality has this super priority status over every other creditor and they should be paid first. Correct?"

What's a Code hearing officer under division 131.1 (sic-31.1) of Article 11? Circuit Court is a judge, so could you explain or ask or find out what… who that is or what that is?"

But what I'm getting at would be, if the court imposes a fine and it's a judge and you wanna now do it this way, which is a serious way of doing it, maybe I could be convinced that at least a judge heard it. I wanna get serious. I'm gonna put it on there, ya know, as a special assessment and you've heard the people that might have a problem with it. I may not have a problem with that. At least I know it was by a judge. Here's the point I'm trying to get at, Representative Schock, is that a hearing officer under division 31 Article 11… if I… it is what I think it is, I just don't have enough time to look it up… municipalities had that administrative adjudication stuff. I actually do that in my other life when I'm downs… I'm just a hearing officer there and what happens invariably people get a ticket for garbage, excessive garbage, excessive lawns, they'll be issued a ticket. When they don't show up, I, by law, can save seven hundred and fifty dollars ($750) with that high. So, I get three for seven hundred and fifty dollars ($750), they've never even been there. And the Circuit Court, to get a fine, you have to send the people; it has to go up in front of a court… You're in front of a judge. This is just some… I don't even wanna call myself, ya know, I don't even wanna say what I am, but it's just some guy up there, don't even have to be a lawyer, nobody shows up and you get a seven hundred and fifty dollar ($750) fine and now you can put it as a special assessment. It's… it's clear that the municipalities have a right and an interest in making sure that people follow their ordinances and we all support that. We support strong options by municipalities to collect these dollars, but there's ample opportunity in the law today for municipalities to collect these dollars. It's the wrong place to put it on the property tax bill. Additionally, I don't see anything about due process in here. And so, the fine has been issued or the citation has been issued perhaps the homeowner or the property tax payer wants to contest it. Perhaps they're in the process of trying to contest it and turn it around. While this is happening, the special assessment is going on their property. And so, I think this is a poorly constructed piece of legislation and I think we should be voting 'no'."

That would be the only situation. Patient confidentiality and patient security is written into every part of this process and the… actually the prototype that I saw would be like a HIPPA form, you would sign-off on the ability of your health care provider to use your electronic health record or to share it and that is going to be built into every part of this because everybody believes it and that is the goal here."

"Not really. This is a very different kind of model. There is… there are different models that are being used in different states. Some… only one state that I know of actually has created this mega database, that is not what is envisioned here. This is more of a record locator service. The patient signs off on being able to access the last provider's record and then the electronic system moves into that person's… into that person's electronic health record and pulls off particular data just for that use. There is no database, centralized database that is being created in this Bill. That was carefully thought through by the task force; they rejected that. This will be a very different kind of process."

It's a sport that is clearly taking… it's grabbin' a hold of the country and even though we may disagree with what's going on, it's something that at least that it's happening that we need to support.
