Senate Bill 115 essentially provides that it is an aggravating factor for a person to commit any crime against a person who they know or should've known was an active duty member of the Armed Forces of the United States. And this includes National Guard and Reserve service. This Bill was brought basically in response for a murder in 2006 of a member of the Armed Forces that was killed home on leave after serving a term of a… combat in Afghanistan. This Bill passed unanimously in the other Body. And I would encourage an 'aye' vote."

Do you see any concern that the defendant in that case, while a heinous crime in either situation, that we are essentially placing a higher penalty-slash-higher value on the life of the Armed Service person in… in the capacity that's really unrelated to their duty in this case?"
"Representative, I… I guess I can see how that might be construed a… a… in general. However, I'm sure there have been cases where a person did know that the individual was home on leave. You know… I can see situations where the person doesn’t even have to be in uniform, but it is known that a… you know… they’re an active duty soldier and… and so therefore, you know, the defendant it… it is not like they did not know. I understand what you’re saying about essentially one person’s life being a little bit more a… a important than another person's life, but I… I really don’t… I really don’t think that the spirit of this Bill was to make that distinction."
"Well, I… here… I… I trust and you know I'm not surprised that this Bill came out of Senate Committee unanimously and out of the Senate unanimously, and obviously your intention and everybody else is nothing but solid here. The concern I guess that I have and it's… you know… it… it… it's ironic. It's a sad irony, I guess, that this Bill's being called today. We had firefighters being attacked when they were responding to fires. Then it was expanded to CAPS members, a… sports referees, nurses. We had legislation in here earlier to make it an aggravated factor for cab drivers. And… And I'm not taking away anything from any of these professions, but my concern, Ladies and Gentlemen, and to the Sponsor, the… the exception truly is swallowing up the rule. Why wouldn’t we at this time simply say, ‘We're going to ratchet up the crime for murder in all cases.’ Because I do think that unintentionally we are having the situation now that the life of the cab driver is placed at a greater value than the life of the tow truck driver. Or that the life of the… one occupation is placed over another one. Obviously again if it was related to the crime, if it was an aggravating factor or the cause of the crime, I… I… I get it. I can't say in all honesty that I'm going to be the first brave sole to vote against this, but, Ladies and Gentlemen, you know we're seeing one or two or three more of these categories being added every year. It's… it's kinda like license plates, and I'm not saying that facetiously. I'm not saying that to make light of this legislation. Though in some point in time, you know we're trying here to revise the Criminal Code and simplify things, and now we are simply ratcheting up penalties for a whole host of professions. "I… I think that we've done an analysis, not a task force, and the analysis, of course, shows that there does need to be some reforms, and that’s now why the task force is being set up."
"I'm just worried that we… Well, I'm going to go to the Bill. I appreciate it. It seems that we study things to death here in Illinois. And I'm looking at a study that was commissioned by the State of Illinois Commission on Government Forecasting and Accountability, and it's called An Evaluation of Illinois Certificate-in-(sic-of) Need Program. This came out just a few months ago on February 15, 2007. On Roman numeral page III (3), the recommendations are very succinct. It says that the traditional arguments for CON are empirically weak, and based on the preponderance of hard evidence, the recommendation should be to allow the program to sunset. If you go to page 3 of the report, they indicate that the Certificate-in-(sic-of) Need Program is subject to wide criticism, because instead of actually controlling health 09500062.doc 26 STATE OF ILLINOIS 95th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 62nd Legislative Day 5/28/2007 care costs, they increase health care costs and stifle competition. It is a barrier to new bus… a… buildings and it's seen as an unfair restriction. I don’t know why we are keeping a failed program going. People who we've hired to evaluate this Certificate-in-(sic-of) Need Program have recommended that it be put to pasture, that it be put away. And I don’t know why we keep artificially putting life into something that should be gone. This is something that stifles competition. It really increases patient cost and it's very bad for the health of our State. I'd ask for a 'no' vote."

It's my recommendation tha… my recollection that in fact CON… the Lewin Group recommended that the Certificate-of-Need Program be extended for three years not so much because a… because they did give the recommendations that the previous speaker suggested, but they also said that the health care industry in general is… is in such a state of flux in the State of Illinois right now that to remove the Certificate- of-Need process would throw things up for grab. I agree that the rule recommendation of the Lewin Report was to continue the Certificate-of-Need process so as to determine whether safety net hospitals, and most importantly safety net services, might be at risk without a planning board with the opportunity to say ‘yeah’ and ‘nah’. The task force that is created under Senate Bill 244 will make a recommendation to the General Assembly and that general… That recommendation could as easily be scrap the whole process as reform it or reinstate it. So I think the appropriate vote on this legislation is a strong 'yes'. The Lewin people in committee said yes, we ought to extend it for a time so we can examine the question whether to protect safety net services we need something in place. Maybe not what we have today. I think it's clear we could change the kinds of services that are covered and so forth, but those issues are left in this Bill for the task force to make recommendations to us. Yes, no or maybe some other kind of animal. I would encourage your 'aye' vote."
