He was an ex-felon on parole and was being prosecuted for domestic battery of Mercedes late last year. This Bill requires the parolees to notify their parole agents within twenty-four (24) hours of service of an order of protection and requires the Department of Corrections to issue parole violation warrants if the parole (sic-parolee) is charged with a new domestic violence crime including domestic battery, aggravated domestic battery, stalking, aggravated stalking, violation of an order of protection or any offense requiring sex offender registration. Under this law, after a new charge for these crimes, a parole violation warrant would be issued, removing the guess work, holding abusers accountable and making victims safer."

"Yes, I will reiterate what I said earlier. Young lady by the name of Mercedes McCully was murdered by her ex- boyfriend while leaving church. The current law with the Department of Corrections says that the Department of Corrections is required to issue a parole violation warrant if a parolee commits a felony with a knife or firearm or does not register as a sex offender. Arrest for all… the offenders are then taken back into custony… custody, that is. Arrests for all other new charges of parolees are decided on a case by case basis. This would require the parolees to have notified their parole agents within twenty-four (24) hours of service of an order of protection. So that we're trying to protect those individuals who have filed an order of protection or asked for an order of protection to be filed to benefit their safety."

This is a unique TIF extension up to twelve (12) years, in that the city is not asking for all the money back. So for the first time since I've been here, we have a TIF extension where a majority of the money that's going to be raised will be allocated back to the respective districts through a process already… already implemented. They're looking for about 30 percent of the money over the twelve (12) years and they will give back 70 percent that will go to the schools and other taxing bodies. Over the life of this extension, one of the schools is going to receive above and beyond what they would have, up to two million dollars ($2,000,000). So this is a unique way of doing a TIF. So, you know, I’m certainly not against transparency, that's what we're asking for with this commission. As you know, all… as you know, this report contains recommendation for pay raises for us, the Governor, and constitutional officers. According to the State Law, both chambers of the General Assembly must pass the same Resolution disapproving the report or the raises will take effect. We need to take action within thirty (30) days of the report being filed which means we only have fourteen (14) days left to reject these pay raises. Mr. Speaker, our state finances are in shambles and the families back home are feeling the pinch as well. Now is not the time to give ourselves a pay raise. I make a Motion to Discharge. "I would like to speak to the Motion that my colleague from Belvidere just made regarding the pay raise, because yesterday when I read the newspaper I was amazed at what I saw. And I saw one of our leading Senate Democrats saying, 'I need a pay raise, I need a pay raise, we need pay raises in the General Assembly'. And when I go home you know what I hear in McHenry County, Illinois, I hear I need a job. I need a job. I hear I need to pay my mortgage. And it's… I believe it's unbelievable for any of us to think that we could go home and justify a pay raise at the General Assembly when people in Illinois are economically bleeding here. It is needs for jobs in Illinois and we should be meeting that need, but we aren't. Just four (4) months ago we came down here to debate the CTA. And we had a healthy debate on that. And many of us said, no capital, no CTA. And it is nearly the anniversary when Representative Molaro said when we asked him when are we going to have a jobs Bill? When are we going to have a capital Bill? His answer was, ten (10) days. He was the Representative leading the charge and putting together a funding package for a twenty-five billion dollar ($25,000,000,000) capital Bill and we were suppose to see it in ten (10) days. We didn't see it in ten (10) days. We asked when would we be voting on it? Three (3) months. We haven't voted on it and three (3) months has gone by. I say we don't take a pay raise 'til we have a capital Bill. We don't take a pay raise 'til we have budget reform. We don't take a pay raise until we look at school funding and do something about it. And we don't take a pay raise until we have transparency on the process that we have here in Springfield, and how do we go home and justify a pay raise when we can't do the jobs that we came here to do. Mr. Speaker, I'm imploring to the Members of this chamber, the time is now and the time is right. When we adjourned here Thursday, we went back to our districts, we got our local mail that was sent to us snail mail. My office was inundated with letters from constituents that say, how can you consider a pay raise? I'd ask myself, how can we consider a pay raise? We cannot consider this pay raise. I look at this Body as the board of directors. And we sit here and we read the newspapers that you got a CEO that makes a billion dollars ($1,000,000,000) on a company that loses money. The board of directors take pay raises on a company that loses millions and billions of dollars. And here this Body can sit in here and not even figure out how we're going to reject a pay raise for our own checkbooks when we've got families in our district that are paying the same gas prices, paying higher food prices. And we take a Roll Call vote five minutes ago that says, nope, I don't want to talk about this right now. The time's not right. Mr. Speaker, the time is right. The time is now. We are the board, we set the policy, we set the tone. Let's tell our constituents that we're in charge here, we're not going to take the pay raise, we can't afford it, the state's in debt. "I have a few questions on this. Following up on the prior speaker, you're saying the person or the entity that would pay the fee would be the… would it be the successful bidder or would it be a person or entity that was making an application for the surplus funds?"
"Okay. It would be… Representative Franks, it would be the previous owner who is now the defendant to the suit."
"I'm not sure that makes sense for this reason. If you… right now are you aware of how many fees are attached when one files a foreclosure? First you have to file the filing fees which are typically for a chancery, about three hundred dollars ($300). Then you have all the service fees which could be hundreds of dollars as well. Then if the property… excuse me… were going to go to sheriff's sale, the sheriff charges six hundred dollars ($600) for the sheriff's sale. Okay? The clerk has already received approximately five hundred dollars ($500), the sheriff has received six hundred dollars ($600) to do the sale. Typically in a foreclosure, that… the entity that forecloses loses about 40 percent of the value. I'm wondering why we would add on another fee to, and I'm not sure who yet would have to pay this fee, because if… here's my question. If you are the mortgagor and you give the mortgage and then you go forward and do the foreclosure, it's very rare that you'd be taken out whole. In most cases you lose about 40 percent. Let's assume there are other defendants, and let's assume they're defendants because they have a judgment against the mortgagee, and they place a lien against the property. And let's assume there's, you know, three (3) entities that have liens, and let's say one of them is the City of Rockford. So the City of Rockford has filed a lien and let's assume there's a surplus and let's just say that the first mortgage holder has a judgment for a hundred thousand dollars ($100,000), City of Rockford has ten thousand dollars ($10,000), City of Waukegan has a ten thousand dollar ($10,000) lien and another city has another ten thousand dollar ($10,000) lien. A purchaser comes in and buys it for a hundred and thirty-one thousand dollars ($131,000). So that way the first mortgagor is paid in full, but then there are three (3) entities who could claim for that surplus. Who would pay that fee?"

This is the Resolution put together by the Senate Education Committee. Basically takes the following actions and I would remind the Body that the action we take is actually a negative action. So, this Resolution actually disapproves certain waivers and there are two (2) of them in the area of physical education, one by Knoxville School District 202 and one by Zion-Benton East District 126. There were a number of school districts who had requested waivers for simulators as a replacement for behind the wheel instruction and this Resolution would approve those for one (1) year only rather than the five (5) years requested. So, it would be a one-year waiver rather than five (5) years. In addition, there's one-waiver for the Rockford School District 205 with regard to general state aid, and that's a one-year waiver rather than the five (5) years requested. There are… there's one (1) waiver for substitute teachers and that was approved… or is recommended for one (1) year rather than five (5). And then finally there's a number in the area of driver's education fees. A number of school districts had requested raising those fees and has been the custom in the past, we're recommending that they only be allowed to do that up to the two hundred and fifty dollars ($250) which has been the precedent of the General Assembly in the past. That basically is what is in this Resolution. The action that we're recommending be taken on the waiver request for this half of 2008. I'd be happy to answer any questions."

"That's an excellent question, Representative Eddy, and probably the one issue that received the most concern over the waivers during this process. The recommendation is that they be granted a waiver for one (1) year. Not for five (5) years as they had requested, but for one (1) year. So that'll give them a year basically to continue to operate the simulators and to come back next year either requesting I guess an extension of that waiver or hopefully they will have been able to work out some of the differences that they have mainly with the Secretary of State's Office."
"So this gives them an opportunity to make their case. Is that right? It just gives them that year, that opportunity to make their case?"
"Absolutely. Right."
"Now when… when the… we discussed… this could be something that the horse is already well out of the barn down the road on because there is a deadline involved with this that has passed. Is that right?"

We did have an option though of amending this Bill and bringing back these, let's say, bringing back the simulators to a four- or five-year waiver other than a one- year waiver or eliminating them altogether. We could have done the same for Rockford on their request on how they count student attendance. However, we chose to not to do that and I think you and I both agree, the reason why we chose not to change what the Senate did, number one, since it's already late that would have made it even later and the Senate would not have acted on that. Basically today's vote is more ceremonial than anything because these waivers by law have already been granted. What… what… every district went before their board and held their hearings requesting a particular waiver, that is exactly the way it's going to be in law. So the simulators, what they requested as a waiver, that's going to stand even though the Senate sent us a Bill they sent it so late there was no opportunity to us to act on it to make sure that the waivers are approved or disapproved. So, any district that required… or requested a waiver this year, they have it. So you can vote however you want, quite frankly, the vote is just simply I guess, do you support the Secretary of State's request or do you not support it. Other than that, this vote means very little if anything. So, Mr. Speaker, I thank you for that clarification. I think that the Adoption Prohibition and Compensation Act was essentially designed for those very rare situations where there may be some inappropriate activity going on regarding the changing of money between an adoptive family and a birth family. And when I talk about the change in relationships with modern adoption practices, we want to codify, at a minimum, an opportunity for biological parents to receive a gift from an adoptive family without it being considered criminal. And so what we've done in this legislation is we have set a cap and teased out the language a little more so we know what is legal and what isn't legal."

If you look at… I don't know what your staff analysis says, but there have been situations where the court and the confidential intermediary are actually trying to get some kind of jurisdiction in other states and have our court orders recognized in other states so that the confidential intermediary can do its job."
"One of the other issues related to this that… that our analysis covers has to do with the perspective adoptive parents of a child that those perspective adopted parents, they could give the biological parents gifts or things of value as long as those are under two hundred dollars ($200)."

I know you and I have talked about this subject starting last year when the Will County State's Attorney's Office brought to my attention that they had a situation where an individual who was on probation in Will County, promised her child to three (3) different families. And one of the families was in New York, one of the families was in Texas and I can't recall where the other state was and it was an issue of what was legal to give to the perspective parent, what could the families really do. If you could please just tell the Body here what this will do to tighten up that type of situation."

This actually… Representative Reboletti, was… this piece of this Bill was due to the exact case that you are discussing, and as you know, you know, we don't want to demonize people under these situations because in most situations these are gifts of love, and… and these are relationships that are very delicate and it's very, very hard to legislate around this kind of stuff. But unfortunately there are some bad actors. And… and unfortunately the Will County case that you brought to the attention of myself and to the Chicago Bar Association is what was the genesis of this portion of the Bill."
