So, it adds a retiree to the board and a retiree, obviously, is not compensated. And it's in full agreement with the board and the pension system."

This Bill originated in my legislative district, was filed by my Senator Mike Frerichs, who talked with some senior citizens at a senior 09500274.doc 9 STATE OF ILLINOIS 95th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 274th Legislative Day 5/28/2008 center in Georgetown, Illinois, in Vermilion County. And they wanted to increase the aggregate value of senior bingo prizes from one dollar ($1) to five dollars ($5) in a single game. And also increase the price of a single senior bingo card from five cents ($.05) to fifty cents ($.50), which would enable them to give a variety of prizes as opposed to the one dollar ($1) limit that's currently on these senior games. The people who frequent the senior center are fully in favor of this. I certainly don't view it as any expansion of gambling. Senior centers do not even need a bingo license to do this. The seniors told Senator Frerichs that this is a form of recreation for them and that this would make the game, perhaps, a little more interesting and exciting for them. I'll be glad to answer any questions that you have."

"Mr. Speaker, just a… a point of issue. This Bill, if you take a look at it, has absolutely nothing to do with what the… says on the board. And, you know, I think a lot of people sit here and they look at that and then they try and figure out what's happening in the Bill. And then you go to your analysis, and there should be something done about that. Because actually, it really has nothing to do about what the title is up there. So, either when you vote for a Bill and then you pull the Roll Call it shows up that there's… it's not that. And if you wanted to ask a question it takes awhile to translate from what you see into what's going here. So, I think that should be looked into. And… I… I have to take a look at what the Lady's Bill is. But just quite frankly, I looked at that and then I look what the Bill does and there's a total disconnect. I think there's a problem with that."

Senate Bill 439 permits the governing body of a municipality to adopt an ordinance that requires the municipal… Municipalities Election Authority to prepare a ranked absentee ballot for municipal and township office candidates to be voted on in the consolidated election. And this ordinance can take place only if the Election Authority submits a statement that says they can, basically, they have the administrative ability to… to do this. So, it is permissive in both ways there. And would like to have this passed. It'll help our military veterans participate, our military people that are overseas and that might have a difficult time getting a ballot back in time, participate in our local elections."

"Well, we… I… I had held it 'til we could have some conferences. I didn't say 'til there would be an absolute agreement. I think we've addressed some of their concerns. I'm not sure how they are right now. But they didn't indicate to me that they were opposed to this."

"In their original concerns, not necessarily a opposition, was it in regard to the implementation? Was it a cost issue? Was it a logistics? What…"

"It… it was part cost and part logistics. And so that's why we put in there the fact that it's permissive. If they feel for some reason that this is cost prohibitive or that it's administratively untenable then they don't have to do it."

"So, county by county that clerk can make that determination based on any unique circumstances that their offices face? This… this isn't… this isn't something that is a mandate requirement for all? This is something that they can choose not to do if for any reason they feel it's difficult or costly?"

"This was brought to me by Daniel Johnson Weinberger, who is a… I guess I'd call him sort of an expert in election law."

"Of all the forces we've had overseas, this one probably has the best ability to communicate, whether it's by cell phone or email. Between a primary and a general election, particularly in Illinois with the primary getting earlier, the candidate on the Bill could become a convicted felon, anything could happen. I… I don't understand the… the ability to go ahead with something like this because I think there's things that change and I think there's better ways of communicating. And then who has a ballot and who doesn't and how do they implement this from the state board? I… I really don't think this is a very good Bill. And then, didn't you agree to hold this Bill? Didn't Representative Eddy just ask you that?"

"I'd really rather not, since this is the last Bill we can… I mean, the last week we can deal with this. The Governor if… if there is some situation as to what you're saying and the Governor needs to do something to clean it up or whatever, which I don’t think there's a need for, but if… if that becomes a concern, then I think he could use his Amendatory Veto."

Where we've not, you know, at least for the largest municipality in this… in this state they have… there's been no military voter, overseas voter that has not been able to vote on a timely basis and… and have their ballot counted."

Ladies and Gentlemen, I… I think that this… I… is… while the goal of the legislation is laudable, is to make sure that our overseas voters are… are getting the opportunity to vote, there is no evidence, at least that I'm aware of, that indicates that there is a problem with the overseas vote… voting in municipal elections. The clerks are very concerned about the ability of their election equipment to do this kind of counting. In fact, it… we know that the election equipment is not tested for this type of counting. And it… we don't know whether the existing equipment would… would work with that kind of counting or whether we would have to invest in new types of counting equipment. I would like to present for consideration Senate Bill 1879, which has been an exhaustive effort on behalf of the financial institutions, the community in the State of Illinois, the Attorney General's Office, City of Chicago and other parties. Senate Bill 1879 is a combination of a couple of Bills that we've discussed most of the spring here in Springfield. The… Senate Bill 1879 adds, through Amendment #3, the language of House Bill 838, which requires homeowners to… about to be foreclosed to receive a homeowner notice 09500274.doc 40 STATE OF ILLINOIS 95th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 274th Legislative Day 5/28/2008 detailing their rights during foreclosure proceedings. It's a Bill that was negotiated with the Attorney General's Office and again, the financial industries here in the State of Illinois to remove all opposition to the Bill. The second major part of… of Senate Bill 1879 is… deals with Amendments to the Human Rights Act to increase the fine of the… the Attorney General can ask a court to impose for a violation of Article 3, which is discrimination dealing with real estate transactions. It would increase those fines from ten thousand dollars ($10,000) to twenty- five thousand dollars ($25,000). And subsequent fines, those fines would go from twenty-five thousand (25,000) to fifty thousand (50,000). Senate Bill 1879 also amends the Fairness in Lending Act to prohibit any financial institution from denying or varying the terms of a loan because of a borrower's race, gender, disability or national origin. Those are the major provisions of the Bill. Would be happy to discuss it if there are any questions."

And I'm noticing… I want to focus on the homeowner notice provision. Because I'm wondering if the requirements as they're written would be violative of the Fair Debt Collection Practices Act? And that's what concerns me. Because under the Federal Law you have to give debtors certain rights and you have to let them know that they can dispute the debt and they have to write within thirty (30) days. But here, you're requiring a notice at the time of summons. And I think it might make more sense to require the notice during the initial communication from the creditor to the debtor."

"Well, it doesn't conflict with the statement that they receive. What we're trying to deal with here is a practical matter. When people get letters from their banks stating… foreclosure notices, the vast majority either out of fear or embarrassment or frustration don't respond in any way. Most people begin to realize the seriousness of the problem when they get served a summons. I think it was a practical approach to a vexing problem to simply put this notice with the summons. When people see that notice of court, to have this information outlining their rights, their options, their choices at a very critical time in the foreclosure process. To give them very straightforward, basic information on how they could perhaps save their home."

"Okay. That makes sense. And I appreciate… I wasn't sure why you did it, but the way you've explained it that makes good sense. I think it's an extra step in a proposal to give as much information as possible in the best… in what we think is the most reasonable way possible."

"Well, I… I think that's a problem here, because under equal protection clauses could we then get a claim from the Polish community that they weren't included for instance? Or from a different community that has a lot of folks. And I think you're opening a real… a real issue here that you may not wish to go, especially, if the loan documents are in English. One, the underlying language of House Bill 838 deals with giving homeowners the greatest amount of information to encourage them to work to protect their homes in the event that they're facing foreclosure. The other provision in the Bill simply deals with equal protection under the law. It's clearly drafted in a way that deals with the fines that are levied for those individuals who have been found guilty of violating practices that are already in the law. We're simply trying to make it more punitive by including greater penalties for infractions to laws that already exist."

"But the burden of proof would be then that you will have to be able to prove that an action took place based on either gender, ethnicity, or racial discrimination?

"Yeah, but we're not debating that at all. The burden of proof does not change with the language that's being put here."

Just to update everybody, currently we do allow for evidence of prior conduct to be admitted if it deals with predatory criminal sexual assault of a child, aggravated criminal sexual assault, criminal sexual assault, aggravated criminal sexual abuse, criminal sexual abuse and battery or aggravated battery involving sexual penetration or sexual conduct. We're not creating a new category here. We're simply adding a few more very serious, serious offenses to be allow… admissible as evidence of a defendant's prior conduct. Senate Bill 2509 also expands a hearsay exception to include any sex offense which would require the offender to register as a sexual offender or predator upon conviction. I think I've spoken to most of the Members about this Bill and many of you are cosponsoring it. I would simply ask you for your support through an 'aye' vote. Thank you. "Thank you, Mr. Speaker. Senate Bill 2713 is an initiative of the Illinois State Police. It clarifies the law… if you remember in the past we passed a Bill called Scott's Law, which basically the Bill provides that when there's a violation for failing to yield the right of way of a stationary emergency vehicle the Secretary of State would suspend or revoke the driver's license of an individual who commits this act only if there's a result of damage or… to the property of another or the death or injury of another, obviously, to protect the… the emergency vehicle's occupants, the police, fire. What's happened is that the Secretary of State has looked at another provision in a different law which conflicts with that and has been suspending individuals even though… who have just been stopped, but who have not been involved in any accident. So, all that Senate Bill 2713 does is clear up that conflict in the two (2) statutes and make it so that the original intent of Scott's Law is put into effect. And I ask for your 'aye'… 'aye' vote."

You'd have death or bodily harm, you'd have the alcohol and drug provision and I believe there's one other and I can't remember it at the moment."

"I'm sorry. Let me just look at this. Basically… I don't think we… we… I think what we did is we added to the other law that resulted in damage or property of another or death or injury of another. And I think that it's an important issue to draw attention to, especially because after I got these complaints I interviewed ten (10) people none of which knew what Scott's Law was. So, I think it's something that the Secretary of State needs to do a little bit more information on to drivers so that they know what it is. Two (2) out of the three (3) people had gotten tickets and then had their licenses suspended without knowledge of that. Thank you."

Senate Bill 2785 provides that the office of the state's attorney shall upon the entry of a verdict of not guilty be reason of insanity, which is not… there's kind a quirk in the law now, inform the victim of the notification services available from the Department of Human Services. This is supported by the Illinois Department of Human Services. And right now, if someone is convicted of a crime and found guilty there are services available so they know when… you know, when the perpetrator is released. But there… unfortunately, with the quirk in the law this did not apply to people who are found not guilty by reason of insanity and have been placed in an institution. And so, basically, now the state's attorney will have to notify the victims that there is notification services available. And I ask for your 'aye' vote."

And… and so, is there a problem with… with HIPAA laws and any type of privacy rights of the person who would be receiving the mental health services and whether or not this victim now knows when those services are no longer going to be received by the person upon who the crime was perpetrated?"

"Well, actually the Bill really provides for notification when someone was either temporarily or permanently released from the institution. It really doesn't go into the type of treatment that they're… or even notify the victim of what kind of treatment they're receiving, only that they have been institutionalized and they've been given a furlough or a temporary release or a permanent release."

But if they're in a… in a mental institution because they were found not guilty by reason on insanity, it's… it's not necessarily the exact type of counseling or services that they were receiving but the simple fact that they were receiving mental health services, which… which does fall under health services and health care. And so, this is the Bill that would provide for the Department of Human Rights to charge a fee to prospective folks, businesses that want to do contracting and be vendors of the State of Illinois. The department is obligated to do an investigation, a background investigation, to determine whether they're in compliance with our laws of the State of Illinois relative to discrimination. The two (2) main concerns when we voted on this previously were, (1) that there be a cap on the fee and so we put a cap of seventy-five dollars ($75) on the fee.
