"Thank you, Speaker and to my colleagues I rise on a point of personal privilege. Many are making much of the delay between the arrival of Senator Burris's most recent documents presented to the House Special Investigative Committee and its dissemination to Members and to the public. As the document was sent to me, here is the story. I'd had a call from Senator Burris's lawyer alerting me that information in response to unanswered and outstanding questions from the committee to the Senator was on its way. After a week in Springfield, I picked up the documents along with the rest of the week's mail from my district office at the end of the day Friday. I brought many papers, including the material from Senator Burris, to Springfield on Monday. I glanced at the document and saw a list of Senator Burris's lobbying clients. This was information that the committee had requested him to submit. Without a closer look, I assumed the entire document was a routine response to committee questions. I searched out 09600013.doc 2 STATE OF ILLINOIS 96th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 13th Legislative Day 2/18/2009 staff Monday morning to check the information against our questions and to begin the distribution of the document, but a miscommunications mishap… there was a miscommunication and that mishap meant staff didn't actually get the document in hand until late Wednesday, the day before a state holiday and the start of a four-day staff weekend. In the meantime, Senator Burris's office released the document to the public on Friday, February 13. It was clearly his expectation and mine that the document would become part of the public record of the Special Investigative Committee. Any suggestion that I engaged in a deliberate cover-up, that I purposely delayed the distribution of the information is totally false. Any suggestion that I should do a better job of reading my mail in a timely fashion is a suggestion I enthusiastically, and more than a little ruefully, embrace."

"Okay. Thank you. As I made reference in the committee this morning, I had reservations about the Impeachment Committee. We were told it was going to be very much like the Heiple Committee, where there would be… it would be a partnership, but it wasn't. We worked quite well together, Representative Currie and I, and on a lot… on the most important issues that are facing this state. And we've had multiple conversations during the month of December and January, Christmas Eve, long conversations and I was honored to be part of this great committee. We kept the committee open for a few reasons: one, it was to ensure that we would have… we'd have to vote again to impeach because of a question of whether or not our action can carry over into a new General Assembly for the trial. Two, was to await perhaps a tape from the U.S. Attorney's Office. And three, any other evidence which we think would be relevant for the trial. The attorney for Mr. Burris on Sunday stated that he reached out to Representative Currie on the 23rd about additional… I'm not quite sure, but he wanted to supplement the record and I don't know exactly the context or the own… exactly what Mr. Wright said, but he was going to provide additional information to the committee. At that point, I should have been notified. It should have been brought to my attention and we should have worked on this collaboratively how to respond to Mr. Wright. And that I'm very disappointed about. But let me add… I will state this, I certainly hope that the documents that I do see now under Special Investigated… Special Investigative Committee, that is the February 4, affidavit and client list of Roland Burris, the transcript of testimony and let me see… not that… the January 5 affidavit to… of Roland Burris. They haven't been given anything. It's not quite… I'm not quite sure if they're part of the 09600013.doc 4 STATE OF ILLINOIS 96th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 13th Legislative Day 2/18/2009 official record or placed into evidence. I have reservations about putting any new evidence into the record at this point 'cause the committee's closed down. We have nothing further to do. But let me talk to you a little bit about there's a… there's a perjury investigation that's going to undertaken by the state's attorney of Sangamon County and under the perjury statute, Subsection (c), there's a clause called admission of falsity. It states where contradictory statements are made in the same continuous trial or hearing, you can make that argument that it is a hearing, an admission by the offender in that same continuous trial of the falsity of the contradictory statement shall bar prosecution; therefore, under the provisions of this code. I do not want the latest submissions to be placed in evidence; I don't… do not want any argument to be made that this latest submission by Senator Burris in effect cures what I believe was untruthful testimony before that committee, so we do that. A sharp lawyer's going to be able to state that section (c) has kicked in, it's been triggered and it could perhaps bar any prosecution for perjury if the state's attorney does find that. The role of this committee, again, was to take in new evidence. It was not to be used to rehabilitate a witness who may have perjured testimony."

If Mr. Burris had this information, he was asked clearly in committee and then all of a sudden, it was later, after his appointment, after all of this that it comes out. Now, folks, you're not that naïve, you can't be, to believe that this wasn't… if not telling the whole truth, just kind of blocked a little bit so that we could go ahead and get him appointed to that seat. I'm not wearing the collar for this in my district, you are. There's a problem here, folks. The ethics and the operation of this government here in the State of Illinois is an embarrassment and this just goes to show it even more. Folks, the committee was working well when information was given. Now, for whatever reason, information was not transferred to both sides of the aisle; information that could have been vitally important for the appointment of this Senate seat. Ladies and Gentlemen, each of you know that I myself am not an attorney, but I don't have to be an attorney to realize certain things were kind of held up. Now, the rule of law may all of a sudden, there may be a trick in the rules here that says, okay, Mr. Burris did not perjure himself. But I believe that there was a lack of willingness to disclose all the information and I also believe, that delaying the information being given out by the committee and those that headed up the committee, reeks, to say the least. Ladies and Gentlemen, and I'll also say this, because I'm speaking as the Representative of the 115th District, if Mr. Burris perjured himself, he should step down immediately."

"Ladies and Gentlemen, I was among the 21 Members of the Impeachment Committee. Using the words of Representative Durkin, I certainly was honored to be a part of that. I had, throughout my 28 years experience as an FBI agent, the opportunity to sit in on numerous wiretap, Title IIIs is how they're referred to and the information that came to us on that Impeachment Committee, as we all know, was overwhelmingly damaging to our former Governor. When Mr. Burris appeared before us, several things stood out in my mind. This man is the former Attorney General of the State of Illinois, the highest law enforcement officer in the State of Illinois, previously. He understands legal questions. He certainly understood simple questions. Representative Durkin asked simple, sensible, on target questions, that were very, very much evaded. I've had the privilege of serving with many of you nearly 7 years. Actually, he said he didn't have any contacts other than friendly conversations with those in the inner circle of former Governor Blagojevich. The most disappointing part of Senator… I'm sorry… of Representative Jim Durkin's questions was he was interrupted, he was castigated. How dare you ask these hard questions? It isn't fair; it isn't right. This is a good, honorable man. Yeah, right. What an embarrassment to all of us. Not only to the Impeachment Committee, not only to the General Assembly, but 12.8 million people in this state were duped right on top of one duping. What a shame, Ladies and Gentlemen, that this has happened to us and now, he travels the state on a listening tour, but he refuses to listen to questions. Face it, Ladies and Gentlemen, Senator Burris won. He wanted more than anything in the world to be a United States Senator and he knew, you bet he knew, he'd known only too well that if he would have been honest and candid with us that appointment never would have happened. Senator Reid, Senator Dick Durbin, were all over that thing. They didn't like it at all because it came from former Governor Rod Blagojevich. Now, they're stuck with him. I call upon the United States Senate to have an ethics investigation about this man and do what is right. If he won't resign, throw him out. Thank you."

"Thank you, Mr. Speaker. I won't attempt to ask questions. I do want to make a comment regarding one of Leader Currie's statements and everyone in here is busy, everybody in here has piles and piles of mail, everybody in here has opportunities to misplace, not read, et cetera, et cetera, et cetera. But I got to tell you something, if the committee had been structured in such a way from the beginning that Representative Durkin would have been given the same level of courtesy, respect, and received at the same time the affidavit that was sent to Representative Currie, perhaps between the two of them one of them would have been alarmed. One of them would have read it in a manner that would have saved all of us this embarrassment. The very rules that were set up in the investigative committee, which allowed for one individual to be responsible, is the same type of situation we're facing with another investigative committee that is supposedly going to look into ethics in this state. It is a mistake to allow a committee structure that would find us in this position. Part of the problem is that that committee structure allowed this mistake to happen. Never mind the bus that just went by and ran over a bunch of staff, that's just another bus. We've got a lot of busses, like a fleet of busses around here. Everybody's throwing each other under busses. The bottom line is, the bottom line is there was an opportunity with that committee to set it up in such a manner that Representative Durkin, as the ranking Member on Republican side, would have had that information. We begged for that opportunity. We shouldn't have allowed it then; we shouldn't allow it with the next committee. And as for Senator Burris, if he has any shred of decency about him at this point, he will resign from that seat. He will allow a special elec… we will allow, through some type of a legislation, a special election to take place because, Ladies and Gentlemen, that is the only way that this cesspool can be cleaned up. This is so tainted, this is so dirty that the only disinfectant that will work is the will of the people. And why we're afraid of it, I don't have any idea. I don't have any idea why we continue to be afraid of an election in a democracy. We've got a lot of work to do here. The people of the State of Illinois are watching us. I mean, you can… as Lincoln said, you can… you can fool some of the people some of the time and you can even fool all of the people some of the time, but you're not fooling the people in the State of Illinois. Representative Bost is right. Where I come from a lie is a lie and the truth is the truth and we didn't get the truth. Final point, we have to make sure that that committee cease to function in a manner that will allow the state's attorney of this county to do his job. And Representative Durkin's point about the do-over, the mulligan that exists in law when you lie or withhold information from a jury or a trial or a committee, we cannot let that be the hole that this guy runs out of. We were called down here several weeks ago to do that and then you on your side of the aisle changed your mind and said, no, no, no, no. Let's reconstitute the Joint Committee on Government Reform. It's not too late to bring that back and reconstitute it. Let's have the same number of Republicans as Democrats on that committee. Let's have cochairs, so what we're going through today and over the weekend doesn't have to happen again. We could do that; it's been done in the past. Thank goodness one of the things we can't seem to influence in this state is the impact of a free press. Would any of this have come to light had it not been for a reporter of the Chicago Sun-Times who called this into play. Ladies and Gentlemen of the House, enough is enough. Last week Speaker Madigan said he would take responsibility for the rules and the conduct of the House. And Mr. Speaker, you know I have… I hold you in high regard and I have great respect for the position that you hold and for the abilities that you have. You can do better, Mr. Speaker. You can truly make the Joint Committee on Reform a bipartisan committee. Let me summarize what the Attorney General of the State of Illinois said today in the Joint Committee on Government Reform. ‘The culture of secrecy that began in the Blagojevich administration must stop.’ I agree wholeheartedly. But that means the culture of secrecy that has been the currency of the Illinois political system for far too long must stop and it must stop now. You can stop it. We can all stop it. But it's going to take more than your words; it's going to take your action and if we can't get action from the top of the administrative… the control of this chamber, then let it begin with each individual Member on both sides of the aisle. Enough is enough. Do you think this just splashes your side of the aisle? Are you the only people that should be embarrassed? Au contraire. It doesn't work that way. I've known Mr. Burris for a number of years, met him years and years ago. I think he is a decent man, from what I have known of him in the past, but now he is caught up in a tsunami, if you will, of public perception, of questions, of snide remarks. Can he, in fact, be effective in the time he has left in the United States Senate? Senator Burris, you're the only one probably that can answer that question and I hope you look yourself in mirror and you answer, whether you now have been a victim of the culture of secrecy in this state, a culture of pay-to-play, a culture of let's take care of our own. If we're going to have reform, let's have one Party control that reform. Don't open the process. Good heavens, we may find some things out that we don't want the public to know. Well, the public is demanding that they be let in. We're not going to stop this and we shouldn't even try. Enough is enough. Haven't we all been embarrassed enough? Let's do what we were called down here more than eight weeks ago. We can still set up the special election, we can still make the Joint Committee on Government Reform bipartisan, we can stop this culture of secrecy, we can stop it here today, but we need action. We're prepared to file the necessary legislation that would do this, but why would it even take that. Why don't we just agree today to stop what has become a perpetual embarrassment on the State of Illinois. We can do it today if you're willing to do so. You don't want to ask questions today. We're focused on the budget problems, we're focused on the… on those promises and issues we were elected to do in the first place and then this happens. Forget the fact that you find out about it by reading about it in the paper over the weekend, you didn't, as a Member of the committee, know the document even existed. But then you go back and you think about the hearing itself. Time and again, questions that were asked by Members on our side of the aisle were interrupted. Interrupted, shut off, time and again. And at the time I thought, wow, these guys are really star-struck, when I heard the first one. And I would just submit, to everyone, go out and read the transcript and look at how many times questions were interrupted. Look at how many times paths were prevented from going down. And then ask yourself, whether that contributed to where we are today. The other thing that I would say is… I found interesting, at one point in time after being interrupted, I finally told Mr. Burris that I didn't think he was answering my questions. And then he said, ‘Well, I'm trying to be truthful.’ Well, we all know how that turned out. Thank you, Mr. Speaker."

Mr. Speaker, I served on the Impeachment Committee. I was one of 21 members who sat every day listening to testimony, requesting documents from our Leader Barbara Flynn Currie, who did an excellent job, her cochair Dunkin… Durkin who helped. I think the important and really significant issue here is, what was the charge of our committee? The charge of that committee was to determine if there was enough documentation and evidence to send the former Governor to trial in the State Senate. We listened to testimony and we decided that he did, there were enough charges that were validated. We looked at enough documentation. We heard from enough witnesses to say there is enough information that's valid to send this to trial. The trial was in the Senate. That was the only role of that committee. The committee was not charged with the truthfulness of Roland Burris. The committee was not charged with is this person eligible or significant or honest enough to sit on the United States Senate? That was not our job. Our job was to see if there were enough documented, validated charges against Governor Blagojevich and the committee did that. Much of this money is under an umbrella of time and if you don't have a program developed, you have a great possibility of not being able to use that money. "Thank you, Mr. Speaker. Mr. Speaker, I would like to share some information with the Body during this month of Black History. And this is for one of our Illinois's citizens that we just lost, and that's Miss Katherine Dunham. Miss Dunham was a world-renowned choreographer, anthropologist and she was the person responsible a lot of the dance steps of Gene Kelly and many of the popular people who we know have made it in the movie industry. I had the pleasure of being one of Miss Dunham's drummers in East St. Louis and got a chance to play for some of the things she did. But I wanted to share that Katherine Dunham was born on June 22, 1909, in Chicago to an African- American father and a French-Canadian mother. She sang in the local Methodist Church in Joliet, but for a financial crisis at her church she might never had sung anything but gospel songs. At the age of eight, she amazed and scandalized the elders of her church by doing a performance of decidedly nonreligious songs. Miss Dunham was not without her fanfare and was invited numerous times to the White House to receive high recognition with Jimmy Stewart and the like. Miss Dunham also had a home in Port-au- Prince, Haiti, which she really loved, the people of Haiti, the fact that is was so impoverished, but she felt that the spirit of the people of Haiti encased the spirit of the choreography and later became known as the Katherine Dunham Technique. Ladies and Gentlemen 09600013.doc 28 STATE OF ILLINOIS 96th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 13th Legislative Day 2/18/2009 of the House, it's come to my attention, after the Rules Committee when Chairman Currie was leaving the room and one could not help but overhear her remarks, and I don't know if it was directed at me or my side of the aisle, but she intimated that we had done enough today attacking peoples' credibility and integrity, I assume, she meant on her side of the aisle. Now, let me just say and I think I can speak… well, certainly speak for myself and perhaps even I think speak for Members on our side of the aisle as well. I certainly did not question her integrity or her credibility. I have worked with this Lady for 23 years. No one was any happier than I when she was named Majority Leader. I have cosponsored legislation with her over the years, some of it very controversial and not embraced by my side of the aisle, but I thought she was right and I thought the issue was right and I was more than happy to join her in some legislative initiatives in the past. Mr. Speaker, it's not our intent to question the integrity or the credibility of anybody on your side of the aisle, but I can tell you what… what I'm questioning and that's the integrity of the process of this House. For 23 years I have maintained sometimes not as calmly and rationally as I perhaps should have, but to me the integrity of this process goes far beyond any of us as individuals. And when we ask that the process, the legislative process, be followed, I think that enhances all of our standing. I certainly think it enhances what we're supposed to do on behalf of the people of the State of Illinois. What I am questioning is the integrity of the legislative process. What this chamber can be is what we should strive to make it every day. I used to wonder… Well, I'll save that for another day. I read a lot of columns in the Chicago media and I used to wonder, how does the City of Chicago work, how is dissent often squashed or discouraged? I'm beginning to find out now and perhaps I can amplify that at some point in the future. But Mr. Speaker, for the record, I appreciate you taking House Resolution #80 out of the record. I would add that if that comes back it is the intent in placing it on the record of the House, that our side of the aisle will ask for a record vote on House Resolution 80. We will also ask that the Sponsor tell us exactly when that Resolution was filed and I think you'll find that it was filed today within minutes of the discussion that began on the House Floor. The Gentleman is serious about his Resolution. I would suggest that he file the proper Motion with the Ethics Committee and that can be looked into. To bring it directly to the floor, to impune the integrity of whoever it is or whoever it might be or whoever it isn't, I don't think that solves anything nor does it save or address the integrity of this process. I said it earlier, I'll say it again, enough is enough. RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SIXTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE SENATE CONCURRING HEREIN, that there shall be submitted to the electors of the State for adoption or rejection at the general election next occurring at least 6 months after the adoption of this resolution a proposition to amend Section 2 of Article IV of the Illinois Constitution as follows: ARTICLE IV THE LEGISLATURE 09600013.doc 99 STATE OF ILLINOIS 96th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 13th Legislative Day 2/18/2009 SECTION 2. LEGISLATIVE COMPOSITION (a)One Senator shall be elected from each Legislative District. Immediately following each decennial redistricting, the General Assembly by law shall divide the Legislative Districts as equally as possible into three groups. Senators from one group shall be elected for terms of four years, four years and two years; Senators from the second group, for terms of four years, two years and four years; and Senators from the third group, for terms of two years, four years and four years. The Legislative Districts in each group shall be distributed substantially equally over the State. (b)Each Legislative District shall be divided into two Representative Districts. In 1982 and every two years thereafter one Representative shall be elected from each Representative District for a term of two years. (c)To be eligible to serve as a member of the General Assembly, a person must be a United States citizen, at least 21 years old, and for the two years preceding his election a resident of the district which he is to represent. In the general election following a redistricting, a candidate for the General Assembly may be elected from any district which contains a part of the district in which he resided at the time of the redistricting and reelected if a resident of the new district he represents for 18 months prior to reelection. (d)If a vacancy in the office of Senator or Representative occurs 180 or fewer days before the next general election, the vacancy shall be filled at the next general election. 09600013.doc 100 STATE OF ILLINOIS 96th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 13th Legislative Day 2/18/2009 If a vacancy in the office of Senator or Representative occurs more than 180 days before the next general election, the vacancy shall be filled at a special election as provided by law. A person elected to fill a vacancy in office shall serve for the remainder of the term. (e)No member of the General Assembly shall receive compensation as a public officer or employee from any other governmental entity for time during which he is in attendance as a member of the General Assembly. No member of the General Assembly during the term for which he was elected shall be appointed to a public office which shall have been created or the compensation for which shall have been increased by the General Assembly during that term. SCHEDULE This Constitutional Amendment takes effect upon being declared adopted in accordance with Section 7 of the Illinois Constitutional Amendment Act.
