This is to help create standards and mechanisms by which if they receive a piece of unclaimed property that could have been used or may be considered as evidence and part of a crime or some type of investigation, this just creates the mechanism by which they work with the State Police and the standards by which they work with the State Police to turn that piece of unclaimed property over to allow it to be used as a piece of evidence in a criminal investigation. So, because the City of Chicago has created a new entity to investigate these cases, they weren't covered under the current law. So, what this Bill does is add agencies that are created like this, by ordinance, so that they can have access to this information under certain circumstances."

"The basic issue is that about 11 percent of the investigations that are handled by the authority involved at least one juvenile victim or a witness to the alleged misconduct. And so, having access to those files gives you more information about who was involved in those… in that particular incident and that's very important in terms of doing a thorough investigation."

This Bill is an initiative of the Cook County Law Library System which is the second largest library system… law library system in the United States of America. But it's a Bill that impacts every law library in every court… Circuit Court system in the state. It simply allows county boards which is through permission of the county boards to raise the fees, the filing fees, that pay for the maintenance of county law libraries. The last time the fees were raised at the county law library in Cook was 1988. And it's an enormous burden on the county budget to fund those libraries in addition to everything else that they do. They primarily fund the county law libraries across the State of Illinois using these fees, these filing fees. We testified in committee and the Bill is supported by the County Law Library Associations, Metro Counties, Illinois Association of County Board Members and Commissioners. There was no opposition in committee. I'd be happy to answer any questions."

"The Bill passed out of both… out of the House and the Senate. It went to the Governor where he vetoed the Bill. It actually and during the… the Bill wasn't called during the Veto Session as much… I think it was called in the Senate first where it originated last year. During one of the summer Veto, 'Veto' Sessions and then there was never a time that and I think a number of the individuals who voted for it was missing during that day, but you only get two more weeks to call it again and we didn't come back until November. So, the Bill eventually… it subsequently died."

"You indicated that Cook County has the second largest law library in the nation. Do we know how many patrons use the law library? Do we have any figures?"

"I don't have them at my fingertips, but I understand that it is the most used, it's the second largest by volume, but it is the most used by virtue of the hours that it's open. I believe it's open from 9 a.m. to 9 p.m. and I think from 9 to 4 on Saturdays. But not only do lawyers use it as a free resource, but it's also an invaluable tool to law students who use the law library while they're matriculating through law school. And anyone who is… the library is open to the public, so anyone can come in and use any of its volumes at any time that the library is open."

"Why… I know they have a good reputation and I know they do a lot of hours. This Bill, in no way does it stipulate that the fees will be set at these marks, that this is simply a ceiling in which they can raise the fees. So, in that regard, it is to say that they'll be raised by 50 percent is not true. I don't even think it's the… and I don't want to speak for the county… but and you can certainly speak to their lobbyist here, but I don't think it's their intention to raise the fees to these ceilings. What this does is create room for them to raise fees…"

What I am concerned though about is the ability to raise these fees so high at a time when, quite frankly, a lot of folks aren't doing real well. And we had an unemployment rate now in the state is over 8 percent. I know in Winnebago County it's over 12 percent. That scares me and I don't want to do anything that could impinge on access to our court system. And I think right now it's pretty expensive when you… when you file a lawsuit and then you have all these additional fees put on and it not only affects individuals, but also affects small businesses. So, as a result, I'm going to vote 'no' and I'm going to encourage people to study this to see if that's really the policy that we wish to have as a state is to increase these fees and potentially make it more difficult for people to access justice. So…"

"I believe that this provision falls under the County Code and it requires… it specifically requires legislative approval to raise this specific fee. So, I believe that to be able to raise the ceiling for this, for the filing fees, is specifically part of the County Code which requires an Amendment in the County Code to do so."

"No, it would not. The Home Rule authority does not impact… would… does not give them the authority to arbitrarily raise this fee."

"In testimony in committee, the director of the county law library indicated the fact that these are ceilings and it is not the intention of the county and the other counties that were there that testified, it was not their intention to raise it to the ceiling, but to create some more breathing room in regards to the mounting pressures of running these law libraries. It's important to point out that we don't try to change it, I think, what the scope of these filing fees are. These are fees that are paid when lawyers file suit in different counties. It is, to raise the fees, what we're giving them is the authority to take a vote at the county board level to increase the fees. "Thank you, Mr. Speaker. I rise in support of the Gentleman's Bill. I have to say that I have been a person on the floor of this House that has been opposed to increases and costs at the courthouse. I think it has kept people out of the courthouse. I think it's been not good for litigants. I think it… anything that puts a burden on people that want to use our court facility is not a good program; however, the difference here is that the Gentleman isn't putting that burden on the court system, he's giving the county board the option of doing it themselves. You'll say it over and over again: local control, local control, local control, until you come across something that sounds political then you're not so much interested in local control, you're interested in General Assembly control. The Gentleman has a Bill that would give county boards all over the state the option of doing what it is that they want to do. It does not add a tax. You would not be voting to add a tax. You'd be voting for what you've always claimed you are for, local control of local affairs. And so, while… if I was on the county board, I may vote against these library fee increases. The Gentleman makes a good point. To give county boards all over the state the option of doing what they want to do, for us to stand in the way of that would be irresponsible."

"The county… the county… Cook County, which I can speak for specifically, already provides for pauper assistance when they are… as for specific types of suits that are filed in Cook County Circuit Court. I don't know what type of suits those are, but I know one for certain is the… for the lawsuits that are under a specific dollar amount, small claims court."

This is completely permissive by county. Every individual county this still does nothing more than give an individual county the authority to discuss, debate and determine what if any fee increases will be in their law libraries. Is… We are not raising one nickel of any fee for any law library in the State of Illinois. That's important to point out. I think Representative Sullivan and Representative Lang hit the nail on the head in terms of what local control is and the proper application of a user fee. These are fees that are paid in part, not the entire dollar amount, but in part, go to fund law libraries so that they maintain at least in Cook County, the second largest law library system in the country, to maintain the fact that anyone can use, lawyer or nonlawyer, can use the resources that those law libraries provide. Law students have traditionally used the Cook County Law Libraries from all over the collar county region simply because of their vast resources, but that comes with a cost. And we're simply saying that counties will now have the ability to help reach and meet those costs of maintaining those law libraries and the assistance they provide to their taxpayers. I urge an 'aye' vote."
