And since the airport still has not developed, we still want to make sure that the taxing bodies continue to receive on leased property. And IDOT's always been a strong supporter of this. So, I would just like to ask that we extend the sunset until 2020 as this proceeds with a third airport."

"Well, you know, one of the reasons that we had a consolidation of departments, and in fact, the new Governor is supporting more of those, is to reduce some administrative costs. "Well, you know, Representative Osmond, I… I happen to think that the director of the Division of Insurance is one of the best administrators we have in State Government. And I think… I don't want to… this vote to be seen as like casting aspersions on him, because I actually think he's done a great job. So, I'm trying to understand what's really going on here. "So, are you just really proposing that we increase the head count at the new Department of Insurance? Is that your goal here? Because, again, the Department of Corrections is a freestanding department, but we certainly, many of us, believe that they don't have adequate staffing right now. In fact, the head count throughout the state agencies is very much down. And I think creating new departments right now is not necessarily the approach. Maybe passing some new revenues would do it, but I don't know what this Bill has to do with head count."

"Well, it does sound… Representative Osmond, it does sound really like you're just trying to increase head count at the Department of Insurance as a legislative policy. And again, this is an area where I think we're encroaching on the Executive. I think we have a new Governor, the new Governor has stepped before us yesterday. "Thank you. I rise in support of the Lady's legislation. This… this item is approved and has been brought forward in conjunction with the Department of Insurance, which up until the last six years was one of the most highly thought of and respected departments within the nation. We were one of the largest. And we've seen some of that change and the effectiveness of some of our regulation change. And so, it made sense to Governor Quinn, Director McRaith, and the department to return to the status where it can be a consumer protection agency that it was designed for. It brings back the respect. There is authorization for the auditors and the people who work within there that are paid for by fees assessed on industries and producers. The only thing that's stopped us in the past from hiring those people and bringing them in was the Bureau of the Budget wanted to drive down head count, and these are people that are paid for. And it's a sad situation when you have tens of thousands of agents and the State of Illinois only has three people who protect or look for fraud. There are only three, many people do not know that, that are out there. That's how far down that has gone. So, it makes sense if you want to provide for the level of consumer protection that we've had in the past and to do something that works in conjunction with the… with one of the best directors, McRaith, that I've seen of the past seven directors and with the Governor, who sees it as the ability to be a pro-consumer structure, given the basis we've historically had and would like to return. I rise in support of the Lady's Bill. Again, as my… as the previous colleague mentioned in terms of an increase in cost, increase in size, given that we're looking at reducing government and is the insurance agency… or excuse me, Division of Insurance less of an effective agency or division than it is as you anticipate it to be within… created as a department? I'm trying to get the real distinction, the cost and the distinction."

"Thank you, Speaker and Members of the Body. This issue is back once again. This chamber fixed this issue last year only to have it stalled in the Senate. A year ago we said that the mandate of a moment of silence in schools not only was bad policy, but was likely to be held unconstitutional, that's exactly what happened. A Federal Court struck down the law that was previously passed. This will simply remove the references to prayer, remove the mandate and make it optional. It takes it back to the way the law in this state was for countless years that schools, if they so choose to have a moment of silence, can do so. That we are not going to mandate what they do. We have countless groups in support of this from the IEA, the IFT, American Jewish Committee, ACLU, ED-RED, et cetera. I'd be happy to answer any questions. I believe everybody here in well-versed in this issue. I'd request an 'aye' vote."

"Absolutely not. As you and I have maintained in the past, in my mind this was not about prayer. And even the Sponsors of the previous legislation had maintained that it was not about prayer. Should a class, should a teacher, should a student want to have a voluntary moment of silence they could do so. Should they choose to pray during that moment of silence, they could do so. That is as it should be. This is really about local control and common sense and constitutionality."

And… and let's be real blunt about this. I don't believe that we need any law on the books to allow schools to permissively have a moment of silence. I think that common sense allows them to do that should they so choose. But this battle has been going on for years now. And what we want to do is say, school district, if you so choose to have a moment of silence, have at it. And if you so choose to have that moment of silence, your students can think about whatever they would like to, be it their home life, be it prayer, be it an upcoming test."

"That would be actually up to the school board to decide. As I tried to indicate before, part of the intention here is to have a local control issue where a school district could adopt a districtwide policy or the school district could simply defer to the classroom. I'm not aware of any school district that has the intention of micromanaging every minute of a teacher's day. "But I don’t think that we want Legislators playing school managers or school superintendents or teachers."

"That… that then becomes an issue within actually the employment agreement between the teacher and the school district. Now, what I don't think the school district could do is mandate a moment of prayer. But the school district could mandate a moment of silence to be followed by their teachers. That make sense?"

"Correct."

"Well, and I… I appreciate the politeness. But, honestly, I don't think that your… that your opinion and mine are that different. I fully believe that the school district should have the choice to make that determination. Where I think we ran afoul of common sense and constitutionality was for us to impose that dictate upon them. And we… we can agree on the nuances of this, but I think on the general concept, we're really not that far apart."

"I apologize." Davis, W.: "Oh no, I was just asking why do we need to do this?"

"Well, with… well, what we have right now has been… we had a law on the books for a long, long time. Then that law was changed and struck down by the courts recently. So, now we're really in a sense of flux. Candidly, common sense would dictate as I maintained years ago, and actually when you had presented the Bill a couple of years ago that for it to be voluntary there was really no need to have any law on the books, but there's been an expressed desire that we have some type of codification of what the state's policy is going to be. My belief is that the state's policy should be one that is in line with the Federal Courts and in line with what we had before, which was that we would leave it up to the schools to decide whether or not they want to have a moment of silence. And if they do have that moment of silence, it can be for whatever purpose that student so chooses. So, as you had advocated before whether it was going to be thinking about the upcoming activities of the school day or thinking about problems at home or thinking about upcoming homework or thinking about prayer, whatever that may be. The previous legislation, as drafted, had said that they could pray or they could think about the upcoming activities of the school day. Were they to think about anything else during that moment of silence, they actually would have been in violation of the law." Davis, W.: "Okay. The… part of reason is, as you've illustrated and as I've read and heard over the past 09600029.doc 30  STATE OF ILLINOIS 96th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 29th Legislative Day 3/19/2009 several months, that the court struck this down. So, is it necessary when the court strikes something down that we have to come back and change it in our statutes? Is that… is that necessary that we have to come back and make the change here when the court strikes something down?"

"Well, I… I… I think the proper thing for us to do then when the court has said that the statute as written was unconstitutional…" Davis, W.: "Correct."

"…and the Legislature in one of two forums has said, we want a statute on the books here. One that we had before that was permissive, one that was mandatory. So, let's rewrite this in a way that is in accordance with the court's ruling, that it cannot be mandatory and cannot dictate that prayer be held during the moment of silence. So, we simply went back to saying, okay, let's make it voluntary and let's clarify that if there is a moment of silence what… what that means." Davis, W.: "Okay."

"That's all we've tried to do." Davis, W.: "Well, I mean I understand your need… you wanted to clarify that, I just asked a question. I'm not a constitutional scholar in that respect. So, I'm just wondering that if something is passed and a court strikes it down is it necessary for us to come back and change it in statute?"

"Not… not… not in every case. We happen to be a state that had a law on the books on this issue and there had been a desire to have clarification of what we think the law should be in this state. The school districts have looked for some clarification from us, since they had in the past. And this is simply our way of trying to give it to them." Davis, W.: "All right. And just for clarification purposes as well, in the analysis it indicates that this was an identical Bill from last Session and it passed out of the House, but it didn't move in the Senate. Do you expect this to move in the Senate this time?"

"I… I… I believe that this Bill will get a fair hearing in the Senate this time." Davis, W.: "You believe so? Okay. Thank you very much."

Representative, when this Bill was presented in committee, I had voted against it because at the time it was my understanding that the court decision was still pending and I felt that, let's let the court decide, you know, before we start making some kind of judgment. And so, my question is more one of clarification. So, what you're trying to do is pass legislation that essentially comports with the court's decision."

"That… that's exactly what I'm trying to do. The… the court found the law to be unconstitutional as previously passed. So, what I'm trying to do is actually take us back to where we were before that and actually clean it up a little bit. I think it… the statute that had been on the books for years was somewhat unartfully drafted itself. So, we've tried to make it very neutral, say it's permissive. You can think about whatever you want during that time. We're not mandating that you have to think about A, B, or C. You can think about whatever you want to do during that moment of silence, but it's up to the school districts to decide if there will be a moment of silence."

"So, maybe another way to say it is that if we were not to pass a law like this or similar law, we effectively would just have an unconstitutional law on the books?"

"We… we would… we would have a law that would be incapable of enforcement because it's unconstitutional, correct."

It includes residents of a CILA, which is a community integrated living arrangement and it puts them into the provision that allows nursing home residents to vote so long as they meet the 30-day residency requirement. The State Board of Education, they… they didn't define CILA in that… in that specific part of the statute. So, we decided to add them so that the people who were living in those facilities were able to vote from those facilities. There's no… no one who is against this. And the Independent Voters of Illinois and Independent Precinct Organization is for it. I also have a wonderful facility in Morris, Illinois, Narvick House, who asked for this specifically. Oftentimes, those local tourism or hotel tax dollars are not necessarily utilized for the purposes of tourism. Tourism here in the State of Illinois is a $26.7 billion industry. The sales tax that we generate at the state level is well over $2 billion per year. The local… and that's at the state level. At the local level they tend to utilize the money for other events, other things that's not tourism related. This is one of the largest industries, probably the third largest in the State of Illinois. And a lot of us, in some cases take it for granted that people come to this state because they have to come here. They come here because of the tourism sales dollars promote in other states outside of this country, in Africa, in Asia, in Europe and this is a vital, vital component to our economy. Senate Bill 2016 is legislation that is necessary to assist our state and city… the City of Chicago in securing the 2016 Summer Olympic bid. It's an insurance program in case there are losses associated with the bid. There's also language that's necessary for the International Olympic Committee in terms of protecting Olympic trademarks, security arrangements. And I would appreciate support on the Bill. And look forward to answering any questions."

"Thank you very much, Representative. I should note that the plan is that there will be $22 billion in economic benefits to the State of Illinois as a consequence of the Olympic games happening in Chicago in 2016, eight billion of that outside of the Chicago region. The American Summer Games have been extremely profitable. There's never been a case of the Summer Games occurring in the United States that were not profitable. The International Olympic Committee requires governments to provide a guarantee, but this is really an insurance policy. "That is correct. This covers the operating costs associated with the games. If there's something catastrophic that happens and there's a loss, it's just the operating expenditures."

"This… this is operations only, Representative."

"Right. That's a very good question, Representative. It… two quick answers. First of all, the way that the insurance program works is that the… any profits that happen from the games will be the first absorbed. The City of Chicago is on the hook first for $250 million. "And so, the future General Assembly, should this be necessary, would be able to ask the very questions that you're talking about and get to the bottom of any issues."

Mr. Burns, I think this is very important for the City of Chicago and the whole State of Illinois and I appreciate you bringing this forward. I wanted to follow up on some of the questions that Representative Eddy had, just I think, to make it crystal clear. The nature of our guarantee is a secondary guarantee. Wouldn't it be that the City of Chicago would have to pay first in the unlikely event that there was any deficit?"

"That's correct, Representative."

"So, we… the State of Illinois's obligation wouldn't come in unless there was a two hundred… an excess of $250 million loss?"

"Actually, Representative, the estimates on the games are… the City of Chicago, any profit that would be gained from the games, would be the first on the hook. So, if the estimates are $450 million for the City of Chicago. So, 450 million plus 250, then you get to the state's portion. "Okay. Well, that's comforting. The other issue that Mr. Eddy had talked about was the real question that I had, as well, concerning the audit function. And I see the position that we're in now, in the State of Illinois, is you're asking us to be a guarantor. Basically, to be a participatory bank, as you will, in case those funds are ever needed to be accessed. My question is, have there been audits done so far of Chicago's effort and are we aware that everything is correct? Because certainly, you don't want to guarantee unless you know that the people who are spending the money are doing so correctly."

"I'm… I'm unaware at this time of an audit of 2016 at this… at this particular moment."

"If… if we… I believe that there are. I didn't know that the Bill was coming today, otherwise I would have come to your office and talked to you about it."

"Sure."

"I believe that there has been some audits, on it as well and hopefully, we'll have a chance to look at those to make sure. And that… that was my concern. Just to make sure if we're going to be guarantor, that everything is correct."

"And I just… I think we have to be prudent on this because this is a lot of money."

"Right. And… and I appreciate that, Representative. The… the other thing I'd want to point out is that, if we do end up being on the hook, there's no appropriation in this Bill. I think it's going to be just a tremendous opportunity for the state and also for the city. And hopefully the Lake Shore on the south end of the city will be as built up as on the north end. "Okay. But as far as these… I guess this is under any particular practice Acts that are being relaxed, if… if some country brings in their own physicians and health care providers and such?"

"You men… you mentioned the procurement process, which procurement process does this mirror?"

"This is for all planning, staging, and all processes related to the games, Representative."

"Well, you mentioned the 25… or I don't know if you mentioned the 25/5? Is that similar language to the City of Chicago goals?"

"Okay. And the key word you mentioned were 'goals'. So, there… so, the intention is that to be a floor, not a ceiling, in terms of a procurement of professional services, contractual, all that type of services for minority participation, is that correct?"

"That's correct. The intention is for the games to… and the people who work on the games and construct the games, to look like the rest of the world. "To answer your question, Representative, my understanding is that there is language in the IOC Charter, the International Olympic Committee Charter, that governs procurement policy. And again, the games will occur… the construction of the games will occur in out years. So, we have some time to figure out some ways to… to strengthen conflict of interest laws. And I'd be happy to work with you as many of these projects will be occurring in my district. And I want to make sure that the people of Illinois understand that there's no funny business going on. But the… but what's critical is to… to have the guarantee on the books now so that we can move forward with Chicago's bid."

The diversity committee's responsibility is to provide oversight over procurement decisions, hiring, and to ensure that OCOG is complying with the city ordinance on 25/5, equal opportunity, human rights laws and anti- discrimination policies." Davis, M.: "And I imagine there'll be a lot of building taking place? I mean, I imagine there'll be lots of work for our union laborers?"

"There will… there is a robust construction plan for 2016 in terms of the Olympic Village and a number of venues that will be built both in Chicago and in Lake County." Davis, M.: "Are there any plans in the works or is there anything being done in order to prepare a labor force from Chicago, namely, African Americans who are not at this time members of the unions?"

Most of these venues and the Village will be in my district. And I've been working with local community partners and would like to involve you in that process with me, as well, to make sure that the Olympic games and the people who work on them and the people who build them look just like the people in the community and in our city and in our world." Davis, M.: "And as we consider that, are there any plans to revitalize Washburn Trade School and have a real vocational school in place where people who live in Chicago can partake of that training, so that they can go to work rather than prison?"

"To your question, Representative, Washburn Trade School is not a project that's being considered as part of the Olympics. My understanding is that there will be robust efforts involving community groups and workforce development folks in the community and community training opportunities. Now, with regards to Washburn Trade School, as you know that's a bigger issue. We've got the capital program coming down, federal stimulus money, and that's certainly something that I'm interested in working with you on in future legislation and budget negotiations." Davis, M.: "And then my final question, perhaps is, there will be people displaced from their homes, is that correct?"

"No, that is not my understanding." Davis, M.: "Okay. So, you will… where Washington Park is you will not be tearing down any of those structures on King Drive, is that correct? Or Cottage, I'm not sure which street?"

"My understanding is that there is… there are no plans to take peoples' homes in order to construct Olympic venues related to 2016. There… I know of no plan to use eminent domain to take peoples'…" Davis, M.: "So, just… just…"

"Well, the plan is to use Washington Park as a site, which is why Chicago Park District is involved in this. And… to use Washington Park as a site for a number of the Olympic venues. To the Bill. I want to first of all commend the Sponsor for his efforts to work with Members of the Black Caucus to tighten up some of the language that was added relative to diversity. One of the things that we attempted to do with this Bill, with some of the Amendments, was apparently there are a number of boards that have to be created to a number of things, oversight boards and otherwise. And to the extent in which we can try to encourage and ensure that these boards are… are taken into consideration, some of the diversity issues that exist in the City of Chicago as well as Cook County and other parts of the state, our Amendments were trying to encourage the board to try to look at that, so that when these decisions are made that the interests amongst a number of different people are taken into consideration from this board. So, that's what you saw a number of members, particularly the Black Caucus, asking a lot of questions, expressing a lot of concern about these kinds of things. And we understand that there are some unique dynamics at stake here. Because we're talking about non profit boards and generally, non-profit boards may or may not have to do these kinds of things. But they've worked with us to try to ensure that certain goals are met, certain goals are in place. So, that as we look forward to the Olympics coming to the State of Illinois and to the Chicago region, that we can have some assurety that the minimum of 25 percent minority, 5 percent women can… will be met. But that's just the minimum. It's certainly our goal and our hope that… that numbers exceed those kinds of 09600029.doc 95  STATE OF ILLINOIS 96th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 29th Legislative Day 3/19/2009 benchmarks. And that's one of the things that we have to work to be able to do to make sure that there are a number of companies that can have the ability to participate in these kind of venues and on these kinds of projects. The Sponsor has talked about a number of things that are going to have to be built to try to accommodate everything that's coming and everything that's part of the Olympics. I know, when I watched the Olympics a few years ago, just thinking about it in the concept of what could happen here in the State of Illinois is kind of mind-boggling. And there's a lot to be done. And that's why many of us have to continue to engage ourselves in this process to make sure, to make sure, that things like minority goals are being met. So, it's not… it doesn’t stop with just this Bill. Again, assuming that Chicago does win the bid, that's 2016. So, between now and then there are a lot of things that are going to have to be done, a lot of construction that's going to have to take place, just a number of things. And it's important for Members of this Body to make sure that we are engaged, to make sure that the entire State of Illinois is benefiting from the 2016 Olympics.
