It simply provides that a… that an additional member be elected to the local school council bringing it… the total members… total number of members to 12. The new member is an individual who is a nonteacher but an employee of the Chicago Public Schools. We're talking about paraprofessionals, teachers aides, perhaps a coach, so that they would have a seat and a say on the local school councils. A little bit… the only real reason behind adding this additional individual to a local school council is to give an enormous group of people who work with children every day a voice on how those schools and those programs are run and implemented. Under the Senior Property Tax Deferral Program, qualifying seniors are allowed to… to defer the payment of their real- estate taxes, we'd take responsibility for paying them, and then at the point at which the property is sold, we'd get the amount of the real-estate tax we have spent plus interest. That program has been in effect for many years and there are a couple of problems that we've discovered with it. For example, one person was able actually to defer $58 thousand in real-estate tax payments. But I just wanted to publicly commend the Governor and to thank the Governor 'cause I learned yesterday that he's having that… that lease reviewed again. And I think he listened to the General Assembly and I appreciate it and it's nice to know that the system works sometimes as it's supposed to work. We questioned the actions and they're reviewing that. So, I know, sometimes we… we complain about officials actions. I think we also ought to commend them when they do the right thing. It would allow the county… It has two years to set up a district which can be no more than two thousand acres in size. It must have brownfield mitigation issues to deal with and must show that the investment would not happen but for setting up this economic development project area. This deals specifically with a certain kind of tax called the machinery and equipment tax that we have in Grundy County which… Grundy is the only county in Illinois that has this countywide. We passed some legislation a few years ago that dealt with this. I would ask for your help again in dealing with this as I have two shuttered industrial plants and this would help both of those plants get back on their feet and deal with some of the… a punisher, this punitive tax that was put on them many, many years ago before many of us were even around or knew what it was about. So, they are there to regulate at the racetracks. They couldn't reach an agreement, so they… they went to, I believe, arbitration or mediation. I'm not sure which. And the mediation ruled in favor of those employees. The Racing Board then, as one of the conditions of these racing dates for Fairmont Racetrack, indicated that they have to reach a collective bargaining agreement with very specific terms or the rest of the employees and the economic engine that is Fairmont Racetrack will not exist."

"So, I agree that the Racing Board and the particular instance involving Fairmont made some mistakes. I agree that they were unfair to the racetrack, unfair to the unions at the same time. It was a big mess that they created, but I don't think at this point there's a showing that the entire Racing Board ought to be eliminated over this one incident. Now, you would say it's a series of incidents involving one racetrack and my concern is have they done… if you can't point anything egregious that this board has done other than what you and I would agree would be errors at Fairmont, why would we take the step of eliminating them by statute?"

However, I believe the Bill would be better without Amendment #2 on it. I would urge the Gentleman to move the Bill back to Second and remove this, what I believe to be, onerous provision in the Bill but presuming he does not want to do that I will have no recourse other than to vote 'no'. We provided a supplemental appropriation for their funding. We asked them and told them that we totally believed uniformly that they were overstepping their bounds by requiring legislative action. They heeded none of that. They listened to none of that. They continued to hold a gun to the head of the employees of Fairmont Racetrack and the families that rely on working there. That is not the reason they were put in place. I'm not saying they're bad people. I come before you with House Bill 5931 which quite simply says that law enforcement in the State of Illinois may not ask or require victims of sexual assault to submit to polygraph tests in the course of an investigation. I would point out one of the reasons that this legislation is so important is that in order for our state to continue to receive federal stock grants that the state needs to certify that it prohibits polygraph testing of victims. Additionally, I would point out the unreliability of the polygraph test in these stressful situations. Based upon those reasons, I would ask for an 'aye' vote from my colleagues."

And I don't know that this issue may not come back in various forms as we go forward right now because I think there is a question and there tends to be, I think, among the general public an inherent and maybe misplaced comfort level sometimes with these."

The university just went through upheaval over an important issue but one I think was overblown and one that most of the people on this floor I think believes is overblown, but nevertheless it was an issue and it was an issue that had to be dealt with. The Governor dealt with it. We have new trustees and as the Gentleman says, they haven't had time to completely get their feet wet yet. We don't know if these trustees are going to do their job well or not well. It's designed to make a political statement about a university. It's not designed to deal with the philosophy of how these trustees become in place in the first place. If the Gentleman was serious about a view that he has that I might not agree with, but if he's serious about the view he has that the power ought to be taken away from the Governor entirely and that because of transparency and the election process or whatever he wishes to argue, that the people of Illinois ought to elect these folks, well then he should have done that. And it's a Bill that should have related to every state university. And because it singles out one single university, a university where it has new trustees and we don't even know how well they'll perform, I think the Bill is ill-advised at this time. I think there's some good parts to this as far as it would be good for Governor to have the advice and recommendations of faculty or alumni, but I really don't think they should be in a position to be making the policy directly themselves. I believe also that the present system of the Governor appointing the members makes him directly responsible to the voters. If the Governor should muff something up, if the trustees do something wrong that he has appointed, then voters can look to him as they do in other departments and say, you're the guy responsible, you need to correct this or we're going to vote against you because we don't like what's going on. I also think that there's a… a problem with the partisan election. I believe this is a… I could be wrong… but I believe this is going to be bipartisan election, so that would be something that I would also have against this. And there probably is some additional cost. When you talk about seven additional members, there are reimbursements that these board members can get for travel and… and lodging or whatever expenses they occur. So, for various reasons, I would recommend a 'no' vote. Thank you."

Dog fighting is an incredibly violent event to witness and it exists within a culture of abuse and neglect. The Illinois General Assembly has recognized the seriousness of this crime. In September of 2009, the Cook County Sheriff's Office seized nine mutilated and abused dogs who were used in dog fighting in my district. The dog fighting equipment was in close proximity to where children play. This Bill will increase the penalty from making a site or facility available for dog fighting when that place is close to where children concentration's by schools, day- care centers, parks and other similar facility. Additionally, this Bill will heighten the penalty for knowingly attending one of these events when the person is an adult bringing a children… a child who is under 13 years of age. It was a very small house where she kept several children there. I think… First of all, the General Assembly has taken, you know, some measures, you know, to deal with this issue as it is. And I think that people who intentionally go to dog fights certainly should have more than their hand slapped." Gordon, C.: "Well, if someone was mauled at dog fight, you could argue under the aggravation and mitigation statutes in the Sentencing Code that there was great bodily harm done and they would be eligible for extended term, right?"

It's… it's… the penalties are extremely disproportionate for what we're trying to punish. If there are such extreme harm done to the victims, it's under these situations, then we can deal with it at sentencing which is already allowed under the Sentencing Code and some of these don't even deal with whether or not someone's hurt, the part that she is amending. I appreciate what she's doing. I know that… that it's a problem. This is also very difficult to prove when you go to court, but I think that there's a better way to handle it and this isn't the way. And I would respectfully request a 'no' boat… 'no' vote from the Body."
