I know many of them personally on both sides of the aisle who want to serve well. Their disagreements at times are great, the debates can be heated but give each one here humility to be corrected, courage to stand on conviction even when it's not popular. "Thank you, Mr. Speaker, and Members of the House. This is House Bill 171. We've talked about this quite a bit. This deals with smoking in casinos. I think it’s very important to note that the difference here with this particular Bill is we're creating smoking optional rooms. Smoking optional rooms, state-of-the-art rooms, ventilation systems, this is ready to go. We heard from Mr. Burke earlier on his Bill. This is far more narrowly crafted. And I ask for your support on this particular provision."

"Can you… can you expand and give us the practical application as to how that would… would work?"

"Certainly. I can use the House Floor as an example. Let's assume that our desks are all gaming positions in a casino and then we have the two anterooms on each side of the chamber. Imagine the anterooms being segregated separated rooms as they are, separate ventilation systems and gaming is going on inside of those rooms. That's the best explanation that I can use or at least explain to you by using a demonstrative exhibit of the House Floor as an example."

"Okay. So, what about the basic argument that everyone is affected and… and employees of… of the casino is obviously, I mean… I mean I get your description…

André M. Thapedi (D)

“Sure.”

“…but what about employees?"

André M. Thapedi (D)

"And I think that if you look at the actual language in the Bill, employees are protected as well and in fact, that was of paramount importance to me that before an employee would be permitted to work in a smoking optional room they would have to apply separately to work in the smoking optional room and in addition, they must also sign an acknowledgment acknowledging the danger and the harmful effects of secondhand smoke which is uncontroverted."

"So, the mechanism… the text of the Bill contains a mechanism that an employee would opt in?"

"If you look at the statute… Can you look at it?"

"Well… well, how is an employee protected, for example, that… I mean, whenever you staff any organization you're going to have a certain number of people that… what if nobody opts in? What if everyone in that organization says we don’t want to work in that environment?"

André M. Thapedi (D)

"I guess it would be the same as an asbestos removal company or coal miners. If coal miners chose not to work in the coal mines or if asbestos removers decided not to remove asbestos, it would be the same scenario. I don’t know if these are real questions or we’re just kind of extending it out for a little bit more time."

"What part of this has to do with the economic impact that the loss of these… this option has had on the industry?"

André M. Thapedi (D)

"And… and again, I think that if you look at the notes, and you'll see that there are several notes on this particular Bill, and those notes were requested by me personally to make sure that I had a full financial picture of what we’re faced with. And I think that you'll recall when Representative Burke ran his Bill I think that he quoted numbers in the hundreds of millions of dollars and there's no question that the State of Illinois has lost hundreds of millions of dollars. COGFA has come up with opinions after the amounts of money that we've lost. In fact, the Federal Reserve Bank in St. Louis earlier this year did their own independent study and opine that Illinois is losing roughly about $200 million per year."

And I represent a border area and I have business folks that… that talk to me all the time. Is there any reason you didn’t take into consideration those additional entities that claim the same loss?"

André M. Thapedi (D)

"I… I take a little dispute with… with your statement because I did in fact take those entities into consideration; however, all I could rely upon is the empirical data. I don’t have any empirical data that shows the amount of losses that those particular entities are losing as a result of the Smoke Free Illinois Act. And I should add, if you actually look at the language of the statute as it exists today there are several enumerated exceptions there. I think that you'll also notice, if you'll take the opportunity to look at the statute that you're questioning me about, that there is one particular provision there and I believe it’s a subsection 3 that's listed as a blank which would lead us to believe that another exception was anticipated or over the course of the years, there's been movement in those exemptions. This is very straightforward, Representative."

"Well, I… I'm not sure what I want to do, but I'd feel a lot better if we were carving out exceptions for other types of groups as well."

"Sure."

"Well… well and I agree with you. It is important to this industry, but I think the question is, here in Illinois we’re $15 billion in debt. We have to come up with innovative ways to raise money. This is something that we’re not raising money on the backs of poor people and in fact, you may recall, Representative, that yesterday the gallery was filled with African American seniors that came down here from the south side of Chicago and they were here because they are fighting to keep vital programs like Circuit Breaker, Illinois Cares Rx those types of programs intact and we’re telling them that we don’t have adequate money in order to fund those particular programs. Here's one solution. It’s not perfect, but it is a solution."

"Representative, I appreciate what you’re doing. I understand the purpose and I actually support the concept. I want to wait and see what happens with the rest of the debate, but again, I would feel more comfortable if we took a broader approach. But I appreciate where you're coming from. Thank you."

"Yes. Thank you. Just of… I have the utmost respect for you. I know you’re a very healthy person; you've got good lung capacity. I'm very concerned. Were you here when we passed Smoke Free Illinois?"

"Okay. Well… I… I was. I'm one of those old-timers and was instrumental in fighting for it. My question to you is, you’re going to have separate rooms. Are there completely separate ventilation systems for these rooms bringing in fresh air from the outside not just recirculating from the smoke rooms?"

André M. Thapedi (D)

"Absolutely. The objective here is to have state-of- the-art ventilation systems and a state-of-the-art room and please keep in mind that it's important for me to make this very clear to you, Representative, that the casinos have indicated to me that they’re willing to make the investment to create this state-of-the-art facility. Under no circumstances and if you'll look at the language in the Bill, under no circumstances can secondhand smoke come out of those rooms. So, I used the anterooms as an example. Smoke would not be permitted to come out of those anterooms. That would be completely contrary to the law."

"How do you seal the doorways?"

"Well, there's several different ways to do it. Think about from a construction standpoint. If you have the anteroom there as we see and if you have yet another interior room there to block it off, it can be done. "Has the casino industry shared with you how much this will cost per facility?"

"They have not shared with me the cost, but they tell me that the cost that they are losing as a result of the smoking ban here in Illinois is not even close."

"Okay. Thank you, Representative. I'd like to move on to the health care costs. Because some of our good health care groups the Lung Association, the Respiratory Health Association have shared with me that the state has saved money. The state has saved money on health care costs since we've passed Smoke Free Illinois. So, I really question, although I… I know you’re a very smart and savvy Legislator so you got these notes, but I don’t know how the Department of Public Health can say that there is no impact on the health when we have seen health care costs go down. I guess I don’t also understand the fiscal notes so while you were very wise to request these notes I am sorry I don’t have at my desk at this moment what has been shared with me by the Department of Public Health and our good health care advocates who oppose this why it will cost us more in health care costs in the long run. So I… I have those… those deep concerns about this. I think that you have worked hard and you have crafted something that perhaps is the least offensive of any Bills to give exceptions to Smoke Free Illinois and I expect that of someone as bright as dedicated as you are. But I do think that it is going to increase health care costs. I do also believe that while employees have a choice if they may feel the pressure that if they say they don’t want to work there and there is a 09700039.doc 9 STATE OF ILLINOIS 97th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 39th Legislative Day 4/8/2011 staffing problem, there may be pressure to say that they want to work there. So while it is not you, it is the Bill you are carrying reluctantly, I have to stand against this Bill and vote against it for health care reasons and the concerns of pressure on employees. "Representative Harris. Sorry, Representative, was there a response for Mr. Thapedi?"

"I wanted to respond to the last statement and I'll be very brief. And I do empathize with Representative May, who I have quite a bit of respect for, that we've worked together on other issues and in fact, we have played tennis together. But I think you should note here that the Department of Public Health did render an opinion with respect to cost that would be impacted by the State of Illinois and they say and I'll quote them, ‘House Bill 171 would not have a financial impact on the Department of Public Health.’ I think that’s because this particular Bill does not encourage or promote smoking. Those who choose to smoke are going to smoke. There's nothing that we can do about that, but if we do have documentary evidence that we’re losing hundreds of million dollars as a result of people making that choice, I don’t see why this proposition is problematic."

"Members, this Bill is on Short Debate and since we didn’t start with the timer, we won't use it on this Bill, but since we already debated smoking in casinos perhaps the Members could show some restraint on this Bill. "The Gentleman yields." Harris, D.: "Representative, it seems to make sense that since we passed Representative Burke's Bill that we would pass this Bill. Let me just make sure I understand. Representative Burke's Bill had no pro… no provisions whatsoever for smoke free areas within the casinos, correct?"

"None. None." Harris, D.: "So, what you're doing is you are mandating that there be smoke free areas within the casinos?"

André M. Thapedi (D)

"Absolutely.” Harris, D.: “Okay.”

André M. Thapedi (D)

“I… I'm carving out sections of the casino, segregated ventilated smoking optional rooms, unlike Representative Burke that was an outright lift of the ban in casinos." Harris, D.: "Right. And it’s my understanding that given the impact, the financial impact that casinos feel they've had from the no smoking…"

André M. Thapedi (D)

"Yes." Harris, D.: "…prohibition that I think the casinos are probably willing to invest in needed… needed funds to make these… these modifications."

André M. Thapedi (D)

"Yes. “Of course, from a financial perspective I believe that the casinos would tell you that their preference is obviously, Representative Burke's Bill because that wouldn’t require them to make any capital investments in their structures but this Bill obviously does." Harris, D.: "Right. Now, so, this might be better than Representative Burke's Bill in that respect; however, you do make a big change from Representative Burke's Bill. As I understand, Representative Burke's Bill only deals with the Riverboat Gaming Act. Your Bill deals with both the Riverboat Gaming Act as well as the Illinois Horse Racing Act…"

André M. Thapedi (D)

"That's correct." Harris, D.: "…which means you anticipate if slots should go in at the racetracks, then the racetracks have the ability also to have these… these facilities."

André M. Thapedi (D)

"You're absolutely correct." Harris, D.: "Okay. Do you have any sense that these racetracks, which in my estimation are not in as good a financial condition as the casinos, that they are willing to make that same substantial investment of dollars to get these sorts of facilities in place."

André M. Thapedi (D)

"And I must tell you, Representative, that I don’t know the answer to that question and you would probably know the answer better than I ‘cause I believe that you’re from the Arlington Heights area that has a racetrack, so perhaps maybe you can give me some insight on that issue. I have invited the racetracks to discuss this matter with 09700039.doc 12 STATE OF ILLINOIS 97th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 39th Legislative Day 4/8/2011 me. They have shown great interest. However, as far as making an investment in a state-of-the-art facility, as we both know, the racetracks are… are clearly, clearly strapped for dollars and I don’t think that they’re in a position now to make the commitment to build these smoking optional rooms, but again, the law as proposed would give them that option." Harris, D.: "Yeah. Thank you for your direct answers and just very briefly to the Bill. The Gentleman's approach I think is a good one based on what we've done with Representative Burke's Bill, but there is a significant change because we no… we now are indeed widdling away at the no smoking ban because now we’re expanding it to… to racetracks. Presumably it could… could come to other facilities as well with future Bills. So, the Members need to be aware that this does not just impact casinos but also the possibility of racetracks, if we… if we put the slots at the racetracks. Thank you, Mr. Speaker."

"So, Representative, could you tell me what your Bill does?"

"I believe that we've talked about this at length, Madam Leader. This this particular Bill allows casinos and racetracks, if they choose, to build smoking optional rooms in the casinos or in the racetracks. And I should point out that these must be enclosed smoking optional rooms and please don’t confuse what I am proposing today with what we 09700039.doc 13 STATE OF ILLINOIS 97th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 39th Legislative Day 4/8/2011 see in airports. The smoking rooms in airports, they don’t work. That’s clear. The scientists have done detailed studies on these smoking rooms in airports, they do not work. I'm talking about something that is state-of-the-art that the casinos have indicated to me that they are willing to make the capital investment to make this a reality and save hundreds of millions of dollars for the state."

"So, these are going to be enclosed… enclosed areas you’re saying and it's going have some kind of ventilation system?"

André M. Thapedi (D)

"It will have state-of-the-art ventilation system, yes."

"And so, have you talked to anybody about… from anywhere about how that would work and if it actually removes all the carcinogens that would be in the air in that room?"

André M. Thapedi (D)

"Yes. Actually we… we discussed this matter and we vetted it out very thoroughly in… in committee. And I provided each of the Members on the Executive Committee with information from a company and I don’t want to give them a free plug, but a company that indicates that they do have the ability to remove all of the harmful affects of secondhand smoke. "I don’t think that the House Floor is 100 precent free of carcinogens that would protect people's health, but I think that what we’re proposing here and what the scientists tell me and what these construction people tell me is that they do have the ability to construct such rooms."

"Well, it's my understanding there's no technology or any kind of apparatus that would do that. Now the second thing I want to ask you about, I want to talk about these waivers. So, you… you say that people who work in casinos will have to sign a waiver that they understand that they’re in a room that could cause them to have cancer or… tell me how that works."

André M. Thapedi (D)

"Well, what's contemplated here is something similar to what, and I've used this example before, coal miners. Coal miners that are working in the coal mines. Asbestos removers that are removing asbestos. Those are dramatic examples but what we’re contemplating here with this particular piece of legislation is that employees that want to work in the smoking optional room, because health care is obviously a major consideration, we want to make sure that they know and that they recognize the harmful effects of secondhand smoke, and in fact, I even made this invitation during the committee that if the Smoke Free Illinois folks that I think that you’re probably reading a script from them, if they have something that they would 09700039.doc 15 STATE OF ILLINOIS 97th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 39th Legislative Day 4/8/2011 like to include in the acknowledgment I'm more then happy to include that in there ‘cause I think that is something that's important."

"So, Representative, in this economy when jobs are at a premium people are going to have to make a determination on whether they can feed their families or their health could be at risk on… in their workplace. Is that what you're suggesting here?"

"People who will sign these waivers will have to make a decision on whether they want to feed their families and keep their jobs and… opposed to their health. They’re going have to make that kind of decision?"

"That is certainly not the legislative intent here. Certainly not that…"

“I would assume that there would be some croupiers and some people that work in the casinos that actually smoke and they would not have a problem working in the smoking optional room."

"As you know, another Bill left out of here and went over to the Senate; I'm not sure what's going to happen to that Bill. It addressed the health concerns and that's where we've been. We’re concerned about people's health. I understand there's only about 20 percent of people in the State of Illinois that even smoke. This is not about smoker's rights; this is about workplace safety. I urge a 'no' vote. And Mr. Speaker… Mr. Speaker, if this gets the requisite number of votes, I'd like a verification."

"I want to go back to the issue of the casino workers and taking a look at this from the workers’ perspective."

So, I'm wondering if this Bill contemplates or if we should contemplate, maybe by rule, requiring a new affirmative request to work in these smoke filled rooms. Because otherwise I think there's a big issue with employees being retaliated against."

It came out of the Illinois Imagines project which is a collaborative effort among the Illinois Department of Human Services, Coalition Against Sexual Assault, and advocates for people with disabilities. The Bill simply provides that for adults with guardians they need not seek advance permission from the guardian for short-term counseling. It's designed to apply in situations of sexual abuse and applies only to five counseling sessions. It doesn’t in anyway, impact the cost of the sessions. There would be no associated cost with this change. It simply permits adults with guardians to request short-term counseling and is designed, again, primarily for sexual abuse situations. So, basically, in order for them to get their… their taxes they would have to have a rate increase hearing that could cost a lot of money that the ratepayers are going to pay along with the rate. And… and in that regards, this is a much cheaper way to recover that cost."

In other words, two semi-trailers, one right behind the other. They’re short in stature; they’re 28 feet. The purpose of my Bill literally takes the wiggle out of the wiggle wagons. There is nothing that changes in the current configuration. The ones that are currently operating on the highway are… will continue to be completely legal. The legislation that I am introducing has absolutely nothing to do with changing weight limits or length limits. It simply removes one of the three pivot points from three to two pivot points, again, taking the wiggleness out of them. It is a tremendously safe concept. This is a piece of legislation that passed out of the Human Services Committee unanimously yesterday that attempts to tighten the controls on group homes, CILAS, in the State of Illinois in response to some total… truly, truly horrendous abuses that occurred in the homes run by the Graywood Foundation here in Central Illinois where two children were murdered and there were 11 other cases of abuse and neglect that were substantiated and the department did not respond because they did not believe they had the adequate authority. We're trying to close these loopholes, prevent this kind of tragedy from ever happening again. I would be happy to take any questions."
