What I think both the Secretary of State and law enforcement officials envision taking place would be for the law enforcement individual and jurisdiction in question to make a request of the Secretary of State based upon their needs."
"Well, if we're basing it based on gunrunning more than three… three guns, I sense a lack of uniformity with the application and the penalty which you are prescribing in this… in this Bill."
"That's absolutely right. The penalty is at the discretion of the Secretary of State and that's definitionally not uniform. It's… it's a…"
"That it is not uniform, but also we're saying that the same penalties we're giving optional penalties, there's really no clear distinction between the two… what would qualify for the suspension versus the revocation. The revocation is the more serious of the two, but we would be penalizing them, one for perhaps maybe a… we're seeking a suspension for one where the facts and circumstances may be more egregious. I think that, as well-intentioned as it is, I think that there is still a drafting error. So, I'll… you know, it's clearly up to you, but I think that this Bill needs a little more work and perhaps just some more clarity."
"Well, my feeling would be that only to the optional nature of the penalty it's acceptable to provide one tool or the other to the relevant law enforcement entities. And so I intend to continue to bring the Bill… to bring the Bill to a vote as it is, but I do appreciate the points."
