It changes the regulatory authority for charitable gaming. We've all been to Las Vegas nights and Bingo nights and charitable card nights. This removes the regulation from... of this activity from the Department of Revenue and moves it to the Gaming Board. Now, you all know I'm not a big fan of the Gaming Board, although they're doing their job much better, but the fact is that the Department of Revenue would tell you that they don't have the people available, the bodies available, the regulatory authority available, to do the work that the statute requires and the Gaming Board does. So, basically that's what this Bill does. It does a couple of other small things. It allows venues to have more licenses, but this does not mean more games. It just means that a good location can go from 4 Las Vegas nights a year to 12 Las Vegas nights a year, but it does not increase the number of total Las Vegas nights that we could have in the State of Illinois and therefore, does not increase gaming. And I've had occasion to talk to my state's attorney and to the State's Attorney of Will County who are vehemently opposed to this legislation. And let me talk to you about it from my perspective and experience as well as what it will happen with respect to criminal investigations across this state. The first thing is that when a search warrant is returned, 09700110.doc 8 STATE OF ILLINOIS 97th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 3/6/2012 110th Legislative Day the search warrant has a list of what was retrieved, and it always isn't returned within eight days and there are numerous reasons for that. If the information contained in the search warrant were made public, there are issues with confidential informant's information being determined. When confidential informants come forward, there may be continuing investigations not only on the target of the investigation but other people that an investigation may then lead to. So, that is going to hamstring investigators. When an investigator knows only the information from the search warrant and only the suspect may know that, but now the media knows that. Now potential jurors will know that and that takes away that element of surprise from the investigators. I would also point you to Supreme Court Rules 306 and 308, which deal with what prosecutors can say to the media and what prosecutors must do to prevent law enforcement from speaking to the media as well. We also need to look at the Sixth Amendment rights of a defendant's right to a fair trial. You have the potential to take jury pools way before anything goes to trial and the media will have the same information as a defense attorney maybe even sooner because the person, the defendant, may be looking for a lawyer and the media will already have information his lawyer would not. Returning these search warrants in eight days would be an egregious burden on the state and also not only turning over what's in the search warrant but making available the items to be seized would be also detrimental to an investigation. That it... it's one thing to turn over the affidavit to which the reason a search warrant is given, the basis of the probable cause but that not everything else is turned over. I think this is a public safety risk. It will put agents and confidential informants in jeopardy. And I would ask for your 'no' vote. Thank you, Mr. Speaker."

As well-intentioned as the Sponsor is... like myself and Mr. Reboletti, we both have some experience in our past lives dealing with search warrants and the execution thereof and also using the articles that have been recovered from a search warrant and understanding full-well that there is a legitimate concern about the identity of individuals or confidential informants who play a very large part of this process. As unseemly as they are, they do provide a value to law enforcement, but this cuts both ways as well. Now, when you have information or documents or... or any type of evidence which is recovered and if that is subject somehow that is going to be disclosed, that could harm a defendant's case. Everything which is recovered from a search warrant doesn't mean it's necessarily going to be admitted in a courtroom. Evidence which could be damning against an individual could poison a jury pool and also the presumption of innocence will be destroyed in some of these cases. I think it does have a compromising effect upon due process and also about ensuring that there's a strict compliance with the Supreme Court rules but also ensuring that both the prosecution is able to conduct a thorough investigation without compromising their case but also it has the effect of possibly challenging a defendant's right to a fair trial if that information is disclosed but it is not admitted into evidence. I would urge a 'no' vote."

I certainly appreciate and respect the previous two speakers concerns about the Bill they log... logged a lot of times in courtrooms and I know their commitment to the administration of justice is strong, but just a point of clarification on a couple of things. This is already the existing law. If you believe that an Attorney General opinion has any weight whatsoever in a courtroom, then you should vote for this Bill. If you believe in the Freedom of Information Act and think that certain matters should be available under the Freedom of Information Act, then you should vote for this Bill. There is simply no reason to keep these records sealed unless a judge deems it so. This is a good piece of legislation. It's been thoroughly thought through. I can understand the concerns expressed on the other side and I'll... I'm perfectly open to continue dialogue going forward to address those concerns, but at this time this Bill has, I believe, what's necessary to pass. There has been some interest expressed by the French National Railway in a major investment in the Midwest with a potential for a major maintenance facility in Rockford using our heavy metal working and aeronautical engineering skills. This would allow on I-90 high-speed rail between Rockford and Chicago where the hub for the Midwest network would be. I'd like to thank Mike Hood, Kareen Kenyatta, and Kara Smith for all their work. House Bill 5233 defines synthetic drugs. It also outlaws the misbranding of these drugs. We, in Illinois, are losing the battle with synthetic drugs. Manufacturers of these drugs find ways to sell them in tobacco shops, convenience stores, and gas stations in our communities. Synthetic drugs are marked as incense or potpourri. There are thousands of brand names and they are labeled not for human consumption. This puts them outside the reach of the FDA and state health departments. Retailers are selling these drugs for huge profits. This approach has been helpful, but simply, the manufacturers change the formulas to stay one step ahead of law enforcement. We need to arm law enforcement better. House Bill 5233 amends our state Food and Drug Cosmetic's Act, an Act that mirrors the federal Food and Drug Cosmetic Act. The law requires labeling of drugs like you would see on Advil or a bag of oranges in grocery stores. Manufacturers and distributors of products are required by law to disclose simply who they are, what the products contain, the applicable warnings to products and the recommended dosage. These are commonsense and commonplace for most companies who are doing business legally. These products, being synthetic drugs, contain a disclaimer that says 'not for human consumption'. Regardless of these words, these are drugs. House Bill 5233 targets retailers of these products. The Bill creates a definition, again, of synthetic drugs and enhances penalties for selling misbranded drugs. The penalties for this must be significant because retailers are making huge profits. As much as 10 to 20 thousand dollars a week selling these products, again, to our teens and young adults. Many times they're also sold for cash which makes them tax free.
