"I rise in strong opposition to this Bill. This legislation applies to all food sold, including fundraising activities on school premises whether or not they are school sponsored. In addition, it also applies to all food and beverages sold on school grounds not only during the regular school day, but also during the extended school day. The State Board of Education is required to develop a procedure for monitoring school board compliance and can establish appropriate penalties for failure to comply. First of all, I disagree with the Representative. Federal legislation has not passed. We should wait until the Federal Government's rules are promulgated. Right now, we're in the middle of the commenting period. Comments are being accepted 'til April 9, and I would ask that the Representative submit his comments to the federal Government. The Federal Government has recently posted for review rules that govern nutritional standards for all schools. The proposed rules include establishing nutritional standards, establishing rules for foods sold inside and outside of school meals, food sold on the campus at any time. "Yes. I think the idea of 'Bringing Your Parents to School' is a stellar idea. We all want parent involvement in school. It has proven effectiveness over time, but as I stated to the Representative in committee, since this is a permissive Bill we would've been better served in having this Bill as a Resolution. I do stand in sincere opposition to this Bill. I think it should be a Resolution because I don’t think we should be dictating the date that a school may hold this kind of activity. Your own superintendant, Representative, stated, that they do this throughout their district and differentiated times for differentiated grades. They do not do it all in one day because it's not possible for them to accommodate all their parents, guardians, whoever might be there to support that student all at the same time. I also think we have not factored in, in any way, shape, or form, the accountability for safety given the times that we are living in and having all these extraneous people who are very connected to our children put into a building at the same time without being able to monitor who's entering our building. So although I think the idea is well served, I think it would be much better written as a Resolution. And I think I know I could show my support for that, but I think we want to be careful what we legislate even when it is a 'may'. Ladies and Gentlemen, as you know in February we honor and respect those African Americans who've gone before us and made a great contribution to this country. I'd like to talk about, for just a second here, heating, ventilation and air conditioning, HVAC. It is the technology of indoor and automated environmental comfort. HVAC system design is a subdiscipline of mechanical engineering based on the principles of thermodynamics, fluid mechanics and heat transfer. Based on that, I want to introduce you to an African American, I'm sure you've never heard of, his name is Mr. David Nelson Crosthwait. He was born in Nashville, Tennessee in May… on May 27, 1898. David Nelson Crosthwait studied mechanical engineering at Purdue University before taking a job with the C.A. Dunham Company at Dunham. Mr. Crosthwait conducted innovative research, designed the heat system for Rockefeller Center, designed the heat system for Radio City Music Hall. Dunham Company, Mr. Crosthwait held many positions. He was the director of research. He conducted research in several areas including heat transfer, steam transport. His work led many innovations in HVAC devices and technology, and he held more than 30 United States patents as we mentioned before. Besides research and development, product development in HVAC systems design, Mr. Crosthwait advanced the field by writing articles, revising sections of several editions of American Society of Heating Ventilation Engineers Guide. His accomplishments were recognized by many in his field. He won a medal from the National Technological Association in the 1930s, and he was made a fellow of the American Society of Heating, Refrigeration and Air Conditioning. He was the first African American to receive such honor and I believe, as I'm sure many of you do, if our children knew this history we'd have a much better world. Thank you very much."

ROAD FUND All funds collected by the State from any taxes or fees levied or imposed for the payment of bonded indebtedness for the construction of permanent highways, and for expenses of the Department of Transportation for construction, reconstruction, improvement, repair, maintenance, operation, and administration of highways shall be deposited only into the Road Fund, its successor Fund, or with a trustee for the benefit of the Road Fund.
