"Ladies and Gentlemen, last week we were all made aware of the senseless and tragic event that happened in Fort Hood, Texas and one of the victims of that shooting was Sergeant… Army Sergeant Timothy Owens, 37, of Rolla, Missouri. Timothy grew up in Effingham, where much of his family still lives. He attended school there and… and moved out to Rolla and then joined the Army 10 years ago. Timothy was a very pleasant, likeable guy, never met a stranger. He chose to be a counselor in the Army 'cause he very much wanted to help everybody that he met. And this is kind of what he was doing last week when the… when the shooting occurred. He was trying to help people and it cost him his life. Talked with a couple of the people in Effingham on Friday and one of the most interesting stories that happened was his sister, who was put up for adoption 52 years ago, had just found out about her… her family and spoke with Timothy last Sunday, just four short days before he was killed. It was the first time they'd ever spoken. I guess God has a plan for everything. In fact, it's funny because, speaking with quite a few of my colleagues, they're either, Linda, you need to do some more fining, or Linda, stay away from it. And the interesting thing is the last, at least two years, I've had IHSA in front of a committee of mine, the Elementary & Secondary Ed, and they've been very elusive, whether… whether it's the… Lisa Madigan's office requesting some information about the way they deal with para-Olympic children in the state or whether it's dealing with our Auditor General. What we find is they were created in 1908 and they have very little to no oversight by the state because they say they take no membership fees from the 861 school districts in which participate in IHSA, which is great, but they do assessments, so they are taking money from the school districts, which are taxpayers' dollars, and this is what I'm getting throughout the state is, what we'd like to do is have a couple hearings. I received some information from my residents at the IMSA, Illinois Math and Science Academy, that one of the gentlemen that was working, this is an editor for IHSA scholastic bowl tournament last year, was reviewing questions that the IHSA had put forth in the scholastic bowl and found that some of them had been plagiarized from Internet sources. When the person reported this and brought the problem to IHSA, he was fired by the assistant executive director and informed the executive director was told about it but they did nothing about that. So, there's question there with scholastic bowl. And then also, that disabled swimmer fighting for chance to compete was a story that was picked up by the Chicago Tribune not too long ago and the Attorney General's Office, Lisa Madigan had asked, because this… this child sued the IHSA in Federal Court in May, alleging that its actions violated the Federal Rehabilitation Act of 1973 and Americans With Disability Act of 1990. Chicago-based Equipped for Equality, a disabled rights group, is representing her. So, there was questions that were brought by our Attorney General for the State of Illinois, which represents all the constituents in the State of Illinois when they have consumer issues, and the IHSA ignored her questions. So, based on all those things, once again, I'm sure IHSA is doing a fine job with what they're doing and running the state's sports. Now, they have every right to ignore us based on the fact that we created them and we gave them self- autonomy and they can literally do whatever they'd like to do in the State of Illinois without any oversight from the General Assembly. To my knowledge and to the research I've done, there is not one other organization that is like that, that does not come under the auspices of this state or the General Assembly, in which we can… we can look into the records and make sure they're doing what they need to do for the State of Illinois and the… the citizens. Now, from a letter from the office of Auditor General William Holland, I asked him, when we had the address, exactly what they are required to report as… as far as auditing with them. And I quote in his letter, in reaching the conclusion, the Attorney General cited the Illinois Constitution limitation on audit authority to public funds of the state and case law interprets the phrase to mean that those funds appropriated otherwise authori… authorized by the General Assembly, following the Governor's preparation submission of the state budget, the City of Chicago v. Holland. So, the Auditor General has even looked into these things, but they have given him very little information and they've come forthright with some issues that had nothing to do with their budget or contracts and those things. The IHSA has never mandated that a school buy any ball, bat, or uniform. The IHSA has annually updates its members of finances, annual report, mailed and online. The IHSA puts its financial audit on the Web for public… public to see. The IHSA has instituted many programs, rules, policies to minimize risk to students. But beyond that, Mr. Speaker, from this Resolution, as other speakers clearly stated, the IHSA does not charge dues to the schools. The IHSA saves the schools a lot of money. But there apparently are conflicting Bills which allow for individual jurisdictions to deal with how a sex offender can address and deal with their children. What we brought to committee was a way to try to clarify, though, that will allow that under circumstances where… that an individual has been granted opportunities to work or to interact with their own children, even if it's under limited circumstances, that that same individual would be allowed, whenever the child is present, to go to a public park and watch that child participate in organized sporting activities. That's essentially what we're trying to accomplish with this Amendment.
