And my recollection is that the first vote on that Bill with all the pieces together got like 8 votes. So then, I broke it into pieces, so that a voting block that could support one part of it would have the opportunity to vote for that part, a voting block that could support another part of it would have an opportunity to vote for that part. I'm actually giving an opportunity here by putting it in pieces to allow for the adoption of both of these Amendments. Lynn Pearson is a county board member in Peoria County. Lynn Pearson has served the county board for almost 20 years. She is chair of the Democratic Women's Organization, excuse me, a former chair of the Democratic Women's Organization, former UAW Local 974 member, served in many capacities within that Union. And personally, Lynn Pearson, along with many of the other women in the gallery, Helen King, Pat Kenney, Rachel Parker, Camilla Kellerstrass, who is my Chief of Staff, have been a part of what I call my kitchen cabinet. We all know there's a group of individuals who we all bounce things off of, rely on for support, and they are that group for me. This year… this year she will be getting her green on in New Orleans while visiting with family. She is an avid St. Louis Cardinals fan, so instead of hanging out with us during Spring Session, you will find her hanging out with Cardinals team in Florida during spring training camp. "Thank you, Mr. Speaker, Ladies and Gentlemen of the House. House Bill 1285 is the unemployment insurance agreed Bill. This is an agreement that was reached between the department, the organized labor as well as business. As you know, this was the agreed Bill process. It worked. I think we 09900088.docx 14  STATE OF ILLINOIS 99th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 88th Legislative Day 12/2/2015 should be doing it for other items such as worker's compensation because this shows that we can come together in order to reach an agreement. What this would do, it would do basically two very important things. It would eliminate the Social Security offset. We are one of only two states that has a Social Security offset that reduces an unemployed worker's weekly benefit by 50 percent of their Social Security retirement payments. That was agreed to by business and that was agreed to by labor. In addition, this would expand the misconduct definition to limit the number of employees who are eligible for… to receive UI benefits. And that was agreed to by business as well as labor. It would also eliminate what we call a speed bump for 2016. When speed bumps are done… or put in place so that labor and business have to come to the table in order to reach an agreement on unemployment and ensure that the trust fund is solvent. This would eliminate that speed bump, a speed bump that would have greatly increased taxes on the employee… employers and reduce benefits on employees. So, this would get rid of that speed bump because of this agreed Bill. In addition, it would indicate that there would be a moratorium on UI legislation through 2017, unless the legislation is agreed to by business and by labor, the department, the Governor's Office, and the Legislative Leaders. It would also develop a mutually agreed method for evaluating the benefit each side will receive from this Bill. They're still working on that, and it is my intent that it is an agreement that they will continue work to verify the benefits to the employers. As someone who has carried the Bill to repeal the Social Security offset for seniors who receive unemployment and… and were the only people in the country here in Illinois who found their benefits cut as a result of being on Social Security. I want to thank everyone who… who participated, who heard the unfairness of that policy, who signed on to cosponsor our Bill, and who heard from my constituent who was a one woman army, who brought this issue to the forefront. Many of you have met with her, heard from her. And this is a great day because this is proof that one person can, in fact, make a difference. The unemployment… the agreed Bill process was never inclusive of seniors. I want to say thank you to Representative Hoffman, Representative Kay, to the Governor's staff who worked on this, all the interested parties who met. Today, with this Bill, we are finally telling the business community in Illinois that the General Assembly will take steps to improve the business climate here in this state. I have heard from a number of small businesses throughout our state who have been negatively affected by the unemployment system as it exists today, the abuses they've been through, the costs that they've incurred. This Bill shows we can make progress. We've got a lot more to do, but we really can do it. So, thank you, and urge an 'aye' vote."

We, in the past on issues of unemployment insurance as well as worker's compensation, have had an agreed Bill process. I would suggest and I would submit that if we truly want to reform the worker's compensation system that agreed Bill process should be in place and that's what we should be working towards is working together to come up with a consensus. I move that we concur in Senate Amendment #2. This is, once again, an agreed Bill. And I would also like to thank Representative Cassidy for all her work and her advocacy on getting rid of the Social Security offset. "Thank you, Mr. Speaker. I'd move to concur in Senate Amendments #2 and 5 to House Bill 500. This is a Bill that extends the Dental Practice Act for 10 years. It also contains several aspects of… or several provisions dealing with access to care. Namely, allowing hygienists to participate in an underserved community to do cleanings, allowing dental assistants to do scaling with… with substantive training, and other issues. I know this Bill is the subject of a lot of debate amongst… in our district offices from hygienists. This Bill is not rabid anti-dentide it's not anti-hygienists. It's straight down the middle of a fair compromise to offer access to care for dental patients in Illinois. I would urge an 'aye' vote."

"Sure, Mr. Speaker, I heard that question but I have a feeling it's going to get harder to hear. Thank you. First of all, Ron, this is a 10-year extension of the Act. So it's important to remember, and were this Bill not to get the votes, beginning January 1 we would have unlicensed dentistry in Illinois, and I… that doesn't do anyone any favors as far as policy. The issue that we've grappled with in this committee has always been the pursuit of access to care, allowing hygienists to participate in underserved areas by doing cleanings and those roll… those acts that hygienists always do. Over the course of several months of negotiation, there were several entities involved: the Illinois Public Health Association, PEW, the dentists, the hygienists. There came about a policy proposal where, in addition to giving the hygienists a step toward access to care by allowing them to participate in these areas where there's underserved communities, dental assistants would be allowed to do scaling which is cleanings in a controlled environment of children under 12 years of age. There's a belief among the hygienists, that that's unfair, that it's an encroachment upon their territory. I have to say, I don't view it that way, I view it as a fair compromise. If we're going to talk about access to care, it means cleanings by hygienists, it means scaling's by dental assistants. I think it's fair. We went through that, we went through this specific issue long and… for a long, time and what I came away hearing from the hygienists was that they were uncomfortable with the arrangement of a thousand hours of practical care followed by 16 hours of training. And I specifically asked them, is your fundamental concern that assistants are going to do this or is your fundamental concern training? And the answer I got was training. And if that's the case, then my answer back to them is, we're here. We're not… regrettably to the citizens of the State of Illinois, we're not going anywhere. So, when you just said a minute ago about access to care, when I was trying to address this issue this was about hygienists being able to go out in the communities and provide care that dentists weren't doing at any given time. Maybe some dentists were, but a wide array of dentists weren't going out into communities, they weren't going into underserved neighborhoods to provide this care. So, is the idea that the assistants are now a part of this, are they going to go out into the community and provide the care?"

"Will, I think what my understanding of the Bill is that in… in areas where dentists are choosing to perform their services in underserved communities, they feel it would be an asset to have their assistants be able to perform this scaling act. So to the question of access to care and what dentists… what, value dental assistants provide when we want our dentists to go out into these communities and do the… the… serve these communities. They feel it's important to their profession, if we're going to shift the focus to access to care to allow the dental assistants to do the scaling." Davis, W.: "Okay. But my question, because when I had… when I was doing… was trying to address this issue and talking to hygienists, they wanted to go into communities where dentists weren't serving and provide care. So, I'm trying to understand because the assistants are now a part of this…"

"Yeah." Davis, W.: "…are the assistants now going to be in the communities providing the care or are they going to still be in the offices? And if so, then how is this increasing access to care if they're not willing to go where the hygienists at least said they wanted to go?"

"Because the hygienists are going to go where… I don't want to speak for you, but the core mission of what the hygienists have always wanted is to be able to go into the communities without having to be under… in the orbit of a dentist. Under this Bill, which is what we… what PEW has said, and what the health associations have said this is a step in that direction. Hygienists are going to be able to do the… do the cleanings and apply their craft in underserved communities. As a corollary to that, as a sidecar to that, in instances where dentists are serving underserved communities, they're going to be allowed to supervise dental assistants that… when they do the scaling." Davis, W.: "Okay. Well, I guess if it's a matter of going back and evaluating at some point in the future, I guess we have the opportunity to do that."

"Yes." Davis, W.: "I'm still concerned that we're… that access to care is not necessarily increasing as a result of this and that the dentists decided to put the hygienists in this as pawns in this conversation 'cause if the… if they don't like what the hygienists wanted to do, then let's add the assistants in there. Now I can appreciate the idea of adding more training for the assistants to give them the ability to provide a service. But my question as I've talked to Representatives, lobbyists about this, who's going to be out in the community because if the assistants aren't going out of the offices, who's going to be out in the community driving, I guess, that business to the… to the dentist."

"The flip side of that, I think, Will, is. "Like, so the… the concern by the hygienists is you're doing… you're allowing dental assistants to do this thing that we don't think they're qualified for. If… if we do that, if we… if we were to say, well, we want to more aggressively put dental assistants in underserved communities, I don't necessarily agree that the hygienists will be okay with that. So, I don't know. I want to work continue to work on access to care. I know this isn't a perfect solution, but I really truly believe it's a step toward what we've all been trying to push in dental care for underserved communities." Davis, W.: "Okay. And this is very, very timely, unfortunately, data breaches are all too common. Just recently there was a breach of a company called Vtech, and it's a child's programmable tablet company that has educational programming. And they had a breach which resulted in the loss of children's names, addresses, gender and even photos also usernames and passwords to access the account. So, some of those items would be addressed in this Bill if it's passed into law. So I would, again, appreciate your support and ask for an 'aye' vote."

What remains in the Bill in that category are medical information, health insurance info, some biometric data, and username and email and password, which of course are very critical if you have a breach. Additionally, reasonable data security requirements are now provided for. And that category is one that would be particularly helpful in the breach that I just referenced, of the company Vtech. So, basically, it's just requiring companies to provide for reasonable means to take care of your own personal data. And right now, there's nothing in the law that requires that. So finally, it provides that you can notify a local media in the event of a breach instead of if you're having a breach, say, in downstate Vienna perhaps, nod to my friend in the back row, you don't have to call the Tribune and report that in. So that's just a small change as well."

"That's not my… I didn't use those… that language, but we didn't change what was a breach. We basically modeled it after the underlying Personal Information Protection Act. We had a Bill earlier this season sponsored by Representative Moylan that spent quite a lot of the money that we collect for local governments, giving that money back so that road projects and other activities that are important to local governments could be funded, not GRF funded, but funded through these special funds that we control. Since that time, the Governor has approached us asking for help, making sure that the bureaucracy that is State Government can continue to operate. As you know, under court orders we are already paying our workers, but some activities through State Government cannot happen unless we authorize additional spending. That's what these measures would do. Without GRF money, without general funds, it would become special funds. And then finally, there's another Section of the Bill that many people in this chamber have been concerned about since we didn't adopt a budget that began July 1. Programs like low-income energy assistance, programs like domestic violence shelters. We've had hearings on this House Floor. We know how struggling these agencies and these programs have been. "General revenue continues to come into the state, and as you know, the Comptroller does her best to write checks to see to it that we pay our debts, that we keep up with our obligations. I should suggest that we are spending at a rate that exceeds the revenues that ultimately will be available to us during the current fiscal year, but in the meantime money is being spent, General Revenue Funds are coming in, General Revenue Funds are going out. State workers are by and in large paid out of general revenues. Much of the operations of the Department of Children and Family Services, the Medicaid budget, that all comes from general revenues and under… under court orders and requests that money is continuing to flow. My point being that we have this budget problem that we can't resolve, but oh, we can spend $28 million in general revenue. So it seems as though we can come to an agreement at least on $28 million. But let me look at the other, and I will compliment you by the way, let me look at the other and ask you a question about the other parts of the Bill. And I compliment you. Representative, 4305, Representative Moylan's Bill was a good Bill; it passed out of here with 114 votes. There was a difficulty with the Bill, and that is, it was de novo it was generated in the House, the earliest it could have been acted on in the Senate presuming they didn't come back would have been January, right?"

"Yeah." Harris, D.: "So 4305 really, the intention of 4305 was good but it couldn't have been acted on the way it was because of parliamentary requirements until January. So what you have done is you've taken 4305 as well as some other things and put into this Bill as an Amendment to a Senate Bill so it can go back to the Senate for Concurrence. So all you need is Concurrence in the Senate and the moneys can start to flow as soon as the Governor signs the Bill, right?"

"Well, we believe the Governor will sign the Bill. So, that's a good thing meaning that the dollars will be able to, presuming that the Governor has agreed and we understand he probably is, the dollars and the moneys will be able to flow to these entities fairly quickly rather than having to wait until January, correct?"

"Yes." Harris, D.: "Okay. That's good. That's good. Let me ask you though, why just these other state funds? How many… how many funds are there in the State Treasury?"

"There are quite large number, as you very well know." Harris, D.: "In excess of… 900 in excess of are there not?"

"Well, and again, this was a negotiated settlement. The Governor decided it was time to govern and so he has asked for… for items that will make it possible for his agencies to operate the way they should. He was very resistant earlier in the Session and I believe he still is, to using moneys in all the special funds. I don't know if he has designs on them, if he wants to borrow from those funds for other purposes. Many other agencies that help people in our communities who are rape crisis centers, sexual assault programs, they're not funded in this Bill. I myself would have wished that they were." Harris, D.: "Would they be funded if we funded all other state funds?"

"Some of those might be, yeah, But some of them…" Harris, D.: "So…so, the Gov…"

"…some of them come, some funding for some programs comes from general revenue." Harris, D.: "So, the Governor's intention aside. We are the Legislature and I agree, quite frankly, with the Speaker of this House who says we are an equal branch of government. I buy that. It is our responsibility to pass an Appropriation Bill. So my question is this, why don't we appropriate all other state funds?"

"So, why don't we need…" Harris, D.: "We can pass an appropriation to do that."

"We… actually we did in May. We did exactly that. And I don't think you were part of that particular solution, that particular important piece of the puzzle, but the people on this side of the aisle did pass a budget. We passed a budget that included all the items that are in Senate Bill 2039 and a good many that are not. The Governor had a chance to fashion the budget through reduction, a line-item reductions and through line-item Vetoes he chose not to take the chance I think now his agencies are telling him that it is time to govern. And I think that's why we're looking at the provisions in Senate Bill 2039 that will help the bureaucracy do its job." Harris, D.: "The budget that was passed in the spring was clearly out of balance, everyone admitted that. We know that, okay. The issue in the budget that was passed was general revenue not other state funds. The other state funds, the dollars are in these funds. The dollars in the Lottery Fund to pay the prizes. The reason that the Comptroller can't write the check is because we have not passed an Appropriation Bill to give the Comptroller the appropriation authority to write the check. So…"

"And we are, in this Bill…" Harris, D.: "In this Bill, that's correct. But my point…"

"…we would do just that. If we have your support to do so." Harris, D.: "I'm not… Representative, I'm not arguing against the Bill. What I'm saying is, why just these funds? Why not… why not all the other state funds. And oh, by the way, is this not true. If we passed an appropriation to appropriate all those other state funds, all that is appropriation authority, correct?"

But the point is, the Executive has that authority because we… what we did in February to grant 1.5 billion where we swept all those funds, it's because the Executive had not spent the money in all of those funds. So the dollars were there to sweep, correct?"

"I will only just reiterate, the Governor did not agree to a Bill that would have spent the money in all the special funds. I don't know if he plans a sweep, I don't know if that's what he has in mind, it might be." Harris, D.: "Okay."

"But I guess I would encourage you to go have a chat with the second floor to see if you can't free up more of the special fund dollars so they can be used for their original purposes." Harris, D.: "As a matter…"

"Early in the Session, if you recall, the Governor's people were very strenuously opposed to the idea that we should appropriate the low-income energy money, even though that was a special fund, not… had anything to do with general revenue. They didn't want to do that and it was always my guess that they wanted to be able to sweep it if things got tight in other portions of the state budget." Harris, D.: "Well, as a matter of fact, I did have a chat with the second floor on this very issue, just earlier today, so 09900088.docx 47  STATE OF ILLINOIS 99th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 88th Legislative Day 12/2/2015 I know where they're coming from. But Ladies and Gentlemen of the House, I stand in support of the Bill. There's a lot of good things in this Bill. There are however, the issue is real. The issue is, why just these funds? Why not all the other state funds? And oh, by the way, I had a conversation with a fairly high level individual within the Governor's Office and I asked him, well, why when Representative Moylan's Bill 4305 was being considered, why don't we do something to help here and take some action on these other state funds? And the answer that I got was this. Well, we don't want to do anything piecemeal. What are we doing? This is known as piecemeal. So next month we're going to come back, of course it'll only take 60 votes next month, but we're doing things piecemeal. We can pass these things, we need to come to an agreement, get a full budget. But why not… why are we concentrating on just these funds when we have so many other… other state funds that need to be funded. So I stand in support of the Bill. I just don't think this is the right way to run a railroad. Thank you."

I just want to point out that in July, Ladies and Gentlemen, we had a Committee of the Whole where the topic of domestic violence and domestic violence shelters in the State of Illinois was discussed, which was the middle of the summer. Now, here we are at the beginning of winter. In that time, you know, there are 52 domestic violence shelters in the State of Illinois. One of them has already closed in Centralia, and it's had to reopen on a very limited basis. There are a lot of things we probably would like to see in this Bill. But taking care of, you know, women who are victims of domestic violence in every corner of our state, providing money for breast cancer treatment and detection is important, providing money for HIV detection and prevention is important. Mr. Harris pointed out quite succinctly how this is a piecemeal budget and unfortunately that's what we're doing here. This Bill is based on Marty Moylan's Bill, and what's interesting about that is the Governor, until shortly before the vote, was opposed to that Bill saying it was a piecemeal budget. And to paraphrase, I think he also said it was a bit of a budget buster because it was too big, but now that we've added more money to it, the Governor is now for it. Again, I appreciate the evolution, because I think it's the right Bill. And I want to thank Barbara Flynn Currie because if you would not have put a hold on the previous Bill, 4305, we would not be here today getting this done, which is a better Bill that will get done quicker now because it will be a Concurrence on a Senate Bill and you were able to negotiate what needed to be done. So I want to shout out to my Majority Leader. It's because of her efforts, that's why we are here today. So nonetheless, we are in great peril. And I think it's time that we need to stop playing political games. The Comptroller skipped, Ladies and Gentlemen understand, the Comptroller skipped… last month's pension payment. Think about that. We passed a budgeting for results law a few years ago that required… required that the pension be paid first before anything else. And the Comptroller did not make that payment because we didn't have the money. Our unpaid bills are on course to exceed 8 and a half billion dollars 8 and a half billion dollars. So I would ask the Governor to keep the General Assembly in continuous Session until we reach a budget agreement no other business should be conducted. And instead of lending money… and I can't tell you how insidious I think this is… instead of lending money to our locals, we ought just to do our job and to pass a budget. So Governor, if you're listening, please keep us here. Let's negotiate a real, full budget agreement and let's build off of the success today because that's what we ought to be doing and that's what we need to be doing, and that's what our constituents expect us to be doing. So I think the time for politics has passed; the time for action is now. Something that my colleague just said a few minutes ago that really strikes close to my heart, we could've moved forward months ago. Actually, we could've moved forward months ago because back in May we submitted a Bill that would have funded all of these things with a couple changes, if the Governor had simply did a line item Veto we actually wouldn't be here, talking about this Bill. Over the last several months the public has witnessed us attempting to fund the needed services that are now represented, some of them in this Bill. The thing that is really striking me about this and I support every one of these items, as I drove 72 this morning and the snow was coming down, my thought went immediately to how we're going to have enough salt for the roads to make sure that the public is safe as we travel the highways this holiday season. And the salt was one of the most important things I thought of this morning, Leader, as I drove 72 because it's a very dangerous stretch of road. And so this Bill includes things that are important to us that may not be as… in the forefront of some people's minds, but as I think about the 9-1-1 services in my community I think about the City of Urbana that's been suffering trying to figure out in this budget how to pay for 9-1-1 services, working with our METCAD system as well as the City of Champaign. But I’m hoping that this afternoon our Leaders will begin the talk… conversation about adding this topic of revenue to their discussion. But finally, I want to say as I traveled over this morning I received a call from our domestic violence shelter and that shelter is, as Representative Harris pointed out, one of those shelters that may end up having to close its door to the families in Champaign County and throughout the area because it is the only shelter that provides that type of service. And so I'm hoping that as soon as you all vote 'yes' on the other side and join us with this that that shelter will have a little bit of courage and support to continue to hold on until the Comptroller can at least release funds to save this shelter. And then finally I'll just say, yes, I agree that the state is in grave peril, but it is not in grave peril just because of one side of the aisle. We have not done what I believe is necessary for the long haul for the state, which is to look at how we tax in this state. Flat taxes do no provide revenue for ongoing generations and we know that that's a fact. So I hope that the discussions include a way for us to look at our Tax Code, to really address the long-term problems that the state will face even after all of us are gone. As a matter of fact, Representative Mautino and I were the cosponsors of a Bill that added $2 to the license plates so that the Department of Conservation, which was woefully short of financial resources a number of years ago, would have the adequate resources to run the department. But we're saying here that they have to have a minimum of 165 officers. We don't even mandate that for the Department of State Police. And oh, by the way, we should have a Department of State Police Trooper school to add more State Police, quite frankly, I believe and we… than before we add conservation officers. Let me throw out a number to you, by way of what this impact is going to mean. The Department of Natural Resources, a short 10 years ago, had a budget excess of $100 million. You know what the Department of Natural Resources budget was as proposed by the Governor for this year, 38 or 39 million dollars? They are struggling… they are struggling to fund themselves. They don't have enough money, in my opinion, to run the Department of Natural Resources. Starved Rock State Park gets 2 million visitors a year and we're starving the Department of Resources. Yet now, we're going to add a three and a half million dollar unfunded mandate on to the department. Absolutely the wrong direction to go.
