It addresses issues of making sure that installations of the cameras comply with the Fire and Life Safety Codes. It addresses a very big concern of the nursing home industry, as far as, you know, when an employee ‘must’ versus ‘may’ turn off one of these cameras at the request of the resident. And it also gives the Department of Public Health explicit rule- making authority, which the department was not sure that they had in the underlying Bill. I'd be happy to answer any questions."

So, there are changes that were requested by the industry and by the Attorney General to be sure that installations of these devices were compliant with the appropriate Fire and Life Safety Codes. There was also a change of the word ‘may’ to ‘shall’ at the request of the industry, who were very concerned that language was permissive about when a employee or agent of a nursing home could turn off or disable a camera at the request of a resident. They just didn't want it to be their discretion; they wanted it be… to be mandatory. So, we changed that language at their request. And there was also a change made at the Department of Public Health to give them explicit rule- making authority over all of the Sections of this statute. Those were the major points."

And today's Bill is an effort to fill in the gap by allowing access in other areas where people and children are likely to experience anaphylaxis for the first time including school buses, day cares, summer camps, college campuses, and restaurants. The Bill allows access, but does not mandate any entity, to carry pens and training options created under the first Bill ensure free and low-cost training options are available. A portion of the Bill, it specifically allows our front-line police officers the option to carry and is known as Annie LeGere's Law, in memory of a 13-year-old Illinois girl who tragically passed away last summer. I want to add special thanks to Representative Manley, Senator Nybo, and all of the concerned stakeholders who worked very hard to craft this important piece of legislation. There is no opposition. The Bill changes the sunset date to October of 2019. For those unfamiliar with Covering ALL KIDS program, this is the health insurance program that ensures that children with family incomes from about 200 to 300 percent of the federal poverty level in Illinois have access to health insurance coverage. The Act provides access to preventive primary and oral health care for kids through the age of 18. And all families in this program are required… required to pay a monthly premium and copay for every visit. This is ultimately the same example of this. And regardless of how the Bill was funded last week, I didn't hear anyone talking about how there was merit in any of those projects that were listed. We're not even talking about the critical human services programs that were contained in that Bill or any of the other projects that we are talking about dealing with in our districts, whether it's infrastructure grants that are on hold for no reason except for the political games that we keep on playing. I think it's important to recognize that once again almost a year later we are still playing these games with our grants, with our projects, with our human service providers, with our higher education institutions, which are in jeopardy of closing and never being the same again, because we are losing a very important quality of programming and quality of services that we are… are just wasting and throwing away with these continued games. It allows for individuals with prior convictions to file a petition to expunge a new criminal record, and that's only in the cases where the… the person was either released without charge, acquitted of the offense, dismissed of charges, or successfully completed an order of supervision, or successfully completed probation for a certain drug and alcohol offenses. The board is very proactive in reaching out to the facilities to makes sure that they send the information with regard to the discontinuation. So, if anything, our attempt here is just to further make sure we're… that they're clear and that those agencies or organizations, excuse me, that have to provide that information that they understand exactly how they are to provide it." Harris, D.: "Okay. And I know you… you have… you feel that this board is needed. I feel that it's not needed. Let's just for one second talk about those discontinuation of services reports. When they go for… when they discontinue services, they no longer need to go before the board to discontinue those services. Is that correct?" Davis, W.: "I be… I believe… I don't… I'm not sure, but I believe they don't have to go before the board, but there is a process that they have to submit documentation to the board relative to the discontinuation of those services." Th… the situation now is they do not have to go before the board to actually present their case for discontinuation; they simply have to provide reports." Davis, W.: "Yes." Davis, W.: "…overseeing." Harris, D.: "Thank you for the answer to the question. And very briefly to the Bill. Ladies and Gentlemen of the House, we have discussed the Illinois Health Facilities Planning and Services Review Board at any number of occasions. I contend that it's an interference with the free market. It's a holdover from… from planning days when we… we planned what health care services were going to be. What's happening in the health care market nowadays is we have all sorts of different variations, not just hospitals, but ambulatory surgical treatment centers, and FQHCs, and all sorts of variabilities taking effect now. And to force them to go before this board, both before and after, and file all these reports is nothing more than a bureaucratic nightmare. While I think the Gentleman's Bill is reasonable to do what he wants to do, the board itself, in my opinion, should be eliminated. Thank you."

One of the reasons they say, our analysis, that they want this Bill is so that the Health Facility Board can become a stand-alone entity in the future. "I can't… I'm having trouble hearing you." Davis, W.: "I think they currently are a state entity in and of itself. They're quasi-governmental. They have an operating board. So…"

"They… they want to become… I think they made three times in our analysis that it's supporting the board's cause to try and become an independent entity." Davis, W.: "Well, I… I think that's making reference to the current agreement that they have with DPH to provide some of their operational support. So, it's not doing anything different in terms of making them a stand-alone board. It's just clarifying that they don't have to seek those operational supports originally which… the way it was. They don't have to seek those operational supports…"

Davis, W.: "No. No, not at all."

"Okay. Explain again." Davis, W.: "Again… again, they're… they're… they are a small shop. They are a small shop. So, the operational supports like payroll, HR functions, they don't have the capacity to do that currently. But this just says that if they want to say talk to CMS about doing those functions in the same manner that CMS does it for a lot of other agencies, that they can go to CMS and seek those supports that it just… that it doesn't have to come specifically from DPH."

"Okay. All right. Thank you. And I really appreciate what the Spon… the Sponsor's answers. To the Bill. And… I understand what you're trying to do, but I think there's a bigger issue here. The question re… really ought to be should we per… be perpetuating a broken system that rations health care, encourages monopoly, increases… increases prices, and is a detriment to health care. Because by making it easier for them to stand alone or to work with other governmental entities, what we're doing is perpetuating a broken system that causes hardship and limits the amount of health care that people can get in the State of Illinois. I believe that this whole entity ought to be abolished. As a result, I would respectfully ask that the Members vote 'no', not in a repudiation of the Sponsor, because I think he's doing what he needs to do but in a much bigger picture. We need to reform health care in this state to make it affordable and accessible to all of our citizens and to stop the monopolies. Please vote 'no'."

I can appreciate the comments of other speakers relative to the… to… to what the board does and the role that they play in health care system in ill… in Illinois. I disagree with that, with their assessment of it, because if we have a free market enterprise system in health care, then who protects to make sure that minority and underserved communities get health care? A free enterprise system means that folks can locate where they want to locate and do it in any manner in which they want to do it without being checked at all. And I'm sure if that's the system that we want relative to health care. We definitely want to make sure that communities, underserved communities, are being serviced in that arena. But that's not what this Bill does. Again, this is a technical Bill that speaks to how the Health Services Board can continue to operate and from which agency they could possibly seek services to. "So, this Bill provides for an update to the Child and Family Services Act as well as the Juvenile Court Act as to how parental rights are terminated for parents who are incarcerated. The law used to provide that if a child was in foster care for 15 out of 22-month period, their rights could be automatically terminated. Obviously, if a parent is incarcerated, sometimes they will exceed that amount of time. This still provides the parental rights can be terminated if it's not in the be… best interest of the child, but for the first time we're contemplating what is, unfortunately, a common situation, and that is children either born to incarcerated parents or children whose parents are incarcerated after they're born."

For children who are dangerous, of which that's 25 percent of the children who get arrested are for violent crimes, clearly those people… those children would remain in detention."
