Senate Bill 61 is actually a repeat of legislation that the Senate passed unanimously last year. It is an effort to prohibit requiring employers to defend the same claim with regards to human rights issues - the exact same claim - in two different venues. It is the practice, unfortunately, sometimes where an individual who's denied in one forum will simply go to another forum with the exactly the same claim and require the person defending the claim to defend it there as well. This -- this would prohibit that practice. I simply -- be happy to answer any questions and ask for an Aye vote.

There are a large number of rural townships across Illinois who, over the years, are -- are accumulating an -- a -- a -- a sizeable backlog of moneys in their general assistance funds. And this comes from a township in my district who wants to make a transfer from moneys being unused from the assistance fund into their general fund to help with issues like roads and -- and -- and other needs that the township may have. In order to be careful, the bill only allows that transfer once every ten years, there can be no State moneys in the general assistance fund, they could not have borrowed against it in the last three years and could not have raised the levy in the previous year. These industries are frequently examined and found, in identifying gender bias-based pricing issues, in discrimination. So the language is the result of work that we did with -- with IRMA to make sure that they would be okay with the bill. So I know of no opposition. We also made sure, in the Floor amendments -- there were some information left out as it applies to penalties - thank you - and -- and also the -- the language -- the providing of the price list, we also came to that, I apologize. So that's what's in the two amendments. Thanks so much for that question. So, last year, we passed a law that repealed the tax on sanitary napkins, tampons, et cetera. In doing that bill, there were other studies out there, and -- and certainly personal experience, that shows that there are areas in the service industry where women are paying more for the same services as men. And rather than make the ultimate assumption that there is discriminatory practices, what we'd really like to do is ask those businesses to have their price lists available on those top ten items. So that, for instance - I think most women in here know - if I go to the dry cleaners and get my jacket dry-cleaned, I'm probably going to get charged between seven and ten dollars for that. If a man goes to a dry cleaner and gets a jacket cleaned, he's going to pay - and these numbers aren't 20 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 34th Legislative Day 4/25/2017 exact - but he's going to pay substantially less for that, maybe fifty percent less. Another great example is if you get a shirt cleaned. A man's shirt - and literally the only difference in a man's shirt is that their buttons are on the other side - in many cases, he's going to pay a dollar or two dollars. A woman's shirt is going to cost between three and six dollars. So if there are reasons that, you know, these services are costing them more, fine - you know, then certainly. We just want to make sure that buyers have that information, know what the pricing is, and we're making sure that we have gender equity.

And if that's true, wouldn't the company try to take advantage of that by pricing lower products or reducing that margin to take advantage of the free market?

I'm not sure if I understood the second half of the question. Certainly, there may be reasons for some of them. Sometimes they talk about, in particular, with women's jackets that the cleaning apparatus that they use to clean them is a little bit different, because in some women's jackets there are items called darts, because we have these things on the front of us that men don't. So the jackets are a little bit different. So -- so my understanding is, with -- some of the dry cleaners have said through the years that they don't have a dummy, basically, to put a woman's jacket on. My argument would kind of be, it's not the 1950s anymore, we wear jackets too, get the right apparati {sic}. But I don't want to make the assumption, so that's why we didn't say in a bill that the prices have to be the same. We said you should have them available to customers. I should know when I go in. You post your prices for your ice cream, I'm sure, on all the flavors. I want the flavors posted. I believe that when we go in and we get our hair done or we get a -- a service that we have a right to know right up front what they're charging us for it, and if those prices are different, we have a right to ask why. So if they have a genuine reason for doing it, that's fine. You know, this is really just helping to inform and making sure that pricing is not gender biased.

Yes, I just wanted to follow up. I'm -- I'm not objecting to companies posting prices. That sounds like a -- a reasonably good idea to me. If I understand what you're saying - I'll just make up numbers - you're saying that a dry- cleaning company might charge two dollars for a man's shirt and four dollars for a woman's shirt. I'm trying to understand why a creative entrepreneur wouldn't come in and start doing women's shirts for three dollars and thereby make -- take advantage of the market and -- and build a new business as a result of that.

I believe that every free market protection that -- is necessary. It's called price discrimination in econ, and my seventeen-year-olds have to answer a question about why don't we outlaw price discrimination. We're not trying to do that. It's allowing every free market price discrimination item that anybody might wish for and it even says "but are not limited to" these. So I believe, as a free market guy myself, I can be in support of this bill.

Right now, school districts, downstate districts with a large number of poor and special needs students, they're required to use federal money -- federal Title I money that's supposed to help these students directly and instead almost half of that money is going to help off {sic} to pay the State's pension debt. Specifically, what the bill does, it amends the State's Pension Code so if school districts make payments to the Teachers' Retirement System from those federal funds and based -- it's based on the employer's normal cost, not the unfunded liability rate. What this does, it allows the money to be used directly for educating poor students and not to go to pay off the State's pension debt. I'm not aware of any opposition and I'm happy to answer any questions.

Senate Bill 677 is Senator Althoff's infamous nurse's Compact bill, back again. I believe this is the sixth time. I have an understanding with a new sponsor in the House that this legislation actually will move and be voted on this Session. So I'd be happy to answer any questions. Basically what it does, it provides a mechanism for RNs and LPNs to obtain the privilege to practice in their home state and all other Compact states under the same licensing. It does not reduce the requirements. Senate Bill 680, Floor Amendment 2, amends the Safe Pharmaceutical Disposal Act and the Environmental Protection Act, and it allows counties to take unused, expired, or unwanted pharmaceuticals collected by a county and/or municipalities and they can dispose of these drugs in a drug destruction device to the extent that is allowed under federal law. Currently, statute allows counties to deal with drug paraphernalia and illicit drugs, but we have no mechanism in which to deal with pharmaceuticals. So this would actually just broaden that description and allow them to deal with drugs, regardless of how they were obtained.

Thank you, Madam President, Members of the Senate. Senate Bill 772 extends the sunset of the Podiatric Medical Practice Act from January 1st, 2018 to January 1st, 2028. It also makes the following changes to the Act: It adds elder abuse as grounds for disciplinary action by the Department; adds that information collected by the Department during an investigation is confidential and can only be disclosed in the case of other law enforcement or regulatory situations or law -- lawful subpoenas; provides for electronic communication from the Department; and eliminates the requirement the Department maintain roster of licensees. And I'll be happy to answer any questions.
