Senate Bill 1285 is actually the Illinois Department of Revenue's annual omnibus technical cleanup. The most important part of the legislation that I need to make you aware of, it actually now provides if a taxpayer overpays on his or her return, the taxpayer may credit that excess payment for the following years or even transfer that credit to a similar taxpayer under the Act. This is something that people, our taxpayers, have asked for for a long time. It's scheduled to expire at the end of this year. This program has been vital to growth in downtown historic districts that struggle economically. This credit simply leverages private dollars to help put vacant, crumbling properties back on the market. It's really been the main economic development tool, I know, in Rockford and that's also the case in cities of Aurora, Elgin, Peoria, and East St. Louis. Important projects would be at risk in those communities as well. This legislation will grow economy in these areas, expand our tax base, and increase revenues in the State. This bill prohibits the State from doing business with or investing in "expatriated entities" that incorporate in a foreign tax haven in effort to avoid paying State and federal corporate income taxes and requires that the Illinois Investment Policy Board identify expat entities so that the retirement systems can engage in shareholder activism and divest from expatriate entities if the shareholder activism is unsuccessful. Senator Righter, this bill brings Illinois law in line with federal law. And the Investment Policy Board can identify all expatriated entities and it would restrict those that incorporate in a foreign tax haven and it would prevent us from investing in those companies.

The -- when you -- you say that this brings us in compliance with federal law, Senator Hastings, I want to be really careful with that language because it implies that, well, this is something that the federal government does so we need to follow suit. This bill amends the Procurement Code to prohibit an expat entity from submitting a bid or entering into a contract with a State agency. An expat corporation {sic} (entity) is defined as a foreign incorporated entity which is treated as an inverted domestic corporation under the federal Homeland Security Act of 2002.

So, Senator, I'll go back to my -- my first question, which was, what do you expect this bill, were it to become law, what do you expect the effect on our pension funds and rate of returns or opportunities for greater rate of returns to be?

Senator Righter, I'm not an investment banker, nor can I predict the rate of return for our investments. But I do think that -- if a corporation is dodging paying their taxes by incorporating in a foreign tax haven, I have a problem with that because they're not paying Illinois income taxes.

Senator, this bill levels the playing field among businesses that compete for State contracts and investments and it prohibits expat entities from bidding on or entering into contracts with the State. And I can -- for me, in terms of these expat corporations, they're not paying their fair share.

Ladies and Gentlemen of the Senate, when I was in law school, one of my professors told me that you shouldn't answer -- ask a question more than twice, because when the person being asked the question doesn't answer it, you've made your point, and I think the point has been made here. Okay, the entities described under Senator Hastings' bill are not in violation of the federal Tax Code, the Code that existed not only under this administration but the Obama Administration. And the reason that it's legal is because we want the opportunity, and the reason we want this opportunity here is because we want the opportunity to maximize our return on investment for our pension funds. So all of you who have any concern whatsoever for unfunded liabilities in our pension funds, I would suggest that you oppose this bill. For those of you who think that we should be wary with regards to political correctness dominating our policies, particularly our financial policies, you should vote No on this bill. This bill reduces return on investment; it makes us harder to be in compliance with regards to what we need to be with regards to our pension funds. Urge a No vote. Thank you, Mr. President.

This bill levels the playing field among businesses that compete for State contracts and investments by prohibiting expat entities from bidding on or entering into 20 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 40th Legislative Day 5/5/2017 contracts with State agencies and restricting the State of Illinois and the State-funded pension systems in investing in expat corporations. Companies that engage in elaborate restructuring schemes avoid paying their fair share of State and federal taxes and should not be rewarded with lucrative State contracts and investments paid by Illinois taxpayers. This is unfair to those individuals and businesses that work hard and play hard and play by the rules and pay their fair share of Illinois income taxes. The State of Illinois should be doing business with and making investments in companies that are good corporate citizens and pay their fair share. The federal government has prohibited federal agencies from entering into contracts with expat entities since 2003. This legislation would piggyback on the federal prohibition and use the federal standards to identify expat entities. And by the previous speaker's arguments, it seems like he's okay with that; he's okay if you go ahead and you want to incorporate into a foreign country because you want to avoid paying your fair share of taxes. If that's the way you really feel, go home and tell your people about it, that it's okay to dodge your tax obligation. That's what the argument is here. People who dodge their fair share, I don't want to do business with you. But, obviously, the argument on the other side of the aisle is that that's okay. But that's not okay with me and that's why I brought this bill. And, Mr. President, I ask for an Aye vote. Thank you very much.

The bill requires the prosecution to disclose any discovery or intent to introduce testimony of an informant at least thirty days prior to any hearings. The bill allows the prosecution to disclose with less than thirty days' notice if the court finds that the informant was not known and could have not discovered been {sic} prior to the thirty-day notice. Finally, the bill allows the accused to request a reliability hearing even if a lawful recording of the incriminating statement is made or if there's a lawful recording of the informant's statement to law enforcement, including any deal or promise made to the informants. This bill, with the two amendments that were just adopted, would incorporate negotiations that have occurred for the past two years to implement automatic voter registration in the State of Illinois. Since we first debated this bill in the Senate and in our committee process, other states have led the way and I think we've brought this to the point to where we have hammered out nearly every issue that has been brought forward both by the Rauner administration as well as Members on both sides of the aisle here in the Senate and 35 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 40th Legislative Day 5/5/2017 over in the House. I'd like to go through a couple of the changes that specifically were incorporated into this bill as it sits today in the Senate. Again, these changes came from both the Governor's veto message that we took up last fall as well as from the Secretary of State's Office and advocates, county clerks, and others that have participated in this discussion. Number one, we align the language of the bill to better address concerns that are ongoing at the Secretary of State's Office with the implementation of REAL ID. Number two, we address concerns that were brought forward regarding mailed notifications when registration happens. Number three, we incorporate into the process name changes, not just address changes. We deal with federal disclosures. And we also deal with notification for current registration. There are other things in the bill, but I would also note that one change that's incorporated into Floor Amendment 3 adds two agencies at the Governor's request to those State agencies that would implement automatic voter registration. Those being the Department of Natural Resources and the Department of Financial and Professional Regulation. With that, Mr. President, I'd be happy to take any questions on the bill.

And to date, I think that this bill is reflective of what we would like to see, both of us, especially… I know that there's one outstanding issue and I appreciate that there's an agreement that there'll be some work in the House to alleviate the concerns that the State Board of Election {sic} (Elections) has. Thank you, Mr. President. I want to begin by thanking the previous speakers both -- on both sides of the aisle. All three of which and beyond have helped craft what the final product looks like today. A -- a couple of points on this bill: This is Illinois leading the way on a very critical issue, and that is access to the ballot box. Number two, I would hope, reflective of the roll call that's going to happen in a few moments, that this provides evidence to people in the State of Illinois that Democrats and Republicans can work together on an issue that oftentimes just goes right down the partisan hole in the Legislature. At the end of the day, what this bill's going to do, it's going to register people to vote whether they vote for a Democrat or a Republican. It's going to save money. It's going to streamline our process. It's going to modernize our system in Illinois, and that is, without question, going to lead to more people, more citizens of our State, regardless of where they live, regardless of party affiliation, participating in our electoral process. And regardless who wins an election, we all win as citizens of the State of Illinois. And I would just close by saying this -- I said this the first time that we took a vote on this bill, which was about a year ago. Thank you, Mr. President. Senate Bill 1980 amends the Criminal Code. It's an initiative of Cook County Sheriff Tom Dart. It adds several crimes to the list of offenses for which a bond court judge may set no bail for a defendant. This problem -- the problem we're trying to address with this bill is actually highlighted this morning in a story posted on the Chicago Tribune website about how repeat gun offenders sometimes bail out of jail at a higher rate than individuals charged with low-level drug crimes. Sheriff Dart has attempted to address this disparity in the past with legislation we passed, like the "Rocket Docket" bills that speed up low-level drug offenses through the system to ensure non-violent offenders aren't just languishing in jail because they can't come up with a couple hundred bucks to post bail. Senate Bill 1980 seeks to address the other end of that discrepancy by ensuring bond court judges place more scrutiny on repeat gun offenders. I know of no opposition to the bill. It provides that there shall be no place of detention and criminal processing established or maintained on the grounds of any school, effective immediately. In -- in simple terms what this bill does -- and it's hard to believe that it even exists. Currently, we do have schools that main -- where the police department maintains a booking station for children. And what this bill does, ensures that that practice is discontinued. The thought that our kids go to school knowing that somewhere in their building there is a booking station to incarcerate other children is just unacceptable in today's society. 60 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 40th Legislative Day 5/5/2017 Senate Bill 852, as amended, extends the live theater production tax credit and the film production services tax credit to January 1, 2027. One of the things we were doing in the Senate Revenue Committee, especially since we had no budget, was not taking up any tax credits that increased or had a GRF impact. These two are extending sunsets of a tax that's already contemplated, so it ends up being mostly revenue neutral. So for that reason, we're extending it. It had no opposition, was on an agreed bill {sic}. Happy to answer any questions.

What they do is allow you to actually sell those at a discount, obtain the cash, invest in the project immediately. You don't have to wait and invest your money, file your return, and then take that against what you -- what you -- revenue you made. So I -- I like them; I'm just not -- I just don't think that we're in a position to be doing that. Now the question is, without them, would this industry be here or not be 62 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 40th Legislative Day 5/5/2017 here? And I think that's the question. We don't really know that. And that's the risk that you take, is that, would they be here or not be here if we didn't do this? I'm not sure that this industry would vanish. Could it -- could -- could some go away? Honestly, I think the setting for most of these is pretty real and enticing from an entertainment standpoint that it's probably not going to go away. I don't think they're going to rename the show "New Orleans" or some other city's name. I think they're going to be just fine. So, with all due respect, I -- I understand the push here, but I'm -- I'm -- I'm going to be a No vote. Thank you.

You know, this is -- this is really an excellent piece of legislation and I'd like to take a moment to point out to the Body that unlike similar legislation in other states that provide credits to the film industry, Illinois was one of the very first states that crafted this type of legislation and it's unique in that the legislation in this State is a credit for jobs created in this State. Not just in the live or the motion -- live theater or motion picture industry, it's in this State. It is a great piece of legislation that we should consider extending. And -- with regard to the previous speaker, I know it's difficult to absorb the concept of giving a credit to another entity, but - Senator Bush and I have had this conversation amongst ourselves - we 63 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 40th Legislative Day 5/5/2017 actually wrap that same benefit in the proposed EDGE enhancement, THRIVE, whatever you want to call it. It's really, if used appropriately, is an excellent vehicle. So I would urge the Body give this an Aye vote. Thank you.

One of the things that is a -- a piece of conversation across all states are exactly what one of the previous speakers stated, in that what would happen in the absence of a tax credit? That is something that we are grappling with across all fifty states - I'll just say that when I put my NCSL hat on. One of the things we know about, when you can measure them and you can see the return on the investment, those are some of the -- the criteria that goes into how we decide whether or not this is beneficial. So I just want to point out that the industry is changing, both for theater and for film, in that it used to be a -- a foregone conclusion that there would be, you know, film in Los Angeles and theater in New York and Chicago had some mix of the in between and now there's more theater in LA, there's more film in New York, and there's more theater and film happening all over Illinois. And when we're competing with the fact that you can make Vancouver look like any major city in the country, we're really happy to have Chicago Med, Chicago Fire, Empire filming here, major movie productions that are creating jobs that you can see and expanding the economy that you can see right now, today - not to mention my favorite, Hamilton. So, I -- I ask for your support.

Senate Bill 1592 eliminates a government entity, the DuPage County Election Commission, and consolidates it into the Office of the DuPage County Clerk. This is an initiative of the DuPage County 72 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 40th Legislative Day 5/5/2017 Chair, and I believe, with the amendments, we have worked out concerns of both Democrats and Republicans with respect to the bill. I ask for your Aye votes.
